Investigating Corruption; Fairness & Justice Must Be Ensured

The JVP deserves the gratitude of the people for taking up matters withregard to the corruption indulged in by the Ministers of the previous regime before the Bribery & Corruption Commission. But it is unlikely that the Bribery Commission can go into the allegations since they lack the necessary technical staff to investigate such allegations. Several of the allegations refer to economic crimes.
JVP Complaint
 The Petroleum Corporation is accused of importing inferior petrol. They are accused of entering into hedging transactions which caused enormous losses which had to be settled in foreign currency. There are allegations of corruption in the construction of the Expressways at excessive costs. The EPF is alleged to have bought shares on the Stock Market at excessive prices which were not worth. All these require a sound knowledge of economics and the ability to understand markets and not only spot markets but also forward markets and options. The policemen or lawyers from the Attorney Generals Department do not understand or have a perspective on such situations and matters.
In the UK they set up a Serious Fraud office which deals with economic crimes and the office uses the services of professional persons including economists, accountants and bankers who analyze market data and advise the prosecutors. Can we do without such professionals to handle these corruption allegations? There is also the mitigating fact that the original decisions cannot be judged from hindsight. They have to be judged in the circumstances given the knowledge of facts and circumstances then available. They cannot be judged from hindsight. It is necessary also to consider the prevailing risks and uncertainties which prevailed when the original decision was taken.

COLOMBO:  In his first television interview since the results of the elections, Sri Lanka's new Prime Minister Ranil Wickremasinghe told NDTV that his government will redress the pro-China tilt of the Rajapaksa regime

"President Rajapaksa's regime tried to play China against India and India against China but it came a cropper," said Mr Wickramasinghe. 

During the Rajapaksa years, China invested an estimated $6 billion in Sri Lanka, some of it in strategic infrastructure projects like ports and airports, irking India. 

But Mr Wickremasinghe told NDTV, "We are looking into all foreign contracts and local ones, and where there is corruption we will certainly ensure we take action whether it be Chinese or any other country. 

In particular, he turned his guns on a $1.5 billion Port City complex, being built by the Chinese on the Colombo seafront. 

"We are also reviewing the Port City project", he said, "Because we have not yet seen the feasibility study and the environment impact assessment. I asked when I was with the opposition, in Parliament, but the government didn't help. Therefore we will have to look into the environmental and feasibility aspects."

Sri Lanka's economic dependence  on China has left it heavily in debt, with almost $6-7 billion owed to the latter.

But the country's Foreign Minister, Mangala Samaraweera is confident of a solution. "I'm sure being old friends we can work things out together," he said.

Move to make another corrupt man as CID director!

mahesh peraraHonest officers in the CID are concerned by a move to reappoint SSP Mahesh Perera, a corrupt policeman, as director of the CID, say the department sources.
SSP Perera is the drinking partner of Maj. Neville Silva, the most trusted man and the chief security officer of former president Mahinda Rajapaksa, and he was notorious for having led the CID to serve the wants of the Rajapaksa regime.
Prior to the election defeat, Maj. Silva was a regular visitor for SSP Perera at the police mess, say senior policemen.
It is well known that SSP Perera made every attempt to cover up the Bharatha Lakshman Premachandra murder probe and to save the suspect, Duminda Silva.
During the probe, he had threatened SP Shani Abeysekera, who led the investigation, that he would be transferred to Jaffna if he tried to be too smart. As he had disregarded the threat, SP Abeysekara was transferred by SSP Perera from the CID to the Homagama police division.
That was the result of SSP Perera’s having got Maj. Silva to carry tales against SP Abeysekara to the president. However, due to strong opposition from within government ranks, the IGP was forced to return the investigation to the hands of Abeysekara.
SSP Perera goes to all casinos in Colombo, which he frequents in the nights before retiring for the day. He is notoriously known in the police department as a game-dealer. Police drivers deployed as his driver have to stay awake at Colombo casinos until early hours of the mornings.

Tributes are being authored about him by the same Colombo media that was sycophantically lauding Rajapakse just weeks ago.

Police again under defense ministry ignoring good governance:Mahinda Balasuriya still a clinging leech


LEN logo(Lanka-e-News- 16.Jan.2015, 11.55PM) The police force , an important department which contributes to good governance of the new government has been brought under the defense ministry again via a gazette notification No.1896/28 dated 10 th January ( appended herein).
The police department was earlier under the defense ministry , but based on the recommendations in the LLRC report , it was brought under the purview of the new ministry of law and order that was created subsequently. If good governance is to prevail, the police department should be converted into a public service instead of being a part of the security forces. In advanced countries, the police force is under the city mayors as a department promoting and maintaining law and order among the public .
In any event under the deposed Rajapakse regime the secretary , first appointed to the ministry of law and order under which the police force was brought under was Nanda Mallawarachci , an officer of the forces. Later, after removing him Mahinda Balasuriya an ex IGP of the police who became notorious for shooting and killing an unarmed citizen was appointed as the secretary to the ministry of law and order. While there were so many having powers , it was brutal Gotabaya Rajapakse who gave the orders .Moreover , Balasuriya himself admitted having committed the murder and resigned his post as IGP at that time.
In other words , the police department has once again been brought under the purview of the defense ministry unofficially, and it is caught between the devil and the deep blue sea, being compelled to take orders from both sides.
It is not possible for those who are advocating good governance to justify this action by saying the police department under the defense ministry is a solution . In the circumstances John Amaratunge who is the newly appointed minister for peace is in a quandary. Though he believed that the police were under him , that has not been the case.
Mahinda Balasuriya has not given up his post and is still continuing in the ministry performing duties. He even gave orders to the police chiefs during his holiness Pope’s tour of Sri Lanka (SL). On the 12 th too he was in his official cubicle issuing directives to the police officers.
According to Gazette notification extraordinary 1896/28, the police department is under the state defense ministry , and its secretary is B M U D Basnayake.
Apparently , Balasuriya is ignorant of the law that following he appointment of the new President and the Prime minister thereafter , all ministries stand dissolved , and the posts of secretaries have to be vacated. Consequently , in such a situation this officer continuing in his office with the stubbornness of a mule has sprung a rude shock among all.
We shall be failing in our duty if we do not reveal the names of the most corrupt officers in the ministries of defense, and law and order .They are hereunder :

Sri Lanka votes against fear and kleptocracy

After a decade in power, Sri Lankans chose to hold Rajapaksa accountable for extensive corruption and nepotism, and for presiding over a climate of intimidation. His relatives and cronies dominated key ministries and institutions, and abused their powers to raid the public purse and silence critics. One-family authoritarian rule under the Sri Lanka Freedom Party did not pass public muster and despite the challenger’s late start and lack of resources, democracy prevailed.

The attempted coup following Sri Lanka’s presidential election by ousted incumbent Mahinda Rajapaksa, was spoiled when his long-time allies switched their loyalty. Many of those who went over to the opposition had supported the murderous war against the Tamil minority in the past. In the aftermath they either watched in silence or gave vociferous support to Mahinda in his attempt to bury the truth about what happened during the war. Likewise his accumulation of dictatorial powers. What stuck in their craw was not so much Mahinda’s bloody record against Tamils and Sinhala workers and poor, but the concentration of power in the hands of his family. The benefits of Chinese investment and economic gain have not been shared out among the political elite and the capitalists; instead swallowed up by one family and their cronies.

It is not, however, a surprise that the new Maithri government is in a way protecting the Mahinda family from any war crimes accusations. We could throw number of questions at Maithri and Co. Why are you still hiding the details of the attempted coup? Why didn’t you reveal the details of the whereabouts of ex-defence minister Gotabaya Rajapaksa and other members of Mahinda’s family? Mervyn files complaint with CID against Basil, Gotabaya

Former Minister Mervyn Silva today lodged a complaint with the Criminal Investigations Department (CID) against former Economic Development Minister Basil Rajapaksa and former Defence Secretary Gotabaya Rajapaksa.
Speaking to reporters outside the building, the UPFA MP stated that the complaint is regarding alleged criminal activities which had taken place under the previous government and that he has handed over evidence to support his claims.
The controversial politician, who was the Minister of Public Relations and Public Affairs under the UPFA government, said that he is not seeking revenge and that, however, Basil and Gotabaya did extract revenge from him.
Silva accused the former Defence Secretary of being involved in several high profile assassinations carried out in the country in the recent past and also blamed him for creating the ‘white van’ culture.
The former minister said that he could lose his life over his allegations, but said he is willing to die proudly after revealing the truth and declared: “If I die it will be as a lion, not as a fox.”  
He stated that of former President Mahinda Rajapaksa, who ended the war, had established good governance, Maithripala Sirisena would have not left the party.
Silva also expressed his strong belief that President Sirisena and Prime Minister Ranil Wickramaginshe as seasoned politicians would usher in a new era in the country with good governance.

I was watching a political ‘debate’ on a private TV channel last night, but got entirely confused and frightened. What used to be a heated debate earlier has turned out to be a non-debate, where all participants were taking a common stand having a free ride.
Will this happen in Parliament also?
I strongly felt that the programme was missing something – what was it? An Opposition. Where are the counter arguments? Who maintains the checks and balances? Who plays the watchdog role?
But isn’t it the reality of the day? Where is the Opposition? Or who is the Opposition? And what are the guarantees to ensure that this phenomenon will not transpire in Parliament when it convenes next week?
The entire electioneering process focused on one cardinal slogan – democracy and good governance,
which require a strong functioning opposition who keep checks and balances on the government. All
political theories envisage the need of a healthy opposition for a strong democracy.

In fact one could comfortably argue the fact that the previous regime played so called havoc due to the absence of a strong opposition. The UPFA had a comfortable playing field with a two thirds majority and a weak opposition for the past five years. Only a few fire-brands like Anura Kumara Dissanayake, Sujeewa Senasinghe, Harin Fernando and even Ranjan Ramanayaka were left on the floor. Dayasiri Jayasekera was bought over and it was a major blow to the Opposition.
But my confusion is mainly about the role of Opposition in the current political landscape. The usual practice is the loosing team sits on the Opposition but who is the looser here? For my own reading as of today the only looser is the Rajapaksa clan, but not the UPFA or SLFP for that matter. Of course it was a race between two candidates – Mahinda and Maithree and Maithree won. Then the Mahinda camp should play the role of Opposition. Even with the post-polls individual cross overs which would provide the new Prime Minister with necessary numbers, there should be a visible Opposition that should provide the balance of power within the House.
But the current political trend suggests otherwise. President Maithripala Sirisena has won another battle of gaining the control of SLFP. Though he vowed to fight back just after the defeat, Mahinda Rajapakse has accepted the reality and decided to step down. Thus, SLFP President and UNP Prime Minister.[We had a similar situation in 2001 but in a different context then when Ranil and Chandrika were arch rivals]. According to some internal sources SLFP may also contest under the Swan symbol at the forthcoming general elections. If this is true, there will be another battle for nominations between the two major political forces and it will be more fierce if it is going to be under the new electoral system.Be that as it may, my worry is the way of securing a strong Opposition even during this 100-day period and also in the next Parliament.
One could argue on the validity of an Opposition when there was going to be a national government as had been envisioned in the Maithree manifesto. But please do not forget the fact that national government does not mean a one-party [or one coalition] rule which undermines the basics of democracy in which an Opposition is a must.
The old Communist and Sama Samaja Party stalwarts have already voiced their opposition against any UNP-led government. But would these Dinosaurs form a strong Opposition within and outside the House?
JVP Role
The obvious choice would be the JVP. They had a strategic stand during the campaign process where it never openly requested whom to vote, but stood strongly against Rajapakse. Also JVP, particularly its current leader Anura Kumara Dissanayaka has managed to regain its lost glory and win the trust of many of its listeners. Of course, it is an undoubted fact that JVP was a leading force in defeating Rajapakse. People would not vote for the JVP in millions but millions would listen to them before voting to others. Thus their voice does matter and its political machinery at grass root level is still effective albeit the defection of the Gunaratnam group which was exposed as a Rajapakse mouth-piece during the last presidential polls. JVP had a challenge from the Sarath Fonseka camp of becoming a third largest political force in the country, but I do not think that factor is valid anymore.
In a peculiar scenario where the two major political forces come together and others like Hela Urumaya and Sarath Fonseka, too, joining the same platform, the non-corrupt JVP would have a better opportunity of leading the opposition camp. With Anura’s leadership, to my mind, they would do a better job in keeping checks and balances provided they receive sufficient numbers in the next Parliament. But it should have a good bargaining deal with TNA for the post of Opposition Leader for which Anura Kumara would be the ideal candidate. Too much of hypothesis?

But, our country is fortunate,” he said while having tea with the SLFP seniors, who had been waiting for the arrival of president Maithripala Sirisena. At that time, the former president, too, had been in a different room at the speaker’s residence. The party seniors listened silently in approval to what the speaker told them.

Bar Unanimously Calls For De Facto CJ Pieris To Step Down

The Bar Association of Sri Lanka today called upon De Facto Chief Justice Mohan Pieris to step down from the position.

“At an emergency meeting of the Executive Committee of the BASL, which was attended by close to 90% of its members, it was unanimously decided to issue a statement calling for the resignation of Chief Justice Mohan Pieris in order to preserve the honour and integrity of the Judiciary in view of the grave and continuing damage being caused to the entire Judiciary as a result of the recent events and uncontradicted reports that Mohan Peiris, while functioning as Chief Justice, was at Temple Trees from prior to dawn of 09th January, 2015 at a time when election results were being announced and political and executive decisions were being taken.” Upul Jayasuriya told Colombo Telegraph.
