On paper Sri Lanka is a REPRESENTATIVE DEMOCRACY, and the preamble to the Constitution recognises the immutable principles of REPRESENTATIVE DEMOCRACY and assures the people FREEDOM, EQUALITY, JUSTICE, FUNDAMENTAL HUMAN RIGHTS and the INDEPENDENCE OF THE JUDICIARY.
Yet these objectives have never been realised in this island nation, which claims to be a democracy. There are very serious issues concerning the constitution making in this country and the ones discussed herein are highlighted to make the people aware of the serious abuses of their sovereign powers. These lapses are brought to the attention of the architects of the new constitution to realise the importance of making a constitution that makes all three organs of the government answerable to the people. This however cannot be achieved unless there is a genuine in the interest to break free judiciary from the clutches of the executive and legislative organs.
Article 3 of the Constitution recognises that Sri Lanka’s sovereignty is in the people and is absolute. This sovereign power includes legislative power, Executive power, judicial power, fundamental rights and franchise.
SripavanThe Constitution also recognises the principle of Separation of Power and it states that the judicial power of the people shall be exercised by the ‘Parliament through the Judiciary’. [Article 4(c)].
It goes on to say that appointment of Judges to the Superior Court system to be made by the President on the recommendations made by the Constitutional Council from the names referred to it by the President (Article 107). [Under President Rajapakse situation was far worse as he (under 18th amendment) retained all judicial appointments under his absolutely control, effectively destroying the integrity of the justice system and people’s confidence in it with a appointment of one of his stooge to the office of the Chief Justice].

May lightning strike..! As New year dawns so Sirisena family safe fills -Many millions of public funds siphoned off !!

This is in relation  to the musical extrvaganza that was held at Galle face green on the night of 31 st December 2015  to mark the dawn of the new year 2016.The entire  responsibility of that extravaganza was borne by the SLT whose chairman is none other than president’s younger brother Kumarasinghe Sirisena , while the organizing and advertising activities of this event were carried out by president’s daughter Chathurika Sirisena as the event manageress of Red Cherry Advertising Co. whose owner (operating from behind the scenes) is Chathurika herself.
(Lanka e news on 26 th November 2015 under the caption ‘Company of daughter of Sirisena along with Janaka gobbling up state funds openly and brazenly’ reported that Chathurika and her husband Thilina Suranjith launched ‘Red Cherry advertising’ by getting Janaka, a close friend of theirs to act as the front man) 
Although the full expenditure incurred by the SLT pertaining to this musical show has still not been accurately assessed ,based on information reaching Lanka e news inside information division ,it is in the region of Rs. 300 million ! Of this one third or Rs. 100 million has been coolly, designedly   and silently  pocketed by the Company of Sirisena’s daughter.
Previously , a similar musical show was organized in Negombo , and that too was by this same company . Through that too a colossal  sum of money crept into the safe of Sirisena family. The exact figures of these massive perfidious earnings can be known , only after the right to information bill is passed , or on the   fortunate  day  when the SLT gets released from the grip of the Machiavellian member of the Sirisena family. In any event , Lanka e news always first with the news and best with the views will shortly be able  to reveal the actual and exact details of the figures to the nation.
It is obvious the SLT organized this musical extravaganza for no other reason than to enable the Sirisena family to amass filthy lucre. The entire nation is aware how Maithripala Sirisena in the recent past created the necessary environment in the SLT which would be conducive to  the Institution to  take decisions in favor of such rackets , by chasing out the good governance Directors through the personal intervention of the president himself , and filling the Director board with confirmed notorious crooks  of the Mahinda Rajapakse era . Moreover , 17 leaders of trade union organizations who were thought will  oppose this move  were sent to Malaysia to enjoy to the hilt , in order to shut their mouths.
We on the other hand however wish to reveal  frankly, fearlessly and forthrightly ,colossal public funds are being gobbled up   through these activities to augment the income and build the financial empire of Sirisena family , based on  the following grounds ….
According to the SLT , the aim of these musical shows is business promotion . In other words  , it is to induce more customers to use its telephone service , and it is to boost its advertisement towards that. But vis a vis the  present state of the SLT this  has posed an  issue . 
At present the SLT is not able to improve its supply of string/ rope  telephones because the cables necessary for that are unavailable at the Co. Those are over.

The refurbishment of PEO TV services of Telecom Co. has become  impossible. This is because the necessary digital units in that connection are by now over. Since new units are not available to replace the units provided to customers   that are  now defective , the SLT has   no solutions for them .
Fiber optic cables that are necessary to be connected to the homes of customers to provide express internet service are also not available at the Co.
Hence , no matter how much business promotion is resorted to , it is unavailing under these circumstances since the required resources are not available at the Co.  Therefore  only the morons and mongols with ulterior motives from Polonnaruwa who would promote business without having the  resources for refurbishment . 
The next vital question is how did the resources evaporate ? - funds are not available.

The SLT is right now managing  on the loan of US $ 75 million taken during  the past. Now a further loan of US $100 million is being sought because the earlier loan is inadequate. That means all this profligate  fun and frolic of Sirisena family is on borrowed money.  While this is the dire predicament of the SLT , by appointing the younger brother as the SLT  chairman, filling the SLT Director baord with henchmen, and through the company of the daughter SLT funds are being wasted  in many millions on musical shows, in order to plunder public monies .This is the stark fact and this is the sorry plight of the SLT !
There is only about 1 % of SLT users who pay monthly bills over Rs. 5000.00 .The majority are users who pay small bills. Among them too a greater many  go for Rs.50.00 and Rs. 100.00 reloads. In other words , the Sirisena family is fleecing only these poor hapless customers .
It is an irony of ironies that we (Lanka e news) who just a year ago did everything to install Maithripala Sirisena as the president of Sri Lanka at a time when the lawless , uncivilized , uncouth Rajapakse regime was wreaking havoc on the country, are now compelled  just a year later to expose these anti national , perfidious and uncouth activities of Sirisena family of Maithripala .Nothing can be more saddening and disheartening to us who wished and hoped Sirisenas would offer a better and  cleaner ‘deal’ for the people  who are thirsting for a government of  good governance under the Sirisenas. It is an indcontrovertible fact  the people at that time who joined in the victorious rainbow revolution of 8 th January 2015 opposed the rapacious family rule because they were looting , plundering and gobbling up the State resources and public funds.
Whether it is the Rajapakses or  Sirisenas who are committing  those crimes  , or even if Wickremesinghes commit those wrongdoings tomorrow  ,  they are crimes nonetheless against the abysmally suffering people  and the state.
Earlier on Lanka  e news under the caption  ‘To the people to whom MaRas aren’t Siras , Siras cannot ever be MaRas,’ reported ,despite evil Rajapakses wielding the powers of five presidents and were carefully  preparing the groundwork to be in power for many decades , because they turned into enemies of the people, they were thrown out lock, stock and barrel by the people and no other ,even when they had two more years to hold sway over the country. In the circumstances , it can be sworn most solemnly via the internet that the mendacious Machiavellian Sirisena family that is gobbling up funds through  subterfuges, certainly will not be allowed to carry on these perfidies and underhand activities for the next four years , even though Rajapakses could go on until their remaining  last two years of their reign.

Mangala Samaraweera who was responsible for the most salutary communication revolution in Sri Lanka , streamlined the service and ensured against the delays through registrations that obstructed applicants for phones , and a most popular, efficient minister in this sphere , best noted for his honesty and integirity was got rid of , and this ministry was brought under an  amateurish Harin Fernando , a most junior minister of the cabinet, was obviously to facilitate the conspiracy of the Sirisenas to rob and plunder at their will and pleasure.
Believe it or not , though Harin Fernando was made the minister , he was not given the opportunity to appoint the board of Directors by Maithripala Sirisena himself. Harin has accepted the role of a puppet because he wishes that the united government shall progress. But , if this is to continue for long , undoubtedly , it is the UNP including Harin that will have to bear the brunt  of part of the blame and wrath for no fault of their own , because 49 % of the shares of SLT belongs to the general treasury under the finance minister.

JaWhat follows has no pretense in the matter of bringing rural Sri Lankans into the First World overnight. However, the few elements of their lives that I intend referring to in this piece can be improved immeasurably without some revolutionary change in local administration or miraculous transformation of corrupt and venal officials who are the epitome of parasites on the helpless.
When I returned some years ago to the land of my birth and that part of Sri Lanka in which I grew up, what struck me most forcibly was the continuing poverty and deprivation that had worsened in the 30+ years I had been away from my home turf.
I kept hearing about and seeing underweight little children and a variety of poverty-related ailments that ended up in some local medic’s clinic where those attending departed with what is now the three-packet response: one packet of an analgesic medication, another antibiotic and the third that did (or did not) relate to whatever ailed the patient. Without exception, the little envelopes did not have the name of the drug on them but simply indicated the dosage and the time of administration. The patient went home and religiously took the medications and after a few days had elapsed, if the ailment had not gone away and the effects of the analgesics had worn off and the pain or discomfort returned, went to another doctor where the same process was repeated. While this sequence of events might not be the case in every instance, it certainly appeared to be in a majority of them. Not right and potentially dangerous? Darned right! The gross underfunding of our medical system is at the root of this problem and the solution obvious enough. When, on one occasion, I accompanied a patient to a hospital and he was sent to a bed in a ward and given some pills to swallow, the nurse in charge expressed surprise that we wanted some water from her to help him get the pills down the hatch and we had to “borrow” some bottled water from another warded patient to get this done! That kind of conduct, I would submit, is the direct result of the callousness that ensues from over-worked staff operating in grossly under-funded circumstances. Neither time nor space permit of the recounting of more instances of this kind of thing.
At the same time, in what might seem like a contradiction of the point made in the previous paragraph, I have seen staff in government hospitals displaying great patience and caring under the most intolerable of working conditions. But let’s not make any mistake: this situation is inexcusable and the fact that anybody who is “somebody” traipses off to Singapore or some other exotic (and expensive) location for so much as an in-growing toe-nail, often at state expense, only serves to further expose the enormity of the injustice perpetrated on the vast majority of our people.                                          Read More

President’s younger bro cheating on ‘Free WiFi’ to destroy Ranil’s most welcome project

LEN logo(Lanka-e-News -04.Jan.2016, 1.45AM) At the last presidential elections it was promised that free WiFi will be made available to the people of Sri Lanka (SL) ,and that was a most essential project launched by prime minister Ranil Wickremesinghe for the benefit of the younger generation and their future.  Sadly this salutary project  has now been converted by  Kumarasinghe Sirisena ,the SLT chairman ( the younger  brother of the president ) along with the SLT into a project which deceives  the people . This is how the deceit is being practised to the detriment of the nation ……..
If this free service is to be utilized , one has to be a customer of the SLT. ( if you are not already a customer ,the usage is limited to 100 megabytes – a very small capacity.) Unlike in other countries  , one cannot  connect directly with the WiFi and use the internet. 
Firstly , one must register oneself at one of the branches of the SLT, and using the password they issue the internet can be accessed. All the usage and downloads using the password will be deducted  from the SLT package already used by the customer. In other words , finally this so called free internet usage is indirectly included in the paid internet package . Clearly this is an absolute unalloyed deception practised on the people.
 
If this kind of deception is practised in any other country , it is cock sure , the government will take action against it . But in SL since the SLT is under Kumarasinghe Sirisena the younger brother of the president and as the latter  is the highest in the hierarchy , even a Kindergarten child  will understand why no action is being taken against the SLT. 
The SLT that can spend wastefully millions of rupees towards holding  musical shows   , being unable to provide the unlimited package or 100 % free WiFi  and is  resorting to mendacity and hypocrisy , because  this welcome project which would prove to be a great boon to the people is the brainchild  of Ranil Wickremesinghe . It is therefore the consensus among the people ,this is a conspiracy  to destroy this  beneficial project and make it  look a bane before the people , so that the P.M. can be rendered unpopular.

Happy New Year! It’s about time the President told the people the truth about Port City

With due apologies for dredging up Port City material on the last hangover day after the festival season, I think it is appropriate to raise the issue that to-date the Sirisena-Wickremesinghe government has not made a formal statement telling the people the whole truth and nothing but the truth about the Port City project. I would suggest that such a statement must come from President Sirisena as a statement in parliament, and that it should be followed by a parliamentary debate, no matter what such a debate might be worth. The President owes it to the people to tell them through the parliament they elected the truth about the following: what are the specific mistakes, improprieties and shortcomings, if any, in the approvals granted and agreements signed by the Rajapaksa government; and how and to what extent are these mistakes, improprieties and shortcomings being addressed in the approvals that are about to be given and new agreements that will be signed by the present government.

Army probing Captain Tissa links

Wasim Thajudeen's murder probe entered a phase with potentially serious political repercussions with the Army opening a probe into Captain Tissa Wimalasena who has been identified by the Criminal Investigation Department (CID) as a major suspect in the assassination of national rugby player WasimThajudeen, sources said.
Investigators claim to have identified links between Captain Tissa Wimalasena and few more killings and other crimes. Last week, the CID also identified Wimalasena's links to several crimes including assault of the former Secretary to the Judicial Services Commission Manjula Thilakaratne, the sources said. Wimalasena is now detained in an Army camp in Jaffna. He served as former President Mahinda Rajapaksa's Chief Transport Officer and was under a corruption charge probe early last year.
Asked what the Army intends doing if Wimalasena is found guilty, Army Commander Crishantha de Silva said the Army would take military action under military regulations against anyone in service who are linked in any way to any of the recent controversial killings. "We will take military action against any wrongdoers before police action is initiated," he said.
"We cannot let anyone get away with murder even if he is in uniform. The law must be applied equally to all citizens. I will not pardon any member of the Army who is proved to have been connected to any murder. I will not protect them or withhold any information about them. It will be an injustice to honourable members of the force," he said.
He added, affording any impunity for wrongdoers in the Army would damage the good name of the Army.
Colombo Judicial Medical Officer Ajith Thennakoon reported to Court on 10 December that national rugby star Thajudeen was killed and did not, as earlier believed, die in a motor accident. Thajudeen's charred body was found abandoned in his car on 17 May 2012 at Park Road in Narahenpita.

In another shocking incident of criminal waste of state resources, the top anti-corruption Presidential Commission last week sealed a Lanka Sathosa warehouse, where 3,500 metric tons of rice deemed unfit for human consumption, was discovered, officials said.

The 198 container loads worth Rs. 210 million had arrived at the Colombo Port from India on Letters of Credit (L/Cs) opened during the previous government, and after clearance, stored in a warehouse at Veyangoda and completely forgotten, they said.

The stock had been in good condition at the time of import, but bureaucratic bungling had resulted in the consignment rotting in the warehouse without being distributed amongst Lanka Sathosa outlets to be sold to the public, they asserted.

Officials of the Presidential Commission of Inquiry to Investigate and Inquire into Serious Acts of Fraud, Corruption and Abuse of Power, State Resources and Privileges (PRECIFAC) had gone to the Colombo Port in connection with the ongoing probe into 300 containers of rice gone missing, when they got wind of a stock stored at Veyangoda, the officials explained.

The warehouse was sealed on Thursday and the following day the Consumer Affairs Authority (CAA) and public health inspectors examined the weevil-infested, spoiled consignment and declared the whole stock unfit for human consumption, the officials said.

This stock had nothing to do with the missing containers, but initial investigations revealed that the 3,500 mt had been moved to the warehouse and allowed to rot due to mismanagement, they asserted.

These are public funds that are being squandered due to mismanagement, they noted. "Rs. 210 million has gone down the drain".

Transporting 3,500 metric tons to be destroyed also entails an additional cost, they pointed out. "At the end of the day, there’s nobody in authority held responsible for this criminal waste of public resources".

The rice is no longer fit for human consumption, says Lacille de Silva, Secretary to PRECIFAC. "It was stored in the warehouse until we moved in and sealed it".

Every indication is that there are more spoiled consignments in Lanka Sathosa warehouses as huge stocks had been imported without proper planning or an effective market survey, the officials said. "It is an open secret that kickbacks flow from imports".

While this huge stock was decaying in a warehouse, the Lanka Sathosa management directed its outlets to restrict the sale of rice to 50 kilos per person during the festive season, an official said.

"We were given this directive during end November 2015 and had to comply", he said. "While rice was rotting in a warehouse, we couldn’t cater to customers who wanted more than the stipulated quantity".

The ITN is facing ruin due to the improper and stubborn management of the present administrators, say its employees. The institution, which had been the no. one television channel for the past six years, has today fallen to the 4th or the 5th place, they point out. They say this situation is directly affecting not only the institution and themselves, but also the country as a whole.

Improper appointments
 
Since the new chairman took over, unnecessary positions have been created and new recruitment  made and various persons appointed as consultants. New consultants have been recruited for the marketing, programme and engineering divisions, and the ITN has to spend around Rs. 170,000 a month on each of them, but they serve no purpose. Their salary is Rs. 100,000 and a further Rs. 70,000 is paid as vehicle, fuel and driver allowances.
 
In addition, the chairman, who is also head of the People’s Bank, has appointed a coordinator for him, who gets a Rs. 75,000 salary plus the above allowances. Furthermore, a consultant has been appointed, at a Rs. 100,000 salary, for Lakhanda Radio, which is suffering heavy losses. It is no question that a consultant is appointed for the upliftment of a loss-incurring institution, but the person here knows next to nothing about broadcasting, but had worked in the newspaper field only.
 
The institution, which gained the no. one position without any consultant, will be ruined due to these improper appointments, employees say.
 
Persons who were responsible for corrupt activities during the previous Rajapaksa regime are still at work at the institution, and have become close to the newly-appointed consultants and the top management, who have failed yet to understand their motives, according to the employees. This handful of persons has become close to the top officials and is taking the institution to ruin, which has become easy due to the inefficiencies of the new management.
 
Earning profits, the ITN gave a Rs. 75,000 bonus to all employees in 2014, but that got reduced to Rs. 44,880 in 2015. While even the loss-incurring Rupavahini is giving cash bonuses, gift vouchers to up and coming employees by way of encouragement, the ITN is curtailing the bonus of even those who worked to take the channel to no. one, much to the disappointment of the employees. Trade unions have brought this matter to the attention of the chairman and the media minister, but the present management is not ready to listen to any of these. Employees say that the most infamous management they had seen was the Anura Siriwardena period, but the present management is on a rapid journey to overtake him very soon. By that time, the institution will be in ruin, employees add.

Face book accounts banned within Air force..! Daughter’s frustration contracted by father -doubly mad


LEN logo(Lanka-e-News -03.Jan.2016, 6.30PM) The Air force commander Gagan Bulathsinghala who is unable to treat  the itch at the wrong place of his daughter Ayendra Bulathsinghala who disgraced herself , the Air force commander (if he has any grace) and the country by leaping on  , hugging and kissing the Latin American pop singer Enrique, has instead of  treating his daughter’s sex starvation  taken measures to penalize over about 4000 of his air force soldiers/ officers . According to the distressing reports reaching Lanka e news , the Air force commander has deprived the subordinates of their fundamental rights illegally.
That is, he had forbidden all those soldiers/officers from  having face book accounts. The  Director administration of the Air force has issued an order to that effect yesterday. That directive states that the face book accounts that were maintained so far by the members of the Air force shall be closed forthwith , and new accounts cannot be opened until further notice. Previously the law that applied to the members of the forces was , not to appear in their official uniforms on their face books. 
Although the Air Force commander had stated this was a decision taken by the security council , such a directive had not been issued to the members of the other forces.
Recently , when the Latin American pop singer Enrique Iglatius held a concert in Sri Lanka , the daughter of the Air force commander Gagan Bulathsinghala darted to the stage , clung on to the singer , kissed and hugged him passionately in a fit of delirious sexual frustration . It was Lanka e news always first with the news and best with the views had the misfortune to report this news for the first time . Following this exposure a storm of controversy was stirred up across the face books and the internet.
After another woman – an  ‘itchy bitchy’ belonging to the latest breed of so called high society too disgracefully threw  her brassiere at Enrique , an infuriated president Maithripala Sirisena who was apparently maddened not saddened , began traveling  to  remote Amparai to speak about this Colombo episode making the Bra his favorite theme which compelled  the internet chain to  dub him ‘Sira the Bra.’  This incident reached such proportions that the president in a fit of insanity made utterances such as ‘lashing with the Ray fish tail’ while making insinuations insulting the disciplined society, whereby he exposed himself to ridicule and humiliation, and even became  a laughing stock. And now to further  aggravate the situation , the president as the defense minister along with  the Air force commander have banned the face book accounts among the members of the Air force, despite the fact these accounts are most popular and sought after among society , and almost indispensable.
Another Institution where the ban operates is the SLT whose chairman is Kumarasinghe Sirisena , the younger brother of the president. Because Lanka e news was exposing all the corruption and malpractices at the SLT , accessing Lanka e news website by SLT employees  had been obstructed.
It is to be noted that even under the Rajapakse corrupt lawless fascist rule , though some news websites including Lanka e news were banned , face book accounts were not. 
Earlier on too after the exposure of the robberies committed by Gagan Bulathsinghala, accessing the face book network was banned within the forces. This was reported  by Lanka e news. The high rung officers of the Air force said   the ban was temporary and it is  because the system was being updated. But now , even maintaining a face book account has been forbidden within the Air force.

Consequent upon this ban , about 4000 members of the Air force have been  denied the opportunity to maintain their links with their relatives through the face book. This action taken by the Air force commander simply because he is unable to reform his itchy bitchy sex starved daughter can constitute a violation of the fundamental rights of the members of the Air force .
It is significant to note ,President Maithripala Sirisena who is also  the commander in chief of the forces was installed in power on 8 th January 2015 , not for him to impose bans on the media but to bar the Rajapakses and free the media . Hence , forgetting this truth so soon on account of Ayendra and her sex starved madness  simply proves that the Air force commander Gagan Bulathsinghala  and the president Maithripala Sirisena are also afflicted with the same madness but much more seriously.
