GENEVA (9 November 2016) – The UN Committee against Torture is due to review Sri Lanka on 15 and 16 November in Geneva. Sri Lanka has ratified the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and so is required to be reviewed regularly by the Committee.

Among the possible issues for discussion between CAT members and a delegation from the Sri Lankan Government are: 

·        Allegations of police torture during arrest and questioning;
·        Allegations of torture and rape by military and security forces;
·        State’s failure to provide fundamental safeguards against torture and ill-treatment;
·        Unlawful detentions and so-called “white van abductions”;
·        Eradication of violence against women, including domestic violence;
·        Deaths in custody, severe overcrowding, unsanitary facilities and insufficient healthcare in detention centres;

·        Poor living conditions in centres for internally displaced persons.
The review will take place at Palais Wilson in Geneva from 10:00-13:00 (14:30-17:30 in Colombo) on 15 November and 15:00 to 18:00 on 16 November (19:30-22:30) and be webcast live at http://webtv.un.org/. The Committee will also hear from NGO representatives.

Dr Navi Pillai receives book on proliferating Buddhist structures

Dr Navi Pillai, the former High Commissioner of UN Human Rights Council who was the key note speaker at the event and recipient of the first copy at the Event in USA, commended the work done by British Tamils Forum in publishing the book. 

She encouraged publication of more similar evidence based documents with facts, to bring to the notice of the international community, the continuing attack on the Tamil Nation, in the Island of Sri Lanka.
 
Several delegates at the event praised the timely release of this book in creating awareness of the current situation, among the western government policy makers and diplomats. This book was released in the UK by All Party Parliamentary Group for Tamils (APPG-T) in association with British Tamils Forum on the 24th October 2016 and in Australia by Australian Tamil Congress (ATC).
 
British Tamils Forum wishes to thank Dr Navi Pillai for her continuing support to the Tamil people and her words of encouragement.  We also wish to salute all the brave people in our homeland who had risked their lives in collecting the evidence that made this document as well as those who have contributed to the publication in various ways.
 
We appeal to our compatriots to support us in our endeavour in making this document reach as many of those who need to know of the plight of the Tamil nation and take the necessary action.

More taxes will increase burden on people: JVP

Janatha Vimukthi Peramuna (JVP) Leader, MP Anura Kumara Dissanayake said the government had now decided to put taxes on goods and services that were exempted in the past and the new taxes such as  the carbon tax will increase the burden on the people. The 2017 budget proposals this year indicate that the budget is merely a worthless piece of paper and not a document which outlines the economic plans of the State, he said.

Finance Minister Ravi Karunanayake yesterday presented what the government called a progressive budget focused on creating "a new economic and social order for the betterment of the country" by not only providing relief to the people but also paving the way for sustainable growth.

The Finance Minister, presenting the 71st budget of independent Sri Lanka, said the social inclusion was a matter of prime concern for the new government, which attempted, through the budget proposals, to enable the entire population to participate in the "journey for development".

"Our attention has been drawn to the fundamental requirements of basic needs extending to land, housing, education and health. Hence, continuous improvement will be made in this regard to sustain the process."

Karunanayake proposed to allocate Rs. 400 million for the continuance of subsidies in the agriculture sector. "We encourage the farmers and farmer cooperatives to improve mechanization through the use of machines such as Transplanters, Hand Weeders etc. As such, I propose to remove the Customs Duty, VAT and PAL applicable on such imports. To also further support farmer cooperatives, I propose a loan scheme where 75 percent of the interest will be borne by the government, for which I propose to allocate Rs. 50 million."

The Government land to the extent of 20,000 acres from the Maduruoya Right Bank and other areas will be released to cultivate the 5 major food crops, fruits and vegetables on a commercial scale, using hi tech modern agricultural practices, targeting the export market. I propose that commercial scale farmers to be provided with a minimum land plot of 1,000 acres on a long term lease basis, he said.

To increase the supply of liquid milk within the country, he said the government had negotiated with foreign countries to import 15,000 high milk producing cattle breeds. "A minimum of 10 such cows will be given to each self-employed farmer, who must then recruit at least 2 Samurdhi recipients to be employed in the dairy farm. Farmers will be assisted through a gap financing scheme, for which I propose to allocate Rs. 400 million."

"Education is centric in our development model. Since we took office, we have kept our promise of ensuring adequate funding for education. In fact, amidst severe fiscal constraints we faced last year, due to the undisciplined fiscal management of the previous government, we allocated in 2016, almost 3 times that of the allocations made in 2014. However, the Ministry of Education has been able to utilize only around Rs. 38,850 million at the end of the 3rd quarter of 2016. We took careful stock of the situation and therefore allocated almost Rs. 90,000 million for 2017. While I admit that allocation for 2017 is less than that of 2016, it is nevertheless 70 percent more than that of 2014. I will also be proposing the provision of an additional allocation of Rs. 17,480 million to further strengthen the development in the education sector," Karunanayake said.

He proposed to allocate Rs 21,000 million to provide basic facilities such as, classrooms, laboratories and libraries in primary and secondary schools.

"We must create the enabling environment for our students to be able to acquire knowledge easily. We must give them a "Smart Classroom" for which we have already allocated Rs. 6,500 million. To supplement this venture, we will also provide free Tabs for almost 175,000 students who enter the Advanced Level (AL) classes and around 28,000 A/L teachers from 2017. I propose to allocate Rs. 5,000 million for this project. I invite the telecom service providers to support this initiative by providing Wi-Fi connections."

To further strengthen the IT facilities in 3,500 schools, he proposed to allow schools to rent a maximum of 50 computers each, for which he proposed to allocate Rs. 5,000 million.

"We will introduce an insurance scheme for all school going children from the age of 5-19, covering 4.5 million students, which is a revolutionary move. Each child will be given a policy of Rs. 200,000. This scheme will cover both in and outpatient services, subject to a maximum of Rs. 100,000 for hospitalization and Rs. 10,000 for outpatient services. The government will bear the premium for which I propose to allocate Rs. 2,700 million."

He proposed to allocate Rs 100 million to support the engagement of university students in extra curricular activities and proposed to extend the lecture hours at universities upto 8 pm.

"We will double the student intake to universities and higher educational institutions by 100 percent by 2020 compared to 2015. However, this endeavor will increase the intake to only 50,000 students."

"We will initiate a loan scheme up to a maximum of Rs. 800,000 per student for the entire course of studies, which will be provided as an interest free loan to 15,000 students based on their Z score to follow courses in selected subjects to cater to the market demand in UGC approved non state degree awarding entities. To support this venture, I propose to allocate Rs. 300 million in 2017."

"As I speak, many in our country continue to suffer from CKDu. This has developed not only as a health issue but also to be an unfortunate social issue as well. Honorable Speaker, we have already allocated Rs. 2,225 million to the Ministry of Health, to address the issues of CKDu and I propose to allocate a further Rs. 750 million in 2017."

He said that the government would design a special incentive package with specific tax concessions for landmark investments of over USD 100 million and up to USD 500 million, and investments over USD 500 million and above, that will change our landscape; we will design a special incentive package with specific tax concessions. order to facilitate the smooth operation of their businesses and investments, I propose to issue a 5 year multi entry visa to such investors and their skilled expatriate labour, he said.

He proposed to set up four more free trade zones in Bandaragama, Embilipitiya, Puttalam and Vavuniya.

"We will commence work on the elevated highways connecting the new Kelani Bridge to Athurugiriya and the Kelani Bridge to the Port Area in 2017. To ease the traffic congestion in the Colombo Metropolitan area, we will also introduce a Light Rail Transit (LRT) system on identified 7 corridors in the Western Region, including, Borella- Battaramulla- Malabe; Kottawa – Malabe; Malabe – Kaduwela; Peliyagoda – Kadawatha; Fort- Maradana- Mattakuliya- Peliyagoda; Dematagoda- Kirulapone – Bambalapitiya and Fort- Bambalapitiya- Borella – Maradana.

One thousand million rupees had been proposed to allocate for the purpose of double tracking the Polgahawela-Kurunegala section and Aluthgama-Galle Section of the railway.

He said that the government would amalgamage the HDFC Bank and the State Mortgage and Investment Bank to create a Housing Bank and 7,500 million rupees had been allocated for the capital infusion.

"To further improve the home ownership, we will take necessary action to transfer ownership of public housing to dwellers who have lived in such houses for more than 15 years. This will start from 1st January 2017," he said.

He proposed to allocate Rs 250 million to support Sri Lanka hosting the Vesak Festival of the UN in May 2017.

For the purpose of setting up a Film Archives and Restoration Unit at the National Film Corporation the government would allocate Rs 50 million and another rs 25 million to establish the Pandit Amaradeva Sangeetha Ashramaya.

"Local industrialists have made submissions with respect to the free telecast of advertisements of foreign products on cable and satellite television. As such, to create a level playing field, I propose to impose a tax of Rs. 50,000 for a 30 second advertisement of foreign products that are telecast through satellite and cable television. Film producers and local artists also made representations regarding the telecast of foreign films and teledramas dubbed into Sinhala and Tamil. As such, the present levy of Rs. 90,000 per 30 minute part will be increased to Rs. 300,000 per 30 minute part. Any such monies collected will be used to develop the local film industry."

We will also introduce a loan scheme facility at no interest to purchase the required equipment that will enable regional correspondents who are registered with the Ministry of Mass Media who work under difficult circumstances to disseminate news, to obtain bank loans up to a maximum of Rs. 300,000 with a 100 percent interest subsidy by the government. Other Media personnel who are registered with the Ministry of Media will also be supported by granting 50 percent interest subsidy to obtain bank loans up to a maximum of Rs.150,000 to upgrade the equipment for media related activities. As such, I propose to allocate Rs. 25 million for this purpose.

He proposed the use of fingerprint machines to mark the attendance at all government institutions.

He said: "Owing to surplus of rice, 5 kilogrammes of rice per month will be distributed to each Samurdhi recipient. The cost of which will be deducted from the Samurdhi Stipend. I propose to reduce the maximum retail price of a. Green gram by Rs. 15 per Kg, b. Dhal by Rs. 10 per Kg , c. Potatoes by Rs. 5 per Kg , d. Sprats by Rs. 5 per Kg, e. White Sugar by Rs. 2 per Kg , f. Kerosene by Rs. 5 per litre , g. LP Gas by Rs. 25 per 12.5 Kg domestic cylinder. I also note that VAT will not be applicable on LP Gas. I also propose to maintain the price of a 400 g locally produced milk powder at Rs. 295 and 425 g locally produced canned fish at Rs. 125.

Tolls on the expressways would be reduced by Rs 50 between 9 pm and 5 am everyday, he said.

The income tax system of the Country is revisited with emphasis being made on the creation of a much simpler income tax regime with minimum tax exemptions and a broadened tax base. Job creation, investment in fixed assets in designated zones, clean energy and the innovation will be the sole grounds for incentives.

The corporate income tax rate is proposed to be revised to create a three tier structure of 14 percent, 28 percent and 40 percent. Income tax rate applicable on liquor, tobacco, betting and gaming, etc. will be continued at the rate of 40 percent. SMEs, Exporters of goods and services, Agricultural sector and Education sector will be subjected to the lower rate of 14 percent. All others including banking, finance, manufacturing and trading will be subjected to income tax at 28 percent. Income tax rate of 10 percent currently applicable on funds, dividends, treasury bills and bonds will be increased to 14 percent. The SME category will be redefined in a rationalized manner.

PAYE rate schedule will be revised in line with the personal income tax rates and all the exemptions applicable on various categories will be removed. Instead, the tax free threshold of Rs. 100,000 per month will be available for every employee on their employment income. The income from the secondary employment up to Rs. 50,000 per month will be liable for PAYE at 10 percent and if it is more than Rs. 50,000, the tax will be at the rate of 20 percent. The PAYE of the employees of state owned enterprises and other government institutions should be deducted from the employees’ emoluments and should not be paid by the institution.

To provide a better price for locally manufactured spirits, duty on imported ethanol will be upwardly revised. I also propose introducing Excise Duty of Rs. 25 per litre for imported non-potable liquor for giving further assistance to local manufacturers. Excise (Special Provisions) Duty will be introduced on the importation of beer can at the rate of Rs.10 per can of not more than 325 milliliter and Rs. 15 per can of more than 325 milliliter.

Capital Gain Tax (CGT) will be introduced with effect from 1st April 2017 at a rate of 10 percent. We consider this tax to be equitable as it bridges the income gap and assists the government initiatives in poverty alleviation.

Road accidents claim more and more lives daily. Most of the accidents are due to the traffic violations. I propose to increase fines charged on traffic offences and to increase the minimum fine to Rs. 2,500.

Budget deficit has been estimated at Rs 625 billion and it would be 4.6 percent of the GDP.

I was fortunate to be invited to study and observe the US Elections of 8 Nov. 2016. So here I am in Washington, DC, thanks to the International Foundation for Electoral Systems. The US election result is out. We have Republican Donald Trump as President-Elect who boasts that “when you are a star, [women] let you do it. You can do anything. Grab them by [their genitals]. You can do anything.” He is vitriolically against Muslims, immigrants and Mexicans. Losing the popular vote – 47% against his classy Yale-educated Democratic rival Hilary Clinton’s 48% – he won partly because of Clinton’s vote for the Iraqi war, her support for unrestricted abortion rights even for late term pregnancies, and her earning millions through speaking fees and donations from foreigners seen as working against the US. Trump’s repeated insult “Crooked Hillary” seemed to reverberate and stick. His xenophobia and sexism seemed to attract the votes of the less educated, especially those whose jobs had moved abroad, while most educated women were solidly behind Clinton.
The US map marked in red for where Trump won is similar when compared to a red density-map of evangelical churches. Trump was certainly helped by the evangelical Rev. Franklin Graham, the son of the more famous Rev. Billy Graham, who said
“There’s two different pictures and two different visions for America. … [Trump] is a changed man. … I have people that say, ‘Well I don’t like Donald Trump, I don’t like what he says [about his grabbing women by their genitals].’ Well I don’t like what he said either, I promise I don’t like it. But those are things that he said 11 years ago, not something that he said today. … I think Donald Trump has changed. I think God is working on his heart and in his life.”scanning

He added later on Face Book, “the difference between the candidates is night and day. … while Trump’s comments might be ‘crude,’ Hillary Clinton’s progressive agenda is godless and cannot be defended.”
Graham was untruthful. Trump’s racist rants are very recent. Trump has to change or America is finished as a nation of free citizens with inviolable rights.
In contrast, Carl Bernstein of Watergate fame described Clinton as a Christian who teaches Sunday School and marks up her Bible and carries it about wherever she goes. She certainly held onto that traditional, centuries-old Christian virtue of marriage-for-life which is spurned by American-inspired evangelical churches when she stood firmly by her repeatedly straying husband.

International schools: issues, problems, myths, and drivel

Patali Champika Ranawaka, at a convention held last week, spoke on private education and the Kannangara reforms. He spoke on international schools and argued that they should either be closed down or be integrated with the country. That is pertinent but certainly does raise some hairs.

Alles and Ekneliyagoda murder suspects too out !

LEN logo(Lanka-e-News - 09.Nov.2016, 9.15PM)  The practice of granting bail without citing reasons  to the Rajapakse brigand rogues who outrageously robbed public  property and the culprits who committed murder for and on behalf of Rajapakses using  the label of ‘war heroes’ , is being continued recklessly by courts in the wake of  the recent  odious ‘ cyanide’ speech of  the president . Today too , Tiran Alles the notorious RADA rogue and two other suspects  incriminated in the Ekneliyagoda murder were enlarged on bail.
The primary  defense advanced by the black coated sharks on behalf of these criminals was : even the president has charged  that the FCID and the CID which filed action in  court against these criminals are discharging their tasks based on political agendas.
Nalin Laduwahetti the lawyer for Alles cited president’s statement as a  defense when requesting bail for his client. On the earlier occasion  , the high court rejected this argument and remanded the culprit , but today the appeal court  vacated that order and directed the high court to  grant bail. Perhaps this is the first time bail was granted to a suspect this way who is facing clear and cogent charges under the Public Property Act of robbing  a whopping  Rs. 2000 million without building a single house for the Tsunami victims out of a sum of Rs. 6500 million of the public funds granted to him for that specific  purpose.

Meanwhile the  two suspects (fourth and fifth accused) who  flaunted the label of ‘war heroes’ , namely , Wadugedera Winnie Priyantha Nilanjan  Upasena alias Suresh and  Seneviratne Mudiyansalage Ravindra Upasena alias Ranji , and were  the remaining two of the suspects in remand custody in connection with Ekneliyagoda murder , were ordered to be released on bail by the Avissawella High court judge  , Amal Thilakarathne today (08) . They were released on a cash bail of Rs. 1 million and two surety bails in a sum of Rs. 3 million each. This means that all the suspects in Ekneliyagoda case are now out on bail. 
While releasing these culprits  on bail , in respect of  the cases against Wimal Weerawansa and Gotabaya Rajapakse long dates  were given by court – postponed the case 7 to 8 months at once, meaning that these two criminals  were afforded  the opportunity to  enjoy to the hilt , their criminalities notwithstanding .
The incumbent president Maithripala Sirisena  who made most solemn and public promises as common candidate during the run up to the last presidential elections that the murderers of Ekneliyagoda will be apprehended and punished ,  did a dramatic turnabout  recently . In his recent  odious cyanide speech , and the subsequent interview with a   newspaper , lamented that the suspects in Ekneliyagoda  murder are in remand custody for a period of 16 long months , in addition to making  a  number  of  obnoxious statements directly bringing pressure to bear on the courts

Sand Mining & Rock Blasting For Colombo Port City

The recent, Negombo protest held by the fishermen came to an end, only after a promise from the political authorities that sand mining will not be done within a distance of 4km from the shore as before. Then a much publicized assurance was given that sand mining activity (dredging) will only be done, beyond 10km from the shore.
However, much distressed fishermen and women are now reporting that the sand mining is done as usual within a distance of 4-6km, causing irreparable harm to the environment and destruction to their only livelihood namely coastal fishing.
The challenge that the fisher leaders and others who are concerned about this matter, face is to verify and confirm those reports. If found true it could be definitely concluded that the fisher community has been betrayed and duped by the politicians just to stop their much publicized protest.port-city
If the government has given a promise to the protesting fishermen, to protect the Coastal Fishing Industry it has to be kept. If it fails, fishermen and all citizens must together confront the authorities, considering the urgency and national importance of this issue.
The experts who are familiar with the marine environment believe that sand mining done even outside a distance of 10km can do cause harm to the coast.
This centuries old, well established Coastal Fishing Industry provides essential protein, fresh fish, to the majority poor of our country. The poor cannot afford costly deep water fish now exported to the EU and it is most unfair to feed the poor of our country with cheap, frequently out-dated tin fish dumped in our markets from foreign lands, when our coastal waters are teaming with nutritious fresh fish.

Airport administrators’ order more vehicles incurring Rs.860 million loss to public

In an environment where Katunayaka International Airport employees’ welfare facilities including uniforms and transport facilities have been slashed the authorities are engaged in a move of misusing vehicles incurring a loss of Rs.86,000,000 to the government say reports.

Modern super luxury vehicles have been ordered to provide transport facilities to the Chairman and higher officials of the administration while tractors and lorries have been provided for transport of employees.

It is reported that the employees do not get their uniforms in time. Trade union leaders state the Chairman of the Airport Saman Ediriweera has taken three luxury vehicles belonging to the Airport for his personal use but has allocated more money to get down more luxury vehicles for the use of the administrators.

Meanwhile, Katunayaka International Airport is criticized for dirt and corruption. Many complains that bathrooms are unclean and understocked with soap and tissues. The stench of the bathrooms reportedly has an ability to radiate out behind the doors, infusing the terminal more broadly. Users also complained about long queues for immigration, created by seemingly disorganized staff.

At least two units which were operating under the Army Intelligence Division have been disbanded with the removal of the Director of the Army Intelligence Division last week, sources said.

Brigadier Suresh Sallay was removed and Brigadier Vijendra Gunatilake was appointed to the post.

Sources said that intelligence units which were operating under Sallay were disbanded with his removal.
Well informed sources said that Brigadier Suresh Sallay was removed as he lost the confidence of the defence establishment.
The recent incidents in Jaffna was one of the reasons behind Sallay ‘s removal, sources claimed.
Sources also said that Sallay was seen as having had close links to the former regime, including former Defence Secretary Gotabaya Rajapaksa.
The former military intelligence chief was also accused of giving false information to the President in an attempt to destabilize the cohabitation government.

(Lanka-e-News - 09.Nov.2016, 9.15PM) IGP Poojitha Jayasundara is engaging in vicious ‘double crossing games’  in order to undermine and humiliate the government , based on information supported by copious and cogent evidence reaching Lanka e news inside information division. 
This is borne testimony to by the fact that while the president and the prime Minister despite the criticisms they are facing have repeatedly and unequivocally declared they would not stifle or intimidate the media ( ‘the media is attacking me even when  I have fallen down. Then when I am erect too  they don’t spare me from their criticism . Yet I shall protect the media freedom’ president said recently ) ,the IGP on the other hand is acting to the contrary by attempting to throttle and intimidate the media that is criticizing him. 
The police that went to  question the friend of Lanka e news regarding a letter that was forwarded to the bank concerning the banking activities of Lanka e news had said , it has to interrogate him in connection with Lanka e news  in spite of the fact  , there was no  complaint made nor a court order obtained to necessitate such an  interrogation. The friend of Lanka e news was abroad at that time in connection with his business activities  , and those who arrived have frightened the employees .  When Lanka e news probed into this , it was discovered that this group which went to inquire about Lanka e news comprised of officers of the SIU ( special investigation unit) directly responsible only to the IGP. 
To the consternation of all,  Lanka e news subsequently discovered  that neither the defense minister , that is the president of the country nor the minister of law and order of the country Sagala Ratnayake in charge of the police had been  aware of such a group .
When the IGP was questioned on  this , he pretended that he knew nothing about it , while  giving  instructions to request the editor to phone him , thereby spilling the beans . Lanka e news views this episode as a conspiracy hatched by the IGP to humiliate and undermine the government while it is also  an underhand  tactic to threaten and intimidate the media which are justifiably criticizing him. 
The second ‘double crossing game’ played by the IGP is most intriguing and interesting , which Lanka e news has named it  as IGP koloma ( IGP’s  clownish eccentricity) ….
The IGP has  these days given instructions to tap the phone calls of his own senior DIGs, DIGs , Directors in charge of divisions and several journalists .
It is to be noted , in this connection , neither the security council nor any other authority has given any instructions to IGP Poojitha to engage in this activity . The State intelligence service (SIS) has also not given a report that such an action should be taken. Usually tapping of phone calls should be carried out only on the directives  of the State intelligence service (SIS) along with a court order. Hence , this high handed action taken by Poojitha is to enable him to learn who are criticizing him - another  ‘IGP Koloma’ of Poojitha the eccentric clown. Not enough the damage he is doing , Poojitha through the media coolies who are his cronies is slinging mud  at the DIG’s he dislikes and  against whom he has a grudge.
In addition ,targeting the DIGs who are his enemies he maligns them  sending spurious e mails via the social media. Most recently , such an e mail was sent targeting the central province DIG Lalith Jayasundara .When Lanka e news probed into such a report we received ,our inside information division was able to detect that these are being carried out by a group operating under Poojitha. The most portentous element in this sly activity by an IGP of all people is , the DIGs across the Island who fall victims to this ‘sordid game’ could conclude that these are being carried out with the knowledge and consent of the government . Gaza’s missing haunt those left behind

On 31 July, workers clearing rubble from a house destroyed in a 2014 Israeli bombing in the Shujaiyaneighborhood of Gaza City discovered part of a human skeleton.

Police were summoned and the remains were taken away for examination.

But identification proved impossible, Ayman al-Batniji, a Gaza police spokesperson, later told The Electronic Intifada. The remains, he said, have since been buried and were likely two years old.
“We were not able to ID the skeleton, but we expect that it belongs to one of the martyrs of the last war since it was discovered during a clean-up of one of the houses shelled then.”

The find was a grim reminder that two years after Israel’s 2014 onslaught on the Gaza Strip people are still missing, most presumed dead.

Gaza’s ministry of health acknowledges that the exact number is not known. The ministry is still trying to follow up with local human rights groups and the International Committee of the Red Cross (ICRC), according to ministry spokesperson Ashraf al-Qedra.

The ICRC, which handles issues related to Palestinian prisoners or those whose bodies have been interred by Israel, is following six cases of missing persons, according to spokesperson Suhair Zakkout.

But the cases at the ICRC are only those where families have come forward. Some have not reported their missing relatives to the ICRC simply because there is no suggestion that they were seized. Others, where relatives may have been active in the Palestinian resistance, do not want to offer Israel any information.

The grief in a father’s heart

Every day after dawn prayers, Hussein al-Hams, 66, goes in search of his son Juma in the rubble of a building east of Rafah, Gaza’s southernmost city. Juma went missing on 1 August 2014 when he was 22. The day became known as Black Friday.

Black Friday was actually one of four days. It was a particularly brutal episode in a devastating 51-day Israeli onslaught on Gaza that saw more than 2,200 Palestinians killed.

The overwhelming assault came after Hamas fighters captured an Israeli soldier and the Israeli military triggered its Hannibal Directive in response – authorizing it to use massive and indiscriminate firepower across the entire area where the soldier might be to prevent his capture alive.

According to Amnesty International, between 135 and more than 200 civilians died in the bombardment before it eased off on 4 August with a ceasefire. Many more were wounded and hundreds of homes and buildings were destroyed.

Among them was a multi-story building belonging to the al-Sarafandi family. Inside were Juma, Rami al-Sarafandi and Ahmad Khalifa, according to the Rafah office of the Qassam Brigades, Hamas’ military wing, which claimed the three as members, and announced that all had died.

But only two bodies were found, those of al-Sarafandi and Khalifa. Juma’s father clings to the hope that somehow his son escaped the fate of the other two. He keeps returning to the al-Sarafandi building to rummage through the rubble with his bare hands.

“Since there’s no body or trace of my son, I’ll continue doing the same until I hear of Juma or find his body,” al-Hams told The Electronic Intifada.

Husam, 36, Juma’s older brother, does not share his father’s hope.

“I’m sure that my brother was killed. It’s not possible that he’s still alive or was arrested by Israel,” he said, citing the Qassam announcement as well as his understanding that a three-day search was made for the bodies.

“We hope to find something to soothe the grief in our father’s heart.”

Mahmoud Fawda, a local reporter with Alresala newspaper, was in the area at the time of bombardment. He said it was unlikely anyone escaped the bombing.

“The shelling was like a volcano,” he told The Electronic Intifada. “It destroyed the houses and left the area unrecognizable.”

Also convinced of Juma’s demise is his mother, Suhair, 62.

“A mother’s feeling never lies. I know he’s dead, but I still hope to find his body or even a part of it; to have a tomb for him so that I can visit him, to lay some roses, and read the Quran for him.”

Husam is thinking about building a symbolic tomb in his brother’s memory for his mother. But his father refuses the idea. Be patient, he tells Husam.

The disappearance of Nour

Just a little north of Rafah, the family of Nour Omran in Khan Younis is still clinging to the hope that the teenager, 16 when he disappeared, is still alive.

The family is in contact with human rights organizations, members told The Electronic Intifada, to ascertain whether he was captured by Israel or killed.

Nour’s case, one of the six with the ICRC, is one of the most puzzling. He went missing on 23 July 2014 in al-Qarara village east of Khan Younis, which was severely hit during the Israeli offensive.

Nour’s mother Rihab, 45, was the last to see him before his disappearance. He had gone to the family’s poultry farm in the area, according to Rihab, and only after he left did the family hear that Israeli troops had invaded the area.

When family and friends later gained access to the farm, which had been destroyed in the bombardment, they only found Nour’s motorcycle and keys, Rihab told The Electronic Intifada. There were no traces of blood or other signs of violence.

“For me, the war never ended,” Rihab said. “I don’t know until this moment whether my son is alive or dead. Was he arrested? Dead? His body, is it among the rubble or with the Israelis? I still don’t know.”

The family provided DNA samples to the ICRC to give to Israeli authorities to ascertain whether he is held captive – dead or alive. But according to the ICRC’s Zakkout, while there was initial cooperation, once the samples were submitted at the beginning of 2015 there has been no response from the Israeli side.

“Israel responded at the beginning, but after the DNA samples were delivered, cooperation stopped,” Zakkout said, adding that the ICRC is still pursuing the case with Israel.

Deliberate obfuscation

Mervat An Nahhal, director of the legal aid unit at Al-Mezan Center for Human Rights, said Israel had been generally unresponsive to requests for information about the six cases filed by rights organizations.

But while the six cases reported remain unresolved, this is not the end of the story, according to An Nahhal. “This number, six missing, doesn’t cover all the missing. In many cases, there is zero information available, and we were not able to reach their families or get their authorization to start an investigation.”

Omran’s family will continue living in limbo until they learn what became of Nour.

“It’s far easier to know that he is dead than to continue this grief, ignorant of his fate,” his mother said.
In March 2015, HaMoked, an Israeli human rights group, reported that the Israeli army held the bodies of 19 Palestinians slain during the 2014 offensive. According to the military’s response to a freedom of information request in 2014, conclusive identification of the bodies had not been carried out, nor would the military reveal where the bodies are buried.

These remains mostly belong to Qassam fighters. At least 10 are from a single infiltration across the Gaza boundary on 21 July 2014 – an attack on a military position near Nir Am, east of Beit Hanoun in Gaza and west of Sderot, an Israeli town near northern Gaza.

In total, of the 19 bodies Israel admits to holding, 14 are of Qassam fighters. Five are unknown.
The Ramallah-based human rights group Al-Haq stated in November last year that “By retaining the bodies of those killed, Israel is directly violating its obligations under international law.” The group urged “Israel to return the bodies of the deceased to their families for proper burial and mourning.”

Riad al-Ashqar, a spokesperson for the Palestinian Prisoners Center for Studies, told The Electronic Intifada that Israel has two considerations when dealing with the issue of missing bodies. First, there is a security dimension. Israel keeps information obscured for the purpose of aiding negotiations over any exchange of bodies or prisoners.

Second, al-Ashqar added, Israel is “deliberately augmenting the suffering of the Palestinian people in general and the families of those missing in particular” to act as a form of deterrence.

Losing hope

Fayez Abu Shamalah, a lecturer at Al-Aqsa University and a political analyst who himself spent 20 years imprisoned in Israel, said the Israeli military is extremely cautious on this issue with the intention of disclosing as little information as possible in order to improve its bargaining position ahead of any exchange negotiations with Hamas over prisoners and bodies.

In September, Lior Lotan, Israel’s chief negotiator, said talks over the return of the 19 bodies had broken down, accusing Hamas of demanding the release of prisoners not from Gaza.

In al-Tuffah, east of Gaza City, Majid al-Batsh has stopped looking for his missing relatives. The 55-year-old lost 18 members of his family in two strikes on family houses on 13 July 2014.

Of those, only 13 are accounted for. The bodies of five people, including a pregnant woman and two children, as well as Majid’s son Jalal, 26 at the time, have never been found, he said.

Majid has stopped looking for his son. He says he believes Jalal was burned to ashes. Two months ago, he asked the civil defense – which had been sifting through the rubble to identify human remains – to stop looking as well.
