Full Text: De Facto CJ’s Ruling On Devolution Of Land

The Supreme Court yesterday, ruled that land powers were vested in the government and not in the Provincial Councils. The bench comprised de facto Chief Justice Mohan Peiris and Justices K. Sripavan and Eva Wanasundera.
The Judges ruled that under the constitution land was vested in the people or the central government to be handed over to the provincial councils according to law and on their request.

Two days ago the Supreme Court of Sri Lanka issued a landmark verdict on land powers under the 13th Amendment.
Giving three separate judgments, de facto Chief Justice Mohan Pieris, Justice S.Sripavan and Justice Eva Wanasundare determined that the powers regarding state land is vested with the Central Government and not with the Provincial Council.

India displeased with Rajapaksa move to hold on to land powers

The Indian government is displeased with President Mahinda Rajapaksa and his government for manipulating to hold on to land powers without vesting them to the provinces according to the 13th Amendment to the Constitution.
A Supreme Court bench headed by Rajapaksa loyalist Chief Justice Mohan Peiris determined recently that land powers should be with the central government and not vested with the provincial councils.
The Supreme Court made this determination annulling a previous verdict given by the Appeal Court.
The Indian government however has witnessed Peiris’ determination as a move by the Rajapaksas to prevent the full implementation of the 13th Amendment.
However, the issue is to be taken up for discussion during Indian External Affairs Minister Salman Khurshid’s visit to Sri Lanka on October 7th.
Khurshid is to meet with President Mahinda Rajapaksa and several other government members and opposition political heads.
