The New Town Hall was full to overflowing, the corridors crowded, the overflow went into the grounds outside; they came from Colombo, they came from the outstations (Sammanthurai, Trincomalee, Hambantota, Anuradhapura, Kandy, Puttalam, Kurunegala, Matale, Kegalle, Galle and Kalutara), young men and women I had never seen before, dozens of old leftists (not just Samasamajists) who I had not met for decades. It was quite something and if the new leaders can hang on to and build on the strategic advantage they have scored, a significant Left entity will surface. While cries of "Samasamaja Pakshayata Jayaweva" and youthful calls for a renewed golden age echoed from speaker to speaker symbolising the enthusiasm of the gathering, I will caution later in this essay that while nostalgia is a tonic, this is the twenty-first century and the tasks of a revitalised LSSP are different from those of a bygone era. Now recalled to life, the Party must reset its targets in ways some readers may find outlandish and different from anything they are accustomed to, but the ‘moving finger writes, and having writ moves on’. There is only one way forward for the Left in Lanka; but before that let me describe the day’s events.

Why no investigation against Tirukumar Nadesan, a wheeler-dealer and close relation of MR?

There was an international inquiry by the Financial Intelligence Unit of Central Bank against Tirukumar Nadesan. He then went into hiding in Dubai and was reported to have been buying gold at cheap prices to take commission monies out of the Bank Accounts and to hide gold in Bank vaults. He is known to be a regular visitor of Prime Minister Ranil Wickramasinghe. It was disclosed that he had gone with Ranil Wickramasinghe to arrange for President Mahinda Rajapaksa to leave Temple Trees early morning on 9th January
Is Tirukumar Nadesan still holding the political appointment as Chairman of Hilton, using a Rs. 25 million luxury motor-vehicle, with a monthly allowance of Rs. 500,000 ? Is not Tirukumar Nadesan the Agent of Airbus purchased by Sri Lankan Airlines of Mahinda Rajapaka’s regime ?
Is he also not the Agent of Taisei of Japan, who got many Highway deals ? He was so powerful to get rid of Highway Secretary Wasantha Karannagoda when he had refused the Outer-Circular Road to the highest bidder of Tirukumar Nadesan, and gave it to the lowest bidder. If Basil Rajapaksa’s ill-gotten billions are to be investigated in foreign Bank Accounts, then Tirukumar Nadesan’s foreign Bank Accounts also have to be investigated. He has not declared his assets and liabilities, which is another offence ?
Why only go after the small fish and allow big fish continue to do corrupt deals under the present Government of President Maitripala Sirisena, who promised to fight corruption and bring in law enforcement against all crooks, which includes Tirukumar Nadesan, a family member of Mahinda Rajapaksa – Concerned Citizen.

A Rajapaksa Front Company Investment US$ 7.0 billion

 
CHEC Port City Colombo Private Limited, a company incorporated in Sri Lanka which is fully owned by CCCC has received official communication from the Secretary to the Minister of Ports, Shipping & Aviation, communicating a decision taken by the Cabinet Ministers of Sri Lanka, directing the suspension of the ongoing work for the Port City Project, with immediate effect.

The official communication further directs CHEC Port City Colombo (Pvt.) Ltd to submit valid permits and approvals issued by the relevant government authorities. The company will be taking all necessary steps to provide these requested documents as instructed by the Ministry of Ports, Shipping & Aviation to abide by the notification received, without prejudice to the legal rights of the company under the Agreement entered into with the Government of Sri Lanka on 16th September 2014, to develop the Port City Project.

China Communications Construction Company Limited (CCCC), is a responsible corporate and is a global Fortune 500 public listed company. The company will fully cooperate with the Sri Lankan Government and continue to adhere to the procedures and conditions stipulated in the said agreement entered into with the Government of Sri Lanka, including the commitments contained in the approved Environmental Impact Assessment study and addendum thereto. Further, CCCC will continue to comply with the laws of the country and follow the necessary guidelines issued by the Government for a mega development project of this nature.

The foreign direct investment by CCCC for the creation of the Colombo Port City Project is USD 1.4 billion and the project is estimated to generate 83,000 local jobs. The project when fully completed is expected to attract international investments with a total value estimated at USD 13 billion. The complete commercial risk of this project will be borne by CHEC Port City Colombo (Pvt) Ltd.

The technical partners of Port City are world-class companies such as AECOM, one of the world’s largest design firms for urban development based in USA, while ATKINS is the world’s largest engineering consultancy firm based in the UK. SWECO of Sweden is the master planning consultant for the project.

The vision for Port City is to establish Colombo as the ultimate business and tourist destination in South Asia. The land created will attract local and international investments for shopping malls, hotels, apartments, an exhibition center, educational institutions, healthcare facilities, theme parks, restaurants etc. Port City is planned to be very much a city for the people of Sri Lanka to be shared and enjoyed by all Sri Lankans.

Huge foreign bank accounts exposed

Billions of rupees enough to bridge 75 per cent of the Budget deficit have been illegally deposited in three countries – Ukraine, the United Arab Emirates and Switzerland — by leaders of the former government and top officials, Finance Minister Ravi Karunanayake told the Sunday Times yesterday.
He said the Government had worked out a plan to recover this money and preliminary investigations had revealed the names of the persons holding the accounts and other details.
Mr. Karunanayake pointed out the estimated budget deficit for 2015 was Rs. 521 billion and the money in the foreign accounts are sufficient to bridge 75 per cent of the country’s budget deficit.  He said the three countries had cooperated in the initial investigations and the names of the account holders would be disclosed.
The Finance Minister said that inquiries were being carried out under the provisions of the Money Laundering Act and if necessary further amendments would be introduced to the Act.
He said a special team from the World Bank’s Stolen Asset Recovery Initiative (StAR) was in Sri Lanka to help in getting the money back. The moves came as the newly established Financial Crimes Investigations Division headed by Deputy Inspector General Ravi Waidyalankara on Friday filed reports in a magistrate’s court on three cases including the flawed oil hedging deals by the Ceylon Petroleum Corporation (CPC).
A five-year-old dispute between the Sri Lankan Government and the Standard Chartered Bank (SCB) over the flawed oil hedging deals ended in June 2013 with a US$ 60 million (Rs.7.5 billion) payment settlement. The payment is higher than what was allocated to some of the ministries from the annual budget. The two other cases related to alleged frauds in the Divineguma Department and in the People’s Leasing Company, a fully owned subsidiary of the People’s Bank.
The Finance Minister said three more investigations regarding major financial frauds had started, but declined to give details.

Three ministers of the former United People's Freedom Alliance Government were summoned by the Commission to Investigate Allegations of Bribery or Corruption (CIABOC), yesterday. They were: Johnston Fernando (Trade and Consumer Affairs), Reginald Cooray (Minor Export Crops) and Rishad Bathiudeen (Commerce and Industries).

Meanwhile, Leader of the National Freedom Front, Former Minister of Housing and Engineering Services Wimal Weerawansa, who had also been summoned to appear before the CIABOC, had informed the Commission that he was unable to be present yesterday and would appear on Monday.
Directress of the CIABOC, Dilrukshi Dias Wickremasinghe told Ceylon Today that Weerawansa has been asked to be present next Monday. CIABOC internal sources revealed that complaints have been received against Weerawansa stating that while he was the Minister of Housing and Engineering Services, illegal activities had taken place at the Ministry and subsequent to becoming a parliamentarian, he had accumulated wealth and assets. 
A complaint has been made, to the CIABOC, by a resident of Mannar, R. M. Q. Khan that doubts exist about the assets and wealth earned by Minister Rishad Bathiudeen after 2004. The Directress of CIABOC said that she cannot reveal any details to the media until legal action is taken against the former Ministers. The internal CIABOC sources also revealed that former Minister, Reginald Cooray was questioned for about three hours by the Commission.
Accusations had been levelled against former Minister Johnston Fernando, who is supposed to be the owner of Wayamba Distilleries Company, about several acts of large scale corruption and fraud in connection with Sathosa during the recent past. He has also been accused of dealing in Ethanol on a large scale and being connected to the Ethanol transactions that have taken place within the country.

Former ports authority chairman alleged for bribing the media!

It is reported that former Ports Authority Chairman Priyan Bandu Wicrama is alleged paying bribes to the media reporters who were critical of his corruption.
It is reported that he has paid these bribes not from his personal money but from a secret account he maintained from the Ports authority Secretary office. An investigation conducted under the instruction of
the current minister Arjuna Ranathunga it was revealed more than 200 people has been paid bribes.
He has made these payments through Sri Lanka Port Management and Consultancy Services (pvt) Ltd which is an affiliated institution functioning under the Sri Lanka Ports Authority. It was revealed that
there are journalists and reporters of Mawbima and The Island Newspaper who received such illegal wages.
A sum of Rs. 50,000 has been paid from August 2011 to December 2014 to each journalist's. The list of names of these corrupt journalists will be exposed to the media by the Ports Authority soon.

The current Chief Operations Officer and Head of Flight Operations Capt.Druvi Perera of Sri Lankan Airlines has been granted the enviable task of now running the identical functions of Mihin Lanka the low cost budget airline too as now both airlines are being ordered to run under one Chairman but under two separate AOCs issued by the Director General of the Civil Aviation Authority of Sri Lanka.
Among many blatant decisions taken in the recent past by the former Sri Lankan Airlines Chairman Nishantha Wickramasinghe and the soon to be out going CEO Kapila Chandrasena, is the controversial appointment of Capt. Druvi Perera to the post he currently holds.
It is important to point out that there is ‘NO’ such post as per the legality and as laid down in the Air Operator Certificate (AOC) manual (ref SLCAP 4100 Appendix I dated 16/05/2011 rev 1). The instructions attached here should have been crystal clear especially to those within the aviation sector and of the national carrier.
Mihin LankaHis post of Chief Operating Officer never existed before and was created and advertised in manner that ensured he was the sole applicant for the post. Strangely even the maximum age for this post was highlighted at 50 preventing other suitable candidates from applying.

What further shocked aviation professionals in the Flight Operations was firstly here was a Pilot who had only his Australian Ordinary Level qualifications besides his flying credentials and further his ability and skills were questionable after his famous approach and landing incident in Chennai and more famously his push back without obtaining Air Traffic Control clearance with a VVIP on board in late 2014.
Since these two incidents were reported by Colombo Telegraph on the 9th and 14th of February 2015respectively, the national carrier is yet to refute both allegations.
Worthy questions been asked now is as to how a person with such track record could be granted more responsibilities when it was commonly known that his controversial appointment and many other dealings is been probed at present at a personal level by Lawyer J.C. Weliamuna and his team.

UN rights chief hails Nepal court for war crimes ruling

The UN human rights chief on Friday hailed Nepal’s top court for barring war crimes commissions from offering amnesty to soldiers and former Maoist rebels in cases involving serious rights abuses.
Nepal is in the process of setting up two bodies to investigate war crimes committed during a decade-long insurgency, which saw security forces and Maoist guerrillas accused of carrying out torture, killings, rape and “forced disappearances”.
Parliament last April gave the two commissions the power to grant amnesty for all crimes except rape, but last week’s Supreme Court ruling revoked that right after a mass petition filed by 234 victims.

The UN High Commissioner for Human Rights, Zeid Ra’ad Al Hussein, praised the court “for upholding international standards relating to accountability for gross violations of international human rights law and serious violations of international humanitarian law”.
”It is essential that the commissions adopt this victim-centred approach, as many victims have felt completely excluded from the process so far,” Zeid said in a statement.The ruling bars the offering of amnesty for serious rights abuses on any ground and requires victims to approve any move towards reconciliation.
The conflict between Maoist guerrillas and the state left more than 16,000 dead, with both sides agreeing to set up a Truth and Reconciliation Commission and a Commission for Enforced Disappearances as part of a peace pact signed in 2006.
Although authorities has issued arrest warrants in several cases of human rights abuses committed during the war, only one verdict has been given in a case involving the murder of a journalist.
A colonel of the Nepal Army, who was arrested in January 2013 in Britain over allegations of torture committed during the war, is also facing trial in a British court. 

Maldives: More on the Farcical Trial of Nasheed

Sri Lanka Guardian( March 7, 2015, New Delhi, Sri Lanka Guardian) Latest media reports indicate that Indian Prime Minister Modi will be skipping Maldives in his tour of the island nations in the Indian Ocean. Had his visit taken place earlier in February, it would have had some meaning but now with the Yameen administration intent upon destroying whatever that is left of democracy, it is wiser to skip Maldives. It will be a signal to Yameen that India does not approve the strong arm undemocratic methods of Yameen.

The trial of Nasheed is fundamentally flawed as two of the three judges presiding over the trial of Nasheed for terrorism charges were actually witnesses to the arrest of criminal court judge Abdulla way back in 2012. This was pointed out by the Defence Lawyers of Nasheed but was rejected outright by the judges.

It looks that the administration with the help of the judiciary is determined to pass a sentence on Nasheed on the so-called terrorism charges. Otherwise where was the hurry of Yameen administration to present a bill to the Majlis to deny “convicted Presidents” of all presidential privileges that go with past presidents?
Nasheed while he took over as President wanted to break the tradition of Maldives in driving the past presidents into exile. Ibrahim Nasir was the last example. It looks that he made the mistake of breaking the tradition in allowing former president all the allowances and a decent living in not pursuing Gayoom with all criminal cases that could have been slapped on him during his 30-year autocratic rule.

Nasheed’s trial is being run like a quiz programme. The Defence lawyers are given specific time limits to forward their arguments. Nasheed was also prevented from sitting with his legal team.

In the court, Nasheed denied having authorised the arrest of judge Abdulla. “Public support to me during Presidential elections by 49 percent demonstrate that they do not view me as a terrorist.”
The State Prosecutor on the other hand gave a new definition to terrorism in the court. He said that detaining someone against his will is an act of terrorism.

Strangely, other defendants in Nasheed’s case include the present Defence Minister Moosa Ali Jaleel, the then Chief of Defence Force Ibrahim Didi and former Col. Mohamed Ziyad. Although Moosa Ali is facing terrorism charges he appears to continue as the Defence Minister even now. There has to be some purpose in letting this continue.

The case against former Defence Minister Nazim is also taking a farcical turn. It may be recalled that in the first report of Police on the raid had said that nothing incriminating was found. Later a pistol and some rounds were declared to have been found. It is now said that a forensic examination of the black bag showed presence of explosive material.

The pen drive said to have been recovered from Nazim’s house sis now supposed to have some evidence of a plot to harm senior government officials with the financial backing of the villa group. Nazim was supposed to have been tasked – individually and jointly to cause harm to the officials!

The attempt now is to involve Gasim Ibrahim too who incidentally is the head of the villa group!
The grand rally of 27th was said to be a great success. There was a turn out of over 25000 persons. The rally terminated promptly at 6:00 P.M. though there were calls to extend the time. In the rally 13 demands were placed. These included

1. Stop restricting fundamental constitutional rights through amendments to either the constitution or the laws.
2. Release former President Nasheed and former Defence Minister Mohamed Nazim.
3. Repeal amendments brought to the Auditor General Act that saw the removal of former Auditor General Niyaz Ibrahim.
4. Withdraw political charges against opposition politicians.
5 Investigate large scale corruption within the government.
6. Continue providing electricity subsidy.
7. Fulfill campaign pledges to provide subsidies to fishermen and farmers.
8. Give back powers taken from local councils and enforce local decentralisation act.
9. Enforce Fiscal responsibility act.
10. Increase wages of teachers, health workers and civil servants.
11. Reverse decision to impose import duty on fuel.
12. Empower legally independent institutions.
13. Fulfill government pledges to provide unlimited health insurance.
In the rally Gases Ibrahim alleged that the government wants to frame and destroy all opponents. The present target appears to be to destroy Gasim Ibrahim, his business and his political career. Sooner or later a deal will be offered to him to either cooperate or get destroyed!

Tens of thousands of Israelis attended a rally to demand a new government Saturday night in Rabin Square. Israel Police estimated that 40,000 people attended.
The rally was held under the banner, “Israel wants change,” and was being billed as an anti-Benjamin Netanyahu event.
Among the speakers scheduled to take part in the event were former Mossad chief Meir Dagan, Michal Kestan-Kedar ( the widow of a lieutenant-colonel who was killed in Operation Defensive Edge), a social justice activist, journalists and others.
In his speech, Dagan told the crowd that he is more scared of Israel’s leadership than its enemies. Saying that he wants neither a bi-national state nor an apartheid state, the former Mossad chief derided the current leadership for using fear and threats to present peace as unattainable.
“To those who say we don’t have any alternative, as somebody who worked directly with three prime ministers: there is a better alternative,” Dagan said.
“Just as there are unavoidable wars there are also unavoidable elections,” the visibly ill former Mossad chief said, describing the upcoming elections as an emergency call-up that Israel cannot ignore.

The event comes 10 days before Israelis head to the polls with no clear winner predicted. Labor and Tzipi Livni’s “Zionist Camp” is showing as the largest party in most polls, although Netanyahu’s Likud is not far behind.
Behind the Zionist Camp (23) and Likud (21), the Joint List of Arab parties grew in the most recent polls to up to 15 seats, according to aggregate pollingProject 61.
Netanyahu has ruled out the possibility of forming a unity government with the Zionist Camp, leaving two possible coalitions: a far-right government that includes one or two of the centrist parties and the ultra-Orthodox; and, a center-left government that includes the centrist parties and the ultra-Orthodox, with the support of the Joint List from the opposition.

U.S. sees even bigger test for Iraq and Iran in the aftermath of Tikrit battle



ABOARD A MILITARY AIRCRAFT — The top U.S. military officer will press the government of Iraqi Prime Minister Haider al-Abadi during a visit to Iraq this week about its plans for avoiding sectarian fallout once the Iranian-backed operation to dislodge the Islamic State from the city of Tikrit concludes.

Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, said he was confident that Iraq would ultimately defeat the Sunni militants in Tikrit, a largely Sunni city north of Baghdad. He said the group’s fighters numbered only in the hundreds there, while the force of Iraqi troops and Iranian-backed militia fighters advancing on the city stands around 23,000.

“The important thing about this operation in the Tikrit in my view is less about how the military aspect of it goes and more about what follows,” he told reporters ahead a visit to Iraq, where he will meet with Iraq’s Shiite-led government. “Because if the Sunni population is then allowed to continue to live its life the way it wants to, and can come back to their homes … then I think we’re in a really good place.”
“But if what follows the Tikrit operation is not that, if there’s no reconstruction that follows it, if there’s no inclusivity that follows it, if there’s the movement of populations out of their homeland that follows it, then I think we’ve got a challenge in the campaign.”

The Tikrit offensive, launched earlier this week, is the first test of al-Abadi’s ability to orchestrate the recovery of a major city from the Islamic State. It is also an illustration of the government’s deepening partnership with Shiite militia organizations and the military of Shiite neighbor Iran, which has provided advisors, weaponry, training, surveillance and intelligence to counter the militant group.

U.S. officials say two-thirds of the force poised to make an attempt for Tikrit are militiamen rather than Iraqi government forces.

The renewed prominence of Iranian-backed militias — many of them groups U.S. soldiers fought prior to the 2011 U.S. withdrawal — and the increasing openness with which Iranians such as Qassem Soleimani, head of Iran’s elite Qods force, now operate in Iraq has raised alarms in Western capitals and among Iraqi Sunnis.

Militias are already being blamed for abuses in Sunni areas they have cleared of Islamic State militants. But their fighting power is a necessity given the weakened state of Iraqi security forces and the decision by Western countries to keep troops out of combat in Iraq.

The overt Iranian involvement is also a strain on the rekindled U.S.-Iraq military partnership. U.S. soldiers returned to Iraq last summer after Islamic State militants, fueled by the conflict in neighboring Syria, seized much of the north and west of the country.

While the United States and its allies have conducted air strikes across Iraq, U.S. war planes are notably absent in the unfolding battle in Tikrit. In contrast to the hands-off role there, U.S. forces have been playing a major role in helping the Iraqi military prepare for another future urban battle, in Mosul.
Dempsey, who once commanded the U.S. effort to train Iraqi soldiers, has voiced a results-based view of Iran’s military role in Iraq. Earlier this week, he said that Iranian support could be “positive” if it does not spark sectarian tensions.

Now, as he prepares to meet with Iraqi leaders, Dempsey said he was “trying to get a sense for how our activities and (Iran’s) activities are complementary, because we don’t actually coordinate with them directly nor do we intend to.”

Dempsey said the Tikrit campaign — characterized in its early stage by a crowded push of pickup trucks and military vehicles — did not currently qualify as a “sophisticated military maneuver.” He said U.S. and allied air strikes around the refinery city of Baiji had made the Tikrit offensive possible by depriving nearby Tirkit of militant resources.

The Obama administration has been scrambling to reassure allies, especially Arab nations which are partnering with the United States against the Islamic State, about Iran’s military rise in Iraq. During the same trip, Dempsey will also meet with officials in Bahrain, a tiny Gulf nation that is a key U.S. military ally but struggles with Shiite-Sunni tensions of its own.

While Dempsey said Iranian support had made the militias more “tactically effective,” he appeared more skeptical that Iran would play a constructive role once the Tikrit battle ends.

If anyone thinks Loretta Lynch, the nominee to replace Eric Holder as U.S. attorney general, is facing a bruisingconfirmation fight, spare a thought for the next ambassador to Cuba.

The Obama administration says it wants to reopen the U.S. Embassy in Havana by early April — an ambitious launch date that has triggered a flurry of speculation in diplomatic circles about whom the White House will nominate for a position that hasn’t been filled since now-deceased Ambassador Philip Bonsal was recalled in 1960 at the height of the Cold War.
