I am glad that a plethora of views, much more than I expected, has already been expressed on my quick observations on the first day events ofBiswal’s visit to Sri Lanka this time. I thank all who have contributed to the discussion including the one’s who tried to re-educate me [like Spark] who said: “It is fellows like you who have been an absolute zero, just rumbling absolute rubbish, over issues that one is ignorant or rather have a twisted understanding of it to satisfy ones own mind set”; and the one who reminded me that “Biswal was received by Prime Minister of Bangladesh and the Sheik of Abu Dabhi received Secretary John Kerry. That is to say, other countries too set aside Protocol ” and principles when receiving visitors from both the “lower drawer” and “upper drawer” (I am indebted to Rajan Philips for tis terminology).

I could understand the negative responses received from other countries to requests from our Ministers when these visits had nothing to do with our own country’s official programmes or with bi-lateral matters with the country visited. At the General Election held on the 17th of August 2015, the United National Party (UNP) emerged as the party with the largest number of seats in Parliament. The United People’s Freedom Alliance (UPFA) obtained the second largest number of seats. It has been announced that a National Government has been formed and that Members of Parliament who contested and were elected under both the UNP and the UPFA have accepted cabinet portfolios. Accordingly, both the UNP and the UPFA bear collective cabinet responsibility. As political parties in Parliament, they thus must publicly support all Governmental decisions made in Cabinet. This support includes voting with the Government when sitting in Parliament. There is thus no question whatsoever of the UPFA sitting in opposition in Parliament. Further, all Members of Parliament who contested and were elected under the UPFA are now Members of Parliament of the UPFA. There is thus no question whatsoever of the constituent parties of the UPFA being recognized as political parties in the current Parliament.
In these circumstances, the Ilankai Thamil Arasu Kadchi (ITAK) which obtained a total of 16 seats, has emerged as the largest political party in Opposition in Parliament. In accordance with Parliamentary practice and convention, the Parliamentary Group Leader of ITAK must thus be recognized as the Leader of the Opposition.
Both President Sirisena and the Government have been public in a commitment to treat the Tamil People as equal citizens of this country. However, a reluctance to recognize the democratically elected representatives of the Tamil People of the North and East as the main opposition party when such is clearly the case can only be reflective of an unwillingness to honour this commitment. A reluctance to even recognize the elected representatives of the Tamil People as the main party in Opposition does not bode well for the readiness of the President and the Government to arrive at a solution that grants meaningful powers of governance to the Tamil People.
At the Presidential and Parliamentary Elections this year, the peoples of this country created the space and opportunity for it to move forward. We urge both the President and the Government not to waste this opportunity. If they are committed to resolving the national problem, then their actions must reflect that. For our part, we are committed to constructively engaging with the Government to resolve the national problem in Sri Lanka.

Sri Lanka has been a ‘banana republic,’ for quite some time, and clearly so throughout the oligarchy of the Rajapaksas. Formally, a banana republic is “a small country that is economically dependent on a single export commodity, such as bananas, and is typically governed by a dictator or the armed forces.”[1] But in our case, the fate of the citizenry is far worse than in most other banana republics. In Sri Lanka, all wisdom, action, dreams, hallucinations and the making of unmitigated profit came from the first family and then from its acolytes.

Sri Lanka follows the Westminster modal, though currently transformed to a mixture of Presidential/ Parliamentary system. Opposition exists by customs, and normal expectations and customs were modified by political realities from time to time. Sri Lanka followed the Westminster model since 1935 and a country mastered on the conventions and practices of the British Model. Free and fair elections supervised by thousands of foreign observers and their positive comments on the General Election and the way the elections were conducted are a credit and an example to the civilized world of democratic ideals. Opposition and the leader of the opposition is a necessity to the democracy and a democratic modelled government system. Sri Lanka can be proud to have followed the democratic ideals and systems based on the British Model following the conventions and traditions of the Western world and Sri Lankan experiences which is exemplary.
In 1846 the Conservative party split into Protectionist Conservative and “Peelite” or liberal Conservatives fractions. The Protectionists became the largest group; the recognized large group in the same party, the recognized leader of the opposition were drawn from the ranks. Though Britain is free to change the conventions and procedure in the absence of a written constitution they continuously adhered to the previous traditions and we too followed the traditions, conventions and the writings of the Jurists and the directions of series of case law and opinions on the subject.

Prime Minister who is the leader of the UNP with the highest Members of Parliament but not the absolute majority, has formed the government and steps are being taken for the formation of cabinet with the participation of the Major Opposition and other parties to be called a National Government with objections from the JVP which has secured few seats and a sizable number of SLFP Members of Parliament. It was a tragic experience thereafter. People learn the absurdities of ‘narrow nationalism’ slowly and mostly through lateral experiences. If your national hero is ‘corrupt, abusive or authoritarian,’ that is a good reason for the people to move away or doubt about ‘patriotic rhetoric.’ This should undoubtedly be consolidated through organized efforts. Education is one means to achieve that.

It has taken a small but a firm step to move away from narrow nationalism towards ‘cosmopolitanism.’ This is not a wishful thinking of a perennial optimist but what is revealed by election results. Both the presidential elections in January and the parliamentary elections in August 2015 confirm a certain maturity of voters towards this direction.

On political equations that never 'stay'


NOTES ON AN ELECTION


Power struggles are rarely about people. Rhetoric is scripted in, yes, but for the most it remains a necessity as a means to an end. Outcomes which get preferred by parties never privilege the voter. This we know. As such election-aftermath has more to do with power and frill than it has with serving the people. This too we know.
 
Writing 12 days before Maithripala Sirisena defected from the SLFP and thereby wrecked the political equation, Udaya Gammanpila, then allied with the Jathika Hela Urumaya, commented on Ranil Wickremesinghe’s moves. Arguing that Wickremesinghe would use a proxy, Gammanpila made a classic inference: that he would use this move to retain position within his party.
 
This is true. Ranil Wickremesinghe’s conduct during the presidential and parliamentary elections was suave to say the least. He aced dissidents within his own party and that in a way which lent credibility to his faction. If at all, he convinced those within the United National Party (UNP) to join him, and thus privilege party above anything else.
 
Political equations do not last long, however. Scripted into MOUs and agreements (between and within parties) are escape clauses. True, Ranil’s grip on party leadership and his ability to wield power in the face of popular dissent is not unknown. If at all, this will sustain his vision for party and government for quite some time.
 
But this is just half the picture.
 
Dayan Jayatilleka once observed that the only way to salvage the UNP was to join up with the JVP and other dissident parties and embark on a consciousness-raising exercise against Mahinda Rajapaksa. What unfolded later wasn’t just a consciousness-raiser but a revolt against incumbent. Both Jayatilleka and Gammanpila couldn’t have predicted Wickremesinghe using a stalwart from the ruling party to become prime minister, which explains why both opposed Sirisena’s campaign, the former on principal.
 
What happened next was the formation of four different voter-camps, all of whom supported Sirisena. They were those who: 1. Supported the UNP; 2. Embraced him from the UPFA; 3. Let go of ideology and supported him (from the JVP, TNA etc); and 4. Were courted by the Jathika Hela Urumaya upon its ejection from the Alliance and hence congealed into the floating voter.
 
The point is that Wickremesinghe’s equation is shaky. Those four classes remain intact, but altered slightly. Now those with the UNP will remain with the UNP. Those who supported Maithripala Sirisena from the UPFA are with the president. But the other two classes, particularly those from the floating vote-base, are what count. Wickremesinghe’s position should be based or rather positioned on this ground. Why?
 
First of all, what’s national in this National Government? What we’ve seen is a coalition, yes, but one in which the UNP dominates. Power-sharing has been for the most vertical, with state largesse remaining with the Greens and “titbit” ministries going to the Blues. In this context it’s not too hard for the prime minister to court popularity within his party.
 
Problem is, these things don’t remain constant forever. Wickremesinghe’s strategy was and is to split the SLFP and this in a way which ensures that his faction within the UNP holds sway on government and party. He needs to do two things here: a successor who’ll continue his legacy, and ensure that his party “gets” the presidency some day. Whether he can do this while accommodating those who’ve been known to oppose him within the UNP is for another article.
 
Right now, here’s what counts. Without delivering on the mandate given to him by the floating voter, Wickremesinghe’s government can hope for very little. This is not just because the UPFAers who affirm(ed) the National Government are led by a party-less drive to weed out corruption and adjust structural flaws. This is also because their representatives wrecked one political equation, turning Rajapaksa into a lost cause. History, as we know, can and does repeat itself.
 
Maduluwawe Sobitha Thero is not Green. Nor is Patali Champika Ranawaka and the JHU, as well as those who helped the yahapalana campaign, Shiral Lakthilaka included. They are as colourless as they can get. As such the primary need to contain opposition and lend credence to a Green government means that two requirements need to be met: national security and foreign affairs.
 
Here’s why.
 
Part of the reason why the UNP lacks support from the rural voter is that it’s perceived as anti-poor and pro-West. This doesn’t make the SLFP a socialist paradise either, but the point is that for almost 10 years, ever since Rajapaksa breached the famous Maithri-Malik deal by allowing defectors to join his government, the UNP was badmouthed as a party which stood against the war. Making matters worse was its tilt towards the West, even when geopolitical realities recommended otherwise.
 
Here’s the pincer: the floating voter supported Sirisena to drive out Rajapaksa for a reason. That had less to do with a rejection of everything Rajapaksa stood for than a need to get his corrupt group out of the way. The former president, let’s not forget, still courts popularity, and from some of his own critics, for the way he handled the war. Those who claim that other factors helped him are hence at a loss for words when asked, “Would these factors have helped without him?”
 
Logically therefore, two things should remain constant should a Rajapaksa Restoration NOT be legitimised: the country’s security apparatus and its foreign relations, the latter of which should remain as neutral and non-aligned as possible.
 
In an interview with foreign correspondent Padma Rao Sundarji (for her book Sri Lanka: A New Country), Sirisena emphatically stated that national security would remain a priority, while the armed forces would gradually exit civil administration. Sirisena’s statement affirms the view that what Rajapaksa left behind must be held together and that in a way which ensures the opposition cannot justify his predecessor’s return to power. The same, by the way, can be said of the country’s foreign relations.
 
As things stand, the UNP has much to gain. Even from the SLFP. Having gained power in a way which would have made Machiavelli proud, Wickremesinghe must now ensure that what he got cannot be squandered. At all. For that, he must satisfy those two requirements without letting go of the broader canvas which he and his party seeks to enforce in this country, economically, socially, and politically. If he’s successful in this, there’s no doubt that the political equation will “stay”, indeed for quite some time.

Former finance secretary P.B. Jayasundara appeared before the CID today afternoon to give a statement. Following the statement the latter came out from the CID at around 1.30PM and stood under a tree within the CID premises in order to avoid the media waiting outside.It was reported that the CID officers have rejected the request made by the latter to send him home in a police vehicle. Waiting until 2.30pm the latter has suddenly started running outside from the CID premises and quickly got into his car and fled avoiding the media reporters.

The media reporters who were waiting near the gates of the CID premises to get a photograph and a voice cut of P.B. Jayasundara have to run a short distance race behind the latter to take a video clip.
Today the person who is running away from the media reporters is not an ordinary person those days.
During the Rajapaksa regime a Supreme Court decision was given by the former Chief Justice sarath N. Silva against P.B Jayasundara confirming his unsuitability for any public service due to his duplicity. However President Mahinda Rajapaksa reappointed P.B.Jayasundara as the finance secretary using his executive powers disregarding the Supreme Court decision. During the time the latter was not under obligation to the former president’s son Namal Rajapaksa
or Wimal Weerawansa who supposedly say that he is the elder son of the former president.
Today the person who is running away from the reporters is that same Jayasundara who had that powerful history.
During the former regime the journalists and media reporters was living in fear from people such as P.B. Jayasundara and Rajapaksa or living in difficulty in exile in another country or to be a puppet in fear of the Rajapaksa bullet and white van.
Today the person who was hiding in fear and running a short race evading the reporters is these same Jayasundara’s.
If the law is enforced duly, not only Jayasundara even Rajapaksa and his allies such as Weerawansa and Johnny too have to run away from reporters. Although Jayasundara and Rajapaksa can run away from the reporters they cannot run away from the people.

What is the unholy haste impelling AG to release PP to Gota saying nothing incriminating against him ? Who took 16 million bribe?


LEN logo(Lanka-e-News -29.Aug.2015, 10.00 AM) Shocking stories shaking  the entire  country to its foundation are doing their rounds at Hultsorf that a high rung officer of the Attorney general’s (AG) Department had stooped most degradingly and disgracefully to collect  a bribe of Rs. 16 million secretly! When the ex defense secretary Gotabaya Rajapakse is incriminated under the Gun ordinance ; explosive device ordinance; Prevention of terrrism Act (PTA) ;money laundering Act and many others , it is a most perplexing and crucial question ,  how a recommendation was hurriedly sent to the CID by the AG that there aren’t sufficient grounds to file  legal action against ex defense secretary Gotabaya Rajapakse in this present climate and context when there is already an on going investigation (many others in the pipeline) in which serious incriminations against him have surfaced  ?
Based on reliable sources , three senior lawyers of the AG’s department who are no longer employed there but engaged in the legal profession still, have got together and given this colossal bribe to this high rung officer of the AG’s department. 
Lawyers Kuwera De Soysa, Dulinda Weerasuriya and Nalinda Indratissa were officers in the AG’s department for some time. They are now three prominent practising lawyers. Hultsdorf informed sources are of the view that they should know the inside out of  this sordid transaction.
It is an undisputed fact that there is a backlog of cases filed by the police and CID at the AG’s department where AG’s recommendations have been  held back for many years. Then how come  pertaining to Gotabaya’s case which commenced in 2015, such jet speed expeditious attention was paid to give  AG’s recommendation ? The CID officers  who are deeply in their toils hoonestly discharging their duties duly with a view to bringing crooks and criminals to book are naturally baffled over this unholy haste shown by   the AG to recommend the release of the passport of Gotabaya, the ex defense secretary .
While long delays are common at  the AG’s department, what prompted the department to act so hastily in Gotabaya’s case ? One simple example which  bears testimony to the delays at the AG’s department  is : when the necessary investigation report along with the other relevant suspicious documents and rgeisters were forwarded to the AG’s department  to get its recommendation in relation to a massive fraud involving many millions of rupees, in which the suspect had made forged documents pertaining to a land belonging to a German couple , and has also cheated the State tax department in colossal amounts , the AG’s department has still not responded several years after the request was made to the dpeartment for its recomendation. This is only one of the many such instances of delays experienced at the AG’s department where procrastination is a matter of routine.
The  case No. of this massive fraud was 769/12 CM when it was forwarded to the AG’s department for its recommendations .  A businessman with powerful political connections from Kalutara has made the fraudulent deeds of transfer  Nos.  793 and 400. The case No. is B 7108/12 when it was filed at the Kalutara magistrate court.
When this is the lethargic state of affairs in the AG’s department , how come it acted with such great enthusiasm to release the ex defense secretary Gotabaya without permitting the filing of cases when he is implicated in so many criminal cases  under  the Gun ordinance , explosive device ordinance , PTA and money laundering Act ? This action of the AG’s department has rudely shocked the entire judiciary . Specially , legal luminaries of Hultsdorf are in the process of probing into this issue.
This controversial order given by the AG that there aren’t grounds to file legal action against ex defense secretary Gotabaya despite such glaring criminal incriminations against him , necessitated the Galle chief magistrate Nilapuli Lankapura  to release the passport (impounded earlier by court) to Gotabaya to travel abroad.
In other words , the gateway is now open for Gotabaya to bolt from the country before he is taken into custody in the Prageeth Ekneliyagoda case.

Former Deputy Justice Minister and MP elect Sujeewa Serasinghe did not appear before the Homagama Magistrate for the third consecutive time on August 26, even after the latter was issued notice to appear for threatening a police sergeant at Athurugiriya prior to the recently concluded Parliamentary Polls, police complained yesterday.

 Police spokesman Ruwan Gunasekera said Senasighe had been charged for several offences in the same incident such as obstructing the duty of a police officer, violation of election law, Motor Traffic act and using abusive or rather filthy words on a police officer according to the ‘B’ report submitted to the court, ASP Gunasekara said.

 "According to normal procedure of the court, once a notice is issued if the accused does not appear before court, he should be arrested as the notice had been pasted on the door of his residence, but the Magistrate has only verbally asked the police to arrest MP Senasinghe without giving a written order. When the police requested the Magistrate to issue a warrant to arrest, he had instead issued a notice once again to appear on September 30," he said.

 Earlier Inspector General of Police N. K. Illangakoon promised to take tough action against Deputy Justice Minister Sujeewa Senasinghe after consulting the Attorney General and the Election Commissioner for some serious allegations levelled against the IGP by the latter at a media briefing before the polls.

 ASP Gunasekera told The Island three weeks back that day that the IGP had ordered that a case be filed against Deputy Justice Minister Senasinghe for he had undermined the office of the Police Chief to a great extent.

 The Deputy Minister has also asked the IGP to resign for allegedly failing to direct police officers to collect important evidence in the suspicious death of rugby star Mohammed Wasim Thajudeen, whose body was exhumed on August 10.

The Police, however, have so far failed to take any tough action against the MP concerned.

( August 29, 2015, Colombo, Sri Lanka Guardian) Unfolding events among Muslim Ummah today have generated many theological questions in my mind. Today, most of Muslim countries are in turmoil or in some sort of problems. Yet, Muslim leaders and Muslim scholars do not seem to have taken any proactive measure to solve these problems. Sometimes it looks that they are heedless, sometimes it looks that they are powerless to take any actions, and sometime it looks that they are incompetent. Is it divine fate that Muslims should suffer like this? Or is it the fault of Muslim leadership today that Muslims are suffering like this? Why do Muslims have to suffer like this in this modern age? Who is responsible for all these sufferings? Particularly, people in Middle East. Why do they have to suffer like this? I think in 1400 hundred Islamic history they have never suffered like this in this scale.
Thousands of refugees from Syria, Iraq and Afghanistan are arriving in some European countries through Turkey and Libya. It is estimated more than three hundred thousand people crossed to Europe recently. It is reported that since the time of the Second World War, this is the biggest mass exodus in human history in recent time. It is because people in large numbers are on move in thousands. The world never witnessed such a mass human migration in this scale in recent time. It is estimated that more than 6 million Syrians are displaced outside Syria since the war started four years ago. Thousands of people have died in Mediterranean Sea. People are suffering a lot in this difficult journey and some are starving to death on the way to Europe. Graphic pictures of Syrian refugees crossing iron wires in Eastern European countries are shown in many media networks.
It is really heart-breaking to watch those graphic pictures. People are walking with babies in arms. Some elderly people are walking with walking sticks, some others are walking with bandages in their hands and legs. And all sort of people are walking hundreds of miles without food and drinking water. People are disparate to come out of Syria and because there is nothing in Syria. The entire county is destroyed, infrastructure is wiped out in most part of the country. People do not have anything to eat. People do not have any option but leave the country. That is why people have decided to take these difficult routes to come into Europe. All Arab countries in Middle East pathetically failed in their duties and responsibilities to the people of Syria. Of course, Turkey has taken more than 2 million Syria refugees and yet, its resources are limited and entire Muslim world should have taken the responsibilities to resolve this problem. Yet, rich Arab nations have done nothing constructively to solve this problem. Arab nations and its leaders will be answerable to Almighty Allah on the day of judgments about these pathetic conditions of Syrian refugees. Syria has been burning for the last four years and people have been crying for help and yet, this ruthless and merciless Arab leaders did not have any remorse over the suffering of these people. Unfortunately, Islamic leaders, scholars and clerics in Muslim land could not do anything to help out Syrian people in this difficult time.
Incapability and powerlessness of Muslim Ummah to help out Syrian people illustrate the pathetic conditions of Muslims world today. Today, Muslim Ummah is like an orphan. There is no any good political leader for entire Muslim ummah today. There is no any centralised Islamic leadership among Muslim ummah today. There is no voice for Muslim ummah in any international forum. People of Palestine   have been suffering for more 60 years and yet, Muslim leaders in Muslim countries did not take any step to stop the atrocities of Zionists. We have more than 53 Muslim countries today with the population of 1.6 billion. Yet, the influence of Muslim leaders in the international diplomacy is minimal and meagre.
On the other hand, Islamic teachings and values such as a universal Muslim brotherhood, Islamic unity, cooperation and collaboration between international Muslim communities are futile. I wonder if Muslim leaders have any sense of loyalty and allegiance to Islamic faith. I wonder if Muslim scholars have profound knowledge and diplomacy to understand the seriousness of problems that Muslim ummah faces today.
It appears that Muslim leaders and Muslim scholars have left the problems of Muslims today in the hands of Allah to sort them out? Is it really a complete reliance upon Allah? Or is it heedlessness of Muslim leadership today? Is it a fatalism in the front of all these challenges? Whatever happens to Muslim Ummah it happens with the will of Allah and nothing happens beyond the knowledge and scope of Allah. Yet, humanity is responsible for all human actions.
All what happens to Muslims is nothing but what they have earned with their hands. I personally think that Muslim rulers are directly responsible for these dreadful conditions of Muslims in Islamic world today.
How long people will maintain tolerance in the face of these dictatorial Muslim political leadership? Today, many Muslim countries are ruled and controlled by dictators in this modern age. This pathetic situation of Muslims today is direct consequence of this ruthless dictatorship. In 1400 hundreds of Islamic history, Muslims are not humiliated by their leaders as we see today. So called Muslim leaders have enslaved Muslim population with support of mighty military powers and cruel forces.
Extremism breeds in Muslim land today due to this dictatorial rule. In Muslim land people do not enjoy freedom of thought, freedom of expression, freedom of political pluralism and any sort of freedom. As a result of this, people revolted against Arab governments in the Middle East and they are severely punished for expressing their political views.
Muslim rulers spend billions of dollars on arms and weapons and yet, they do not have willingness to support these Syrian refugees. Muslim rulers spend billions of dollars to build their palaces, houses and hotels and yet, they do not have any money to save the lives of these displaced people. At least, 28 European countries under UN convention on refugees agreed to shelter some Syrian refugees.
Why cannot Muslim nations have some sort of Islamic conventions to resettle these Muslim refugees in Muslim lands? Why cannot Muslim countries emulate prophetic tradition of helping Muslim migrants in this difficult situation? Where is the Islamic teaching of helping and supporting destitute people in this difficult situation? I think that some western nations are really applying Islamic teachings on this issue than any Muslim nation. Why cannot Muslim countries have some mechanisms to help these people?
Kings and Princes of Gulf countries will not take their wealth and money when they die. But for sure their good and bad deeds will accompany them when they die. In case of Syrian refugees they have utterly failed and they will be questioned by Allah on the day of judgement about this issue.

A video was posted to YouTube on Friday that showed an Israeli soldier putting an injured 12-year-old Palestinian boy in a headlock during an attempted arrest.
The four-minute clip was shot in the West Bank village of Nabi Saleh, where activists regularly gather to protest against Israeli settlements, which are considered to be illegal under international law.
In the video a 12-year-old Palestinian boy, who has his right arm in a cast, screams as an armed Israeli soldier roughly attempts to detain him.

Two Palestinian women and a girl sweep down a hill and try to pull the Israeli soldier off the boy.
“Get him off,” they are heard to shout at the soldier. “He is a little boy. He is a little boy.”
The women desperately pull and hit the soldier with their hands.
Palestinian children are regularly detained and imprisoned by Israeli forces – at the end of May 2015 rights group B’Tselem reported that 163 Palestinian minors were being held in Israeli custody.
As the two women struggle to pull the Israeli soldier off the Palestinian child, another soldier enters the scene and hits one of the women across the face.
The women, who can be heard screaming and crying throughout, continue to hit the soldier holding the boy. Eventually the soldiers relent and flee the scene, leaving the boy behind.
Haaretz reported that one of the soldiers was “lightly wounded”. The Israeli daily said that one Palestinian and one foreign activist were detained during the clashes at Friday’s protest in Nabi Saleh.
The Israeli army said their soldiers had decided to arrest the 12-year-old Palestinian boy because he had thrown stones during the protest.
“The youth who was photographed was identified by the lookout force as a stone-thrower, and because of this it was decided to detain him. At the time of the arrest, a violent provocation by a number of Palestinians developed, including women and children. In light of the violent altercation, the commander decided to not to go ahead with the detention."
Activists at the scene told Haaretz that they had not seen the boy throw any stones.
