ஐ.நா.விசா­ரணை தொடர்பில் பாரா­ளு­மன்­றத்தில் விவாதம் நடத்­து­வது காலம் கடந்த விட­ய­மாகும். பாரா­ளு­மன்­றத்தின் அனு­மதி பெற்று நீங்கள் யுத்­தத்தை நடத்­த­வில்லை. இதேபோல் ஐ.நா. மனித உரிமைப் பேர­வையில் 3 தட­வைகள் முன்­வைக்­கப்­பட்ட பிரே­ரணை தொடர்­பிலும் பாரா­ளு­மன்­றத்தில் ஆலோ­சனை நடத்­த­வில்லை. இந்­த­நி­லையில் தற்­போது பாரா­ளு­மன்­றத்தில் விவாதம் நடத்­து­வது பய­னற்ற விட­ய­மாகும் என்று தமிழ் தேசியக் கூட்­ட­மைப்பின் தலைவர் இரா. சம்­பந்தன் கடும் எதிர்ப்பு தெரி­வித்­துள்ளார்.
 
ஐ.நா. மனித உரிமை ஆணைக்­கு­ழு­வினால் நிய­மிக்­கப்­பட்­டுள்ள விசா­ர­ணைக்­குழு இலங்­கைக்கு எதி­ரான விசா­ர­ணை­யினை மேற்­கொள்ளக் கூடாது எனக் கோரி பாரா­ளு­மன்­றத்தில் ஆளும் கட்­சி­யினால் முன்­வைக்­கப்­பட்­டுள்ள பிரே­ரணை மீதான விவாதம் குறித்து ஆராய்­வ­தற்­காக நேற்று சபா­நா­யகர் சமல் ராஜபக் ஷ தலை­மையில் கட்சித் தலை­வர்கள் கூட்டம் இடம்­பெற்­றது. இதில் கலந்­து­கொண்டு கருத்து தெரி­விக்­கை­யி­லேயே கூட்­ட­மைப்பின் தலைவர் இரா. சம்­பந்தன் இவ்­வாறு கூறி­யுள்ளார். சபா­நா­யகர் தலை­மையில் நடை­பெற்ற இந்தக் கூட்­டத்தில் அர­சாங்­கத்தின் பிர­தம கொற­டாவும் அமைச்­ச­ரு­மான தினேஷ் குணர்­தன, அமைச்­சர்­க­ளான பஷில் ராஜபக் ஷ, டியூ குண­சே­கர,வாசு­தேவ நாண­யக்­கார, ஜே.வி.பி.யின் தலைவர் அநு­ர­கு­மார திச­நா­யக்க, எதிர்க்­கட்­சியின் பிர­தம கொற­டா­வான ஜோன் .அம­ர­துங்க ஆகியோர் கலந்­து­கொண்­டனர். கூட்­ட­மைப்பின் சார்பில் அதன் தலைவர் இரா சம்­பந்தன் மற்றும் பாரா­ளு­மன்ற உறுப்­பினர் எம்.ஏ. சுமந்­திரன் ஆகியோர் பங்­கேற்­றனர்.
 
இந்­தக்­கூட்­டத்தில் ஆளும்­கட்­சியின் பாரா­ளு­மன்ற உறுப்­பி­னர்­க­ளான அசல ஜாகொ­டகே, மாலினி பொன்­சேகா, ஜானக பண்­டார, உதித் லொக்­கு­பண்­டார, ஏ.எச்.எம். அஸ்வர், சாந்த பண்­டார, ஜே.ஆர்.பி. சூரி­யப்­பெ­ரும, நிமல் விஜ­ய­சிங்க ஆகிய 9 எம்.பி.க்களினால் ஐ.நா. மனித உரிமை ஆணைக்­கு­ழுவின் விசா­ர­ணைக்­குழு இலங்­கைக்கு எதி­ரான விசா­ரணை மேற்­கொள்­ளக்­கூ­டாது என்று கோரி சமர்ப்­பித்­தி­ருந்த பிரே­ரணை குறித்து ஆரா­யப்­பட்­டது. இதன்­போது கருத்து தெரி­வித்த கூட்­ட­மைப்பின் தலைவர் இரா. சம்­பந்தன், இந்தப் பிரே­ர­ணைக்கு தமிழ் தேசியக் கூட்­ட­மைப்பு எதிர்ப்பு தெரி­விக்­கின்­றது. இதற்கு நாம் ஆத­ரவு வழங்க மாட்டோம். இவ்­வா­றான ஒரு பிரே­ரணை பாரா­ளு­மன்­றத்தில் முன்­வைக்­கப்­ப­டு­வ­தா­னது காலம் கடந்த விட­ய­மாகும்.
 
பாரா­ளு­மன்­றத்தைக் கேட்டு அர­சாங்கம் யுத்தம் நடத்­த­வில்லை. ஐ.நா. மனித உரிமை ஆணைக்­கு­ழுவில் இலங்­கைக்கு எதி­ராக 3 தட­வைகள் பிரே­ரணை கொண்­டு­வந்து நிறை­வேற்­றப்­பட்­டது. இதன்­போ­து­கூட பாரா­ளு­மன்­றத்தில் இவ்­வி­டயம் குறித்து ஆலோ­சிக்­கப்­ப­ட­வில்லை. சர்­வ­தேச விசா­ரணை தொடர்­பான பிரே­ரணை ஐ.நா. மனித உரிமை ஆணைக்­கு­ழுவில் நிறை­வேற்­றப்­பட்ட உட­னேயே இந்த விசா­ர­ணைக்­கு­ழுவை ஏற்­றுக்­கொள்­ளப்­ப­வோ­தில்லை என்றும் அதற்கு ஒரு­போதும் ஒத்­து­ழைப்பு வழங்­க­மாட்டோம் என்றும் இலங்கைப் பிர­தி­நிதி தெட்டத் தெளி­வாக கூறி­விட்டார். இந்­த­நி­லையில் இந்த விசா­ரணை குறித்து பாரா­ளு­மன்­றத்தில் விவா­திப்­பதில் எந்­த­வித அர்த்­தமும் இல்லை.
அர­சாங்கம் இந்த விட­யத்தில் எப்­போதோ தீர்­மானம் நிறை­வேற்­றி­விட்­டது. இந்­த­நி­லையில் பாரா­ளு­மன்­றத்தில் விவா­திப்­பது அர்த்­த­மற்ற செயற்­பா­டாகும். இந்த பிரே­ர­ணைக்கு நாம் எதிர்ப்பு தெரி­விக்­கின்றோம்.இதற்கு நாம் ஒத்­து­ழைப்பு வழங்க முடி­யாது. தற்­போது பாரா­ளு­மன்­றத்தில் இந்தப் பிரே­ரணை விவா­திக்­கப்­ப­டு­வ­தனால் நாட்டில் சர்ச்­சையே ஏற்­படும். இத­னை­விட வேறொன்றும் இடம்­பெ­றப்­போ­வ­தில்லை என்று தெரி­வித்­துள்ளார்.
 
இத­னை­ய­டுத்து ஏனைய கட்சித் தலை­வர்­களும் கருத்­துக்­களை தெரி­வித்­துள்­ளனர். இந்தப் பிரே­ரணை குறித்து 17ஆம் 18ஆம் திக­தி­களில் விவாதம் நடத்­து­வது என்றும் தேவை­யேற்­படின் வாக்­கெ­டுப்பை நடத்­து­வது எனவும் இக்­கூட்­டத்தில் தீர்­மா­னிக்­கப்­பட்­டுள்­ளது.
 
இந்த இரு தினங்­களும் பிற்­பகல் 2.30 மணி முதல் 6.30 மணி வரை விவாதம் நடை­பெ­ற­வுள்­ளது.
 
இந்தப் பிரே­ர­ணையில் ஐக்­கிய நாடு­களின் மனித உரி­மைகள் ஆணை­யாளர் அலு­வ­ல­கத்­தினால் இலங்­கைக்கு எதி­ராக நடத்­தப்­ப­ட­வுள்ள விசா­ரணை இலங்­கையின் நல்­லி­ணக்க செயற்­பாட்­டுக்கும் சமா­தா­னத்­துக்கும் பாதகமானதாக உள்ளதாலும் இலங்கையின் இறைமைக்கும் கண்ணியத்துக்கும் மேன்மைக்கும் சவாலாக உள்ளதாலும் குறிப்பிட்ட விசாரணை மேற்கொள்ளப்படக்கூடாது என்று இந்தப் பாராளுமன்றம் தீர்மானிக்கின்றது என்று தெரிவிக்கப்பட்டுள்ளது.
 
திகதி குறிப்பிடாது பிரேரணை முன்வைக்பட்டபோதிலும் நேற்றைய கட்சித் தலைவர்கள் கூட்டத்தில் இந்தப் பிரேரணைக்கான விவாதம் தொடர்பில் தீர்மானிக்கப்பட்டுள்ளமை குறிப்பிடத்தக்கதாகும்.

ජාත්‍යන්තර යුධ අපරාධ කොමිසමට සිංහලයෙක් රජයට එරෙහිව සාක්ෂි දීමට සැරසේ

perisPathulaඔහු ලාංකික දේශපාලනයේ 1971 සිට  87/90  කාල වකවානු  දක්වා  යුධ අපරාධ  වල සජීවී අත්දැකීම්  විශාල ප්‍රමානයක් ඇති  අයෙකි. “විජේවීර ඝාතනයේ අභිරහස“ ‘කැරලි නායකයකුගේ  භිහිසුනු  සමු ගැනීම ‘හා අප  ‘පතුල‘බෙබ් අඩවිය කොටස් වශයෙන් පලකරන ‘පණ ඇති දෙවිවරු‘  ආදී  සැග වුණු  යුධ අපරාධ ගැන   හෙලිදරවු කල   කෘති  රචනා කර ඇත්තේද ඔහු විසිනි.     මහිංද රාජපක්ෂ, එස්බී දිසානායක.  ආර් ප්‍රේමදාස  ජනතා විමුක්ති පෙරමුන  සිදු කල හා මෙහෙය වන ලද   ඝාතක කංඩායම්  ගනනාවක්  සමග   සෘජු සම්බන්තතා පවත්වා ඇති මෙම සාක්ෂිකරු  සතුව අති විශාල  ඝාතන ප්‍රමානයක තොරතුරු ඔහු සතුය. පසුගිය  දසකයක් පමන කාලයක්  කාලයන් උසාවියට අපහාස කිරීම,  උමතු බව, හා වංචා, කිරීම යන   විවිධ  චෝදනා යටතේ   ඔහු    බන්ධනා ගාර ගතව සිටියේය.      උමතු බව  යන  චෝදනාව  මනෝ වෛද්‍ය වරු ප්‍රතික්ෂේප කර තිබුනි. එහෙත් ලංකික අධිකරනය පිස්සන්  වංචා කිරීම වරදක් බවත් මාංචු දමා සිටිය දී සැකකරුවෙකුට වුව  පොලීසියට වෙඩි තැබිය හැකි බවත්  තීන්දු කර ඇත.ඒ ලංකික අධිකරන සංස්කෘතියයි.  එහෙත් අති දැවැන්ත ඝාතන ප්‍රමානයකට තමන් සම්බන්ද බව ලිඛිතවම ඉදිරි පත් කලද දශකයකට අධිකකාලයක්  කිසිදු ආණ්ඩුවක්  හෝ වෙනත් කිසිදු පාර්ශවයක්  ඔහුට  විරුද්දව අධිකරන කටයුත්  සිදු නොකරන්නේ  මන්ද? 
71 ජවිපෙද ප්‍රධානීන්ද ? 87/90 දි    ඒජාපයේ ප්‍රේමදාසද?  එයට අමතරව  එකල විපක්ෂයේ සිටියද  වර්තමාන ආණ්ඩුවේ  ප්‍රධානියා හා වන  මහිංද රාජපක්ෂ   හා  තවත්   අමාත්‍ය වරයකු වන එස්බී දිසානායකද  මේ ඝාතන පසු පස සිටි බවට ඔහු ඇසින් දුටු  ප්‍රබල සාක්ෂි කරුවකු නිසාය.
පසුගිය කලයේ  වසරක  කාලයක්  බංදනාගාර ගතව සිටි ඇත.  වෙනත් අපරාධ සදහා බන්ධනාගාර ගතව සිටි   එ හමුදා නිළධාරීන් හා සෙබලුන් ගෙන්ද   එයට අමතරව  පසු ගිය මාස 6ක් පමන   යාපනය හා මන්නාරමේ සංචාරය කර  යුධ අපරාධ රාශියක තොරතුරු   ඔහු රැස් කර ඇති බව කියයි.  මේ වනවිට  ඒ තොරතුරුද සමග  ඉතාම සූක්ෂමව රටෙන් පිටව ඇත්තේ  බිරිද හා දියනිය සමග  දඹදිව වන්දනාවේ යන  මුවාවෙනි.
ජගත් මානව හිමිකම් කොමිසමේ   නවන්දනී පිල්ලේ මහ කොමසාරිස් වරියගෙන් මේ වන විට  පත්කිරීමට නියමි ත යුධ අපරාධ කොමිසමේ   තමා සතු තොරතුරු  ඉදිරියේ පත් කිරීමට   යුධ අපරාධ  සාක්ෂි සහිතව ඉදිරිපත් කිරීමට   අවස්තාවක් ඉල්ලා මේ වන විට ජිනීවා මූලස්තානව වෙත දන්වා ඇත.  එයට අමතරව   නේපාලයේ  UNHDR  ශාකාවටද  මේ වන විට මේ බව   දන්වා ඇති බව අප හා පැවසීය.  මේ වන විට ඔහුගේ  බිරිද  හා දියනිය සමග  යුධ අපරාද විශාල ප්‍රමානයක තොරතුරුද  රැගෙන ඔහු නේපාලයේ  ජීවත්වේ.   ඔහු නමින් රංජිත් පීරීස්ය.  මේ සගවන යූධ අපරාධ වල වෙනත් මානයක්  ඔහු ‘පතුල‘ වෙබ් අඩවියට  ඉදිරියේ දී ෙහෙලදරවු කිරීමට   එකග තාවය  පලකර ඇත.

Seeking an opportunity to testify at the International probe on war crimes in Sri Lanka
I  am Ranjith Peris, a well known writer in Sri Lanka. Most of my writings were based on hidden war crimes committed by the government of Sri Lanka. The books namely ‘Wijeweera Gathanaye Abirahasa (The secrets behind the murder of Rohana Wijeweera who was the founder of ‘Janatha Wimukthi Peramuna’ ) ‘’Karali Nayakayage Bihisunu Samuganeema’ (ferocious farewell of the rebel leader) ‘Panaathi Dewiwaru’ (Live gods)  were written by me endangering my life.

I left Sri Lanka on the 22nd May 2014 along with my wife C. Vijeyalatha and my daughter Rebecca Testi with aiming to be a witness at the international probe on war crime in Sri Lanka.  A witness to the International probe in Sri Lanka as you well aware that I cannot be repealed my testimony while living in Sri Lanka. Therefore I left the country along with my family. We have already informed our arrival to the UNHCR in Nepal on the 06th June 2014 accordingly.

Hence I would like to request you to give an opportunity to be a witness at the international probe under the United Nation on war crime in Sri Lanka. I would be highly appreciated if you could response me at your earliest.

It now seems to be generally agreed that Sri Lanka could enter into a collision course with India if the SL Government continues to shilly-shally over reaching a political solution to the ethnic problem on the basis of devolution. Adverse reactions from India and the Western powers could turn out to be seriously detrimental to Sri Lanka’s interests. What strategy should our Government follow in this situation? I concluded my last article On Collision Course with India?  – after pointing out that international relations are determined by power and morality – as follows: “Sri Lanka has no military or economic power worth talking about, and the only way it can come through unscathed is by occupying the moral high ground, in dealing with India and the international community, and above all in dealing with the ethnic problem,”
In this article I want to deal with the question of the moral dimension in international relations, why it counts, and why what might be called “moral power” could count for even more than the hard power of guns and the soft power of economic might or media control. This question can be addressed in many ways. I find it convenient to have recourse to Bertrand Russell’s  A History of Western Philosophy which I had occasion to consult recently. He wrote, “Ever since men became capable of free speculation, their actions, in innumerable respects, have depended on their theories as to the world and human life, as to what is good and what is evil. This is as true in the present day as at any former time.”

Now masses are prepared to come out. University students under the leadership of IUSF were able win their demand because of this general conditions now prevailing in the country. Five years back situation was very different with a fascistic force supporting the regime. NSSP was able to build a tactical alliance with the UNP and fight back. Our efforts were successful and the erosion of the regime started. Students struggle was helpful but it is the general mass action that broke the back bone of the regime. It is good that the student organisation IUSF – ANTHARAYA - called a mass movement under the banner “Students –people standing against neoliberal capitalism and anti democratic repression of the regime”. We also participated under UFL banner. However in the slogans, though all agitations, struggles and repressions are mentioned, the national problem is kept out. Repression of minority communities, most glaring ant democratic repression was not mentioned. the capitalist leader Ranil has sharply criticized the intervention of the IMF to dismantle the welfare state , attacks on free education, free health, pensions , provident fund etc, while demanding the implementation of both 13th amendment and the LLRC recommendations. In such a scenario this movement in its march foreword, will be handicapped by the omission of repression of minorities. Left mass movement will appear less democratic than the movement of the bourgeois. We request the left oriented TU leaders who are in the movement, to raise this matter with the IUSF to seek a remedy immediately.

While these problems arise in the oppositional mass actions Mahinda regime is tied down by the proposed inquiry by the UNHR organisation. Latter has demanded visa to come to Lanka. Mahinda regime is opposed to this and it has decided to bring this issue to the parliament for a decision. Clearly this is a bogus action, as the regime has over 2/3 majority in the parliament. Who prepared the ground for this foreign attack on our motherland? It was Mahinda himself. He failed to implement 13th amendment and the LLRC report recommendations, though he promised to do so to the international community. He should call a conference of all representatives of minority communities and get their support by a genuine agreement and issue a combine statement to the foreign powers to not to barge into our country as we are resolving all human rights issue locally. Even the most obedient Muslim leader, cabinet minister Hakim complained that the minimum equality is not granted to minority nationalities when the NE provincial councils are treated differently by forcing governors and chief secretaries on them with out any consultation and agreement.

One minister made a strange statement in the parliament. He reminded that British invaders brutally murdered Sinhala masses without any mercy and now they wanted to inquire in to the oppression of Tamils. How can this minister make such a foul statement? Firstly British rulers made those atrocities while there was opposition among the British masses; Infact even Marx and Engels lived there. Later Philip brought socialism from Britain. One Britisher Brace girdle became a hero by fighting for human rights. Hence British democratic masses have every right to be concerned about HR violations in Lanka. Also parliament came to Lanka through the British. Does the Minster want to go back to old monarchic constitution? He should remember how Philip fought for democracy and won. Secondly does the fact that the British carried out brutal aggressions in the past, give the minister and the government a right to carry out brutalities against the Tamils. Is that his argument?

Mahinda has said that some crows are selling the country to receive dollars. Who is this Kaka, crow? It is Mahinda who for the sake of dollars from the IMF and other dollar lenders, cuts social welfare in this country and bleeds the inhabitants. Under the bogus development that suites them, Mahinda regime is filling their pockets. So kaka the crow is in the presidential house. This crow has let down the country, bled the country and opened doors for aggression form alien powers. Mahinda has said that Sinhala identity was protected by the Buddhist temples. This is a slander on Buddhism and Sangha. Buddhism is not a protector for any clan whether Sinhala Tamil or otherwise. It is the end of philosophical pursuit of mankind. Long before Hegel or Marx, Buddha explained that the fundamental nature of reality is impermanence, division and lack of content. Empirical world of physical reality is created by continuation of the law of arising, existence and perish. Our attachment to the physical world and desire for permanence make us live in illusions. By controlling this drive one would be able to look at the other with love and kindness. Buddhism claims all humans, women and men are equal and could achieve universal consciousness by suppressing desire. Mahinda should learn Buddhism before making it an entity connected to Sinhala identity.

SC orders English translation of ITAK manifesto

Based on a petition filed against the use of the word “Confederal” instead of “Federal” in the amended policy statement of the Ilangai Thamil Arasu Kachchi (ITAK), the Supreme Court ordered that the original and the amended policy statements be translated into English and submitted to Court.

The petition filed by H.K.D. Chandrasoma stated that a citizen could petition the SC in the likelihood of a political party or a group attempting to set up a separate state in Sri Lanka and create a division among multiethnic communities.

This petition was taken up for hearing by a SC Bench comprising Eva Wanasundera, Sisira De Abrew, and Priyantha Jayawardene.

Attorney Dharshana Weerasekera representing the petitioner told courts that the word “Samasthi” mentioned in the original policy statement of the ITAK had been replaced by the word “Inaipachchi” in its amended policy statement.

He said the word ‘Samasthi’ was similar to the word Federal, but however the word “Inaipachchi does not bear similarity to the word federal and was interpreted more as ‘Confederal’.”

“The words Federal and Confederal are not two words with the same inference, but words that give different meanings altogether,” he said.

The Counsel said the amended policy statement infers that people living in a unitary state were expecting to live under a different system in accordance with a Confederal state. By this amended policy statement of the ITAK the Unitary state mentioned in the Constitution was grossly challenged. He also appraised the court by quoting from the Wadukkodai policy statement.

The respondents in this case, the ITAK was represented by MP and Attorney M.A. Sumanthiran who said there was no difference between the original policy statement and the amended policy statement as claimed by the petitioner.

He said t hey had only substituted correct Tamil words for the Sanskrit words contained in the original policy statement and that no violation of the country’s constitution had taken place.

The three-judge bench after considering the submissions directed that the ITAK’s original policy statement and its amendments be translated into English through the Official Languages Department and submitted to Court at the next hearing on July 15.
Crony of child and women's development Minister and son of IGP’s relative rape 14 years old orphan : IGP hiding rapist

(Lanka-e-News-13.June.11.30PM) After Leslie Alexander Shakespeare , a bosom pal of child and women’s affairs Minister Tissa Karaliyaddhe committed brutal rape on a 14 years old girl of Medawachchiya , it is now revealed the same victim had been raped regularly by a son of a relative of the IGP too. Now, the IGP in spite of being the highest in the hierarchy of the police and should be enforcing the law duly on the other hand taking advantage of the lawless MaRa reign is making desperate attempts to suppress this heinous crime after hiding his relative’s criminal son, according to reports reaching Lanka e news inside information division.

The poor hapless victim is a fourteen years nine months old orphan who after the death of her parents was under the care and custody of her relative. It is well to recall that Lanka e news reported on the 9 th about this hapless teenager , an orphan and how she was raped by Leslie Alexander Shakespeare a close crony of child development and women’s affairs Minister. At the same time we also revealed, following pressures exerted by this child development Minister , plans were afoot to distort the facts to court and get the accused released on bail. 

Unfortunately for the child development ( or rather child deflowering ) Minister and his pal , owing to our exposure in keeping with our policy of always championing the cause of the oppressed , their frantic efforts ended on the rocks. COLOMBO: The appointment of Sandra Beidas as Coordinator of a 12-member UN team to investigate alleged war crimes and human rights violations in Sri Lanka during and after Eelam War IV, signals the beginning of the investigation process, United Nations officials told Express on Friday.
Asked if the process will begin only after the two top experts are appointed, an official said that it is the 12-member team coordinated by Beidas which will be doing the investigations and the experts will only be offering their guidance and expertise.
“The appointment of the experts is not critical since the investigation is to be led by the Office of the High Commissioner for Human Rights (OHCHR). The OHCHR committee appointed by High Commissioner Navi Pillay with Sandra Beidas as the Coordinator, is the one which will be conducting the investigations. With the appointment of the committee, the investigative process has already begun in a sense,” the official explained. 
The committee comprises specialists in various fields under which war crimes and human rights questions fall. There will be forensic, legal  and gender experts among others on the team.
Dame Silvia Cartwright of New Zealand, who was a judge in the Khmer Rouge War Crimes Tribunal, will be one of the two pro-bono experts. The other expert is yet to be named.
The OHCHR is looking for an expert from an Asian or African country. But so far, nobody from those regions has given his or her consent to join the controversial and delicate task.
UN sources expect the investigation to begin full scale by mid-July and take 10 months to wind up.
Following the Sri Lankan government’s decision to refer the probe issue to Parliament, the latter will take up the issue for a debate on June 17 and 18. The government will table a motion rejecting the UN probe on the grounds that it  infringes the sovereignty of Sri Lanka and jeopardizes the Sinhalese-Tamil reconciliation process already on in the country.
Lanka had previously made it clear that it would not cooperate in the probe.

The Tamil National Alliance (TNA) will leave no stone unturned to provide evidence against the government, if an international war crimes probe is held against it by the international community.


" This is a very serious situation and it is up to the representatives of the war affected people of the North and the East to provide evidence against the government in the event of a war crimes probe being held at international level," TNA spokesman and Jaffna District MP Suresh Premachandran told Ceylon Today last night.


He also asserted that it was up to the people of these affected districts to provide the evidence, and if they were intimidated, the TNA as a political party would go all out to provide the evidence and fully support such a war crimes probe.


However, when pointed out that the government had rejected the need for such a probe and also that a group of government MPs had made written representations to Speaker Chamal Rajapaksa rejecting the need for such an international probe, Premachandran said that the TNA and the victims would provide the evidence even at a location outside Sri Lanka, irrespective of what it takes.


He also said that it was also in the best interest of the government to support such a probe to clear its name, and also in the interests of the people who were the victims, whether they were Tamils or Sinhalese or whatever ethnic denomination they belonged to.


Meanwhile, Government spokesman and Media Minister Keheliya Rambukwella, when contacted last night, vociferously rejected the war crimes allegations, claiming that they were made against Sri Lanka by the international community and were unilateral, flawed, baseless and malicious.


Rambukwella also referred to the address that External Affairs Minister Professor G.L. Peiris made to the United Nations Human Rights Commission, spelling out that the allegations were totally biased and the countries which voted for the motion, were ones which had political interests.
" The fact that 14 countries voted against the motion and 12 abstained, speaks volumes of the biases and the flaws in the entire Geneva resolution, he asserted.


That was the basis on which even President Mahinda Rajapaksa also rejected the allegations and said that he would not allow any such probe against Sri Lanka and that was why a group of MPs also sent a motion against such an inquiry to Speaker Chamal Rajapaksa, he said.

WE REPORT. YOU DECIDENavi Pillay, the UN High Commissioner for Human Rights, says her office has put together a support team to conduct special investigations to advance accountability and, through this, reconciliation in Sri Lanka.
She made this observation at the twenty-sixth session of the UN Human Rights Council in Geneva, Switzerland on Tuesday.
In response, Sri Lanka’s Permanent Mission to the UN in Geneva said that Sri Lanka will not co-operate with the “OHCHR-driven comprehensive investigation”.
The twenty-sixth session of the UN Human Rights Council began in Geneva on Tuesday with follow-ups on matters discussed at the twenty-fifth session of the council.
This is incidentally the final session of the Human Rights Council where Navi Pillay presides as the High Commissioner for Human Rights, prior to the expiration of her term.
“I note also that last month marked the fifth anniversary of the end of the war in Sri Lanka, where scars created by terrorism and conflict have yet to heal,” Pillay said at the session. “My office team has now put a support team which comprises several experts and special procedures to conduct special investigations mandated by this council in order to advance accountability and, thus, reconciliation.”
“Human Rights violations are among the root causes of every form of instability and conflict, which means that every state has an interest in detecting gaps in its human rights protection. Yet the very careful analysis conducted by my office and our calls for investigation into allegations of abuse have frequently been greeted with strong holds and denial. Is this because we have criticised governments? Surely that is the nature of human rights advocacy to speak truth to power to confront privilege and enraged hierarchy with an unshakable belief in human dignity and equality and freedom,” she stated.
Reacting to the statement made by Pillay on the appointment of a team of experts to conduct investigations into accountability concerns in Sri Lanka, Ravinatha Aryasinha, Sri Lanka’s Permanent Representative in Geneva, also spoke at the session.
“The resolution adopted with the support of less than half the council’s membership, challenges the sovereignty and independence of a member state of the UN, violates principles of international law, is inherently contradictory and is based on profoundly flawed principles, inimical to the interests of the Sri Lankan people. The resolution’s lack of clarity sets a dangerous precedent and will destabilise the intricate balance of the homegrown process of national reconciliation.”
He added: “While the prejudice and bias concerning Sri Lanka, repeatedly displayed by the High Commissioner and the OHCHR, remains of deep concern, reports, which question the credibility of the co-ordinator appointed for the investigation, have already emerged. It is ironic that the resolution calls on Sri Lanka and the OHCHR to conduct parallel investigations.”
Meanwhile, following Ambassador Aryasinha’s remarks in Geneva, Sri Lanka’s Permanent Mission to the UN in Geneva said in a statement that Sri Lanka has re-iterated its categorical rejection of the Human Rights Council resolution on Sri Lanka, adopted at the twenty-fifth session, and that Sri Lanka will not co-operate with the OHCHR driven “so-called comprehensive investigation.”
The statement reads that Sri Lanka has observed that the government is firmly committed to continuing its ongoing processes of reconciliation, nation-building and accountability, and towards this end, will continue to work with countries and inter-governmental and non-governmental organizations that are genuinely interested in the welfare of the Sri Lankan people.

Whether Sri Lanka cooperates or not, the UN Human Rights Commission (UNHRC) mandated investigation into alleged human rights violations here, with a probable focus on the closing stages of the long war, will go forward. The Mahinda Rajapaksa administration will no doubt get parliamentary approval later this week for its non-cooperation strategy. While parties like the TNA, who have made no secret of the fact that they support the UNHRC initiative, inspired in large measure by the Tamil diaspora in North America and Western Europe, will get pilloried by government MPs in the usual fashion. These tub-thumpers are seemingly oblivious to the fact that the notorious KP, the LTTE’s chief arms procurer and Prabhakaran’s self-proclaimed successor, is cocooned in the North with every comfort for reasons that have not yet been explained to the people. Also, Vinayagamoorthy Muralidaran alias Karuna Amman who once upon a time led the LTTE in the East when unspeakable atrocities were committed now sits in Parliament and is no less than a vice-president of the SLFP!

The UNP has after a long hibernation, with its leadership act anything but resolved and Mr. Ranil Wickremesinghe firmly glued to his seat, has in an unusually strong statement issued on Friday accused the government of responsibility for this situation of external scrutiny of the country’s internal affairs. But it has called upon the government to cooperate with UNHRC saying that the mandate of the investigation includes Tiger crimes and these, at least, should be presented to whoever will conduct the inquiry. The JVP has set the cat among the pigeons, or as one newspaper headline had it yesterday ``called the government’s bluff’’ in taking this matter to Parliament by submitting an amendment to the government resolution. This calls for, among other things, the conducting of a credible and impartial domestic inquiry into a long list of incidents, both recent and distant, such as the Rathupaswala shooting, the killing of a Katunayake FTZ worker, a Chilaw fisherman, several custodial deaths and attacks on journalists over the past several years. The Marxist party that is doing much of the work that is really the UNP’s, wants the report on this investigation, if conducted, presented to Parliament within three months. These, no less than the government’s action to consult Parliament, are obviously moves on the political chessboard. Indications are that the situation is growing nuttier and fruitier by the day as it often happens in this democratic, socialist republic of ours. Unfortunately these events are not mere laughing matters.

We are all familiar with the ridiculous `zero casualties’ claim at the time the war ended and the 13+ promises airily made. But it is an iron-clad fact that President Rajapaksa and his brother, Defence Secretary Gotabhaya Rajapaksa, deserves the nation’s unequivocal gratitude for liquidating the LTTE monster after nearly three decades of civil war that cost this country thousands of soldiers killed and maimed, children orphaned and the lives of countless other innocents brutally snuffed out by the mindless terror acknowledged even by the ranks of Tuscany. We also owe much to General Sarath Fonseka who led the military and his troops, many of whom paid the ultimate price. No Lankan of whatever political persuasion can countenance external interference in our domestic affairs, especially at the behest of those Western powers behind the UNHRC putsch whose recent conduct in external theatres of war like Iraq and Afghanistan cannot bear examination. Nevertheless the numbers were against us and now that the investigation will soon begin it is necessary to say that whatever circuses and sideshows that may be played out here or elsewhere, there are important obligations that lie on High Commissioner Navanetham Pillay in implementing the UNHRC resolution.

It is important that if the findings of whatever investigatory body that is appointed is acceptable to all reasonable people, be they Sinhalese, Tamils or Muslims here or members of the international community. Whatever conclusion that is reached should be based on due process and proven evidence and to ensure this, the Commissioner should conduct herself in an appropriate manner whatever the provocations of the past for some of which, like Mervyn Silva’s clowning when Ms. Pillay was here, the government is at least vicariously responsible. Among the principles that apply is that appointments to the investigatory body and officials assisting it should not be the sole prerogative of the present holder of office. The names of those conducting the inquiry should be made known in advance, before their appointment, so that members of the UNHRC and the Government of Sri Lanka can make their observations. Whether our government would choose to distance itself fully and keep totally mum even on such matters remains to be seen.

It is absolutely vital that the committee consists of independent personnel from outside the UN system, as the UN system and particularly UNHRC have been parties to this dispute, and the UN cannot be seen as an independent, impartial actor. The UN already has a viewpoint, as expressed in the Darussman Report and it is important that any new investigation should not be tainted by UN attitudes regarding that report. Already OHRC has been compelled to try to fend off what it called a ``campaign of defamatory comments’’ (orchestrated by whom it has not been said) aimed at Sandra Beidas named as the senior coordinator appointed to run the probe. Ms. Pillay should consider her own role in this matter very carefully. She has only a few more weeks and days in her current job and her successor has already been named. If not exactly a lame duck, she is somewhere close to it. Moreover, she herself has been a controversial figure in relation to Sri Lanka. So it is advisable that she leaves the decisions regarding the appointment of the committee to her successor. Also, it should be noted that what is being investigated is mainly the result of ethnic divisions. So it is proper to expect that the Commissioner, who belongs to one of these ethnic groups, and especially now that she is moving out of her current job, should not be party to the organization and appointment of the committee so that there are no suspicions regarding the credentials of the committee.

It is equally important that those appointed to the committee and officials connected to it do not belong to the various groups in Geneva, whether they are in the UN or outside. Two of those playing an active role in Geneva supporting the Tamil diaspora in its actions there are two former UN officials, both British nationals. One, a former speech writer and close confidante of Kofi Annan when he was Secretary General of the UN, is believed to be involved with the Kofi Annan Foundation in Geneva. The other is a former UN Resident Coordinator in south Africa during Annan’s time. These are all people with close contacts with UNHRC. Annan’s name too has been mentioned in connection with the inquiry and there are many good reasons why he should not be part of the process. A spokesman for Pillay’s office has said that contrary to ``numerous speculative reports’’ in the Sri Lankan media OHCR is still in discussion with a number of possible senior experts to ascertain their availability and interest and no one has yet been officially appointed. Given that those selected will meet for the first time in July, the clock is ticking.

The Janatha Vimukthi Peramuna (JVP) today submitted an amendment to the Government motion, which opposes the United Nations Human Rights Council (UNHRC) inquiry into allegations of violations of Human Rights during the last stages of the war.

The JVP amendment calls for a domestic independent inquiry into the alleged violations of human rights.

JVP Leader Anura Kumara Dissanayake told a media briefing that they had already handed over the amendment to Parliament General Secretary Dhammika Dassanayake seeking an indigenous inquiry into human rights violations and to be completed in three months.

The Amendment calls for an independent inquiry into the killing of Roshen Chanaka at Katunayake during the protest over the private sector pension scheme; the killing of Anthony Fernando during the fishermen’s protest in Chilaw; the killings in Rathupasawala; the killing of nine journalists, the attack on 27 others and several media institutions.

The JVP had also called for an inquiry into the killing of prisoners at Welikada, the disappearance of a prisoner from the Vavuniya prison, the attack of the Inter University Student Union members by the Slave Island police, the abduction of Lalith Viraj, Kugan Murugan and all disappearances in the North. The party also called for investigation on the attack on former Bar Association President Wijedasa Rajapaksa the attack on the Secretary of Judicial Services Commission and the attack on Lawyer Gunaratne Wanniarachchi.

The Amendment calls for the completion of all inquiries within three months and bringing those responsible to book.

Mr. Dissanayake said the JVP’s decision on whether to support the government motion or not would depend on how the government responded to its amendment.

He said the JVP decided to submit an amendment to stop the government from using the UNHRC inquiry as a political gimmick to win elections. Mr. Dissanayake said his party discussed the amendment at yesterday’s party leaders meeting and the nod was given for them to submit the amendment. (Yohan Perera and Sanath Desmond)
JVP has not changed its ways– Dr. Vickramabahu Karunaratne

Reports from London indicate that the JVP, under the new leadership, could not convince the pro-socialist groups that they have grown out of their Sinhala chauvinist middle class party format. Some groups congratulated the organizers for showing the JVP for what it still is, a Sinhala nationalist organization trying to hide behind Marxist rhetoric. It all came out at the speech, and the answers given by Anura himself.
 
As the JVP is incapable of organizing a meeting of this kind anywhere outside Sri Lanka, they had to rely on others to organize the event. Not so surprisingly, they could not attract Tamil or Muslim minorities to any of their meetings. This, however, did not stop them from claiming to the Sinhala media in Sri Lanka that they had held 'successful meetings internationally.' But the truth is somewhat on the contrary.
 
Quite obviously the JVP has been trying to revamp their war-tainted image by selecting this new leader and claiming to have achieved a sharp change. However, it is their still practising communalism that gave a relatively successful comeback in the last provincial elections. Yet, their support among the Sinhala Diaspora remains very weak, as neither the socialists nor the chauvinists are willing to accept their leadership as genuine.
 
The emergence of the Frontline Socialist Party (FSP) from their rank and file is a shock from which they cannot recover. The young breakaway group accused them not only of dragging them into a coalition government with the SLFP, the nationalist bourgeoisie party, but also openly committing them to an oppressive war in the North. The international tour by one of its leaders, Kumar Gunaratnam, has also done huge damage to the JVP. If the aim of Anura's visit is to recover from this set back, then it was a failure.
 
The London meeting and the connected international campaign, once more demonstrated the inability of the JVP to attract revolutionary sections of the Lankan Diaspora. Faced with questions, Anura used his diplomatic serious attitude to sideline the difficult questions, rather than actually attempting to provide answers.
 
The fact remains that the JVP, which never had a working class backing, went into a coalition with the SLFP and played a more chauvinist role than that of the SLFP leaders, before breaking off. This is in sharp contrast to the old opportunist Left Leaders, who remained pro devolution in spite of participation in coalitions. To that extent old Left Leaders could be classified as reformists, in all national democratic tasks faced by the country.
JVP on the contrary, became sometimes extreme leftist in relation to socio-economic problems, while on the other hand, brutal oppressors of minority communities. They were responsible in 1988/90 period for killing nearly a thousand leftists who supported devolution and defended the parity of languages.
 
Responding to the apology given by the Leader of the JVP, Anura Kumara Dissanayake, during an interview with BBC Sandeshaya regarding the 1988/89 insurgency, JVP trade unionist, K.D Lalkantha, said that the apology was not for their struggle, but for the innocent victims killed during that period.
 
"Due to the situation at the time an arms struggle took place in the country, people who had no involvement in the struggle perished during that period. Therefore, this apology was particularly for those people who were unnecessarily killed in the struggle. We are certainly not saying that the struggle was wrong, and we are not apologizing for the struggle, but only to these innocent people," he said.
  
Lalkantha added that they had not anticipated the deaths of those innocent people, but unfortunately that is what happened; though it was not their intention. "We were deprived of our civic rights and there was no other means for us to continue our politics, and that is why we had to resort to that sort of armed struggle at the time. It was certainly not against the people but the government at the time. However, many innocent civilians lost their lives in the struggle, which we did not anticipate, and we regret that deeply. Hence, this is what our leader meant when he apologized. It was for the innocent civilians," he added.
 
It is a fact that JVP was banned and they were fighting against a repressive government. But the government was forced to come out with the 13th Amendment and give partial devolution to the Tamil people. The government retreated from the oppressive position. JVP completely misinterpreted this situation, and turned their guns at those leftists who came out to defend the reforms given to the oppressed communities. They did not kill innocent people but deliberately killed left and democratic people who stood for minority rights. Cuban revolutionary, Che Guevara, was also involved in armed struggle but he never aimed consciously at others who were fighting for human rights against the repressive regime.
 
As reported, Anura had an opportunity to explain the mistakes of the past to his audience – the JVP's false perspective that led them to enter a coalition with an anti-worker, racist capitalist government, and to be complicit in the genocidal slaughter of Tamil-speaking people that took place in 2009. Apparently despite repeated probing, he touched on none of these issues.
For Anura these issues may be in the long-forgotten past, but they are firmly centred in the minds of the radical masses in Lanka and elsewhere.
