Probe Into Irregular Appointment Of VC Without Further Delay: EUTA

The Eastern University Teachers Association (EUTA) while criticizing the delay on the part of the University Grants Commission and the Higher Education Ministry to take action against the illegal appointment of the Eastern University Vice Chancellor, has urged the authorities to take immediate action against the misappropriations committed by the VC during his tenure which is due to expire on February 12.

Issuing a statement on the issue, the EUTA President Dr. T Jayasingam and Secretary Dr. KE Karunakaran have pointed out that although the main slogan of the President during his campaign was to establish good governance, the government’s delayed action against academic fraud and politicized appointments is disheartening.
They have pointed out that the appointment of the EU VC Dr. K Kobindarajah despite being a Canadian citizen and an official who was under vacation of post should have been probed into immediately.
“His application should have been rejected during the selection process. But instead it was accepted by the Registrar and the competent authority of the EU at the time. Thereafter the former Higher Education Minister SB Dissanayake called for the Council to vote for him although the majority of council members had not even seen him before,” he said.
Earlier the EUTA compiled a document of 160 pages on the malpractices of the VC and of the irregularities of his recruitment process which was submitted to the UGC and the Higher Education Ministry but until this day no action has been taken on the matter.
The academics have pointed out that the UGC needs to be reviewed for its inefficiency, the politicization and for their ignorance of the issues because when the Registrar checked with the UGC whether a foreign citizen can apply,she had replied with a yes.
The academics of the Eastern University have therefore urged the relevant authorities to strip the VC of the position as an illegal appointment and to probe into his malpractices and abuses of power before he leaves the country after his term expires in a few weeks and hold him accountable for the actions.

Avant Guard have a secret dealing of weapons smuggling to the rebels in Eritrea and Somalia ?


LEN logo(Lanka-e-news- 25.Jan.2015, 11.00PM)  I have seen that they have having investigations for the Ship Security (Sea Marshals) operated by the Avant guard Sri Lanka. Once I was sailing from Singapore to Safaga, Egypt (Red sea Port) through south of Galle, Sri Lanka. 2 foreign mercenaries boarded with semi automatic weapons. Off Galle at sea, due to the bad weather the Supply Tug “Mahanuwara” (Sri Lankan registered vessel) could not come alongside our ship and they used a Sri Lanka Navy attack vessel from Galle (SLNS Dakshina base) to transport these mercenaries. (Not sure if they charged any fees for this)
Another sea voyage in same route, we had two mercenaries board our vessel from the Tug “Mahanuwara” at sea off Galle. Most of these mercenaries are American, Israeli and Russians. I am sure they are in the spy services which might jeopardize the Sri Lankan national security. They told me that they were flown in to Sri Lanka and transported by a VIP vehicle and stayed in a hotel off Galle until they board merchant vessels off Galle. (They arrive on tourist visas) Some foreign mercenaries even work on Supply Tug “Mahanuwara”, without proper crew visas. Under the merchant shipping act they are not able to work in a Sri Lankan flag vessel without the proper approval of the merchant shipping director or the defense ministry and immigration authorities.
It is also notice that when these mercenaries board these merchant vessels they bring large cargo compartments which they do not want to declare. What I have heard from the crew is, that they carry about another 20-30 semi automatic weapons. When we enter red sea passing Somalia, they discharge all of these cargo compartments with the weapons and mercenaries disembark the ship. This is done to a small vessel off Aseb, Eritrea. Aseb is a port city in the Southern Red Sea Region of Eritrea. I am sure they have a secret dealing of weapons smuggling to the rebels in Eritrea and Somalia.
When those rebels who board the ship usually come and have a meal in the ship before they carry those mercenaries and weapons. I have met few of those rebel leaders who came on board the vessel for foreign cigarettes and Scotch whisky.  They told me that they have a secret deal with the Sri Lankan government through Avant guard security and most of the Avant guard directors have travel to African continent to meet their rebel leaders. Most of those Avant guard directors are high ranking ex and current military officers from Sri Lanka. You could verify this matter if you check Avant guard security director’s passports and why they have travelled to those countries.
Most leading International merchant ship companies like to employ armed security officers when transiting in or near Somali waters to prevent pirate attacks. Now a days pirates know exactly which ship is carrying armed guards (Amazing) and they do not attack those ships. They have good network with all the corrupted governments and private security companies. Director Ex Sri Lanka Navy Rear Admiral Lakshman Illangakoon (Southern Navy Commander) has deleted all the African trip visit photos from his face book recently.
Merchant Ship Captains and the crew sign a confidential declaration with the ship owners and legally they cannot disclose any information regarding this matter.

The government is proceeding with its 100 Day programme that President Maithripala Sirisena presented as part of his election manifesto.  This plan promised a national government and new cabinet with UNP Leader Ranil Wickremesinghe as its Prime Minister after the presidential election.  It also contained a promise to change from a presidential to a parliamentary system, to repeal the 18th Amendment, to come up with a 19th Amendment to the Constitution, restoring independent commissions, setting up a national advisory council and also presenting an interim budget.  The detailed plan also included setting up a special investigatory mechanism to probe corruption and passing legislation on right to information and a new health policy. 

Lawyers to boycott appearing before Mohan Peiris

Lawyers affiliated to the Bar Association of Sri Lanka (BASL) have decided to boycott cases heard in the Supreme Court, presided over by the 44th Chief Justice Mohan Peiris.
The Executive Committee of the BASL took this decision on Saturday (24).
Chairman of the Standing Committee on Rule of Law of the BASL and Convener for Lawyers for Democracy and Lawyers' Collective, Lal Wijenayake. .added that lawyers have stated that they do not want their cases in Supreme Court taken up before any Bench comprising Peiris.
Peiris has agreed to resign and retire but he is now putting forward conditions, he remarked.
"Now he is bargaining because he knows that there is a lacuna in the law with regards to removing him. This can only be done through an impeachment, a process which would take three to four months at the very least. His conditions imposed on the government include wanting to be made an Ambassador. Thus, the attorneys have decided to not appear in the Apex, superior Court of the Supreme Court when the cases of which they are the legal counsel are taken up in the presence of the incumbent Chief Justice," Wijenayake explained.

The 17th Amendment is to be re-introduced. But it is necessary to make some amendments to it to preserve the rationale for such an independent Commission like the previous Public Service Commission. To ascertain the rationale for such an independent Commission for recruitment, promotion and discipline of public officers one has to go into the theory and practice in countries like the UK and USA. In USA the spoils system prevailed under which the president and the ministers appointed the officials to the public service not on merit but on political affiliation and loyalty. They used the power to favor their party supporters and in the process ignored the principle of merit in appointments and promotions. In 1872 the New York Reform League consisting of citizens campaigned for the principle of merit and following the UK practice demanded the setting up of an independent Civil Service Commission. Their agitation led to the enactment of a law in 1883 and the setting up of the Civil Service Commission.

From the beginning its scope was limited to that of maintaining the merit principle in appointments, promotions and protecting public servants from unfair exercise of power by the President or his Ministers. It was realized that personnel administration was a part of executive management and that the heads of Departments should exercise these powers themselves but be required to follow the principles of merit in appointments and promotions and fairness in discipline. It is intended to protect the public servants from the politicians who are the Executive, be they presidents, prime ministers or ministers who want them to carry out illegal or unethical decisions. Public officers in the higher ranks have enough experience of the excesses of executive powers. Several public officers have in their routine work been requested to ignore the law, delay the law or wink at it. It is in this way that the attack on good governance takes place. Human beings are not angels and they are not governed by angels as observed by James Madison. So in the interests of good governance and the upholding of the rights of the citizens vis a vis the State, the protection of the public officers is necessary. This is what happened after 1956 when politicians started dictating to public officers irrespective of the law and principles of good governance. So the rationale for an independent Commission is purely for the upholding of the merit principle and the protection of the public officers from unjust actions of the Executive. The threat to the merit system comes from politicians including the president or prime minister or the ministers.Read More

Retired Brig. Duminda Keppetiwalana of the Sri Lanka Army, connecting with us via telephone with regard to the article published by our website on January 24, told us the following.
We are publishing same as per the right to reply open for parties mentioned in our articles.
“It is incorrect to say that intelligence officers under me, as the commanding officer of Colombo, had given information regarding the movements of ‘The Sunday Leader’ editor Lasantha Wickrematuga, as reported by Lanka News Web. I entirely reject those allegations.
Gotabhaya Rajapaksa and military officers loyal to him made a big attempt following the defeat of Gen. Sarath Fonseka at the 2010 presidential election to blame the murder on him. Soon after the election, they kept me for three months under detention orders, exerted intense pressure on me and my family members, to obtain a confession from me after blaming the killing on me. But, I was not prepared to accept responsibility for something I had not done. In the end, they had no option but to release me. I was arrested by the then IGP Mahinda Balasuriya, who is also a relative of mine.
On 30 January 2010, nearly 12 senior military officers, including me, were sent on retirement by president’s secretary Lalith Weeratunga on the instructions of president Mahinda Rajapaksa. Thereafter, I went overseas for employment. Five years later, I returned with the hope that justice would be meted out. But, it was saddening that instead of justice, we had to respond again to the false allegations leveled against us by the Rajapaksa regime. In operational duties, I was a frontline officer of the infantry troops. I will never bow my head to injustice. If I am given a chance, I am prepared to carry out my obligations by the motherland again.”
Published below are two letters sending him on compulsory retirement.

We never said Brig. Duminda Keppetiwalana was linked to the Lasantha Wickrematunga murder. What we said was that the military intelligence under him had supplied information to the underworld. It was not a fabrication by us, but verified in CID investigations. We only reported it.
But, here we have to believe Brig. Keppetiwalana, because we too, accept that had he given the information, he would not have been spared by Gotabhaya. We are reiterating to him that what we did was reporting only. However, if his family or he has suffered pain of mind or damage to reputation, our editorial expresses its deep regret.

CID investigations have revealed that a paramilitary group comprising members of the Army and the underworld had murdered ‘The Sunday Leader’ editor Lasantha Wickrematunga on an order by former defence secretary Gotabhaya Rajapaksa.
Intelligence personnel serving under Brig. Duminda Keppetiwalana, commander of Colombo at the time, had provided information regarding the movements of Wickrematunga under the plan to kill him.
A deserter of the Special Forces identified as Galabada alias Thappara Katta had knifed the senior journalist to death, CID investigations point out.
He is the same person who had gunned down Bharatha Lakshman Premachandra, the trade union affairs adviser to the former president. Four days prior to the shooting incident, the high court had released him on bail. He had carried out criminal contracts under MP R. Duminda Silva. He has disappeared thanks to the white vans gang in order to cover up the murders forever.
Certain military personnel will expose those who had masterminded these killings, say our sources. The CID has resumed these investigations that had been stalled during the previous regime. CID officials say there is an attempt to transfer the investigators in order to hide these investigations once again.

Such conduct was not seen during the tenure of President Jayewardene or Kumaratunga. President Rajapaksa seem to have pioneered worshiping tarmac, Tree worshipping of this nature and took astrology to new heights.
Is President Sirisena following in the foot steps of President Rajapaksa? We will let our readers judge if the voters have bought Old wine in new bottles.

The deprivation of liberty under national security laws: What can be done to provide immediate relief?



GroundviewsDuring the past fortnight there have been many calls for the immediate repeal of the Prevention of Terrorism Act (PTA). Given the fluid and complex political context, and the upcoming parliamentary elections, it appears unlikely this will happen in the short term. However, there are a number of immediate measures the government could implement to illustrate its bona fides, and begin the process of re-building a relationship of trust with citizens, particularly Tamil speaking persons who constituted the majority of those arrested under national security laws. In addition to immediately reviewing the cases of those in detention and remand, and either releasing them or filing charges based on credible evidence, one of the other measures that could be taken is rescinding regulations issued under the PTA in August 2011 following the lapsing of the state of emergency.

Foreign trips for Gota loyalists still!

gota 1 26Despite a change in government, loyalists of former defence secretary Gotabhaya Rajapaksa are still enjoying special privileges, say Army sources.
A case in point is Maj. Gen. Sumedha Perera’s participation in a seminar in Bangladesh on January 19 on Sri Lankan peace keepers. The one time military spokesman publicly engaged in politics in breach of army and elections acts and promoted Mahinda Rajapaksa at the presidential election.
The situation is the same at the UDA, which once functioned under Gotabhaya Rajapaksa. Its director (western) G.W.G. Abeygunawardena is to be appointed the director general. Deputy director Prasad Ranaweera and Priyashantha of the housing division, who also engaged in politics openly, have established their positions under the new government too, say UDA sources.

Questions To USJ Senate On Namal Rajapaksa’s ‘Dodgy’ PhD Attempt

There had been a number of stories about a PhD program by Parliamentarian Namal Rajapaksa at the University of Sri Jayawardenepura. As published by Colombo Telepgraph earlier, the junior Rajapaksa has been successful in securing the senate and academic council for this program.

The University in its Senate Report 316.08.05 said that it has approved the candidacy of Lakshman Namal Rajapaksa for a PhD program under the registration number 1805SS2011001 for a research on a study on the Social Cultural Factors influencing Child Sex Abuse in Sri Lanka under the supervision of Prof N L A Karunaratna who was the former Vice Chancellor of the university and Prof M W Jayasundara, the Dean of the Criminology Department of the university. The appointed examiners are Prof Sarath Amarasinghe of the Ruhuna University and Prof Daya Amarasekera of the Peradeniya University.
As far as Colombo Telegraph understands Namal Rajapaksa does not possess with necessary qualifications to pursue a PhD study. According to university sources, even his basic degree is in question.
Thus, the Colombo Telegraph would request the university senate to respond to us for the following questions;
  1. Did Lakshman Namal Rajapaksa provide his necessary qualifications to pursue a PhD Program ? If so what are the provided qualifications
  2. Did the university counter-check the provided qualifications by the candidate?
  3. Does the university conduct MAQ examinations on annual basis for all applicants? If so when was the MAQ exam held for the years 2013 and 2014?
  4. Did Rajapaksa sit for a special MAQ exam conducted by the university only for him?
  5. What are the qualifications to sit for a MAQ exam and does Rajapaksa have those qualifications? If so please provide us with the details.

A former Tamil newspaper editor N. Vithyatharan, who was abducted in February 2009 by armed men in notorious ‘white-van’ has given his consent to cooperate with the new government’s probe into the scores of white van abductions and extra-judicial killings, blamed on former Defence Secretary Gotabhaya Rajapaksa.
White vans had become a hate symbol because they were used by “unidentified gunmen” in the abduction of political opponents, dissidents and journalists during and after the war that ended in May 2009.
“A top minister of the new government asked me whether I, being probably the only survivor of the white van abductions, could co-operate with the probe into the white van abductions. I have given my consent to share my bitter experience and all what I know in that regard,” Vithyatharan told Colombo Mirrorvia phone late Friday evening.
“I have nothing to hide and have no reason to hide too,” he said.
The new government of President Maithripala Sirisena has vowed to expose all misdeeds of the previous government of deposed president Mahinda Rajapaksa, who has also been accused to have tried an unsuccessful military coup on the next day of the election in a desperate bid to stay in power.
Last week a former cabinet minister, Mervyn Silva filed a fresh case with the Criminal Investigation Department claiming that deposed President Mahinda Rajapaksa’s brother and former defence secretary Gotabhaya Rajapaksa was the author of numerous white van abductions and the extra-judicial killings, including that of ex Sunday Leader Editor Lasantha Wickrematunga.
Demanding the CID to conduct thorough investigations into all these cases, he said he has provided adequate details to back his claim against Gotabhaya Rajapaksa in this regard.
Although Vithyatharan was abducted, with police initially denying knowledge about his whereabouts, the Colombo Crimes Division (CCD), which was functioning under Senior DIG Anura Senanayake, few hours later, claimed that he was arrested and held for questioning for allegedly “assisting the LTTE to carry out the air attack on February 20″.
It was later revealed that the then Indian Foreign Secretary Shiv Shankar Menon, who was in Colombo on an official visit on the day of the incident, had mounted an immediate pressure on President Rajapaksa to ensure the safety of the veteran Tamil journalist.
The 56-year old former Editor of Uthayan and Sudar Oli Tamil newspapers, was abducted on February 26 around 9.30 am while attending a funeral of a family relative at Mahinda Florists, Mt. Lavinia. He was accompanied by his family as well as the Managing Director of Uthayan and Sudar oli newspapers E. Saravanabavan, who is now an elected parliamentarian of the Tamil National Alliance (TNA) from Jaffna.
According to eye-witnesses, at least six armed men (three in police uniform and others in civvies) alighted from a white van and dragged Vithyatharan from the funeral parlour, bundled him into the van and sped away. The crowd attending the funeral had tried their best to hold Vithyatharan back, but was overpowered by the armed men. Although the men in police uniform had told the crowd that he was being taken for questioning to the Dehiwela police station, the van had fled on the opposite direction.
It was incidentally a day before that Vithyatharan was interviewed by an Australian television journalist, in which he has said that the media freedom in the country was at its rock bottom and he being a journalist was not too sure whether he would “return home alive”.
“My management and I have decided to stay here and fight for the rights of the people. This is the crucial time and the journalists have to act prudently on behalf of their people,” he said.
Coincidentally, the same television journalist had a pre-booked interview with Gotabhaya Rajapaksa barely a couple of hours after Vithyatharan was abducted.
Mentioning Vithyatharan’s name, Gotabhaya Rajapaksa provoked “surprising response”.
“He is involved in the recent air attacks. I am telling you. If you try to give a cover up for that person, you have blood in your hand. We have definite information on that. If somebody tells, he was arrested for media, that person has also blood (in his hand) for innocent civilians died in Colombo. Good thing that you asked for that. I am telling you with responsibility that he is a terrorist. He is in-charge…he is responsible for things co-ordinating the air attacks in Colombo. I will arrest…We have arrested him and it is the right thing to do. We will take legal action against him,” he said.
However, Vithyatharan was released two months later by a Colombo Court on April 24, 2009 without any charges against him.
