National Executive Council meets today

The National Executive Council to be established to bring in essential constitutional amendments and create good governance in the country will be convened today (15th) at 5.00 p.m. say reports.
The JVP proposed the establishment of the National Executive Council targeting the urgent reforms that should be carried out as a part of the 100 day programme of ‘Maithri’ administration. All parties agreed to the proposal and it would be convened today.
Leaders representing all political parties and representatives of several civil organizations are expected to participate. President Maithripala Sirisena, former president Chandrika Bandaranayke Kumaratunga, Prime Minister Ranil Wickremesinghe, the Leader of the JVP Anura Dissanayaka, Ven. Athuraliye Rathana Thero representing the JHU, M. Sumanthiran representing the TNA, the Leader of the SLMC Rauff Hakeem and the Leader of the Democratic People’s Front Mano Ganeshan are among those who would participate at the Council today.
At a media conference held recently the Leader of the JVP Anura Dissanayaka said the National Executive Council is a proposal by the JVP for Mr. Maithripala Sirisena’s 100 day programme.

A Law Against Hate Speech Is Urgently Required

The problem of devolution of power and the resolution of the grievances of the Tamil people have run into opposition from 1956 onwards Firstly it was the Buddhist monks who opposed the B.C Pact and the Dudley Senanayake -Chelveynayagam Agreement of 1965. There were also K.M.P Rajaratne and a motly crowd of oliticians and civil society activits who opposed rectifying any grievances of the Tamil people. They stirred up communal and religious hatred against the Tamil and Christian minorities. Recently the previous regime allowed organized groups to stir up hatred against the Muslims. All these campaigns stirring up hatred against minorities is due to the lack of a law in our criminal law which curbs hate speech although ther is a provision in our Penal Code. Articles 18 and 19 guarantee the rights to freedom of religion and expression.
True that there should be freedom of expression which is recognized by the UN Declaration of Human Rights. But even the UN Declaration of Human Rights recognizes the need to impose restrictions on free speech in the interests of others. “In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society”.
However, it is the International Covenant on Civil and Political Rights (ICCPR) which gives guidance on the relationship between freedom of expression and the prohibition against incitement to hatred or “hate speech”. Article 19 provides that:

“ 1. Everyone shall have the right to hold opinions without interference.
2. Everyone should have the right to freedom of expression; this right shall include freedom to seek, receive and impart information and ideas regardless of frontiers, either orally, in writing or in print, in the form of art, or through any other media of his choice.
3. The exercise of the rights provided for in paragraph 2 of this Article carries with it special duties and responsibilities. It may therefore be subject to certain restrictions, but these shall only be such as are provided by law and are necessary:
a. For the respect of the rights and reputations of others;
b. For the protection of national security or of public order (ordre public), or of public health or morals.”
This is qualified by Article 20 as follows:
“1. Any propaganda for war shall be prohibited by law.
2. Any advocacy of national, racial or religious hatred that constitutes incitement to discrimination, hostility or violence shall be prohibited by law.”
The wording of Article 20 also implies a not simply advocacy but advocacy of national, racial or religious hatred; not simply such advocacy, but one that constitutes incitement; not simply such incitement, but one that is related to discrimination, hostility or violence”. The injunction inherent in Article 20 is further advanced by the International Convention on the Elimination of All Forms of Racial 5 Discrimination (CERD) which adds (in regard to racial discrimination only) another Article pertinent to the discussion: Article 4, as follows:
“States Parties condemn all propaganda and all organizations which are based on ideas or theories of superiority of one race or group of persons of one color or ethnic origin, or which attempt to justify or promote racial hatred and discrimination in any form, and undertake to adopt immediate and positive measures designed to eradicate all incitement to, or acts of such discrimination and, to this end, with due regard to the principles embodied in the Universal Declaration of Human Rights and the rights expressly set forth in Article 5 of the Convention, inter alia:
a) Shall declare an offence punishable by all dissemination of ideas based on racial superiority or hatred, incitement to racial discrimination, as well as all acts of violence or incitement to such acts against any race or group of persons of another colour or ethnic origin, and also the provision of any assistance to racist activities, including the financing thereof;
b) Shall declare illegal and prohibit organizations, and also organized and all other propaganda activities, which promote and incite racial discrimination, and shall recognize participation in such organizations or activities as an offence punishable by law;
c) Shall not permit public authorities or public institutions, national or local, to promote or incite racial discrimination.”
A perusal of the laws from the region reveals that a large number of countries and territories covered by this study have laws which can be used, directly or indirectly, to prohibit hate speech in its various manifestations, although the terminology on the issue may vary. They include: Afghanistan, Armenia, Australia, Azerbaijan, Bahrain, Bangladesh, Bhutan, Brunei, Cambodia, Fiji, India, Indonesia, Iraq, Iran, Israel, Japan, Kazakhstan, Kiribati, Kyrgyzstan, Lao People‟s Democratic Republic (PDR), Malaysia, Maldives, Mongolia, Myanmar, New Zealand, Pakistan, People‟s Republic of China, Philippines, Qatar, Republic of Korea, Saudi Arabia, Singapore, Sri Lanka, Syria, Tajikistan, Thailand, Timor Leste, Tonga, Turkmenistan, Tuvalu, United Arab Emirates (UAE), Uzbekistan, Vanuatu, Vietnam and Yemen.
UK will continue to 'exert pressure and bring Sri Lanka to bear'

The British government will continue to push Sri Lanka on addressing human rights abuses said Lord Wallace, a spokesperson for the Foreign Office this week, calling on newly elected president Maithripala Sirisena to facilitate the ongoing United Nations investigation into mass atrocities.

During a House of Lords debate on Wednesday, Lord Bach had questioned whether the UK would “encourage  [Sri Lanka] to review, seriously and as a matter of urgency, the allegations that have been made about human rights abuses”, as well as “to sign up to the End Sexual Violence in Conflict initiative - "something that the previous Sri Lankan Administration singularly failed to do.”

In response, Lord Wallace of Saltaire, Government Whip acting as government spokesperson on the Foreign and Commonwealth Office, said Britain was in “regular dialogue with Sri Lanka”. He further added,

“Members of this House may not be aware how closely the British Government and their representatives work with our colleagues in the European Union on issues such as this—in Sri Lanka as in Georgia—to exert pressure and bring it to bear. There is of course the UN human rights investigation, which will continue. The UN Human Rights Council will discuss that at its forthcoming meeting in March.”

Noting Sirisena's pledge to initiate a domestic inquiry into reports of war crimes, Lord Avebury asked whether the UK will encourage Sri Lanka to facilitate the already ongoing UN investigation into mass atrocities.

Lord Wallace stated that an international investigation “has been the position of our Government for the past year,” but noted Sri Lanka had “sensitive issues of national sovereignty”.

“I am well aware of the previous Government’s resistance to the UN inquiry,” said Lord Wallace. “I hope that the new Government, as they get under way, will take a more generous approach to the UN investigations.”

Pope Francis said that religious freedom is a fundamental right of all and expressed his hopes that the Catholics of this country will make a great contribution to peace, justice and reconciliation in Sri Lankan society during the Homily of the canonization Mass of St. Joseph Vaz.
"Each individual must have the freedom, whether alone or in association with others, to seek the truth and to openly express his or her religious convictions free from intimidation and external compulsion," The Pontiff explained during his Homily.
The canonization ceremony of Bl. Joseph Vaz, the first to sainthood from Sri Lanka, followed by Holy Mass conducted by the Holy Father took place at Galle Face Green yesterday (14) with the participation of over half a million devotees according to Papal Media.

The Mayor of Colombo offered the Keys of the City to the Pontiff upon his arrival at Galle Face Green to formally welcome him to the commercial capital of Sri Lanka.
"We are called to go forth with the same zeal, the same courage of Saint Joseph Vaz," Pope Francis said, adding "but also with his sensitivity, his reverence for others, his desire to share with them the word of Grace which has the power to build them up."
Meanwhile, various celebrations in Goa will take place today (15) to mark St. Joseph Vaz's passage to sainthood 20 years after Pope John Paul II declared him Blessed, said the Archbishop of Goa.

The Sri Lankan Saint's honorific title thus will change from Blessed to Saint and the canonization will be followed by the renaming of the Sanctuary of the Blessed Joseph Vaz Pilgrimage Centre in Sancoale, Goa to reflect his sainthood.
As the revered saint hailed from Kandy, the stage in which the Holy Father carried out mass was made to the model of the Paththirippuwa (Ocatagon). Various aspects of the Kandyan Culture were also seen among the decorations of Galle Face Green.
Saint Joseph Vaz, a priest of the Oratory arrived in Sri Lanka from Goa to provide spiritual and moral enrichment to the Christians suppressed by the rule of the Dutch. He carried out his services from Kandy and reached out to various other parts of the Island until he died at the age of 59.

His Eminence Cardinal Malcolm Ranjith thanked the Pope for the gift of a Saint to Sri Lanka. "Over and above the gift of your presence on this soil, you have given us the gift of a saint: St. Joseph Vaz," he said, "For Sri Lanka now has its own saint, the Pride of Goa and God's precious Gem for Sri Lanka."
His Holiness Pope Francis will leave the country for Philippines, Manila at 9:00 a.m. today (15) after his 3 day visit to the Island of Sri Lanka. President Maithripala Sirisena is scheduled to arrive at the Bandaranaike International Airport (BIA) to bid farewell to the Holy Father.

The Pontiff is scheduled to leave the Apostolic Nunciature in Colombo at 7:30 a.m. and arrive at the Cultural Institute at Bolawalana, Negombo by 8:15 a.m. The Pontiff will be welcomed by His Eminence Cardinal Malcolm Ranjith and Fr. Quintus Fernando at Bolwalana where he will spend some prayer time in silence. Immediately following his visit to Bolawalana, Pope Francis will then pose for group photographs outside the Chapel.

Upon arrival at the BIA, the Pope will be received by the President and will bid farewell to our country before beginning his journey to Manila. The Sri Lankan three day visit the Pope made was the first Asian Visit of his Holiness's Asian Tour.

The police had visited the Jumbugasmulla house on a tip off that a lorry loaded with cash amounting to Rs. 7 billion is being kept concealed in that house . However by the time the police visited the place , the lorry and cash have disappeared.
The police nevertheless informed Lanka e news that cash in a sum f Rs. 500,000.00 was found there , and the rent for that premises is as high as Rs. 240,000.00 per month.
After Rajapakse’s favorite lickspittle and administrative crony Abeykoon was made by Maithri his secretary, and two locations of Gamini Senarath were being raided yesterday itself by the present government based on good governance , a secret discussion was held in the night (yesterday14) between Maithri and Medamulana MaRa at the speaker’s residence , based on unofficial reports reaching Lanka e news.
Chamal who since this morning acted as an intermediary in the disputes that had erupted lately has summoned those of the disgruntled group (anti MaRa) . MaRa who was remaining hidden in a room had suddenly appeared before them and somehow ironed out the differences , it is learnt. MaRa and his brothers who are most infamously famous for conspiratorial , corrupt and dastardly activities have finally made Maithri the incumbent President the hunted victim of their insatiable and bestial power greed.
During these discussions , MaRa has laid down some conditions which do not relate to the needs of his cronies and stooges , but rather the needs of his own family. The conditions are : not to mount any charges against his son Namal; and at the next elections to give the leadership of the group for Hambantota to them. MaRa had told Maithri that if he consents to these terms , his (MaRa’s) rivalry against Maithri for the post of leadership of the SLFP will be withdrawn.
Based on information reaching Lanka news , no final decision was reached in this connection between them.

Another ‘files’ operation at Sethsiripaya

An attempt to destroy a large stock of files containing information on former President and Minister of Finance Mahinda Rajapaksa, former ministers Basil Rajapaksa, Wimal Weerawansa, Rohitha Abeygunawardene and former prime minister D.M. Jayaratna’s Ministry of Buddha Sasana has been prevented by JVP Parliamentarian Sunil Handunneththi and the stock of files was handed over to the police say reports.
Mr. Handunneththi has rushed to Sethsiripaya today (15th) on getting information regarding the attempt to destroy the files.
Among the files that were to be destroyed were application forms for employment for various ministries, appointments, plans for the 2015 presidential election, information regarding Maga Neguma, Divi Neguma and on several projects.
There were also books that had been printed to promote various ministers and individuals.
Mr. Handunneththi said employees
of relevant institutions have taken a keen interest to give information regarding files.

Maithirii’s cliff hanging victory over Mahinda was greeted with relief by lovers of democracy though it looked remote before the entry of Maithiri. Maithiri provided fresh air to breathe for most of the Sri Lankan’s particularly to the minorities who were suffering in silence. Even his party members and cabinet ministers excepting his family members, were boiling with frustration and anger waiting for the opportunity to pay back Mahinda. What was the reason for Mahinda’s defeat?
Mahinda NimalMahinda was glowing with confidence to score unlimited terms of victory relying on a never winning Ranil or some else from the opposition to contest him. A wounded Chandrika manouvered to pull out Mahiri to settle her personal score with Mahinda. Ranil’s wise decision to back Maithiri jolted Mahinda who could not find any vote catching slogans to challenge Maithirii who also exposed the skeletons in the Mahinda’s cup board. The credit for the defeat of LTTE, obviously goes to Mahinda and company but he mistakenly relied on this achievement which paled into laess importance due to the passage of time coupled with his bad governance, corruption, nepotism, non-accountability for his violent political groups or persons treating the ministers and members as figure heads and non-entities with family rule by passing the rule by consensus of cabinet and member of parliament. Mahind’s sweeping anti-democratic legislations like replacing the 17th amendment and passing of the18th amendment which clothed and granted unbridled power to an already executive presidency. This high handed act of President bared his teeth and greed for more power to don the role of a dictator. Power corrupts absolutely . Absolute power corrupts absolutely. Mahinda is classic example to vindicate this statement. Mahinda’s attitude towards persons who challenge his acts or failed to toe his line were revenged and it was counter- productive end earned worl wide condemnation. Former President Mahinda won in areas outside the north, east, upcountry and the Colombo City but President Maithripala won in these areas (despite losing in Sinhala majority areas). Tamils and Muslims have become kingmakers.

I expect that every man and his dog is going to take a run at conducting a (premature, one hopes!) post-mortem on the new cabinet appointed post-Rajapaksa Take-Over Attempt.
While politics might be the art of the possible as the man who first expressed that sentiment is (mis)-quoted as saying, some of the choices that have been made give one pause for, either, philosophical reasons or judged on the basis of just plain horse sense.
That John Amaratunga, despite his documented sycophancy to Mahinda Rajapaksa had to be accommodated for reasons of simple “seniority,” I suppose, was inevitable. However, the sooner this bootlicker of Mahinda Rajapaksa in pursuit of free plane tickets is put out to pasture the better for this country and any government that aspires to perform its duties consonant with the wishes of the people who elected it.Read More

In July 2014, I wrote an article, wherein I referred to the 3G Sinhala BuddhistJihadistsGnanasaraGotaGammampila Combine , who have been leading the way to national disaster through a well-organized  campaign to rekindle Sinhala Buddhist extremism. In my considered view,  the combined effect of these 3 Gs, (not the individuals, but the lobby they represent), acting in concert , harboured vicious plans , to further their own agenda , to create an intolerant and a majoritarian minded Sri Lanka , with no space for the ‘other’ to exist as equal citizens with self-respect. During the recent election campaign, it became very apparent that the bond amongst the 3Gs were clearly cemented by the ‘King MR’. Gnanassara openly supported MR while Gammampila ( known as Gembampila- the jumping frog) jumped back to MR’s lap after initially leaving the government with JHU.

Gnanasara was heard vowing to continue his sacred task of further digging the ethnic and religious fault lines and started raising his oft-quoted war-cry – ‘Muslim extremism’ in Sri Lanka.
