Doctors’ strike , Petroleum strike and attack on mosques are part of the conspiracy to evict good governance govt.- Mujibur Rahman

LEN logo(Lanka-e-News -17.May.2017, 11.30PM)  The attack launched on the Kohilawatte mosque on the 16th by religious extremists is an attempt to topple the  good governance government legally installed in power  on 2015-01-08 following the rainbow revolution, and bring back the lawless  regime of the religious extremists and racists, Colombo district M.P. Mujibur Rahman pinpointed.
About six masked individuals who arrived in the early hours of the morning of 16 th at about 1.00 had caused this attack , it has come to light.
The M.P. who arrived on the scene following the attack said , the Rajapakse regime after getting down people to Colombo for its May day rally on May 1st , is of the view it can oust the ruling government through conspiratorial actions. The doctors’ strikes , the petroleum strikes and attacks on mosques are a part of this conspiracy , he noted.
After the anti Muslim hate speech made by Galagoda Aththe Gnanassara at Polonnaruwa inciting religious hatred , mosques in Polonnaruwa , Thoppur , Panadura , and now Kohilawatte have come under attack, Mujibur Rahman bemoaned.
Mujibur Rahman has already lodged complaints with the police against the foul derogatory words such as  ‘ Allah’s labba’ used by Gnanassara at Polonnaruwa . If a priest of another religion had said “ Buddha’s labba’’ , what amount of pain of mind it would have caused to the Buddhists. All Buddhists should understand what amount of damage is being done to the Buddha dhamma by Gnanassara’s derogatory remarks and degrading conduct directed  against other religions, the M.P. asserted.
( Though the disgraceful video footage of the barbaric robed monk Gnanassara and his foul mouthed filthy utterances is in our custody , LeN as a news website with repute has decided not to publish it and soil its own reputation , because Gnanassara’s words stinks worse than even  his spittoon of a mouth) .

The Cabinet reshuffle will be happening soon. No changes for the UNP

The Cabinet reshuffle will be happening soon. No changes for the UNP

May 18, 2017
The much discussed Cabinet reshuffle will happen in a day or two, according to inside sources of the Government.
The Sri Lanka Freedom Party has been expressing their willingness to a Cabinet reshuffle despite the long standing opposition of the United National Party towards the move. The Sri Lanka Freedom Party is emphasizing on a reshuffle on several top ministerial posts including finance.
According to sources a decisive meeting was held yesterday at the President’s house. Among the participants were the President, Prime Minister and former President Chandrika Bandaranaike Kumaratunga.
AT the meeting the Prime Minister has pointed out that a Cabinet reshuffle is unnecessary. But if the SLFP wants they can change ministerial portfolios held by their members.
He has emphasized the majority of the votes at the recent General elections were to the UNP and therefore the decision belongs to the UNP.
According to UNP sources its ministers and MPs see the urge for a Cabinet decision with doubt. They have insisted the Prime Minister not to go ahead of a Cabinet reshuffle. Majority of the UNP MPs are of the view that the SLFP is trying to create a chaos in their party through the reshuffle where they will attempt to grab strong ministerial portfolios held by UNP members and failing which appoint some other MPs of the UNP which would definitely lead to unwanted competition among the UNP members.
The Prime Minister has informed the President that it is best to head for a reshuffle in another six months, if it is really required. Former President Chandrika Kumaratunga has agreed to this suggestion and eventually the President had to agree.
The doubts have arisen as many SLFP members who worked for the victory of President Maithirpala Sirisena and appointed to ministerial posts are still act as supporters of the former President Mahinda Rajapaksa. The UNP inside sources say that it is these members who emphasize on an immediate reshuffle. They continue on a double image having a close relationship with the President while clandestinely supporting Mahinda Rajapaksa. This situation would surely create chaos within the Government eventually weakening the power. And this situation will be favourable for Mahinda Rajapaksa.

Kohilawatte Mosque attacked ! Scourge of mad monk Gnanassara again on the prowl !

LEN logo(Lanka-e-News -17.May.2017, 11.30PM) An unidentified group 15th night attacked a mosque,  a place of religious worship of Muslims  in Kohilawatte , Wellampitiya with stones and missiles causing damage to it .
So far no one has  been arrested.
Recently Galagoda Aththe Gnanassara the robed monk who is by now best known for his worst  hooliganism and lunacy had gone to  Galegodella , and once again insulted and vilified  the prophet- the religious leader of Muslims ,and  scolded the government politicians with a view to incite religious extremism   and create racial tension  while urging the people to turn violent against  the Muslims in much the same way as he conducted himself during the lawless era of the deposed corrupt Rajapakses who are now deservedly disdained and discarded by the people ( relevant videos appeared on the face book pages of the social  media). These   violent activities stemming from religious extremism and racism  are being promoted with the LTTE defeat commemoration day in view.
If the good governance government does not take prompt preemptive action against mad monk Gnanassara’s venom and vengeances targeting minorities , it will sure have  to court uncalled for despair, and even compromise lives of  innocent people.

Diaspora is defined as the dispersion of people from their traditional homelands. There could be over 1.2 million Sri Lankan Tamils living in various parts of the world. The majority of Sri Lankan Tamils fled the country due to political and economic reasons. The number of Sri Lankan Tamils living abroad is even greater than the Tamils currently residing in the Northern Province.

GSP-PLUS: AN ELIXIR OR JUST PALLIATION FOR SRI LANKA’S EXPORT WOES?

Sri Lanka Brief18/05/2017

IPS/ Sri Lankan exports, which have been flagging in recent times, gained some much needed relief with the European Union’s (EU) Foreign Affairs Council deciding to grant additional trade preferences to Sri Lanka under its GSP-Plus initiative. By granting this concession, Sri Lanka will now benefit from the full removal of tariffs on Sri Lankan imports into the EU on 66% of tariff lines (approximately 1200 Sri Lankan products), covering a wide array of products including textiles, small machinery, and fisheries. While gaining GSP-Plus is undoubtedly a positive development for Sri Lanka’s economic progress, its impact will provide only temporary relief and policymakers and the private sector should urgently ensure broader economic reforms in order to fully utilize this opportunity.

Sri Lanka’s History with GSP-Plus

GSP-Plus concessions were initially granted to Sri Lanka in 2005, after the Tsunami. However, in 2010, the EU withdrew Sri Lanka’s preferential access under GSP-Plus to the European market due to the government’s failures in adhering to human rights standards set under the provisions of the scheme.

Between 2005 and 2010, under GSP-Plus access, Sri Lankan exports to the EU grew on average by 7.96%, notably amidst a decline in consumer demand in Europe due to the financial crisis during 2009 and 2010. Contrastingly, during the 2010-15 period, Sri Lankan exports to the EU grew by a mere 1.02%. The most direct impact was tariffs being reinstated on Sri Lankan imports to the EU, making them uncompetitive compared to similar imports from other developing economies such as Bangladesh, India, and Vietnam. The impact was particularly severe on medium sized apparel producers, as they did not possess the technical and financial resources to adequately diversify their export portfolio compared to the larger firms. As a result, with regional competitors such as Bangladesh and Vietnam producing similar products, a significant volume of both domestic and foreign investment relocated to these countries seeking preferential access to the EU market.

Scope for Growth

Whilst regaining GSP-Plus is a significant achievement for Sri Lanka, both policymakers and the private sector should consider it as simply temporary relief. Gaining tariff-free access to a European market that has seemingly recovered from the 2009 financial crisis and regional economic pressures such as the Greek debt crisis bodes well for improved demand for Sri Lankan goods. This will especially be a boon to the apparel and fisheries sectors that suffered significantly in recent years and face growing pressures from regional competitors. Other export sectors such as small manufacturing and especially those that have emerged in a post-conflict Sri Lankan economy will also get an opportunity to penetrate the European market.

Temporary Relief, Not Permanent Solution

The abovementioned benefits, however, will be restricted to the short term and Sri Lanka should prepare its export sector and the economy overall for the eventuality when these benefits expire. Critically, Sri Lanka will lose GSP-Plus concessions once it graduates to upper-middle income level (Gross National Income per capita between $4,306 and $12,475). Currently Sri Lanka’s GNI per capita is $3,800 and will likely achieve upper middle-income status in the near future, estimated to be around 2021.
More concerning, however, are the structural limitations of the Sri Lankan economy that will hinder the ability to fully leverage the benefits of GSP-Plus. Crucially, the apparel sector is currently facing significant labour shortages that undermine the ability for the sector to expand sufficiently in a manner that can cater to expected increases in demand. Similar structural issues such as high para-tariffs and policy instability also reduce the competitiveness of the Sri Lankan economy. Whereas Sri Lanka’s competitors such as Bangladesh and Vietnam are embarking on large-scale economic reform agendas, Sri Lanka’s relative reticence restricts its potential for growth.

2
Source: Central Bank Annual Report 2016

In addition to these structural challenges, Sri Lanka should also be cognizant of the impact of Brexit on leveraging GSP-Plus. Since the referendum and the subsequent triggering of Article 50, the United Kingdom is scheduled to leave the European Union on the 29th of March 2019. Worryingly for Sri Lanka, approximately 30% of Sri Lanka’s exports to the EU are to the UK. Sri Lankan exports will no longer qualify for preferential access to the UK once it leaves the EU, unless a similar arrangement is negotiated directly between Sri Lanka and the UK. Therefore, Sri Lanka should prepare to face an economic shock, at least temporarily, to its export sector once the UK officially leaves the EU.
Managing the Future

A combination of structural failures, protectionist economic policies, and external factors has led to Sri Lanka’s export sector performance diminish in recent years and fail to fully realize its potential. The withdrawal of GSP-Plus in 2010 was especially damaging since the country was not adequately prepared to compensate for its loss in relative competitiveness in the European market. Therefore, regaining GSP-Plus is a much welcome development for the economy. These benefits, however, are short-lived and the country will fail to fully leverage the opportunity afforded by GSP-Plus for improved trade in the future unless significant reforms are undertaken to address structural weaknesses in the economy.

Such reforms need to focus on promoting growth, tackling demographic issues, fostering an efficient public taxation system and improving the labour market. Liberalizing product and service markets would further encourage private enterprises to participate in economic activities. In the meantime, the private sector should consider this as temporary relief and use the opportunity to diversify its product basket while also looking towards diversifying its export destinations. Preferential access granted through GSP-Plus provides Sri Lankan exporters an advantage in sectors that the country may not traditionally trade.

Therefore, the risk of diversification is lower and the reward of exploring new opportunities for exports will be much higher. Moreover, the most dynamic economic growth is expected to occur in countries like India, China, and other East Asian countries in the ASEAN region. Therefore, Sri Lanka can no longer depend solely on the European and US markets and would be better placed by reorienting towards emerging economies in Asia and the Middle East.

Kerala state owned company formally recruit transgender women

Kerala state owned company formally recruit transgender women

May 18, 2017

The Kerala metro rail has recruited 23 transgender women to serve in ticket counters and house-keeping work in the station, customer relations, parking etc. depending on their qualifications and training.  According to Indian news reports this is the first time a Government owned company formally recruited these women.

These women are recruited through Kudumbashree, the Kerala state Poverty Eradication Mission along with over 500 workers trained by the Kudumbashree Mission. All these workers will be recruited to 11 different stations.
Many media reports rise frequently on the rising rate of deaths and harassments the transgender persons face in Kerala, despite positive policy decisions taken to ensure their rights.
Kerala Metro Rail Limited Managing Director Elias George told ‘the Hindu’ that this is an attempt to give these people their rightful share in this society and ensure that there will be leave no space for any discrimination to happen between transgender women and other women.

Living in a similar environment, Kerala has always been compared to Sri Lanka and its people. By holding on to narrow minded concept Sri Lanka seems to have falled far behind Cochin.

Grave Errors In Ravi K’s Letter Submitted By Mahendran’s Lawyers On Bond Case

logo
A letter signed by Finance Minister Ravi Karunanayake which calls on the ex-Governor Arjuna Mahendran to raise Rs. 75 billion in just one month shows many grave errors in the official communication. The controversial letter was submitted by Mahendran’s lawyers to the Bond Commission investigating the matter.
Incidentally, this letter has been typed out on a letterhead which appears to be used only for internal communication purposes at the ministry and has been addressed in an odd manner ‘to whom it may concern.’ Another serious issue in the letter is that there is no date in it, although Karunanayake’s signature has been placed at the bottom of the letter. It also wrongly mentions that Malik Samarawickrama was a Cabinet Minister on 26th of February 2015.
The letter bears no contact information or even an address which is the standard norm of any letterhead, especially if used for outside communication purposes, and for such matters of serious financial transaction orders. The letter submitted by the ex-governor’s lawyers aim to justify Mahendran’s action to issues treasury bonds worth Rs. 10 billion on 27th of February 2015.

Intriguing..! Court delivers biased verdict but Geetha thanks Mahinda – video hereunder ..

LEN logo(Lanka-e-News -17.May.2017, 11.30PM) The appeal filed by Geetha Kumarasinghe M.P. in the supreme court (SC) challenging the verdict delivered by the appeal court which rescinded her parliamentary representation  thereby unseating her , was taken up for hearing on the  15th .The panel of three judges who heard the appeal decided (with one judge dissenting) to suspend the appeal court verdict unseating her ,until the SC trial was concluded .

The two judges who were in favor  were Upali Abeyratne and Eva Wanasundara . May we recall it was Eva who some time ago told the newspapers  how she was  invited  to be  given the appointment as SC judge by Mahinda after reminding her of the love affair circulated  linking him  with her   during their days at Law College.

(She related thus …He  told ‘Eva … here ….  here’ , twice or thrice  , and  said  ‘I am putting you on the SC bench.’  You are happy about it  , aren’t you ?’ At that moment my heart told me , Eva , you always wanted to be a judge , now somebody is in front of you  who is telling you to become a judge.’  I was  wondering  , whether I should tell ‘yes’ or  ’no’ .Then  I thought a dream of mine is going to turn into reality .When  anybody else asks a question from me , I  say, I shall  first  speak with my husband , before giving  an answer , and give the reply only the following day. In fact I thought on that same line  at that moment .  But again I thought the question is being asked by a country’s  leader , and besides he is my friend. He is asking such a question because he has some reason.  So , I replied ‘ Yes Sir’ , I consent.   During that period  we were very close friends. Even today those close ties exist – ‘Deshaya’ newspaper  page 5  first  article dated 2014-07-06.)

When the case was commenced yesterday Eva said , she did not have time to study the case . Yet she announced her decision.

The lawyers for Geetha presented most stupid arguments . Their contention was ,Geetha secured her citizenship in Switzerland because she married a Switzerland national , hence  it was automatically granted, and she did  not ask for it . By that alone her Switzerland citizenship was  confirmed by them , and moreover ,whether she secured Switzerland citizenship with or without her consent is irrelevant from the standpoint of election laws.

Eva acknowledging  such a stupid  contention alone  clearly bears testimony that the judgment is not impartial.

The SC which heard the appeal on the 15 th the very next day following its filing ,and  was in an unholy haste to issue the restraining order against the appeal court verdict, even before the Gazette notification was issued , however did not show that haste when fixing the next court date -decided to postpone the next hearing until as late as 25 th September. Sadly this action of SC  erodes the faith and confidence the public have in the SC.

In any event the dissenting judge Anil Gunaratne on the 15 th objected to the suspension of the appeal court verdict delivered against Geetha .

The SC decision in Geetha’s case notwithstanding  , it has now become very clear who is behind the scene based on an intriguing  dialogue recorded by the  cameras during the last court session .

After  the verdict was delivered  by the SC , it was none other than Mahinda Rajapakse  who was thanked . As Geetha was coming out of court , a lackey of Mahinda who was in the vicinity received a call , and he gave his phone to Geetha . The latter answering the call said ‘ Thank you ’ whereby confirming clearly who is behind these manipulations.

NDB employees stage a protest

NDB employees stage a protest

May 18, 2017

In support of the Chief Financial Officer of the NDB Bank, who recently got suspended, the NDB Employees Association has staged a protest today (May 18) in front of the National Arbitration Centre. The protesters were seen criticizing the management of the bank for not taking the correct action against the corrupted officials of the institute instead of suspending the Chief Financial Officer.

The NDB Bank's Chief Financial Officer was the whistle blower who leaked information about the irregular practices of senior bank officials and a former official which the Lanka News Web reported previously.
According to the information received the matter is currently being inquired at the National Arbitration Centre and the next session is scheduled for May 30.
The Lanka News Web received the reliable information from a member of the NDB Employees Association who wished to remain anonymous.
The CFO has made the complaint about the corrupt official adhering to the company protocols. Since then he had been under severe pressure and ultimately was suspended by the NDB Bank senior management as they decided to initiate an inquiry on the issue.
It is of utmost concern that the person who pointed out the malpractice is hassled by the bank management rather focusing on the corrupt officials and his henchmen who are still employed by the bank

Palestinian killed by Israeli settler in West Bank clash

Hundreds of Palestinians had gathered at an Israeli military checkpoint south of Nablus when the protester was killed

Thursday 18 May 2017
A Palestinian was killed by an Israeli settler during a clash near the city of Nablus in the occupied West Bank on Thursday, the Palestinian health ministry and security sources said.
The clash near a military post erupted when an Israeli settler in a car attempted to cross a crowd of Palestinian protesters, with the settler and Israeli soldiers opening fire, Palestinian security sources said.
The Palestinian killed was identified by the health ministry as Muataz Bani Shemsay, 23, from a village near Nablus. He was shot in the head, it said.
An Israeli military spokeswoman said a "violent riot broke out" that saw Palestinians threw rocks at passing cars.
Ahmad Jibreel, the head of the ambulance and emergency department of the Palestinian Red Crescent, told Ma'an news agency that an Israeli settler stepped out of his vehicle and opened fire at Palestinians “in a random manner,” hitting two Palestinians, including Shamsa.
He also said that the attacker, who also hit a Red Crescent ambulance with his vehicle, had opened fire on the crowd at the same time that clashes were ongoing with Israeli forces, who had deployed tear gas canisters against the demonstraters.
A photographer with Associated Press news agency was also wounded by gunfire but was in a stable condition, medics said.
Soldiers "responded with riot-dispersal means. One of the Israeli citizens, whose car was damaged from the rocks, fired into the air."

The Israeli military spokeswoman confirmed one person was killed and another wounded.
"One of the Israeli civilians whose car was damaged from Palestinian rock-throwing fired into the air," the spokesperson said. She added that the army had not been involved in the shooting of Shamsa, and that "it may possibly be from the Israeli, but the incident is under review."
Hundreds of Palestinians had gathered at an Israeli military checkpoint at Huwara, south of Nablus and the regular site of clashes between Israeli soldiers and Palestinian stone-throwers.

Protest in support of hunger strikers

The protest was held in support of hundreds of Palestinians in Israeli jails on hunger strike since 17 April.
An Israeli settler attempted to drive into the crowd, the security sources said, and was surrounded by protesters who threw stones at the car.
He then got out of the car and opened fire along with soldiers who deployed, the sources said.
A wave of unrest that broke out in October 2015 has claimed the lives of 264 Palestinians, 41 Israelis, two Americans, two Jordanians, an Eritrean, a Sudanese and a Briton, according to an AFP count.
Most of the Palestinians killed were carrying out knife, gun or car-ramming attacks, the Israeli authorities say.
Others were shot dead during protests or clashes, while some were killed in Israeli air strikes on the Gaza Strip.
The violence has subsided in recent months.

US activists’ homes targeted in pro-Israel intimidation campaign

American Muslims for Palestine and Jewish Voice for Peace say smear campaign against their leaders won’t stop them working together.

Charlotte Silver-17 May 2017

An anonymous campaign has targeted two leaders in the Palestine solidarity movement at their homes in New York and California.

University of California, Berkeley lecturer Hatem Bazian left his house on the morning of 10 May, to take his daughter to school. He grabbed a flyer that was tucked under his car’s windshield wiper and threw it in his car.

It was only after he dropped his daughter off that he took another look at the flyer and realized it featured a color photo of himself and the claim, “he supports terror.”

His picture was next to one of Rebecca Vilkomerson, the executive director of Jewish Voice for Peace, a national group that organizes for Palestinian rights.

Bazian is the chair of American Muslims for Palestine.

Underneath their photos was printed the hashtag “#SketchyAliance.”

“When I got back home I realized that every car on my street had one of these flyers,” Bazian told The Electronic Intifada.

Sowing fear of “terror”

Bazian is familiar with campaigns of harassment and intimidation. He has been the target of similar poster campaigns on campus and has received hate mail and emails for years. But this was the first time that his opponents hit him at his home.

The back of the flyer calls Americans for Muslims for Palestine a “smokescreen for a violent movement” and claims that Bazian called for a “violent uprising here in America.”

It also accuses Jewish Voice for Peace of “supporting terrorists” and claims that American Muslims for Palestine’s ideology is “deeply rooted in terrorist organizations like Hamas.”

In bold letters, the flyers warn, “Today terror abroad. Tomorrow terror at home!”

Bazian contacted Vilkomerson, and found out her home in Brooklyn had also been flyered that morning.
Vilkomerson told The Electronic Intifada that her entire block and two surrounding blocks had been plastered with the same flyer. Her husband and neighbor tried to collect the hundreds of flyers before her children returned home from school.

The flyers were also spotted in different parts of Manhattan as well as downtown Berkeley. One person forwarded to Vilkomerson pictures said to show a man handing out the flyers in Berkeley.

Only a few Twitter accounts have used the hashtag #SketchyAlliance.

The first was created in April this year. The user, who claims to be a Berkeley graduate student, used the hashtag the day before the flyers appeared.

The only others using the hashtag were two editors of the pro-Israel blog Israellycool.

Brian Bishko, who tweets and writes under the pseudonym Brian of London is a contributing editor at Israellycool, according to his Linkedin profile.

David Lange, who works under the pseudonym Aussie Dave, is the publisher of the propaganda website.
Lange and Bishko have been associated with online harassment campaigns against Palestinians and Palestine activists in the past.

Lange has a history of using online aliases to infiltrate Palestine forums. Bishko, or Brian of London, has a history of overt online incitement and racism against Palestinians.

Harnessing Islamophobia

Bazian is also the founder and co-editor of Islamophobia Studies Journal and director of the Islamophobia Research and Documentation Project. He sees the flyer’s invocation of terrorism and fear of Islam as part of pro-Israel groups’ strategy to consolidate support for Israel in the United States and Europe.

“Specifically, these groups are trying to say that Israel’s war with Hamas is the same as the US’ and Europe’s war with terrorism in the Muslim world,” Bazian said.

This line of argument appeared in a recent opinion article in The New York Times by Israel’s public security minister Gilad Erdan against the Palestinian hunger strikers.

Erdan asserted that European capitals are becoming more sympathetic to Israel’s war against “terrorism.”

“As I was told recently by the ambassador of a northern European country facing a growing terrorist threat, ‘Now we get you,’” Erdan claimed.

Israel’s “black ops”

Erdan also leads Israel’s ministry of strategic affairs, which spearheads the country’s effort to thwart the growing Palestine solidarity movement. The ministry is reportedly engaged in secret “black ops” which, according to a veteran Israeli analyst, may involve “defamation campaigns, harassment and threats to the lives of activists” as well as “infringing on and violating their privacy.”

Neither Bazian nor Vilkomerson know who is behind the flyers. Bazian says the posters embody an attitude promoted by a number of pro-Israel groups.

The tactic closely resembles a poster campaign by anti-Muslim agitator David Horowitz, targeting students and professors involved in Palestine solidarity on campuses.

Horowitz’s posters which appeared last October also attacked Bazian and contained unsupported claims attempting to tie American Muslims for Palestine to Hamas.

The Southern Poverty Law Center, which monitors extremist groups, says Horowitz has “become a driving force of the anti-Muslim, anti-immigrant and anti-Black movements.”

Undeterred

“This is not new to target American Muslims for Palestine or to use them to target others by using these guilt-by-association tactics,” Vilkomerson said.

Bazian filed a report with Berkeley police, who he says initially wanted to categorize the flyers as an attack on free speech. Bazian objected, insisting it be labeled an Islamophobic incident.

He says he is also installing a security system at his home.

But Bazian and Vilkomerson are not deterred. A day after the flyers appeared, they reaffirmed their commitment to working together: “Our two organizations represent a hopeful future horizon for Jewish-Muslim partnerships grounded in social justice, deeper understanding and opposition to all forms of racism.”

By Stephanie van den Berg | AMSTERDAM-Thu May 18, 2017

The World Court ordered Pakistan on Thursday not to execute Indian citizen Kulbhushan Sudhir Jadhav, convicted of spying, until it hears a case brought by India arguing that Islamabad violated a treaty guaranteeing diplomatic assistance to foreigners accused of crimes.

The court, formally known as the International Court of Justice (ICJ), is the top United Nations legal body for hearing disputes between states and its rulings are binding - though occasionally flouted.

The dispute revolves around the fate of Jadhav, a former officer in the Indian navy who was arrested in March 2016 in the Pakistani province of Baluchistan. There has been a long-running conflict in Baluchistan between Pakistani security forces and a militant separatist movement.

"It is appropriate for the court to order that Pakistan take all measures at its disposal to ensure Mr Jadhav is not executed before this (11-member) court has given its final decision," presiding Judge Ronny Abraham said. The decision was unanimous.

Pakistani authorities say Jadhav confessed to being assigned by India's intelligence service to plan, coordinate and organise espionage and sabotage activities in Baluchistan "aiming to destabilise and wage war against Pakistan".

In April, a Pakistani military court sentenced him to death.

India asked the ICJ for the injunction barring its fellow nuclear-armed neighbour from executing Jadhav, arguing that he was denied diplomatic assistance in violation of the Vienna Treaty on Consular Relations at what it terms an unfair trial.

Pakistan maintained that the ICJ need not intervene as it had adhered to a 2008 bilateral treaty with India that supersedes the Vienna pact by stating that the right to consular access can be waived where "national security" is at risk.

India rejects this interpretation.

Islamabad has also noted that Jadhav's sentence remains subject to appeal and he is no immediate danger of execution.

ICJ RESERVES FINAL DECISION

The ICJ ruling did not favour the arguments of either side but was meant to prevent Pakistan from taking any irrevocable steps before the court can decide whether it has jurisdiction in the case and, later, which side is right or wrong.

"The court has given its ruling on provisional measures, which is basically a procedural process," the Pakistani envoy at the ICJ, Moazzam Ahmad Khan, told reporters. "The court has said nothing on the merits or maintainability of the case."

The ICJ will now call for a more comprehensive filing from India before it decides whether it has jurisdiction to hear the case in full - a process that could take years.

Indian Attorney General Mukul Rohatgi described the court's decision as a victory. "The whole world now knows that there was no fair trial. The whole thing was a charade," he told reporters in India. "The bogus stand put forth by Pakistan has been completely blown by this decision."

Pakistan has described India's decision to take its case to the U.N. court as "political theatre".

The Vienna Convention has been a frequent subject of disputes at the ICJ, often in cases involving the United States. U.S. authorities ignored a similar ICJ injunction in 1999 and executed a German national.

Labour is right—Karl Marx has a lot to teach today’s politicians
The shadow chancellor's comment provoked scorn. Yet Marx becomes more relevant by the day

May 11th 2017

AN UNOFFICIAL rule of British elections holds that you don’t mention big thinkers. On May 7th John McDonnell, the shadow chancellor, broke this rule by mentioning not just any old big thinker but Karl Marx. “I believe there’s a lot to learn from reading ‘Capital’,” he declared. The next day Jeremy Corbyn, the Labour Party leader, described Marx as “a great economist”.

This produced jubilation on the right. The Daily Telegraph dismissed Messrs McDonnell and Corbyn as “the Marx brothers”. The Daily Mail reminded its readers of the murderous history of communism. David Gauke, a Conservative minister, warned that “Labour’s Marxist leadership” was planning to turn Britain into a “hard-left experiment”. He added for good measure that Marx’s thinking is “nonsensical”.

Yet Mr McDonnell is right: there is an enormous amount to learn from Marx. Indeed, much of what Marx said seems to become more relevant by the day. The essence of his argument is that the capitalist class consists not of wealth creators but of rent seekers—people who are skilled at expropriating other people’s work and presenting it as their own. Marx was blind to the importance of entrepreneurs in creating something from nothing. He ignored the role of managers in improving productivity. But a glance at British business confirms that there is a lot of rent seeking going on. In 1980 the bosses of the 100 biggest listed firms earned 25 times more than a typical employee. In 2016 they earned 130 times more. Their swollen salaries come with fat pensions, private health-care and golden hellos and goodbyes.

The justification for this bonanza is that you get what you pay for: companies claim they hire chief executives on the open market and pay them according to their performance. But the evidence is brutal. Most CEOs are company men, who work their way up through the ranks, rather than free agents. In 2000-08 the FTSE all-share index fell by 30% but the pay for the bosses running those firms rose 80%. J.K. Galbraith once said that “the salary of the chief executive officer of the large corporation is not market reward for achievement. It is frequently in the nature of a warm personal gesture by the individual to himself.” Corporate Britain is more subtle: CEOs sit on each other’s boards and engage in an elaborate exchange of such gestures.

The political system is no less rife with rent-seeking. Politicians routinely cash in on their life of public service by transforming themselves from gamekeepers into poachers when they retire, lobbying departments they once ran, offering advice to companies they once regulated and producing platitudinous speeches for exorbitant amounts of money. Tony Blair became rich in his retirement by offering advice to bankers and third-world dictators. George Osborne, a former chancellor, is also cashing in: he makes more than £650,000 ($840,000) for working for BlackRock investment managers one day a week, earns many tens of thousands for speeches and edits a London newspaper, the Evening Standard.

Marx predicted that capitalism would become more concentrated as it advanced. The number of listed companies has declined at a time when profits are close to their highest levels ever. Concentration is particularly pronounced in the most advanced sectors of the economy. Google controls 85% of Britain’s search-engine traffic. Marx was also right that capitalism would be increasingly dominated by finance, which would become increasingly reckless and crisis-prone.

What about his most famous prediction—that capitalism inevitably produces immiseration for the poor even as it produces super-profits for the rich? “Immiseration” is too strong a word to describe the condition of the poor in a country with a welfare state and a minimum wage. Yet many trends are worrying. Average wages are still below their level before the financial crisis in 2008 and are not expected to exceed it for several years. The rise of the Uber economy threatens to turn millions of people into casual workers who eat only what they can kill.

The problem with Marx is not that his analysis is nonsensical, as Mr Gauke maintains, but that his solution was far worse than the disease. And the problem with Messrs Corbyn and McDonnell is not that they have learned something from Marx but they haven’t learned anything from the past hundred years of history. Mr McDonnell is a fan not just of Marx but also of Lenin and Trotsky. Mr Corbyn described Fidel Castro as a “champion of social justice”. A leaked draft of the Labour manifesto resurrects defunct plans to renationalise industries and extend collective bargaining.

The Tory party is heading for a substantial victory in large part because Labour’s leaders are so unreconstructed. But it would be a mistake for the Conservatives to ignore the lessons of the master himself. As Trotsky once put it, “You may not be interested in the dialectic, but the dialectic is interested in you.” The financial crisis suggested that the economic system is worryingly fragile. The vote for Brexit suggested that millions of people are profoundly unhappy with the status quo.

The genius of the British system has always been to reform in order to prevent social breakdown. This means doing more than just engaging in silly gestures such as fixing energy prices, as the Conservatives proposed this week (silly because this will suppress investment and lead eventually to higher prices). It means preventing monopolies from forming: Britain’s antitrust rules need to be updated for an age where information is the most valuable resource and network effects convey huge advantages. It means ending the CEO salary racket, not least by giving more power to shareholders. It means thinking seriously about the casualisation of work. And it means closing the revolving door between politics and business. The best way to save yourself from being Marx’s next victim is to start taking him seriously.
