BASL in writing requests immediate investigation against erring Gangodawila judge Kanishka !


LEN logo(Lanka-e-News -07.June.2016, 10.30PM)  The Bar Association of Sri Lanka (BASL) through the Judicial Service Commission (JSC) has sent a letter to the chief Justice (CJ) requesting him to conduct an investigation immediately into the flagrant professional misconduct of Kanishka Wijeratne the Gangodawila magistrate responsible for grave miscarriage of justice ,and who  shamelessly insulted  the  judiciary including  the  entire legal fraternity  and the bench on a scale never witnessed before in the country ‘s history , in order to save a notorious robber judge  Thilina Gamage the Elephant rogue, based on reports reaching Lanka e news inside information division.
The BASL letter under the signature of its president Jeffrey Alagaratnam containing the request was received by CJ yesterday evening , LeN inside information division sources confirmed. 
The charges leveled against Kanishka Wjeratne most uncaringly and erringly   prostituted his official position  , and made the exalted legal profession look the oldest but most frowned upon profession in the world- prostitution ,by his shameless and disgraceful  official misconduct are hereunder …….
1. It is a well and widely known fact (the whole country  is aware) that Thilina Gamage and Kanishka the two judges are most close and intimate pals. Hence , Kanishka should have steered clear of this case based on legal ethics and norms , and during the proceedings the state counsel representing the Attorney General too pinpointed this in so many words. Yet judge Kanishka based on ulterior motives subverting the legal practices ,norms and ethics   , with the sole and whole objective of rescuing his elephant thief friend Thilina, undertook to hear this case himself and pass verdicts sending a wave of rude shock across the entire country. This professional misconduct is a flagrant violation even of the sacred oath he took when being sworn in as a judge .
2. Kanishka Wijeratne who showed special preference to Thilina the accused heard the case until as late as 7.00 p.m – something that had never ever taken place any day in any court in Sri Lanka.
3. Providing facilities to the  accused (elephant rogue Thilina) to hide himself ,by permitting him to  enter and leave court using the elevator  that is exclusively meant for judges.
4. Providing facilities to the gangs of  Thilina the accused to come inside  the court without  any  hindrances , and permitting them to freely appear within. Even the media at that moment objected to this.
5.Unlawfully allowing accused Thilina to go home free and come back on the following day to fulfill the bail conditions 
It is now unsure following these wrongful procedures and unlawful actions whether these facilities and concessions are going to be granted to the other accused too by this court in the future .  Besides , because the media had given immense publicity to these calculated judicial aberrations and corruption , the faith and confidence people repose in the judiciary  have been  eroded completely .
In the circumstances , we request  the chief Justice  to conduct  an immediate investigation against the judge through the JSC.

Taking Stock Of Yahapālanaya & The Way Forward

Last year on January 8th, people of this country did take an important decision at the Presidential Election. This decision was reaffirmed by the subsequently held General Election. It was an ardent loud and clear call against corruption, bribery, waste, nepotism and other social evils. The collective message was that the country’s political landscape should be changed for better!
I was one of the people who supported and voted for the change. In my personal capacity, I also did canvass and convince people to cast their vote against the then incumbent regime and the corrupt politicians. Definitely, this was not out of malice, but it was a must at the time, for the best interest of my country!
After the change, I wrote my very first article on politics (I have written many articles but those were based on my professional expertise) to the ‘Sunday Observer’ of February 15, 2015 and it was entitled: ‘Wiping out terrorism, feather in Rajapaksa’s cap’. In my view, this title did not go with its content (you too might agree with me if you read it), but it was an executive decision, made by the editor at the time, to serve his defeated political master further!
Through this article, I constructively (my hope at least) criticised President Mahinda Rajapaksa for his undemocratic moves, short-sighted vision and decisions, personal agenda which were simply unbecoming of his position that put the country in the doldrums.
That being said, we the Sri Lankans have now given a clear mandate to President Maithripala Sirisena and Prime Minister Ranil Wickremesinghe to bring the country back on the right track sooner rather than later. This entails conceptualising a long-lasting vision that will take Sri Lanka through the 21st century in a sustainable way.
However, President Sirisena, Premier Wickremesinghe and their government have been bequeathed an uphill task of setting their house in order. As they are now about 17 months into the task, it would be interesting to examine the progress or the lack of it, the country so far has seen, and the new direction the government is practically taking.
In the said context, it is my intention to ponder on the following in this article; (not listed in any particular order)
People’s right to accurate information
Let me make my premise to the discussion with a personal observation. As a citizen of this country, what I have been experiencing last several months is only the noise and clutter. In my view, this gives confusing messages and the government has not paid enough attention to keep its citizens reasonably informed! In other words, the people are not quite sure of the direction or progress the country has been really making to which they have a fundamental right. This shortcoming is becoming increasingly noticeable as the days go by as expectations of masses from the ‘Yahapalanaya’ (good governance) government are quite high!

Salawa disaster struck during ‘special event’ – Defence Secy Fire drill also mentioned

Sunday’s disaster at the Salawa Army Camp at Kosgama had occurred while a special event was going on within the camp premises, Defence Secretary Karunasena Hettiarachchi said yesterday.

Asked what the special occasion had been, the Defence Secretary did not give a direct answer but mentioned fire drills among other things.

Hettiarachchi said he was not in a position to reveal the exact cause of the base fire. He would do so in time to come, he said.

He was addressing journalists at the Defence Ministry’s Media Centre yesterday.

According to the decisions taken at the Security Council meeting, a special court made up of tri-forces had already been set up to probe the incident at the Salawa Army Camp, besides the Magisterial and CID investigations, Hettiarachchi said.

He said action would be taken against those responsible for the disaster, according to the country’s law.

Hettiarachchi said all armouries of tri – forces would be shifted to unpopulated areas within a few months, according to a decision taken at the Security Council meeting on Monday.

He said Cabinet approval for relocation of armouries would be obtained shortly on the instructions of President Maithripala Sirisena, who is the Minister of Defence.

Hettiarachchi said there was no proof that such a move had been made by the previous government. "I checked with ministry officials, but the previous government had not taken a decision to relocate armouries to isolated areas."

Hettiarachchi said no one could reach the Salawa camp premises so far as there were still unexploded ordnance though the fire had been doused by Monday evening.

"We deployed the bomb disposal unit of the Special Task Force to clear the place," he said, adding that they expected to reopen the Avissavella-Colombo main road as soon as possible.

Hettiarachchi said about 1,000 people evacuated from the immediate danger zone due to the explosion had stayed in temporary shelters, but the number had come down to 600 by yesterday morning. He ruled out that the fire at the armory at Salawa Army Camp was a threat to national security.

Military Spokesman Brigadier Jayanath Jayaweera said people could return to their homes beyond a distance of 500 meters from the camp as the area was safe now.

"We ask people to hand over any debris that they find in their home gardens and surroundings to the authorities," Brig. Jayaweera said.

Tomorrow (08) is the massive public protest against court action that committed contempt on law abiding citizens !

-Defense secretary also contributed to conspiracy to rescue elephant rogue!

LEN logo(Lanka-e-News -07.June.2016, 10.30PM)   In a country where even if a citizen  sneezes within a court it is treated as a contempt of court and he/she is rendered  liable to imprisonment , shouldn’t jail sentence be imposed on a judge (who should act most responsibly and respect laws) who  conducts himself unlawfully  in a most despicable and disgraceful manner to help another judge charged with robbing an elephant, and even releases the culprit judge  on bail,  as well as goes as far as to  allow the accused  to go home without fulfilling the bail conditions ?  That is ,  the accused was  allowed to come back the following day to fulfill the bail conditions. 
Indeed this is a grave contempt committed on the  citizens by a court unprecedented in history ! This contempt committed by a court on the citizens is more serious than contempt of court committed by a citizen , for the courts the seats of justice are expected to be exemplary and hence cannot commit even a minutest wrong.
Lanka e news earlier on reported on this contemptible action of the two judges , and those  behind this are three ministers , a president’s co ordinating secretary ( a brief – less black coated shark) , a most notorious mayor, and based on information reaching us , the defense secretary KarunasenaHettiarachi  moved heaven and earth to save the rogue judge , and helped  him to circumvent the laws. A massive public protest against these dastardly and contemptible  actions of these scoundrels and rascals is to be staged tomorrow (08) at 12.00 noon, in front of Judicial Service commission ,Hultsdorf.
The organizers and the heroic law abiding citizens  urge the  law abiding citizens  to come in their thousands to stage their protests against the court action which is a contempt committed on the law abiding citizens , as well as to sign a public petition. 
Justice shall triumph!  We shall be the victors!!

BRIBERY SCANDALS ROCK SLFP PORT UNION

Three rival trade unions of the Colombo Port will soon file a series of complaints with the Commission to Investigate Allegations of Bribery or Corruption (CIABOC) this week against the SLFP Trade Union of the Colombo Port for malpractices committed which border on bribery and corruption.
This follows Audit Superintendent of the Auditor General's Department R.G. Hettiarachchi submitting a detailed report to the Chairman of the Sri Lanka Ports Authority, alleging that the SLFP Trade Union in the Colombo Port - the Sri Lanka Nidahas Sevaka Waraya ( Pvt) Ltd ( which has been registered by the Registrar of Companies under the Registration Number 63912) has signed a Memorandum of Understanding with a leading beverage company, awarding a contract to the company, providing the company a monopoly of supplying soft drinks to the Galle Face Green and all the SLPA canteens
The report also said that the company has paid a gratification of Rs 3 million per annum for five years to the SLFP Union for the monopoly of supplying this brand of beverage for Galle Face Green and Rs 2.5 million per annum for the monopoly supply of this beverage to all the SLPA canteens.
The Memorandum of Understanding which has been signed between the SLFP Port Union - the Nidahas Sevaka Waraya (Pvt) Ltd (which is in possession of this newspaper) also says... ( interalia) that the five year contract will begin from 21 June 2010 and where the second year of the contract will begin on 21 June, 2011 and that the trade union will provide the company with the exclusive rights for branding the 39 or more outlets depicting monuments within the Galle Face Green and also ensuing that NSW undertakes to prevent either directly or indirectly any other product that competes with the company being sold or promoted or exhibited within the Galle Face Green during the entire period of the Agreement.
The report also said on page 5 under Clause 6, under obligations, the company shall pay to NSW, by way of cheque drawn in favour of NIDAHAS SEVAKA WARAYA (PRIVATE) LTD (NSW), put up suitable kiosks for all outlets by ensuring the safety and supervise regularly performance of the outlets and operations.
On the same page, under confidential information, Clause 8.1 says "NSW undertakes to keep confidential information in strict secrecy during the currency of the agreement....
There is also evidence in the report that the company has paid a sum of Rs 3 million to NSW by Cheque No. 969217 on 18 July, 2011 and further Rs 2.5 million by the same bank and same branch via cheque No. 114722 on 16 March, 2011.
The report of the Auditor General's Department also alleged that NSW has also procured illegal contracts to the tune of Rs 30 million for the demolishing of buildings which were even outside the Port premises!
It was also alleged that NSW had been the beneficiary of the revenues which had been earned through the operation of a yacht service within the premises of the Trincomalee Port, for the benefit of tourists, when the real beneficiary should have been the Sri Lanka Ports Authority (SLPA).
The report also said there has been a further income of Rs 11.6 million (Rs 11,652,851) which has been earned from the lease of the Galle Face Green, incomes which have been made from the sale of parking tickets and also from the trade stalls and tourist vehicles and others, while there had also been an expenditure of Rs 17, 744, 275. There has not been any evidence of these revenues and expenditures. It has also been pointed out in the report that it was illegal for a privately registered company to draw incomes which should have been accrued to the government.
The report of the Auditor General's Department says that this union, while pruning down the welfare benefits of the employees had also engaged in these illegal practices as well. This agreement with the company has been signed by the union without the prior approval of the SLPA Management and the Board of Directors whereby the monopoly has also been illegally given to the company.
The report also points out that these employees have no right to enter into such agreements without the prior approval of the management while being permanent employees of the SLPA. The report also says that no State institution signs monopoly agreements with any private organization which will restrict the consumers' rights.
SLPA Chairman's reply
Former SLPA Chairman Dr. Priyath Bandu Wickrama, in his reply to this letter from Audit Superintendent R. G. Hettiarachchi of the Auditor General's Department says that he has sought advice from the Attorney General's Department and has requested him to inform the SLPA Chief Legal Officer on the due process of recovering these monies.
The former SLPA Chief, in his reply has also said that he has directed the Chief Legal Officer to determine whether legal action could be taken for the recovery of revenues which have been earned from the Seruwila 2 yacht.
NSW Chairman, Working Director charge-sheeted
The Chairman of the NSW, Prasanna Kalutharage, who was also the SLPA Working Director at that time, has been charge sheeted by the SLPA Chief Manager (Administration) R.A.M.S. Ratnayake, asking him to show cause as to why disciplinary action should not be taken against him in accordance with the charges levelled against him with the charge sheet dated 5 November, 2013 which this newspaper is in possession of.

Five suspects including the former Vice Chairman of the Musali Pradeshiya Sabha has been arrested for illegal sand dredging across the banks of the Malmathu River in the Murunkan area in Mannar.  

Murunkan Police said that the suspects were arrested this morning following a raid carried out by the Vavuniya Police dangerous drugs unit, based on information received by the DIG in charge of Vanni District T.M.W. Deshabandu.  

Various equipment used by the suspects to engage in the illegal excavations and two tractors have also been taken into custody by police. 

 According to reports, the suspects have been engaged in illegal sand dredging activities for a long period which has caused severe environmental damage. 

 During the raid, the former Vice Chairman of the Musali Pradeshiya Sabha Mohamed Fairooz had proceeded to threaten the police officers and therefore has been charged with obstructing police duties.  

The arrested suspects are to be produced at the Mannar Court today (7).

To Israel, being “from Gaza” is a crime

I was invited to take part in this year’s PalFest literary festival as a Palestinian writer talking about my novelVanished and my theater work. I traveled to Palestine as a British citizen with my red passport. Everyone in my group was waved through at the Israeli-controlled Allenby crossing between Jordan and the occupied West Bank. Except me.

Far worse than not being allowed to enter Palestine was the fact that Israel denied me entry because I am from Gaza.

Not only did Israeli soldiers deny me entry but they were shocked to see someone like me trying to visit the rest of Palestine. Imagine that you are from Manchester or somewhere else up north and tried to fly into London and were told that you were “a northerner, you can’t come here.”

They were surprised that I even thought about it. “You are from Gaza,” they kept saying.

When I was sent back and the Jordanian authorities realized that I had been denied entry, the guards at the border were furious, and said, “You are from Gaza, what were you thinking?”

As if trying to go back home is a crime, as if the idea itself is a crime, as if I had to accept my oppressed status and not even dare to think that I could be a normal human being traveling to my own country.

Panic

I could almost feel the Israelis’ panic, their fear and confusion the moment they realized that I was from Gaza. I could almost see sweat drops on their foreheads as they were turning me away.

A man came and shouted at me to hand him my Palestinian passport and ID. Another man told me that they needed those documents.

A soldier with a big gun took me to a room and showed me my details on a screen followed by details of my family in Gaza.

“Go back to Gaza!” he shouted.

But how? Why don’t you bloody let me go there to see my family whom I haven’t seen for more than three years now, who haven’t met my daughter yet? Let me through to see my ill mother, let me through to see my aging father, let me through to hug my niece, to be at my brother’s wedding.
“You are from Gaza,” he continued.

“I am not,” I said.

I really am not from Gaza. My family live in Jabaliya refugee camp, they have blue United Nations refugee cards, they are considered homeless and it is all thanks to you and your fascist state.

You will probably finish your shift today and go back to your house. For all I know, you may live in my family’s village of Deir Suneid. You may even live in the same house my grandfather built and was expelled from.

“You have a Gaza citizenship,” he continued shouting at me.

What does that even mean? I really didn’t know; it was the first time I had never heard this term, “Gaza citizenship,” being used.

It pained me to see everyone go into my country except me.

I was happy the rest of the group got through, of course.

But all I could think of was that it was a dream for me to see the cities I heard about while growing up in Gaza. To go to RamallahJeninNablusJerusalem and all the others.

Second class citizen

I heard so much about them, was told stories at bedtime, many of my people in Gaza died for them. Yet I have never ever been able to see them simply because I am from Gaza.

I said to the Israeli soldier that I was traveling as a British person, not as a Palestinian. But he looked at me and said “khabebi, you are from Gaza. I can’t do anything for you.”

I got my phone out and wanted to call the British consulate in Jerusalem. But I stopped halfway.

Something told me that it was going to be a wasted call. Something told me that if he could say it to me like that, surely a British consulate wouldn’t really do anything, surely I wasn’t the first person this had happened to, surely I was just a second class citizen to them.

Maybe if I was white and was called Michael, it might be different.

I had written to the consulate many times previously, asking for their help to allow me access to visit my family when my mum was in hospital and then again when my brother got married. But the response was: “We are sorry, we can’t help you because you are from Gaza.”

Lucky?

So here I am writing these words and thinking that I am the lucky one because I have a British passport and I am based in London at the moment.

But I am thinking of the 1.8 million people trapped in Gaza. I am thinking of all the mothers who haven’t seen their children, the elderly, the children who urgently need medication, the students, the business people, the nation.

I am thinking of that awful ghetto. Where else would such conditions be allowed?
I am thinking: what if an Israeli writer was denied entry on their British passport? Would the BBC cover it?

The PalFest group were amazing: a talented collective of writers, poets, journalists, bookshop owners and filmmakers. They kept in touch with me all the way through.

They took pictures of my novel Vanished in all the cities they went to. It was very touching.

The poet Ricky Laurentiis read passages from the book at the closing evening in Ramallah. I felt like I had been martyred, as if I was dead, watching people from above reading my words.

I wondered if I would be remembered afterwards or if the agony will pass. I wondered whether my fellow group members would see what happened to me as another symptom of the occupation.

I wondered whether, like every single Israeli assault, it would become an expedition, a funeral that people come together for, then leave the bereaved to their pain.

I cried as they ejected me from the Israeli-controlled side of the boundary between the West Bank and Jordan. I cried because it hurt, because that was the only thing I could do.

The tears scratched my throat before coming up. I was powerless, I was angry.

Confused, frustrated and lost, but mostly hopeless that anything or anyone could change this.

And now all I want to do is write, and write that I am a Palestinian from Gaza. Write it down: I am a Palestinian from Gaza, I am a Palestinian from Gaza.
Live with it.

Explosion targets police vehicle in Turkey's Istanbul

At least 11 people killed and several wounded in bomb attack on police bus in the central district of Beyazit.

A bomb attack targeting a police vehicle in a central Istanbul district has killed at least 11 people, including seven members of the police force, the city's governor has said.

Speaking at the scene of the blast in Beyazit district, Istanbul Governer Vasip Sahin said a bomb placed inside a car detonated as a police vehicle passed by. 

Reports said the explosion took place near the Vezneciler metro station, which is within walking distance of some of the city's main tourist sites, including the Suleymaniye Mosque.

Emre Rende, a freelance journalist reporting from Istanbul, said the "bus was targeted by a remotely detonated car bomb before a second blast believed to have been caused by a gas canister.
"The attack happened close to the Grand Bazaar so it might have been done to keep tourists away," he added.

According to the state-run TRT news channel, the bus was passing in the Beyazit district of Istanbul.
Pictures showed the bomb had turned the police vehicle into mangled wreckage and that nearby shops had their front windows smashed out by the force of the blast.

President Tayyip Erdogan said on Tuesday the country's fight against armed groups will continue "to the end". Speaking to reporters after visiting some of the injured in a hospital near the site of the blast, Erdogan said the attack was "unforgivable".

The bombing came during the first days of Ramadan, the Islamic holy month, a time marked by dawn-to-dusk fasting and intense prayer.

Istanbul had already been hit by two bombings this year, including in tourist areas.

Both attacks were blamed on the Islamic State of Iraq and the Levant (ISIL, also known as ISIS) group, and a pair of attacks in Ankara that were claimed by Kurdish separatists and killed dozens.

The two attacks in Ankara were claimed by the Kurdistan Freedom Falcons (TAK) - a splinter group of the better-known outlawed Kurdistan Workers' Party (PKK).

The attacks have had a dire effect on the tourism industry heading into the key summer season.
Some 1.75 million foreigners came to Turkey in April, down more than 28 percent on April 2015, the tourism ministry said in its latest release.
The attack took place less than 1km from the Grand Bazaar, a popular tourist site in the Vezneciler area [EPA]


 Syrian President Bashar al-Assad signaled Tuesday that his government intends to escalate military efforts to crush the five-year-old uprising against his rule, saying the bloodshed will not end until he has regained control over all areas of Syria lost to the rebellion.

His tough words came amid indications that Russia is preparing to reengage in the war in support of Assad, almost three months after it threw its support behind a U.S.-backed cease-fire and announced it was withdrawing most of its military from Syria.

The violence has already been ticking up, with government and Russian warplanes conducting air raids over northern Syria in the past week and rebels launching an offensive to recapture territory south of the city of Aleppo. According to the Institute for the Study of War, Russia tripled the number of its airstrikes over a four-day period last week, to levels not seen since before the imposition of the cessation of hostilities in late February.

Assad’s comments, made in an address to a newly installed parliament in Damascus, suggested that he and his Russian allies are preparing for a full-scale resumption of the war, with Aleppo as their first target.
“As we liberated Tadmur [Palmyra] and before it many areas, we will liberate every inch of Syria from their hands,” he said, referring to the ancient town in central Syria recaptured from the Islamic State militant group in March. “Our only option is victory, otherwise Syria will not survive.”

A peace process launched in Geneva earlier this year has failed, Assad said, blaming the West and its allies. The talks have deadlocked mainly because of disagreements over whether he should remain in power.

“Our war on terrorism will continue not because we like war. They imposed war on us.” Assad said. “The bloodshed won’t end until we root out terrorism, wherever it is.”

He singled out Turkish President Recep Tayyip Erdogan for blame, saying Erdogan had continued to funnel support to “terrorists” in the Aleppo area. Assad has consistently labeled all the armed opponents to his rule as terrorists.

“Aleppo will be the grave where all the dreams and hopes of that butcher will be buried,” he added, referring to Erdogan.

A full-scale return to war would mean an end also to U.S. hopes for a diplomatic settlement through a tentative partnership with Moscow. The effort has yielded some results, diplomats say, including evidence that Moscow has exerted pressure on the Syrian government to comply with the cease-fire at least in some places and has held back from supporting some of the regime’s recent offensives.

But Moscow has also signaled impatience with what it regards as U.S. intransigence on several key Russian demands. They include a request that the two powers conduct joint airstrikes in Syria and that the United States oblige moderate rebels to disengage from al-Qaeda affiliate Jabhat al-Nusra.

On Monday, Russian Foreign Minister Sergei Lavrov said Russia would step up air support for the government in the Aleppo area in response to an offensive launched mainly by Jabhat al-Nusra to the south of the city.

“What is now happening in Aleppo and around it — we warned the Americans about this in advance,” Lavrov said. “The U.S. knows that we will be providing air support to the Syrian army to prevent territories from being seized by terrorists.”

At the same time, Russia and the Syrian government have stepped up airstrikes to the northwest of Aleppo, effectively severing a key supply route that is the last remaining link between the rebel-held portion of the city and the outside world. Scores of civilians have been killed in the escalation of strikes, which have also targeted Aleppo itself and towns in the nearby province of Idlib.

The main architect of this barbarity has been the  Rastriya Swayamsevak Sangh, RSS, and its deceptive fronts such as VHP, BJP, Shiv Sena and many others who call themselves Hindus.

This is sheer fascism in the name of Hinduism. However there is no place for such barbarity in the ancient and peaceful Hinduism .  Most   Hindus who follow genuine Hinduism remain peaceful people co existing well with others. Even today they constitute the largest number despite RSS manipulating itself to power through BJP.

Destroying the economic base and turning Muslims into to helpless and voiceless paupers has been   the main target of these well calculated RSS carnage on Muslims. This has been happening under both under the congress and non-congress governments   under the watchful eyes of police whose connivance with Hindutva fascists were common knowledge.
According to some reports there were around 48,000 small and major   attacks on Muslims. There were even incidents that Muslim women were stripped naked, paraded and video filmed in this largest democracy in the world.

In this ongoing process one of the worst massacre of Muslims took place in Gujarat  in February 2002 when the present Indian Prime Minister Narendra Modi ,then Chief Minister of Gujarat,  was accused of being the architect of this pogrom. In view of his involvement in the Gujarat massacre and destruction, most countries in the west including United States and Europe refused to grant him a visa to enter their countries.

The irony is that this very same Narendra Modi is prime minister of this great country-India.
Ever since Narendra Modi became Prime Minister attacks on Muslims continue to rise .According to some  reports that within a year and half after of Modi’s government   attacks on Muslims  recorded a 25 percent increase. Today this has become an ongoing affair with the complete connivance of police backed by government indifference.

One of the latest of such barbarities is the attack on a Muslim animal trader, who was stripped naked and brutally beaten in the name of cow protection. Reporting the   attack the New Delhi based fortnightly The Millie Gazette had this to state in its 2 June 2016 issue;

Muslim transporters of "Cow" were nearly lynched in Rajasthan yesterday. Truck is said to be carrying 50 cows and was passing through Chhoti Sadri Pratapgarh district, Chittorgarh, Rajasthan on 31 May 2016. 

The mob of Hindu “activists” chased the truck and later set it on fire. The driver and his three helps were stripped and mercilessly beaten in the presence of police. A case of cruelty against animals have been lodged against the four transporters

The Cow Protection Groups (Gau raksha dals), which operate in numerous areas, celebrate with great impunity all their catches and the bruta

When Milli Gazette called on the numbers from which the photos had reached an activist in Chhoti Sadri,  said they were happy on their achievement and that they beat such people in such a way that the “Cow trader” does not die, but will not able to walk or sit for months due to the deep wounds.l punishment they reward to beef dealers. They themselves share pictures and videos of their “great” achievements. In one case near Aligarh they even allowed an “embedded journalist” to record and report their stories of saving Mother Cow.

In their press note, the Police not only mention the names, father’s names and addresses of the four transporters but also mentions their religion as "Muslim". This is how crimes of the majority community are justified by the state machinery.

These are clear photos of the perpetrators and the face of the policemen is also clear. But nothing will happen to them. This is not the first such case and will not be the last. Since BJP formed government at the Centre in May 2014 with a clear majority and Narendra Modi as the Prime Minister, hate crimes against minorities, Muslims and Christians, as well as dalits have increased alarmingly.

Vietnam’s Evolving Role in US Asia Strategy

U.S. President Barack Obama began his three-day visit to Vietnam on May 22. This visit is believed to have given an edge to Vietnam in the South China Sea disputes as part of the larger confrontation between the United States and China. As another article in The Diplomat put it, “Vietnam stands to benefit from the competing interests of the superpowers vying for control of the South China Sea.”

However, the reality is more complex. It must not be forgotten that Vietnam and the United States used to be enemies 
The Diplomatduring the infamous Vietnam War. Only in 1995, 20 years after Vietnam’s independence, were  relations between two nations officially normalized with President Bill Clinton’s visit to Vietnam. The Vietnam war exerted such significant impacts on both countries that the recent rapprochement has been phenomenal. The improvement in relations could only happen because the United States has developed a new strategy, the so-called “Pivot (or Rebalance) to Asia.”

It is, therefore, important to reassess the position of Vietnam in the United States’ overall strategy in the region.

Vietnam in U.S. Containment Policy

For Washington, the war in Vietnam was seen as the key to prevent the “domino effect” of communism. This theory speculated that, should one country in a region fall under the influence of communism, the neighboring countries would subsequently follow suit, like dominoes toppling one after another. As a result, the Vietnam War was considered a legitimate intervention by the United States to prevent the communist takeover of South Vietnam and subsequently Southeast Asian countries. U.S. involvement in South Vietnam was part and parcel for the U.S. Cold War containment policy.

Vietnam was turned into a proxy battlefield, where North Vietnam was supported by the communist bloc of the Soviet Union and China, and South Vietnam was supported by the United States. At the time of Vietnam War, Vietnam was a young independent country, gaining independence in 1945 only to be interrupted again by the French in 1946, and then having to continue the war for unification without any break after the Geneva conference in 1954. Vietnam in the 21st century is a politically stable country with positive economic development. Vietnam is a dedicated member of ASEAN and has established a wide network of diplomatic and economic relations around the world. Being geographically next to China, possessing an organic connection with Chinese and ASEAN economies, and appearing as one the two strongest claimants of territory in South China Sea, Vietnam holds a strategic position if the United States has the intention to contain China.

Thus, Vietnam has again become a vital element in the new U.S. containment policy at three levels. At the economic level, Vietnam is included in the Trans-Pacific Partnership, a macro free trade agreement, whichintentionally leaves out China. At the diplomatic level, Vietnam is important in supporting the Philippines’ arbitration case against China regarding the disputes in the South China Sea and for emphasizing the cooperation of ASEAN countries as a legitimate regional forum. At the level of military containment, the United States has recently lifted the arms embargo on Vietnam and increased financial support for Hanoi’s maritime self-development. The fact that Vietnam is the only country involved in U.S. containment policy at all three levels (the Philippines, for example, is not included in TPP and Japan is not within ASEAN or involved in the legal case against China) shows the importance of Vietnam in the new U.S. containment policy, which is a great evolution from its unfavorable position during Vietnam War.
From U.S. Enemy to U.S. Strategic Partner

The first striking evolution of Vietnam’s position in the U.S. containment policy was the upgrade of Vietnam’s status from being Washington’s enemy to a strategic partner.

During the Vietnam War, Vietnam was targeted by the United States as a key to stop the “domino effect” of communism in Southeast Asia. Vietnam went through a deadly and destructive war with the Americans to achieve unification of the country. The country became well-known worldwide for being able to resist the advanced, high-tech power of the United States, and thereby completely shook Washington’s foreign policy with the so-called Vietnam syndrome.

However, in the 21st century, the position has changed dramatically. After the increasing aggression of Chinese claims in the South China Sea, the U.S. made a decisive decision to partially lift the arms embargo which had been imposed on Vietnam since 1984. Furthermore, Vietnam is also included in Washington’s new Southeast Asia Maritime Security Initiative,  which aims to upgrade the ability of eight ASEAN countries to manage maritime challenges in the South China Sea.

Most remarkably, Vietnam is included in the Trans-Pacific Partnership, the U.S. answer to the Chinese initiative of “One Belt, One Road.” TPP is considered by some as an obvious attempt by the United States to contain China, due to the agreement’s deliberate omission of China despite its important role in trans-Pacific trade. The absence of Philippines in the list of TPP partners is also noticeable. While the Philippines is Washington’s close ally in ASEAN, with a defense treaty obligating the U.S. to protect the Philippines in case of attack, Manila is not included in TPP – but Hanoi is. This very fact shows that Vietnam is becoming more essential in the U.S. containment strategy for China.

From Passive Involvement to Active Partnership

Part of the reason for this change is that Vietnam enjoys a more independent position in the South China Sea disputes than it had in the Vietnam War. Back then, Vietnam was a small, newly-independent country, with few resources to manage the war with a U.S.-supported South Vietnam. The target of U.S. containment policy at the time was the Soviet Union and communism.

However, the United States allied with China to take advantage of the crack in the communist bloc, changing the structure of U.S.-Soviet-China relations. In the early 1970s, tension between two big communist states created the opportunity for the United States to intervene. The so-called “opening to China” process started after President Richard Nixon’s trip to China in 1972, greatly improving the diplomatic relations between the U.S. and China.

At that point, the United States could negotiate with China, persuading Beijing to limit support for Vietnam and the Soviet-Vietnam link. In the first negotiations between the United States and the People’s Republic of China, the Vietnam War was one of the two important topics discussed, along the Taiwan question, as Henry Kissinger noted in On China.

Vietnam was turned into a bargaining chip and the triangle of U.S.-China-Vietnam relations became a key in U.S. containment policy. In that triangle, Vietnam was the most vulnerable. The United States wanted to take advantage of diplomatic opening with China to quickly finish the Vietnam War, while China wanted to use Vietnam to bargain and gain more standing in U.S.-China cooperation against the Soviet Union.

South Vietnam, or the Republic of Vietnam, was directly supported by the United States – but despite that close relationship, Washington forbade the South Vietnam government from bombing the PRC when China took control of the Paracel Islands in the South China Sea. And China was ready to reduce support for Vietnam, like it did in the 1970s, if it was beneficial for U.S.-China relations against the Soviet Union. Vietnam was stuck in the middle, used as bargaining chips by big powers. Vietnam at the time had little means to decide its own destiny.

However, in the South China Sea dispute today, as an independent state, Vietnam has more space to develop its own position. That is not to say that Vietnam is completely independent from the influence of the United States or China. However, Vietnam can to some extent manage the level of cooperation and relations. For example, after peaking disputes in South China Sea, the Chinese government always has to follow up with diplomatic visits and attempts to reconnect relations. Xi Jinping visited Vietnam in October 2015, at a very sensitive point in their relationship. Though more symbolic than substantive, Xi’s visit showed that China did not want Vietnam to completely drift away from Beijing. On the other hand, Vietnam can also actively initiate and encourage military and political advances with India, Japan, and the United States to balance the relation with China.

From a Bipolar to a Multipolar World

The way Vietnam perceives itself in international relations, especially in the U.S-China-Vietnam triangle,dramatically affects the position of Vietnam in U.S. containment policy. In the past, the world was bipolar. Vietnam chose to be in the communist bloc and subsequently fell into a proxy war with the United States. There was no middle ground; Vietnam could not simultaneously ally with the Soviet Union and the United States.

That power structure has changed. The new world is multipolar. U.S. hegemony has been undergoing a considerable decline relative to new emerging powers such as China, Japan, Australia, Germany, India, and so on. In the new world order, Vietnam has the chance to choose a variety of alliances and avoid falling into direct confrontation with either the United States or China.

Undoubtedly, Vietnam could have chosen to side completely with the United States, like Japan and the Philippines. However, Vietnam decided to commit to a more flexible position. Vietnam cautiously avoided a direct confrontation with China by not following the Philippines in taking Beijing to court for violations in the South China Sea. Obviously, there is pressure from China for Vietnam not to join the Philippines’ case, but Vietnam was also aware that a court case would not work in favor of its geopolitical position. Vietnam prefers a balance between the United States and China rather than making straightforward commitments with either of the two superpowers.

Rather than totally allying with big powers like Russia, China, or the United States, Vietnam is simultaneously trying to enhance cooperation with many countries, such as Russia, Japan, India, and Australia. Many scholars give ASEAN special attention as Vietnam’s most favored form of balancing or containing China. While the future cooperation of ASEAN to speak as one voice on the South China Sea issue remains doubtful, ASEAN is expected to provide the most legitimate power and commitment for ensuring conduct in the South China Sea. Such a multi-dimensional outlook offers Vietnam more space and flexibility to partly form its own position and while keeping its importance in the U.S. containment policy centered on the South China Sea dispute.

What Next for Vietnam?

Self-development is the only way for Vietnam to insulate itself from the influence of major powers’ clash.
Vietnam is a small country stuck in the middle of confrontations by superpowers — in the past between the United States and USSR, and currently between the United States and China. Vietnam’s geopolitical position shaped the fate of the country as relates to U.S. containment policy in both the Cold War and today’s South China Sea dispute. In the 21st century, Vietnam has again become an element in U.S. containment against China.

However, this time around Vietnam has been quite flexible in adjusting its position in the U.S. containment strategy. Vietnam’s foreign policy on the South China Sea issue is an example of the evolution of an independent and pragmatic state. Being China’s neighbor, but with a long history of fighting against Chinese influence, pushes Vietnam into an extreme dilemma. On one hand, resisting China is the core of Vietnamese identity and nationalism; it is almost impossible for Vietnam to submit to Chinese supremacy and bandwagon with China. The two sides’ cooperation under the communist bloc already marked the best period in Vietnam-China relations. On the other hand, bordering China does not leave Vietnam the chance to ignore Chinese power and completely commit to a strategic partnership with the United States. After the liberation of 1975, Vietnam has always tried to balance relations between the U.S. and China, being careful not to anger China by over-intimate dialogues with the Americans.

Given the interdependence in the new world order, Vietnam cannot expect any committed support such as it received from the Soviet Union. The best position for Vietnam in the U.S. containment policy up till now is to stay flexible, multilateral, and independent. However, such a strategy is not sustainable.

Already, Vietnam is struggling to balance relations with China and the United States, in addition to being on the verge of losing its claimed territory in the South China Sea. Developing its economy and improving Vietnam’s internal situation is the only sustainable method for having a position in the South China Sea dispute. Otherwise, Vietnam will again lie at the mercy of the great powers’ game.
