Negombo HC judge Gaffoor pockets Rs.15 million bribe on heroin case ,day before his hoped appeal court appointment that was called of
(Lanka-e-News- 20.Sep.2014, 10.30AM) The notorious Negombo high court judge M.M.A.Gaffoor most infamous for his venal obsessions who was to be appointed as an appeal court judge was turned back at the last moment without being given the appointment because it has come to light that he had collected a bribe of Rs. 15 million , and much worse , has not given a cent of his kickback to the Rajapakses , according to reports reaching Lanka e news.
Three judges were to be sworn in as appeal court judges day before yesterday (18) morning at 9.30 at Temple Trees. They were Dhilip Navaz ,M.M.A. Gaffoor and Rohini Walgama. About the putrid antecedence of Navaz was reported by Lanka e news a few days ago on 16 th. No matter what , these three judges were to be sworn in on 18 th. These three judges assembled at Temple Trees and waited from 9.30 a.m. until 1.00 p.m. In the end , the swearing in was cancelled , and they were sent back.
While Navaz assumed that his swearing in was denied because of the exposure by Lanka e news, Gaffoor had realized that he deprived himself of his appointment because of the massive kickback (fat Packet –santhosam) he received 17th , and his failure to pass a portion of it to Rajapakses. The assumptions of the disgraceful judges notwithstanding , these glaring facts go to illustrate to what sordid level the Sri Lanka’s judiciary has descended because of MaRa making a mockery of the laws.
Based on reports , the 15 million bribery involvement of Gaffoor is as follows:
The prime suspect David Cooper and 8 other suspects were remanded following their arrest with 200 kilos of heroin in relation to case No. B 1074 /13 at the Negombo high court.
Although it is a well and widely known fact that even suspects taken into custody with just 2-3 grams are languishing in remand custody for years, three bail applications in respect of the 8 accused were made to high court Negombo, judge M.M.A.Gaffoor . The bail applications Nos. were 108/14,109/14 and 211/13, and this case was to betaken for trial in December this year. However , Gaffoor who hoped to take up appointment as appeal court judge on the 18 th summoned this case on the 17th based on a motion filed in court. Although this was the shield behind which Gaffoor tried to hide. In fact Gaffoor heard this case on the 17 th , because he wanted to pocket the 15 million rupees bribe and quietly take up the position of appeal court judge.
Gaffoor having collected the bribe , enlarged all the 8 accused on bail to the dismay of all, even uncaring the vehement objections raised by the state counsel Chrishani Fernando. Gaffoor who was disappointed on the following day (18) when he did not receive the appeal court appointment , on the 19 th morning came back to Negombo high court , withdrew his earlier order granting bail to the 8 accused , and introduced new terms and conditions, after calling up the case on that day.
It is significant to note a judge has no powers to cancel bail the day following after granting it ,without any valid reason . These two stupid eccentric decisions of Gaffoor are now in the hands of Negombo magistrate Amarasinghe. It is unfortunate that unlike many who take bribes secretly , in the case of Gaffoor , he is the most notorious among the legal circles and in courts in general for taking bribes from anyone who offers. There is nobody who does not know him as a shameless bribe taker . In addition he has been tainted with child molestation charges.
He was charged with sexually abusing a 12 year old girl who made her to work unlawfully in his house . These involvements were somehow suppressed.
One district judge speaking to Lanka e news regretted that he is feeling ashamed to call himself as a judge from Sri Lanka in a foreign country . To that most disgraceful level the unlawful and brutal Rajapakses have driven the judiciary into , he bemoaned.
