No let-up in arrests of Tamil youths at Katunayake airport

airport-bandaranaikeDespite regime change and claims of relaxing security measures especially against the ethnic Tamils, the arrests of Tamil youths at the Bandaranaike International Airport at Katunayake continue to take place unabatedly.
According to official sources, at least Two Tamil youths have been arrested by the CID on arrival from the Middle Eastern countries at the airport two days before Independence Day and detained at the notorious Fourth Floor in Fort.
Kandasamy Karunananidhi (36) from Mankadu, Batticaloa has been arrested on February 2nd at the airport by the CID when arrived in from Qatar on holiday to visit his wife and child. Similarly, 29-year old Thamodaram Baskaran from Kokkaddicholai, Batticaloa has been arrested by the CID on arrival from Dubai. He too was returning home on holiday to visit his wife and child.
Batticaloa district parliamentarian of the Tamil National Alliance (TNA) P. Ariyanethran has said these two youths, working in the Middle-Eastern countries have often been visiting Sri Lanka during vacations to visit their families.
“According to the parents, these two boys had briefly been in the LTTE, but they left the outfit long ago and were working in Doha and Qatar. They have often visited their families from time to time without any problem in the past. But this time, they have been arrested and detained by the CID at the Fourth Floor,” he said.
“The President is changed, the government is changed but the security-related intimidations against the Tamils have not changed and continue as it was during the Rajapaksa regime,” the Batticaloa district MP said.
These incidents have happened at the country’s international airport barely a few days after the government and its top ministers made a public announcement requesting all the Tamil expatriates to return home and join the new government’s effort to collectively take forward the embattled nation.
“I raised this issue in parliament today. I told the House clearly that the situation for the Tamils in the country remains the same regardless of who comes to power. There is no freedom for Tamils in the country. Looking at these developments, it is clear the situation is not yet conducive for the Diaspora Tamils to return,” MP Ariyanethran said.

The Independence Day celebrations this year will be significantly different from those of the recent past.  The government has said that the ceremony will be simple.  There is an emphasis on cost cutting.  The previous government spared no cost to make its celebrations grand affairs. One of the main issues on which the presidential election was fought over was corruption and waste, and the misdirection of economic resources away from the poor to those at the helm of the government.  The opposition parties leveled charges against the former United People’s Freedom Alliance government that it led the country into massive debt due to its white elephant projects, waste and corruption.

As Ezra Taft Benson stated the President has shown that “Pride is concerned with who is right. Humility is concerned with what is right.” Humility does not show weakness in leadership as some people believe but it is concerned with what is the right approach for the issue at hand. The previous regime showed arrogance in-lieu of humility hence they were unable to learn from their mistakes. If the new President governs our country exactly the way he has outlined in his address to the nation, there is no doubt that he will become one of the great leaders in Sri Lanka. As Rabidranath Tagore stated “We come nearest to the great when we are great in humility”.

Indian military academy welcomes war crime accused Sri Lankan commander

A senior commander of the Sri Lankan armed forces  accused of war crimes has been accepted by India to a leading defence academy in Delhi. Major General  Shavendra Silva who has been named for committing war crimes and crimes against humanity  by leading human rights organisations, has commenced  studies in at the National Defence College (NDC) Governed by the Indian Ministry of Defence. The NDC course has been accorded recognition by the University of Madras.
Major General Silva who commanded the  58 division accused of killing civilians and the execution of Tamil Tiger leaders who surrendered carrying white flags, has started following a course in Defence and Strategic Studies at the NDC in January. At the successful conclusion of the residential course in December, Silva will be eligible to receive an M Phil. He is one of the select few senior military officers from around the world to be accepted by India for the course. During the earlier stage in his military career, Silva has completed a course in the Parachute Regiment Training Centre in Agra. The recognition by a National Defence College is a major qualification to be appointed as the commander of the Sri Lankan military.

Shavendra Silva has entered NDC following his stint in New York as Sri Lanka’s Deputy Permanent Representative to the United Nations. A lawsuit filed against him in NY by affected Tamil victims was dismissed by courts due to the protection provided by diplomatic immunity. However, he was barred in taking part the UN Special Advisory Group on Peacekeeping Operations in January 2012.
Silva was a pioneer member of the Rapid Deployment Force (RDF) that terrorised southern Sri Lanka during the Janatha Vimukthi Peramuna (JVP) youth insurrection in the late eighties. He was raised to the rank of captain while conducting counter-insurgency operations in central Sri Lanka under Colonel Gotabhaya Rajapaksa. The former Ambassador Silva and the Former Defence Secretary Rajapaksa were comrades in arms in Matale District where a mass grave over 150 bodies of Sinhala youth have been found buried.

ms janakaAccording to the information, Janaka Ratnayake joined Mahinda Rajapaksa’s electioneering in 2005 through a SMS campaign. Although he claimed he carried out the campaign with his own money, it is well known that he got the money from Basil Rajapaksa. A grateful Mahinda Rajapaksa appointed him as the MBSL chairman.
He also created the financial crisis in Lalith Kotelawala’s Ceylinco Group in 2008. Promising to resolve the crisis, he obtained money in the following manner – Rs. 50 million from The Finance, Rs. 35 m from Asian Finance, Rs. 30 m from Ceylinco Savings Bank, Rs. 40 m from Standard Credit, Rs.15 m from Fingara Country Club, Rs. 45 m from The Finance and Guarantee, Rs. 600 m from Ceylinco Housing and Real Estate, Rs. 40 m from Nation Building Society and Rs. 40 m from Sussex College.
After receiving money from directors of these companies he advised them to flee the country.  He says he shared the money with the Rajapaksas. Ratnayake also says publicly that he had spent several millions of Singaporean dollars to buy a house in Singapore for ex- governor of the Central Bank Ajith Nivard Cabraal.
If the new government intends to investigate Ceylinco Group and depositors’ money, the first thing that should be done is to question this Janaka Ratnayake. Expect a detailed report on his corrupt deals and the other persons involved.

Despite the Sri Lankan government’s announcement of freeing previously blocked by the Rajapaksa regime and even after the appointment of President’s brother Kumarasinghe Sirisena as the chairman of Sri Lanka Telecom, Colombo Telegraph continues to be blocked.

The new president, who took office on January 9th, has ordered the Telecommunications Regulatory Commission to lift the ban on news sites that were blocked underRajapaksa.
After the presidential elections of the 8th of January 2015, the Internet blocking that was taking place at the mobile operator Dialog Axiata PLC against the website Colombo Telegraph was released. The site remains under monitoring at the Sri Lanka Telecom network, the largest telecommunication provider in the country.

Our research reveals that the blocking is talking place at the servers ns.slt.lk, particularly the server 203.115.0.46, that is actively tampering the name resolution of colombotelegraph.com.
Users requesting access to the domain name colombotelegraph.com that make use of domain name servers depending on Sri Lanka Telecom get a bogus response (127.0.0.1), that makes the site unaccessible.
We have tested this behavior from the following networks inside Sri Lanka Telecom. 203.115.18.0/24, 203.115.19.0/24, 203.94.73.0/24, 220.247.213.0/24 and 220.247.225.0/24. The first four networks correspond to customer’s lease lines and the forth network is a government network hosting websites like “The Public Service Commission” or the “ICT Agency for Sri Lanka”.
Our research confirms that DNS requests in these networks are forwarded to server r1.ns.slt.lk, a domain name server resolver located in the central office of Sri Lanka Telecom at the OTS Bulding in Lotus Road in Colombo.
Our forensic examination also shows evidence that the interception is implemented by a Barracuda* appliance. Barracuda appliances are sold by South Asian Technologies Ltd., the authorized distributor of Barracuda products in Sri Lanka.
Barracuda is an American security firm funded in 2003 by Dean Drako that became lately notoriously known for integrating backdoors in their products.
It is our understanding that the blocking was implemented at the direction of the Telecom Regulatory Commission and/or the Minister. Under the provisions of the Sri Lanka Telecommunications Act, No. 25 of 1991, s. 69, “the Minister may, upon being satisfied of the above matter by Order made either generally and published in the Gazette or specially in writing in respect of any telecommunication service provided in any place in Sri Lanka or in any ship in the territorial waters of Sri Lanka or in any vehicle or aircraft in or over Sri Lanka or the territorial waters thereof.”
In the absence of such lawful order, we contend that the TRCSL has engaged in an act that is ultra vires. Colombo Telegraph request the Sri Lankan government authorities to examine the facts of the case and provide us with (a) a detailed explanation and (b) an assurance that such unlawful acts shall not be repeated.

New Sri Lanka president renews troop deployment orders

Sirisena’s election last month had been expected to lead to a lessening of the numbers of troops in towns and cities — particularly in former war zones — which had been a prominent feature of his hardline nationalist predecessor Mahinda Rajapakse’s tenure.

During the build-up to his election victory, Sirisena promised to confine the military to their barracks and call them out only in the event of an emergency or a threat to national security.

But, according to a presidential decree seen by AFP, Sirisena has now renewed a monthly authorisation for the deployment of troops across the island.

"By virtue of the powers vested in me, I, Maithripala Sirisena, do by this order call out all the members of the armed forces…for the maintenance of public order," read the order.

The presence of large numbers of troops is particular contentious in the mainly Tamil northern and eastern provinces that bore the brunt of a 37-year separatist conflict, which was brutally crushed by the army in May 2009.

During a speech on Wednesday to mark the 67th anniversary of the former British colony’s independence, Sirisena had stressed his desire for a national reconciliation which Rajapakse is accused of failing to deliver.

Tamil lawmaker Suresh Premachandran said the president should explain why he felt it necessary to call out troops nearly six years after the end of the war.

"We have been asking for the withdrawal of troops from the north and the east, but this order only serves to continue the army presence," Premachandran told AFP.

"I strongly believe that there is no need to deploy troops anywhere in the country."
"He (Sirisena) promised change but if he is going to continue what the previous government did, then we are back to square one."

The Free Media Movement (FMM), a leading local rights groups, said it had expected Sirisena to confine troops to barracks.

"We think this is a retrograde step in dismantling the role of the military in our day to day life," FMM spokesman Sunil Jayasekera told AFP.

Sri Lanka lifted a state of emergency in August 2011, two years after security forces crushed Tamil Tiger rebels and declared an end to war but the previous government had deployed the military alongside the police.

BASL Pleads For Time On Sirisena Giving Police Powers To Armed Forces

Although the Bar Association of Sri Lanka had criticized the previous regime’s draconian regulations imposed under section 12 of the Public Security Ordinances that transferred Police powers to the armed forces, when the new regime does the same, the BASL says they need time to take up the issue.

When asked for the BASL’s opinion on the presidential order issued by President Maithripala Sirisena on 2 February 2015 under section 12 of the Public Security Ordinance vesting police powers in the military, the president of the Bar Association, Upul Jayasuriya said; “I believe as a matter of routine this same order would have been extended. The government is barely 3 weeks old. Give us a little space we will take it up.”
On July 14, 2014, issuing a statement under the title “Sri Lanka Transforming Into A ‘Crypto Military And Authoritarian State” the BASL said; The BASL Executive Committee meeting has gone on to say the situation has been further deteriorated due to a regulation imposed under section 12 of the Public Security Ordinances that transferred Police powers to the Army, Navy and Air Forces, covering the entire country.”
As Colombo Telegraph reported yesterday, the new President Maithripala Sirisena has also issued the same order calling out the armed forces to exercise police powers under the pretext of public security.

1. Is it correct that, in July 2014, the BASL released a statement condemning presidential orders issued under section 12 of the Public Security Ordinance vesting police powers in the military?

2. The July 2014 statement published on the BASL website described such gazetted presidential orders as ‘illegal, unjustified and ultra vires’. What was the reason for stating so?
3. In the statement published in July 2014, the BASL also stated that these gazetted orders were opposed by the BASL from its inception having foreseen the ‘danger faced by the people’. Is this still the position of the BASL?
4. What is your opinion on the presidential order issued by President Maithripala Sirisena on 2 February 2015 under section 12 of the Public Security Ordinance vesting police powers in the military?
5. Is the BASL taking steps to condemn the new order dated 2 February 2015? If not why?
On February 3rd a fundamental rights application has been filed by Dudeesha Duminda Nagamuwa, the candidate nominated by the Frontline Socialist Party (FSP) for the January 8, 2015 presidential election, asking the Supreme Court to give relief for the violation of the fundamental rights of citizens of Sri Lanka by former President Mahinda Rajapaksa by abusing his powers and unnecessarily deploying the army in all 25 districts at election time, under the same section of the Public Security Ordinance.
Critics say this is against the hope that we would return to civilian administration. This means he is of the opinion that circumstances endangering public security have arisen in all 25 districts, and that the police are inadequate to deal with that situation.”
Meanwhile Colombo media reported, senior lawyer and President of the Bar Association, Upul Jayasuriya, has been appointed as the Chairman of Board of Investments (BOI) of Sri Lanka. “According to sources, Jayasuriya has been appointed to the post by President Maithripala Sirisena and he will be replacing Dr. Lakshman Jayaweera.” Colombo media further said.

Sri Lanka to go ahead with Chinese-funded port city in Colombo

Return to frontpageBacktracking from its pre-election announcement on scrapping the Chinese-funded port city in Colombo, the Sri Lankan Government on Thursday said it would go ahead with the $1.34-billion project.
According to Cabinet spokesman and Health Minister Rajitha Senaratne, a report on the environmental impact of reclaiming land near Colombo’s beachfront said “it [the project] was fine”. The impact of the development of the area will be assessed later as “there was more time”, he said, addressing media persons. The decision comes less than two months after Prime Minister Ranil Wickremesinghe announced, prior to the country’s January 8 presidential elections, that the massive port city project would be scrapped due to concerns over possible environmental damage to the island’s coastline.
At that time, Mr. Wickremesinghe's remarks came as good news to sections in New Delhi that had been rather concerned about Sri Lanka’s apparently growing proximity to China. New Delhi conveyed its “serious concerns” to Colombo, after a Chinese submarine docked at the Colombo Port twice last year.
Asked if the newly-formed government had not been aware of the environment impact assessment report then – readied prior to the inauguration of the port city project in September 2014 – Minister Senaratne said: “Certain people were not aware.”
The port city — Sri Lanka’s single largest foreign investment inaugurated by Chinese President Xi Jinping in September 2014 — is coming up near Colombo’s container terminal, also built by the Chinese. China’s agreement with Sri Lanka enables it to gain ownership of a third of the nearly 580 acres of reclaimed land where the port city is to come up.
The project, Mr. Senaratne said, will be further discussed when President Maithripala Sirisena travels to China in March, soon after Prime Minister Narendra Modi wraps up his visit to Sri Lanka.
Under former president Mahinda Rajapaksa, Sri Lanka appeared to be moving closer to China, which invested heavily in the island’s infrastructure following the war, primarily by way of loans. Just ahead of the elections several members of Sri Lanka’s then joint opposition, which has now formed the government after unseating Mr. Rajapaksa, were publicly questioning this perceived “over-reliance” on China.
Mr. Senaratne, who also announced other cabinet decisions, said a special presidential task for on reconciliation has been set up to look into cases of persons being detained for many years. “The government is considering releasing 275 Tamil prisoners,” he told reporters.

The common opposition government looked strong and stable when they started. Although Mr. President seems committed and sincere, the common platform appears cracked and shaky which the MR group is trying to thrive on! Firstly the different groups have different agendas! The UNP will love this victory by proxy, and try to edge out the others! Already we are not sure of the position of Gen. Fonseka and CBK, VenSobitha or some Muslim groups etc? Any idiot should know that the UNP would never have come to power for decades (to come) if not for the common platform! MR group knows it.
MaithriIt is not SIMPLY removing the RRR FAMILY from their seats that matter, but understanding that they are still alive and kicking. First understand that they have their relatives and friends who are temporarily dangling from their power bases. They still have officials who were (are) corrupt and made money for the family while pocketing small (relatively) change, other officials who made money or wielded power! Names like the despicableKshanika Hirumburegama is sitting tight on Rajiv W‘s lap while FUTA is screaming without any response. It was interesting to see the smiling Hirumburegama at the Independance celebration. Some of the secretaries and Samurdhi officials are wolves in sheep’s clothing. The former NCPA Chairperson was reappointed after she worshipped the Minister and influence from a lawyer from Polonnaruwa. Fortunately sanity prevailed and was removed. However, she is still giving orders to some of Namal‘s Nil Balakaya appointees and a NCPA lawyer as to how it should go obviously for the benefit of MR towards 100 days!

What was the gift Gamini Senerath gave her daughter as a wedding present? A gift like what Duminda Gave Gota‘s son! A consultancy given to a lady an associate of PB Jayasundera in the Tax office still prevails??? What is ourRavi K doing about it???
What has happened to secretaries and officials who even got on platforms or arranged meetings to ‘MEET THE PRESIDENT’ at dinner or breakfast meetings at venues like Hilton and Galadari / Taj like 10 days or so before the election? Are these meetings legal under election laws? Who paid the bills? Ministries or Divi Neguma loose cash? Are these officers legally and officially accountable? Are the relevant Ministers, PM or President going to order investigations? Or are we going to sweep it under the carpet and allow the rot to restart?
Some trade unionists working in government especially in the Health sector openly canvassed for MR. They probably have their files with SB or tax files to hide!!
All these guys and gals are still hovering around ministers sucking them to the extreme! ‘yes sir/madam no sir/madam three bags full!’ We have seen this before and will see it in the future. One thing is for sure! These Leeches, and Vavulas (bats) will hang on to anything that suits them, opportunists who will suck blood irrespective of the colour of the skin black, brown, white or yellow as long as there is blood. On one hand these blood Suckers are so ‘flexible’ and may be suitable to all politicians, since they will/can do similar dirty /corrupt things for the new ministers??? Think of these same guys who were UNP stalwarts in the yesteryears, then overnight became CBK henchmen and then MR, and now MS!!! These lizards also change colours like politicians: no wonder one of the same kind.
Are we serious about ‘YAHA PALANAYA’? Or is it just a 100 day honeymoon wanting an orgasm for those in governance? Are these people calculating the odds? Are we seriously thinking and planning for at the end of 100 days? I pity Mr. President, he has to be a great juggler to manage all these balls! I hope he is not depending on Ranil and Co. alone? Already some ministers are talking out of tune, forgetting unity!
Whatever said and done MR got 55% of the Sinhala Buddhist vote! In the General Election MS & Co. will not get Tamil and Muslim seats! Then MR will be a winner with or without the minorities who will then try to get their pound of flesh! The 55 % Sinhala Buddhist vote has to be reduced! Exposure of corruption alone will not shift the vote! Proving it and sending people to jail in 100 days is not possible! All those who did not jump because of files cannot be prosecuted for the contents in the files or how can Mr. President get a 2/3 majority? Of course the big diehard sharks don’t matter they have to be prosecuted! What about people likeBasil, Namal, MR and the rest of the family?? One can afford to get rid of Sudu Putha alias Duminda. Mervin is trying to play it safe. Is he he going to be a Crown Witness??
Don’t under-estimate MR and Co. They are now free to strategise with vengeance! They have money to buy people! Already new web sites are popping out against the government. OVER TO YOU MR. PRESIDENT! But don’t block those sites!
