Things worse for SL if Nat'l question ignored-Leader of the Opposition

2017-11-02
Things will get worse for Sri Lanka especially in the international arena if the country fails to address the National question, Leader of Opposition R Sampnanthan told the Constitutional Assembly yesterday.
"Sri Lanka knows very well that all the problems it has faced in the international arena, particularly since 2012, is because of its failure to manfully address the National question. Things can only get worse; they cannot get any better if the same attitude remains," Sampanthan said.
"Sri Lanka was able to garner the support of all the important players including the US, European Union and India to defeat the LTTE. The LTTE was banned in all these countries as a result. You made it look to the world that the LTTE terrorists were an impediment to a finding a political solution for the country. You assured the world that an acceptable political solution would be found after the defeat of the LTTE. Ask yourselves whether you can abandon the said assurances and commitments you made to the world," he added.
The Tamil people of the North-East have been absolutely clear in regard to the manner and mode of power sharing. They have advocated a federal arrangement within a united, undivided country in a united Tamil speaking North East region comprising the Northern and Eastern provinces" he added. (Yohan Perera and Ajith Siriwardana)

Dr. Dayan Jayatilleka Discovers A Plot – And Also The Proof

Karikalan S. Navaratnam
logo“The folly of mistaking a paradox for a discovery, a metaphor for a proof, a torrent of verbiage for a spring of capital truths, and oneself for an oracle, is inborn in us.” – per Paul Valery, French philosopher and poet.
Dayan’s fusillade
In a barrage of narratives, one after another in rapid succession, Dr. Dayan Jayatilleka has propelled his familiar themes: viz., federal-phobia, fear-mongering about Tamil agenda, glorifying Rajapaksas’ ancien regime, gloating over his 2009 Geneva “feat”, excoriating “yahapalana” government etc. etc. This write-up appears in the context of Dayan’s fusillade, the latest of which has spotted “The Federalisation Plot: The Proof ” (Colombo Telegraph, 28 Oct.2017).
Dayan has particularly targeted RW-CBK combine allegedly for promoting a Federal solution to the ethnic problem. His visceral hatred for the duo finds expression in his vitriolic verbiage. The irony is that even as Dayan claims to have exposed the “federalization plot”, the TNA leadership has been pathetically pleading with the government to implement the 13A intact, and help them to save face vis-à-vis their Tamil constituency.
Federalism – Not Treacherous
This writer does not hold a brief for RW-CBK doublet or the “yahapalanaya” government. If RW-CBK duo have, now or ever, proposed federalism, it is a salutary thing and is wholly welcome. There is nothing blasphemous or treacherous about advocating a federal system to resolve the ethnic issue.
In fact, that is the most sublime idea. Plot and perfidy are not techniques congruent with a constitution making process. Dayan’s postulation of “a plot and the proof” defies logic. He innocently claims to have proved his discovery “beyond reasonable doubt.” Interestingly, that is the standard that must be met by the prosecutor in a criminal prosecution. In a civil suit, the proof is on a “balance of probability.” In any event, the probative value of Dayan’s evidence is a problem. He relies entirely on hearsay evidence – multiple hearsay at that !. Further, the evidence cited by him says that there would be a country-wide referendum on the Federal Constitution:
“At this point, such a solution would have been acceptable to nearly all Tamils and a vast majority of Sinhalese as well. Then, there could have been a referendum…….” (“The Federalization Plot: The
Proof “ CT 28 Oct. 2017). If the Federal plan was to be presented to the entire population, including the Sinhala people, at a referendum for them to have the last say, where is the conspiracy Dr. Dayan Jayatilleka? Does not a conspiracy connote subterfuge and secrecy?
Dayan’s Broadside
Typically, Dayan’s broadside is bifocal: To dislodge the government by hook or by crook and to debilitate the Tamils politically. After their ouster from office in January 2015, Rajapaksas and their cohorts have been hell-bent on recapturing power and are in a hurry to be restored to status quo ante. They believe, quite rightly, that race, religion, federalism, separatism are sexy issues to seduce the Sinhala-Buddhist constituency. With vigour and verve the Rajapaksa camp has been working overtime fomenting racism and creating combustible conditions conducive to an eruption of another Black July.
“Ellam except Eelam” – Premadasa
Until the army recaptured Kilinochchi from the LTTE in January 2009, every government leader was ready and willing to strike a compromise with the LTTE on any terms, short of acceding to a separate Eelam. That includes the vociferous professor G.L. Peiris as well. Even Dayan Jayatilleka’s previous patron-saint, President Premadasa, publicly offered to the LTTE, in rhyming words, “ Eelam thavira Ellam tharukiren” (“I will give you everything except Eelam”). He was conversant in Tamil. Mr. Sirisena Cooray, Chairman, Premadasa Centre, recalls the Tamil words in his article on Premadasa’s “The ‘3D’ solution to the north east problem” Premadasa had also recommended an “asymmetrical devolution” of power to the Tamils and spelt out the rationale therefor.” (Sunday Leader, 13 July 2008, Vol.15, No.4 ).
Neither CBK nor RW originally parented the Federal idea as Dayan claims to have proven. Discerning students of politics and essayists have, time and again, recorded the role of SWRD and the Kandyan National Assembly, representing the Kandyan Sinhalese, in espousing a federal system of government in Ceylon. The structure envisaged by the Kandyans included a linguistic Tamil State combining the North-East provinces. Evidently, the Communist Party of Ceylon also had flirted with the federal idea. (Vide: Daily Mirror, 24 Sept. 2015 –“SWRD stood for maximum devolution and Proposed Federalism” by K.K.S.Perera ; The Island, 24 Sept. 2016 -“SWRD Bandaranaike and the paradox of Sri Lankan Federalism” by Rajan Philips )
S.J.V. Chelva & Federal Party
Mr. S.J.V. Chelvanayakam (Chelva) founded the Federal Party – Ilankai Thamil Arasu Kadchi, in Tamil (FP) on 18 Dec. 1949 and sought the mandate of the Tamil people for pursuing the goal of a linguistic state in a federal Sri Lanka. FP suffered a humiliating defeat at the 1952 elections.
Even Chelva himself lost his seat at KKS. The federal concept did not resonate with the Tamil constituency at that time. At 1956 elections, even as SWRD’s MEP overwhelmingly won in the South, the FP romped home with a resounding victory in the North-East provinces. Ever since, to this day, at every subsequent election – with the only exception of 1977 election – the FP or the FP-led bloc has increasingly obtained massive mandate from the Tamil people to pursue its Federal objective. At the 1977 election the TULF coalition (including the FP) fought and won on a “Separate Eelam” platform.
The commitment and conviction of the Tamil people are so strong that they have consistently voted for a ‘Federal state’ solution.
Tamil people have made their choice. They want a linguistic Tamil State encompassing the Tamil habitats of the North-East provinces within the Federal Republic of Sri Lanka. Dr.Dayan Jayatilleka and his ilk may have to choose not between “13-minus” and federalism, but between Federalism and Separatism.
“Sinhala Only” Slogan
Post-1956, this country had endured recurrent ethnic violence, bloodletting, a Black July, deaths, destruction, chaos, carnage and foreign (Indian) intervention before the Sinhala leadership could realize that “Sinhala Only” slogan was an unmitigated disaster. Indeed, the country had paid a heavy price. It took two decades for the wilfully blind leadership to wake up on the language issue.
How long will it take – and at what cost – before Dayan and his bedfellows wake up? When will they stop their demagoguery, demonizing the Tamils – and by extension, the Federalists ?
Dayan’ Mission
In Rajapaksas’ passionate pursuit, Dayan is not only akin to a missionary, but truly a visionary as well, in that, he is one among those advisors who plan the Rajapaksas’ future with imagination and wisdom. That is because, Dayan’s own future is intricately intertwined with Rajapaksas’ future. His agenda is to promote Gotabaya Rajapaksa as President and Mahinda as Prime Minister. And, perhaps in return for his services, he hopes to find a niche for himself – maybe as a Foreign Minister or an Ambassador Extraordinary and Plenipotentiary in a Western/European capital. One cannot grudge his ambition or ability. Dayan has an incisive mind and mastery of the equivocal diplomatic language. On the other hand, Rajapaksas have the pelf in plenty and political clout. It is a formidable combo. Dayan and his patrons are resourceful and powerful. Given the current Sinhala–Buddhist mood, thanks to the yucky record of the yahalpalanayas, Rajapaksas’ ambitious agenda does not seem wholly a fantasy.

Getting people to draft a new Constitution instead of this discredited and incapable parliament is the only way to guarantee a New Constitution for the People.

by Kusal Perera-
( November 4, 2017, Colombo, Sri Lanka Guardian) Taken together, 106 UNP MPs with over 40 UPFA/SLFP members who add to the 2/3 majority have rejected the voters who elected them. This parliament, therefore, is no more the parliament people elected in August 2015. It is a deformed and a politically illegal representation now, that has no moral right to legislate for the people.

Will president listen even now on UN day dedicated to us !

LEN logo(Lanka-e-News -03.Nov.2017, 7.30PM)  It is matter for deep regret though the  media organizations have consistently and persistently urging that a Presidential Commission vested with full powers be established to investigate the crimes committed against the media ,  president Maithripala Sirisena despite loudly and proudly  calling himself as a president of good governance when he came to power,  has paid no heed to the requests and pleas made in that direction since the day he became president  .The louder the cry , the more he turned deaf and blind to the woes.
Instead of probing into the media victimizations , he has appointed a Rajapakse  informant who claims Portuguese lineage in his blood as an unofficial media secretary against whom strong accusations were  mounted as the one who aided and abetted in the disappearance of journalist Prageeth Ekneliyagoda .
Therefore  the Free Media Movement has once again issued a communique requesting the appointment of a  Presidential Commission vested with full powers to mete out justice to the victims of media persecution in the past  in Sri Lanka until   2nd of November  in line with the pressures exerted by the UN on  United Nations day to root out the impunity with which crimes  are committed against the media in SL.
The text of  the communique issued by the present conveners , C. Dodawattage  and Dilisha Aeysundara   of the Free Media Movement under their signatures which is completing 25 years of service this year is hereunder …
There had  been reports in SL of heinous crimes committed  including murder of journalists , attempted murders , disappearances, abduction ,  infliction of ruthless torture ,and attacks on media Institutions. Since it is the government which must shoulder the full responsibility if  investigations are not  duly conducted and  justice is not meted out in respect of these crimes  , we hereby request the appointment of a presidential Commission vested with full powers to duly investigate   these crimes which targeted the media, with a view to dispense justice.
Full text as follows:

A presidential commission with a comprehensive mandate is necessary to deliver the justice for crimes against media -Free Media Movement

While regret to emphasize the fact that no justice has been delivered for the deliberate crimes against journalists in Sri Lanka, Free Media Movement urges the President of Sri Lanka to appoint a Presidential Commission of Inquiry with a comprehensive mandate of investigation. FMM has been campaigning for this for the last 25 years, including lobbying at the meeting with government officials and by issuing media statements. However, no justice has been delivered to the deliberate crimes against journalists and media institutions that launched in order to suppress the freedom of expression and right to information.
Murder, attempted murder, disappearances, abductions and torture of journalists as well as attacks against media institutions have been reported in Sri Lanka. We emphasize that the responsibility lies within the Government of Sri Lanka for the investigation and punishing the perpetrators.
The United Nations have nominated the 02nd November as the day to end impunity for crimes against journalists, due to this worldwide trend of impunity. Therefore, Free Media Movement urges the President Maithreepala Sirisena to appoint a presidential commission with comprehensive mandate in order to complete the ongoing investigations and to expedite the process of litigation.

Dr. Dayan Jayatilleka Discovers A Plot – And Also The Proof

Mass Usuf
logoA fact is something that is proven to be true and is known to be the truth. When it is said that a person is in a state of denial, it would mean that the person knows the fact or truth of something but does not want to accept it. Such irrational behaviour in a person may sound very silly and stupid for an outsider. The reason why he would not accept the fact as it is, is because his thinking and decision-making ability are prejudiced by strong and complex emotions. These emotions can be based on a variety of reasons like idealisation, desire, shame etc.
There are two issues that need to be addressed by this nation at this crucial time. The outcome of which, history will record it either with unforgiving disapprobation or with generous laudation. Firstly, the constitutional absurdity between Article 9 of the Constitution where Buddhism is given the ‘foremost place’ and Article 12 which states about Right to Equality. Secondly, the idea amongst the populace that this is a Sinhala Buddhist country – a notion perpetuated by opportunistic politicians or politicians who are in a state of denial and, by those belonging to religious institutions, who have transformed the noble teachings of Buddha innovating it into a political, cultural and commercial institution. Very, very sadly, far astray from the teachings of Buddha.
Fear And Suspicion
When the absurdity of Article 9 is referred to, it is done with the objective of good constitution making for our country. After all that is the document that will tell the world who we are. In order to allay the fears and suspicions if any, of those who may have difficulties in interpreting and accepting facts in its true sense and living in a state of denial, it is necessary to unequivocally state that this writer is a great respecter of the true teachings of Buddha and, secondly, would never want this great country of ours to be divided.
Why Cannot We?
South Africa, we all know was at one time the most ostracised country in the world. They were in a permanent state of denial vis a vis apartheid. They are different today because they accepted the fact, as the fact. Acknowledged the truth, as the truth and shed their bigotry to understand, accommodate, reconcile and co-exist.  In that pursuit, they formulated a new constitution which, today, may be named as the most modern constitution. The Preamble to the Constitution reads:
“We, the people of South Africa,
Recognise the injustices of our past;

Questions I ask myself-whither do we go?

If not rebirth, why was I born a Muslim? Was it by choice, or was it or is it, I was to have this one single and profound experience which will resolve all things for me or mould me into that perfection by which all things are resolved for me?

 2017-11-04
My typewriter is getting old, almost falling apart and so am I. Before things get any worse let me put some crucial thoughts down. So many hundreds have done this sort of thing before - some of the greatest, noblest beings, those who have reached the pinnacle of spirituality.

What is the purpose of our lives? Have our purposes been determined for us? Or have we been set down upon this earth, as a machine may have been set down, programmed to live through for a certain number of years depending on the vagaries of our environments and the potentialities set down for us? Or are we part of the vast evolutionary processes described by Charles Darwin? Where does God come into all this? And what about the different views held by the different religions of the world ? What about belief and unbelief? What about miracles and what do they do to enlighten us on the way ? What indeed is the meaning of all this wondrous existence of ours? I despair even before I begin to ever find answers to these questions, questions which are nevertheless of utmost importance to our lives, as to how we carry on from day to day, hour to hour and perhaps second to second. I am not like the philosophers or religionists trying to find answers to universal problems, I merely wish to understand things for myself.

First, let me try and resolve this question of whether there is rebirth or not, or whether we have simply to through one lifetime, given the one single chance in life to make it or break it. If not rebirth, why was I born a Muslim? Was it by choice, or was it or is it, I was to have this one single and profound experience which will resolve all things for me or mould me into that perfection by which all things are resolved for me?
As a Muslim I am given to know that God knows all things and we with our puny understanding can know but little and are all but ignorant
To my way of understanding, there is nothing that can possibly explain and resolve the iniquities and inequities replete in this world of ours, the sufferings that human beings have been heir to throughout the annals of human existence, the existence of animals
And creatures lower down the evolutionary scale. Yet why such an apparently endless detour to reach the eventual happiness or goal of life we envisage.

As a Muslim I am given to know that God knows all things and we with our puny understanding can know but little and are all but ignorant . As the Sufis who have as far as we can tell reached the pinnacle of spirituality will tell us it is the final absorption in God, in the Divine through first an entry into states of bliss and into an Heaven that will be the ultimate revelation.

We are given revelations through the Prophets sent down to earth by God as guidance for humanity and finally the revelations sent down to the Prophet Muhammad setting a seal as it were upon all the earlier revelations and therefore perfecting them. Is this then the solution that has been and is available to the billions of beings both human and otherwise, the solution which offers salvation to them all ?

The Sufis moreover tell us that it is Love at its loftiest heights, Love that infuses all things that surely is the grand finale to such a grandiose play which describes our sojourn on earth.

True perhaps as it would seem to many, but is it open to all and to all things and how long does it take finally - an eternity or many eternities? It is known that our Earth in cosmic time is said to be 5 billion years old and human beings have been around for the past 10,000 to 15,000 years- that is a long, long time. The Hindus believe that there have been in the course of time 6 Pralyas (Extinctions) and we are nearing the end in a 7th extinction.

A contemporary Muslim theologian, Sheikh Imran Hussain who has made Islamic eschatology his specialty says that the Akirazaman ( the end of the world) as it is known to Muslims is round the corner and predicts the appearance of the personage known as Dajjal - a one-eyed being who is said to make his appearance in order to mislead humanity. He avers this may be a metaphor for the Zionist State - and also of the Second Coming of Jesus Christ as it has been predicted in the Quran. . He says that all the predictions in the Quran and the Hadis -the traditions of the Prophet Muhammad which include his sayings point to the Malhama or end of the world. I may have no doubt about all these and no doubts about much more Islamic theologians may speak about. My problem, however, is how to reconcile all this in terms of what happens to us in our personal lives, in our relationships with each other, who hold such a diversity of beliefs.

Those who have had Near Death Experiences (NDEs) , gone out of their bodies and beyond our earthly prison to a beyond and returned again to earth reluctantly speak of an inconceivably peaceful world in those other realms. This surely does not accord with the notion of an earthly sojourn which has to end, with a resurrection followed by an eternal life with a hell or heaven in-between. Or as Buddhist and Hindus believe with renewed life again on earth in forms determined by how a beings life was conducted during an earlier lifetime - a form of trial otherwise spoken of in the traditions of the monotheistic religions.

God-realisation may be one thing but how to conceive of a God can be quite puzzling. The Greeks had the conception of gods, goddesses, various powers of nature and of an all-powerful deity controlling all. The Hindu conception encompasses deities too with their multifarious functions like the Greek pantheons. Buddhism although in its original form propounded by the Buddha was purely rationalistic later acquired the trappings of the deistic Hindu religions and though it continued to rebirth as fundamental came to accept Nibbhana - annihilation or as others would have it ultimate bliss as the end of it all..

Will it ever be possible in the course of our brief lives on earth to find consensus, ever to have one religion for the entire humanity and have beliefs and experiences each according to the findings, the revelatory experiences, visions and certitudes in miracles of those belonging to different dispensations ? There are many Christians who believe that Jesus Christ was crucified and died in order to absolve the sins of humanity while Muslims believe Christ was taken up to Heaven bodily. Then there is incontrovertible evidence of stigmata among Christian savants like Father Padre Pio. If one were to ask contemporary Muslim theologians like Sheikh Ismail Menk, Nouman Ali, Hamza Yusuf and others like them they would say we cannot have final answers and would have to stop when it comes to probing what they would call the Unseen. What then?

Do we follow whatever dispensation we take up as the most credible, as the best that should be followed according to the experiences and beliefs which we can come closest to understanding and wait for the rest to unfold in a beyond, whatever that beyond may hold for us ?

“We may not know him as God; we may know him as Nature, our Higher Self, Infinity, some ineffable goal. It was so that the Buddha approached Him.  He is accessible even to the Atheist. To the materialist he disguises Himself in matter. For the Nihilist he waits ambushed in the bosom of Annihilation,” says Sri Aurobindo the Hindu sage.

“Man is a transitional being.  His is not final. He is the middle term of the evolution, not its end, crown or consummating masterpiece, “he also said.

I shall end with another quote from Sri Aurobindo after which little needs said. It is as follows:
“There is nothing mind can do that can be better done in the mind’s immobility and thought-free stillness.

“When mind is still, then Truth gets a chance to be heard in the purity of the silence.

“....Truth lives in the calm wordless Light of the eternal spaces; she does not intervene in the noise and cackle of logical debate.

“...Cease inwardly from thought and word, be motionless within you, look upward into the light and outward into the vast cosmic consciousness that is around you. Be more and more with brightness and the vastness. Then will Truth dawn on you from above and flow in on you from all around you.”

“IF POLYGAMY WAS NOT PERMITTED, ADULTERY WOULD BECOME A NORM” SAYS SRI LANKA MUSLIM CLERGY!

Sri Lanka Brief04/11/2017

All Ceylon Jamiyyathul Ulema (ACJU)  in its submissions to reforming the Muslim Marriages and Divorce Act (MMDA), says that “If Polygamy was not permitted, Adultery would become a norm.” Issuing a statement on ACJU submission Muslim Personal Law Reforms Action Group (MPLRAG) commented that ‘the ACJU submissions have recast most demands made by Muslim women as a non negotiable. ‘NO’ to women holding any decision making or responsibility bearing position including and particularly becoming a Quazi. ‘NO’ to women being appointed as a Marriage Registrar. ‘NO’ to a minimum age of marriage as 18 years without exception. ‘NO’ to accommodating different sects. ‘NO’ to strict conditions on polygamy and ‘NO’ to unambiguous and equal treatment in divorce.’
The full text of the MPLRAG statement:

MMDA Reforms Should Not be Held Hostage to ACJU Demands.
The Justice Minister Must Step in!

We are aghast at the recently revealed submissions attributed to the All Ceylon Jamiyyathul Ulema (ACJU) with regard to reforming the Muslim Marriages and Divorce Act (MMDA). This Act promulgated in 1951 has colonial roots and is a combination of Islamic law and local culture. Due to its detrimental impact on Muslim women and girls, a committee was appointed in 2009 by the Ministry of Justice under the chairmanship of Hon. Justice Saleem Marsoof to review and make recommendations for reforms. The committee has been deliberating for the past eight years and is yet to release its recommendations.

The ACJU’s  previously publicized submission and related public utterances were condemned by all quarters. Their latest submissions to the reforms committee, as revealed, make it blatantly clear that the ACJU has not changed its position since and is in fact doubling down on most. It is evident that their claim to have ‘always taken a flexible approach’ and to look into ‘finding solutions to the grievances of women’ and ‘establishing justice to each and everyone’ were a cynical public relations exercise. Despite a number of sincere attempts to voice concerns by women of the community, ACJU has shown its inability to listen to the plight of women and has repeatedly demonstrated contempt for their views.

The new 37 page submission does not provide positive reform suggestions to some of the key concerns that Muslim women have been raising for decades in relation to the Muslim Marriage and Divorce Act (MMDA).

It fails to recognize the lived realities of women and is based on the fundamental and grossly flawed thinking that women do not deserve equality. The ACJU have also disingenuously cherry picked from the extreme interpretations of Islamic jurisprudence when there are other progressive interpretations that have been adopted by many countries including Muslim majority countries on these same matters. They conveniently reject many interpretations and examples that afford a better position to women as ‘unauthentic’, ‘un-islamic’ or inadmissible because they don’t recognize the Islamic credentials of the sources.

We reiterate our position that with such misogyny and extreme and rigid positions that are not reflective of the diversity in the Muslim community in Sri Lanka, the ACJU should not be in government appointed committees dealing with issues concerning women. They certainly should not be given the place of sole voice of religious authority as they fail to respect the diversity of religious views within Islam, should not be afforded a deciding say on matters pertaining to women in the community nor be permitted to hold up the much needed reform process.

The ACJU submissions have recast most demands made by Muslim women as a non negotiable. ‘NO’ to strict conditions on polygamy and ‘NO’ to unambiguous and equal treatment in divorce. They want three of the advisory board positions to be reserved only for Alims.

The ACJU submission is also replete with strange assertions and understandings of both men and women, such as:

“If Polygamy was not permitted, Adultery would become a norm.”

Contradicting its own logical assertions they state “If a woman is appointed as [marriage] registrar, it will be forbidden for her to enter to the Masjid as the Scholars’ of the four Madhabs are of the view that it is not permissible for a menstruating women to stay in the masjid” which statement was preceded by a quote by Prophet (Peace & Blessings of Allah be upon Him), “Do not prevent your women from going to the mosque, even though their houses are better for them.” Somehow focusing solely on the ‘houses are better’ part of the comment to say entering the mosque is “forbidden”.
Uses cringeworthy language such as “Even though they (children) are given in marriage they should be handed over to their respective husbands, only when they are physically suitable for consummation.”

And comes from a place of deep misogyny as apparent in statements such as “the travelling of women alone, the mingling of women with non-mahram men and processing the (marriage) registration will no doubt have practical and Shari’ah concerns.” and “So, Islam tells women to stay in their homes and not go out except in cases of necessity. And it forbids them from mixing with men and being alone with them, because that poses a threat to women and their honour”. What does the ACJU think women do in this day and age, how do they think they manage their affairs? How can they treat women with so much disrespect and be permitted to promote it from an underserved position of power?
They quote ‘it means a nation that makes a woman their ruler will never succeed, hence women should not be appointed as a judge’. This they say in Sri Lanka and in 2017.

Given this background we echo the sentiments of the Women’s Action Network (WAN)  made in March this year titled “Religious Leaders cannot be trusted to reform MMDA”. Our statement of 4th April 2017 signed by over 300 individuals and organizations demanding accountability from women and men leaders in the Muslim community, from political representatives of the people of Sri Lanka who are watching this injustice perpetuate, and from the members of the MPL Reform Committee, appears to be falling on deaf ears.

Far from intervening to support and to ensure that reforms address the concerns of women and provide relief to the daily burdens they face, the silence to the plight of the Muslim women is deafening. Muslim women have been threatened by hardliners, ridiculed and sidelined by the ACJU and abandoned by the Committee considering reforms and by Muslims politicians. The State is watching from the sidelines and letting discrimination continue to the detriment of Muslim women and girls.
We demand that:
  •  The Sri Lankan state take responsibility for continuing to treat a section of its citizens in an unequal manner and take steps to redress this injustice. The Minister of Justice, should convene forthwith the committee that was appointed to look into MMDA reform in 2009 by the Ministry and hold them accountable to a strict timeline, preferably before the end of the year, for delivering on the report of reform recommendations;
  •  Justice Saleem Marsoof to release his report noting dissenting opinions if any, before the end of the year and make it available in Tamil and Sinhala so that the public can respond and engage with the reform process;
  •  The Minister of Justice to take Hon. Justice Saleem Marsoof Committee’s recommendations as a starting point, consult with the cabinet sub-committee appointed on the subject, hear public representations, work with Ministry of Women and Child Affairs and expeditiously prepare a draft amendment bill, that meets international standards including Child Rights Convention(CRC) and Convention on Elimination of All forms of Discrimination Against Women (CEDAW), for cabinet approval;
  • The Human Rights Commission of Sri Lanka to weigh in with their opinion on the amendment to the MMDA.
We also demand of our Muslim political leaders in all political parties to stop hiding behind ACJU, to assume responsibility, to truly listen to their constituencies including women and engage actively in the reform process to uphold the rights of a section of the community that is facing injustices on account of the MMDA. We want these elected representatives to take leadership on reforms and be accountable to their constituencies and not abdicate their responsibility.

We call upon all right thinking Muslim men and women to actively engage in this process that demonstrates the diversity in the community and not let this important issue be determined by a group of very conservative men using a very narrow interpretation of the religion.

We are encouraged by the interest shown on MMDA reforms by women’s groups across the country and for showing solidarity with their Muslim sisters. We are encouraged also by the diverse voices of Muslim women’s groups who are supporting reforms in the interest of women. Our collective continued engagement on this issue is much needed and makes a difference.

The Waiting Earth: Communities and cultivators affected by Sri Lanka’s drought

Featured image courtesy Amalini De Sayrah

AMALINI DE SAYRAH-on

At the time of writing, 488,277 families and 1,665,961 individuals are affected by the on-going drought in Sri Lanka. The country’s rice harvest has been halved, the worst on record in 40 years, with countless in need of food aid and life-saving support.

In comparison to the coverage of the 2016 and 2017 floods, mainstream media reporting on the drought is substantively poorer. It is sporadic, and with little to no emphasis on the long-term consequences, climate change, and the need to treat the drought not as aberration, but increasingly, the norm.

Small group of monks misbehave: CBK

2017-11-03
Former President Chandrika Bandaranaike Kumaratunga said at a recent function that a small group of extremist Buddhist monks, under the cover of their robes, were sowing discord, racism and religious fanaticism among the people.
She expressed these views at an event held at the BMICH on Wednesday to award prizes to the winners of the All-Island School Art and Essay Competition organised by the Office of National Unity & Reconciliation (ONUR) and the Bakeer Markar Centre for National Unity (BMCNU).
She said those who had no other means of gaining political power had resorted to racism and fanaticism as a tool for achieving their targets.
“I am a good Buddhist. What is more regrettable is the fact that a group of Buddhist monks indulge in extremism. That is a minor group. A majority of monks are good. Yet, what is highlighted most is the extremist voice from a few. We should not stop doing what is needed in fear of these extremist few,” she said.

LEN logo(Lanka-e-News -03.Nov.2017, 7.20PM) The  Supreme court (SC) on the  2 nd delivering  a landmark verdict decided that Geetha Kumarasinghe Galle district M.P. who is having dual citizenship cannot hold a member of parliament post .  That is ,the SC held that the earlier decision delivered by the appeal court is tenable and valid.
This is the first time the SC of  Sri Lanka decided a dual citizen cannot be an M.P. In other words ,though Geetha has broken many scandalous records and by now  best known for the most squalid reasons , this was the first time  she earned the discredit of  creating  a record as the first  M.P. who was unseated based on dual citizenship .

The appeal  filed by Geetha Kumarasinghe in the Supreme court (SC) challenging  the decision delivered by the appeal court on 30 th May against her was rejected by the SC  on the 2nd. The  SC confirming he decision of the appeal court  decided she cannot sit in parliament as a people’s representative (M.P.). The court also ordered the court registrar that this decision be immediately communicated to the Parliamentary secretary.
The appeal was heard in the SC before five judges including chief justice Priyasad Dep (president of the panel)
With the unseating of Geetha,   Piyasena Gamage who is next in the UPFA list on the preferential votes will  secure the opportunity to enter parliament. He too was in court on the 2nd.

After the decision was delivered , Gamage speaking to the media said , as he is a  vice president of SLFP , he is with  his party. By that he implied in parliament he will not be with the UPFA but with the SLFP group.
It is noteworthy Basil Rajapakse who has formed a new political party is also a dual citizen . He says he will not cancel his dual citizenship. Gotabaya Rajapakse the other Rajapakse manimal  who is now  trying to become a ‘man’ (human)  through “Vipath Maga’  (Disaster route ) , a new organization of his is also a dual citizen.  He too is not prepared to give up  his American citizenship . He is so Americanized that he wears tie and suit not only when he goes to America but even  when he has to go to the latrine at home, sources  say.  Besides , how can these two infamous racketeers who have purchased a large number of  properties in America  out of illicitly earned colossal wealth and plundered public funds of Sri Lankans withdraw their American citizenships ?
No matter what , the decision of the court against Geetha signals what is in store for these two crooked scoundrels too.

Sri Lanka: Future Leaders of “Blue Economy”

We have organizations such as Sea Scouts and such but they are not followed through in Sri Lanka. Thus, we will recreate it as the Young Mariners Association.

by Ayesh Ranawaka-
( November 4, 2017, Colombo, Sri Lanka Guardian) Last year, the President Maithripala Sirisena signed the Paris Agreement on Climate Change along with 170 other countries. While job innovation is one branch of “Blue Economy”, protecting the environment is another aspect, and we are ready to take this challenge.
We have already taken the initiative to launch projects for the protection of the future of our country. Everyone is aware of the relationship between children and nature. In order to protect both of this, we must work to bring children closer to nature, and that is when our country will have a future. We cannot confine ourselves to politically motivated, narrow minded agendas. This is why the Ministry of Fisheries decided to commence the Young Mariners Association, with the assistance of Ministry of Education.
We have organizations such as Sea Scouts and such but they are not followed through in Sri Lanka. Thus, we will recreate it as the Young Mariners Association. This will enable children aged 5 to 18 to have better knowledge about “Blue Economy”and to be at one with nature. They will want to protect the oceans and they will learn how to.
Although there have been activities to protect our beaches, we have decided to go further out into the water. Instead of stopping just at the beach, we must teach children to protect our oceans. Because without water there is no life, and this fact is not stressed enough in the present generation. We cannot restrict ourselves to just the beach. Before the Tsunami disaster struck Sri Lanka, causing a great impact to many lives, we hardly knew what a Tsunami was. However, Tilly Smith, a 10-year-old British girl was able to help save 100 tourists from a Thai beach hit by the Tsunami simply because she learnt in school. This is why we stress the importance of Knowledge.
Exploring the Ocean will take these children to greater heights. For the first the Marine Environment Protection Authority, the Sri Lanka Navy, the Sri Lanka Coast Guard and the Sri Lanka Fisheries Ministry will commence this forum – the young Mariners Association.
