Let’s not to put the cart before the horse; An argument for a pragmatic political reconciliation process in Sri Lanka
It is reported in the Media that the President Mahinda Rajapaksa invited the Leader of the Tamil National Alliance (TNA) for direct talks over the Tamil Question. While appreciating such a move, it is imperative to look at this move in the context of much discussed reconciliation process of the country. When we put reconciliation into practice, transcending theoretical discourse and adopting a pragmatic and clear approach befitting the Sri Lankan context is vital. Let’s start this discussion by quoting Dalai Lama, the spiritual leader of the Tibetan people.
“Many people today agree that we need to reduce violence in our society. If we are truly serious about this, we must deal with the roots of violence, particularly those that exist within each of us. We need to embrace ‘inner disarmament,’ reducing our own emotions of suspicion, hatred and hostility toward our brothers and sisters.” - Dalai Lama XIV
Reconciliation actually takes place in the hearts and minds of the people.  Therefore it is an emotional project. In theory, means of reconciliation are multifaceted and encompass aspects related to political, psychological, and victim-perpetration. However, when it comes to practice different countries adopt different strategies to bring reconciliation in their respective lands. South African reconciliation process and the role of Nelson Mandela are considered to be the finest examples for reconciliation.  There are so many other countries in the world that ventured into this kind of reconstruction of their social mind and soul. Some have produced results while others have failed. Success stories of reconciliation pinpoint several salient factors that contribute towards such a success. First is the preparedness of the social psyche. Second factor is political will of the leaders in such a society. Colombo TelegraphFinally after nearly two decades of waiting, the nation achieved their dream of having another world cup. This time it’s the T20 world cup. Sri Lankan Cricketfans around the world are celebrating this great achievement with our outstanding cricketers who Put Sri Lanka On The Map Yet Again. It’s wonderful news to not only to the fans, but also our nation.
Of course our cricketers have brought immense pride to our tiny nation. They have won two World Cups and Sri Lankan cricket lovers around the world are very happy!! But are our cricketers happy? Corrupt officials are enjoying all the perks but they fail to treat our cricketers well. It’s very unfortunate to witness that it is only  when our players cause national pride, that everyone backs and supports them. However when they are having issues with the Sri Lanka Cricket Authority, no one speaks on their behalf.
I have observed that this usually happens when issues regarding their demands arise; they are forced to fight alone as there is no support rendered from either the fans or external parties.  From my point of view, it is unjust to ignore their demands and this has usually fallen on deaf ears.  I strongly believe that fans of these great cricketers must stand with them whenever they have difficulties in dealing with the Sri Lanka Cricket Authority.

Tiran Alles ridicules judiciary!

.Gateway Institute at Koswatte in Nawala, owned by the family of Tiran Alles, is ignoring a Supreme Court ruling and going ahead with the construction of a swimming pool without a valid license, according to reports reaching us.
The facility began to be built in February 2013 on a construction license no: ME/BA/N/09/08 of Febraury 2008. However, gazette extraordinary 392/9 of 10 March 1986 makes this license valid only for one year period from the date of issue. By the time the swimming pool began to be built, the license had expired.
Furthermore, as per the development plan 2008-2020 of Sri Jayewardenepura Kotte Municipal Council issued by the Urban Development Authority in April 2008, the area in question has been declared a highly residential area, and swimming pools are not included in the list of approved constructions. The Environmental Authority has confirmed that no required document has been obtained as per regulations for this construction.
When contacted, the UDA’s internal sources said the construction work began in 2008 on the orders from the top and no proper inquiry had taken
place.
Taking up a case filed by a neighbour, the Supreme Court on 05 February 2014 issued an order preventing further construction work until the conclusion of the hearing.
However, considering a motion filed by president’s counsel Romesh Silva who appears on behalf of Gateway Institute, the Supreme Court on 10 March 2014 permitted only for the laying of tiles in a concrete layer and ordered that no new construction should take place. Now, the courts are on vacation, and ignoring the order, further constructions are taking place.
According to reports, the complainant is to go to courts once again, since this amounts to a contempt of court. For that, the Kotte mayor is getting the backing of Welikada police and top police officials of Colombo. It is rather questionable as to whether Tiran Alles and family can act in this manner, disregarding a Supreme Court ruling, due to their wealth, political or any other power.

Development in Sri Lanka and the structural Genocide of the Eelam Tamils

Development is a rather ambiguous term lacking clear definition; nevertheless it holds positive connotations to rehabilitation, progress, prosperity and wealth. Subsequently it is propagated with such values in the discourses of international neo-liberalism and national modernization. What is not illuminated in such state -corporate centered narrations is that the nature of the very development supposedly in benefit of locals is often directed by extra-local power holders.  In order to understand the implications of extra-local decision making it is necessary to remember that development is not implemented in a vacuum but within the context of larger socio-political and historical processes. For these very reasons development has therefore neither been apolitical nor neutral and demands critical assessment.

The Governor of the Central Bank of Sri Lanka (CBSL) has penned a compelling article entitled “Practical, not Conventional, Wisdom has driven Sri Lanka’s Rebuilding and Reconciliation” which was posted on the official website of the CBSL on Thursday 3rd April 2014 and abruptly removed on Monday 7th April 2014 for reasons best known to CBSL. However, this author has downloaded the Governor’s article which is available on request. The objective of this rejoinder is to demystify the theory of “practical wisdom” postulated by the Governor from what he claims to be the “conventional wisdom” in economic science.

President Mahinda Rajapaksa, in what appears to be a response to Opposition Leader Ranil Wickremesinghe's much-talked-about trip to the US, volunteered to give tips on how to topple a government and said one needs not go to Harvard for that.
 

The President, attending the presentation of the 64th Annual Report of the Monetary Board held at the Central Bank premises yesterday, in his capacity as the Minister of Finance and Planning, said the governments should be toppled, but not by force."There is no need to go to Harvard University to learn how to topple a government. If they come to my place in Medamulana, I will teach them how to do it," he said.
 

President Rajapaksa also said he was concerned about the growing inequality that could arise in a developing economic atmosphere.
 

"Economists have pointed out that the country's post-conflict economic growth was unsustainable and one think-tank, Verité Research, highlighted official data to show that inequality was rising.
 

"In any country, political and economic stability are key factors for development and compared to other countries in the region, Sri Lanka is in a better position. Sri Lanka's growth, which is underpinned by stability, would allow the country to meet its broader socio-economic development objectives of an inclusive growth process, while bridging existing inequalities. Hence,economic growth spread out to all parts of the island," the President stressed.
 

Commenting on the growth recorded last year, he said, in terms of numbers, the growth of 7.3% from 6.8% in 2012 seems to be small, but the country attests to a commendable growth in the economy; particularly, the inflation rate remaining at a single digit for the past five years is remarkable.
 

"We have not been afraid of criticism. Although we won the Provincial Council elections last week with a 59% voter turnout, for some people this was not enough and this shows their higher expectations. With the economy moving to the next level, the mindset and the attitudes of the public too have changed over the past few years.
 

"People buy clothes two three times a month unlike a few years back, when they bought clothes only for New Year. The young chaps now wear branded clothes; people from the villages want carpeted roads. So, the lifestyle has changed with the overall economic transformation that took place during the past eight years," he added.
 

He also said, "We have already signed the China Free Trade Agreement (FTA) and the final procedures are being attended to at present. With the agreement in place, the economy could benefit commendably. Accordingly, over the next few years, the financial sector should be actively encouraged and support the industries to move towards a new vision.
 

"Sri Lanka will continuously strengthen the key pillars of sustained high economic growth. Sustained improvement in economic performance despite the uncertain global economic environment will ensure continued peace and development," he noted.
Rajapakses and LTTE stand shoulder to shoulder –GL says international investigators disallowed to come
(Lanka-e-News- 09.April.2014, 7.00PM) Sri Lanka Rajapakse regime foreign Minister Dr. G.L.Peiris stated officially that no assistance will be extended to the international investigation into the monumental human rights violations committed by the ruling regime and the LTTE terrorists . This investigation was recommended by the UN human rights council (UNHRC) following its adoption of a resolution on a vote taken at its sessions. The Minister added that neither the investigation team nor any individual will be allowed to enter the country in that regard.

Dr. Peiris made this announcement at a media briefing held day before yesterday(07) afternoon with the participation of foreign journalists. Even after the rejection internationally of the foolish and fake arguments advanced that UN High Commissioner or the UN HRC has no legal foundation to conduct an international investigation as regards SL , this buffoon of a Minister had indulged in this tomfoolery. This asinine Minister reiterated the stand that if a mechanism is established here to conduct an international probe into the crimes , SL will not extend any support towards it.

He added that no opportunity will be provided for such a team or its members to arrive in SL , and the SL government is not prepared to support such an investigation (impliedly exposing the guilt). 

The prospective international investigation clearly includes the crimes such as murders , abductions and assaults committed on the media personnel as well as arson committed on Media Institutions in SL. It also includes the murder of innocents , bus explosions and heinous crimes committed by the LTTE. Despite these terms and conditions being so clearly stipulated in the proposed investigation , the SL media coolies and lackeys of the regime are relentlessly and regularly reporting that this investigation is aimed against SL. 

SL regime’s consent or dissent is irrelevant to this international investigation ; yet by not extending support to it , it is very evident the Rajapakse regime is directly protecting not only the criminals of the country but even the LTTE terrorists , whereby the interests and dignity of the law abiding citizens are compromised most gravely.

‘Attack Chandrika’, president tells his henchmen!

chandrika bandaranayakePresident Mahinda Rajapaksa summoned several of his closest ministers to Temple Trees yesterday (08) and ordered them to ruthlessly attack former president Chandrika Bandaranaike Kumaratunga through the media.
Worried by Mrs. Kumaratunga’s having hinted in public recently at Halmilara in Embilipitiya that she would return to politics, the president has given the order to Dilan Perera, Mervyn Silva, Nirmala Kotelawala, Rohitha Abeygunawardena and Sarana Gunawardena.
Also participating were ministers Dullas Alahapperuma and Keheliya Rambukwella. The president has specifically said that those who had joined the government from the UNP and Champika Ranawaka, Wimal Weerawansa and others from UPFA affiliate parties should not be used to attack the ex-president. Only the MPs and ministers of the SLFP should be employed for that task, the president has noted.
At this meeting, minister Alahapperuma has distributed among those present several documents pertaining to Mrs. Kumaratunga. It was stressed that the mission should convince the people that European countries dancing to the tunes of the Tamil Diaspora were in a conspiracy to bring her back to power.

‘Mal Kumara’ sells properties, sends money overseas!

bandula padmakumaraLake House chairman Bandula Padmakumara, aka ‘Mal Kumara’, is reportedly selling his properties and sending the money overseas. He is being advised on that by his daughter Muthu Padmakumara, presently a staff member of the Sri Lankan High Commission in London.
He has hastened to do so on the advice of his daughter after the government’s setback at the recent provincial council elections and the submission of a complaint to the Bribery Commission by a group of Lake House employees against his colleague Sendanayake.
Accordingly, the Queen’s Road, Colombo 3 house he had bought recently was sold for Rs. 475 million and the money deposited at the Colombo branch of a foreign bank. This money is due to be sent overseas in instalments within the next few weeks. Padmakumara purchased the house about a year ago from one Selvanayagam for Rs. 350 million.
Before becoming Lake House chairman, he had been living at a rented apartment at Hotel Road, Mt. Lavinia and was deeply in debt. Since then, using state powers, Padmakumara has influenced the Swarnavahini administration to pay him Rs. 600,000 a month for ‘Mul Pituwa’ and ‘Loka Sithiyamen’ programmes he is presenting, and Rs. 500,000 a month for Mobitel newspaper headlines. This in addition to his Rs. 400,000 salary, two official vehicles, unlimited fuel, a Rs. 500,000 credit card and rent for official residence as Lake House chairman.
There have been allegations of his having obtained millions of rupees in commission from the importation of printing paper and printing machines for Lake House. He had not brought that commission money to Sri Lanka, but got it sent directly overseas. The Bribery Commission is investigating this complaint.

Sri Lanka: Post-Geneva, Post-Provincial Council Elections

GroundviewsPost- Geneva and post- PC elections, some clarifications are in order because the resolution, locally, came to be obscured by the fog of elections and the scare stories that were put out about sanctions and the electric chair, not to mention the absurdity of the arithmetic of the Geneva vote propounded by no less a personage than the Minister of External Affairs.
The regime clearly intended to scare the electorate into voting for them.  First came the ridiculous rhetoric about the electric chair which resulted in a queue to qualify for it from the President to Sarath Fonseka, with the Leader of the Opposition assuring all who cared to listen, that since he did not, when Prime Minister, sign the Rome Treaty setting up the International Criminal Court, all can sleep safely at night.  He is correct in that we are not signatories to the Rome Treaty. Consequently, it is only the UN Security Council that can refer the issue of Sri Lanka to Rome via a resolution and in any event there is no capital punishment at this level.
It is only the UN Security Council too, that can impose sanctions against a country.  All members of the UN have to comply with a resolution to such an effect. To cut a long and misleading story short, the UN Human Rights Council cannot impose mandatory sanctions on Sri Lanka or any other member state -the sponsors of the current resolution on Sri Lanka made very clear at the outset that sanctions were not being contemplated.  Of course individual countries could decide to impose sanctions- however, there seems to be no likelihood of this happening in the near future.  And as far as the Security Council is concerned, the regime is insured against any punitive action by the Chinese and Russian vetoes.
The issue now remains that of the High Commissioner identifying the precise modalities for such an investigation and setting it up.  It is clear that the regime will not allow any international commission to visit Sri Lanka. The commission will have to work with information already available outside of Sri Lanka and with any evidence supplied by anyone in Sri Lanka who dare communicate with the commission.
On further clarification on the resolution -regime propaganda, the contortions and distortions of the Minister and various other acolytes aside, the point that needs to be borne in mind and the lesson that needs to be learned in respect of foreign policy is that, notwithstanding their dislike of single-country resolutions and whatever other misgivings they might have had with regard to the resolution on Sri Lanka, 12 countries from the global South abstained – yes, they did not vote with the US; more importantly they did not vote with the Rajapaksa regime.  All these countries surely know that a resolution in the UNHRC is passed with a simple majority. Therefore, abstention facilitates rather than impedes the passage of a resolution. Regime foreign policy makers should take serious note of this instead of indulging in such ridiculous casuistry.  It is an insult to the polity.
The prospect of policy revision by the regime is dim and distant.  We were treated to a foretaste of the regime’s response even before the vote was taken in Geneva.  Human rights defenders Jeyakumari and her daughter, Father Praveen and Ruki were detained – the latter two subsequently released.  We are told that the LTTE is re-grouping even within Sri Lanka and that an individual named Gobi has been tasked with the responsibility for this. Jeyakumari and her daughter are supposed to have given sanctuary to this individual; yet in the highly militarized Vanni, Gobi is yet to be found.   These incidents have been followed by further detentions and search operations in the north – according to some accounts between 30-40 have been taken in.  Finally, there is the ban on 15 diaspora Tamil organisations, pursuant to the UN anti-terrorism resolution and under our PTA, on the grounds that they have LTTE links.  Any contact here or abroad with these organisations is prohibited and carries severe penalties.
The priority of the regime appears to be to stop the flow of information from the ground, nationally and internationally, so that the civil society counter-narrative to its propaganda can be challenged on the grounds of being woefully deficient in terms of hard facts and dismissed, therefore, as largely accusatory and fabricated.  The banning of the diaspora organizations also serves the purpose of restricting the flow of funds to the north and east and to the TNA for developmental work and social welfare, in addition to attempting to de-legitimise the international investigation on the grounds of the engagement of these organisations with it.  The regime will argue that the investigation is based on information provided by pro-LTTE sources.
Then lumping together of a number of diverse organisations and tarnishing them with the same secessionist brush is probably no accident.    Anyone with a smattering of information and knowledge of Tamil diaspora politics would not lump all these organisations together unless the objective is to paint them all as extremists and thereby marginalize them.  Are there not moderates amongst them?  Is the TNA to be banned next?  What of reconciliation?  Is it to be achieved only through engagement with KP and Karuna and no one else?  Who in the diaspora can participate in the South African initiative for truth and reconciliation?  Wasn’t the diaspora supposed to be a key stakeholder in this and one the regime was especially interested in engaging?
The question then arises as to why such action is being taken. Is it necessary? Is it disproportionate?  What signals does it send, nationally and internationally? As for the former, available evidence suggests that the detentions, searches and the ban are having a chilling effect on life in the north – again, probably as intended.  Internationally, the message conveyed could well be of a country not quite as yet at peace as trumpeted, but rather of one in danger of reverting back to the future?  Is this intended, as well?
The answer probably lies in the investigation and the sustenance of a rationale for maintaining the high level of militarization and draconian anti-terror legislation. Furthermore, there are the political benefits to the regime from its self-portrayal as the defenders of the nation against a resurgent LTTE.
Given the sound and fury unleashed by the regime at the recent provincial elections over the Geneva resolution and its threat to sovereignty, a much higher turn out in its favour could have been expected at the polls.  That this did not materialise clearly indicates that it is a card of diminishing returns.  Two caveats are in order though, a presidential election may be a different story and their best efforts to put the best face on the elections results notwithstanding, it is clear that the main opposition party is yet to convince that it is a convincing alternative to the current disposition.
Politically, the country is in a sense, in limbo.  The regime’s popularity is decreasing; that of the opposition is not increasing anywhere near what is required to win elections.
Changes are in the making though in terms of truth and accountability.   Gradually, may not be to the satisfaction of most, but it may be the only way for change at present.
