If an ethnic group which accounts for 4% -10% of the populace is defined as a nation, just how small does an ethnic group have to be, to be recognised as a national minority or minority nationality? As Minorities Are there no such entities, in the Chief Minister 's scheme of Things?
The basic points I am making here do not change even if one were to prefer the higher figure of roughly 10% for the Sri Lankan Tamils which is found in certain source material. The UN Chairperson of the Working Group on Minorities, Prof Asbjorn Eide of Norway, clearly stated on a working visit to Sri Lanka during the CFA years, that going by international, and chiefly UN criteria, Sri Lankan Tamils are not a nation enjoying the right of self determination but a national minority deserving of equal rights and enjoying, arguably, the right to autonomy.

It is not merely the Sinhalese who do not accept the Tamils of Sri Lanka as a nation without a state. No country does. Most importantly, the Two Nations and goes against the thesis is rejected by

Can any democratic political party in the island's South, ranging from the UNP to the JVP, be convinced into recognizing the Sri Lankan Tamils of the North and East as a nation? If not, isn't the Chief Minister's very definition of the problem such that it precludes a solution? In the alternative, doesn't the Chief Minister's definition of the problem, which precludes domestic support from the South, leave an externally propelled partition as the only 'solution'? Was that the problem from the very start?
Perhaps still more negative is the other consequence of Chief Minister Wigneswaran's thesis. By classifying the Tamils of Sri Lanka as "a nation without a state" rather than a minority without autonomy or equal rights, he deflects the struggle for the achievable goals of minority rights and more equitable inter-ethnic relations, devolution of power and anti- discrimination, pre-empts a civil rights movement and locks the Sinhala and Tamil communities into the protracted zero-sum game of a struggle over nationhood - an eternal tribal conflict-on this small island.

Senior UNPer Gamini Jayawickrema Perera told The Island that the government was planning to take another 'long nap' as it had done after the first two UNHRC resolution against it were passed, but India had called for a domestic probe assisted by the UNHRC into the war crimes allegation against the Rajapaksa regime and the LTTE.
Asked what the UNP thought of the stand taken by India, he said: "It is reasonable since it will help prevent foreign interference in our country's affairs. The Rajapaksa's and their mouthpieces should at least now stop talking and listen to good advice. If they continued to be stubborn and refuse to come down from their high pedestal, the people and the country will have to suffer ultimately considering the powerful forces that had ganged up to obtain a UN mandate for an international war crimes probe on Sri Lanka. "
Jayawickremea Perera said that India had abstained on the UNHRC vote against Sri Lanka as a matter of principle and not because it was indifferent to what was happening in the Wonder of Asia just across the Palk Strait. "The powers that be were foolishly trying to justify their failure to speedily implement the key LLRC recommendations by claiming that only 12 voted for the UNHRC resolution, while 12 each opposed and abstained making it 24 votes in its favour. This sort of approach has worked only locally for the Rajapaksas all these years. But the results of last week's Western and Southern Provincial Council Elections have proved that the masses are also beginning to slowly but surely realise the stupidity of those in charge of their destiny. "
New Delhi has time and again complained of failure on the part of the Rajapaksa administration to honour its pledge to fully implement the 13th Amendment to the Constitution and the key LLRC recommendations aimed at establishing good governance and the rule of law, he noted.

Then again I feel a bit miffed that Ketheeswaran from Erukkalampiddy who is minding his own business of running the off-licence in London is a wanted person whereas I who have been lambasting the government am free to travel to Sri Lanka. Gotabhaya must have been thinking that scribes are simply doing their job and any publicity is better than no publicity; ergo he supports me and who knows will welcome me with an embrace (grr, not a pleasant thought) as the wheels of the aircraft ground to a halt on the tarmac of BIA in my once blessed and now blighted land and I feel the warm air touch my face.
Where is the justice and where is the thrill? Am I not going to get my 15 minutes of fame as Andy Warhol predicted? I should have allied myself to some off-shoots of the LTTE and shouted slogans like down with Rajapaksa; down with Sinhala hegemony in front of the UN compound in Geneva but I could not afford the time or money since I have to pay rent and bills and forfeit my salary by fighting for justice to Tamils.
UK is not Sri Lanka where neighbours would sympathise with you when you are down and out and see to it that you don't go without food. My Enderamulla neighbours would gladly send round a plate of rice if they could not see smoke coming out of my chimney so to speak like Mrs Lankage. Only the other day when I called her on the telephone she said, "Pearl, oya mehe enda. Mama Somatunga'ge kambare oyata thennang. Eya bimme buthiya ganda puluvang ".
That Somatunga had been sleeping on the floor as revenge since he had a discreet relationship with a housemaid when he was in Saudi is not lost on me.

Fr SJEmmanuel. He went to Italy in September 1965 along with three other priests and my father. While my father paid his own way for his studies in Fine Arts at Perugia University, Rev. Fr SJE and his colleagues were supported by Rt Rev Bishop Emilianuspillai, cousin of Fr Peterpillai who founded Aquinas College of Higher Education, and they were already in robes. To be wearing a robe one has to have undergone years of seminary education. Seminarians are allowed to attend universities.
I have known Fr Seemampillai as he was then known personally. He used to visit my father at our house and I have great respect for him. I still have a photo of him in robes when he left for Italy in September 1965 along with my father (rescued from the photo album in July 1983 debris and with which I arrived in London), the only layman in the group. I have also known him since his return and he was a pious and humble priest in the parish of St Mary's Cathedral in Jaffna. He was the last priest who aspired to becoming a bishop. His service was to God and humanity and he was not at all a materialistic person.

Although my Colombo neighbours Somatunga and Mrs Lankage are illiterates, their children always worshipped them on their knees before leaving the house to go school or anywhere else. They are true Buddhists with that 2,500 year old culture. Thank the Lord and thanks to the sacrifice their parents made, they are now holding good positions as lawyer, air hostess and government civil servant. But then DBS would not know anything about religion or fear of God. His world is all about himself and how he can accumulate.

Today, the 5 TH of April 2014, Marks Lasantha 's Birth 55 years ago. Five birthdates have come and gone and his family, friends and colleagues still remember Lasantha with affection. Is the pain less for those near and dear to him, after a lapse of five years? I say ... No.
Many changes have taken place in Sri Lanka during the past five years and it is natural to wonder what impact, if any, Lasantha would have made, had he been alive. Most certainly he would have had plenty to say and say he would have aired his views, with a vengeance. Would he have influenced change or made a difference? He may have. He may not have.
In hindsight, I believe he would have been murdered nevertheless for what he stood for. It was a time when there was no space in Sri Lanka for someone like Lasantha. By not bringing those responsible to court, it is justifiable to believe that Lasantha was a "common enemy" and not worthy of bother in the bigger scheme of things.
Lasantha lived news and what could be termed "of politics". His Suranimala column was digested with coffee by his readers on a Sunday morning. I am aware that many were stung by his exposures. One businessman, who thrived on government contracts and armament supplies, gloated over his murder. His exact words? "He was killed like a dog on the streets ... Damn Good". He did not know Lasantha but was stung by what he wrote. I felt sad that a human being could condemn another's right to life, purely for monetary gain. But I digress.
Lasantha was not right all the time. Nor was he wrong. But he should have been afforded a full and natural life. He would have enjoyed his three children. He would have watched Sri Lanka reach the finals of the T 20 World Cup. He would have enlightened us each Sunday. But mostly, our elected legislators and bureaucrats would have been kept on their toes.
Was it such a crime that he had no right to life? More so, should the perpetrators and those who ordered his murder continue to be shielded for some incomprehensible reason? They too have had five birthdates since his death!!
Insiders say that the decision makers who order the termination of perceived trouble makers, may not see eye to eye after the deed but continue nevertheless to safeguard the foot soldiers who carry out such instructions.
It's time for Sri Lanka to give Lasantha a birthday present. Bring those responsible for his murder to court. The Police can. Someone just needs to give the order.

Pathmanathan KP was known As the Chief procurer of arms and the LTTE's Head of the 'Department of International Relations.' He is said to have also been involved in LTTE's administrative matters. On 5 August 2009, Sri Lankan Intelligence agents captured and deported him to Pathmanathan in Southern Sri Lanka.
In an order issued under the UN Act No 45 of 1968, a backdated extraordinary broskev No 1854/41 of 21 March 2014 was issued by the Defence Ministry. The groups have been designated by an order issued by External Affairs Minister Prof. Indicative GL Peiris and Operational aspects of the applicability of the ban.
The list includes natural persons, Legal persons, entities and Groups.
The banned organizations are: LTTE, Tamil Rehabilitation Organization (TRO), British Tamil Forum (BTF), Canadian Tamil Congress , Australian Tamil Congress, Transnational Government of Tamil Eelam (TGTE), Tamil Coordinating Committee, World Tamil Movement, Global Tamil Forum (GTF), National Council of Canadian Tamils, Tamil National Council, Tamil Youth Organization, World Tamil Coordinating Committee (WTCC) , Tamil Eelam People's Assembly,
Tamil Relief Fund (WTRF) and the Headquarters Group.
The LTTE First Temporarily proscribed in 1978 had lifted the ban in 1987 consequent to the Signing of the Indo-Lanka Peace Accord. The ban was reimposed in 1998 following the bombing of the Dalada Maligawa but was again suspended in 2002 during the political dialogue between the UNP Government and the LTTE. Again the LTTE was proscribed in 2009, to which Remains Effective Date, Though defeated by the Sri Lankan Security forces in May 2009.
At the International level,

Tamil Diaspora groups to take legal action against proscription

The Global Tamil Forum (GTF) has reportedly said it will deploy all legal and political instruments that are at its disposal to send a clear message to the regime that none of these 'terror' tactics will work as they live in a free society where they cherish freedom of speech and democracy and democracy not as defined as in Sri Lanka but practicing democracy.
The Canadian Tamil Congress (CTC) has been quoted in Colombo Gazette saying it will seek the intervention of the President of the UN Human Rights Council, the Canadian government, and various international non-governmental organizations, many of whom have already voiced their indignation at the proscription.
Meanwhile, the Transnational Government of Tamil Eelam (TGTE) has said it is expecting the International community to denounce the "anti-democratic" measure.
The government recently listed 16 Tamil Diaspora groups under a UN Security Council resolution which seeks to curb finding for groups linked to terrorism.
GTF spokesman Suren Surendiran has been quoted in the media as saying that the proscription proves that President Mahinda Rajapaksa is bankrupt of political will to even attempt to resolve the root causes of the Tamil National Question. He has said that as the UN Human Rights Commissioner acknowledged after her visit to Colombo in August 2013 and in her recent report, Mahinda Rajapaksa's authoritarian tendency is now giving rise for him to think that he can suppress freedom of speech even overseas.
"By creating fear and by allowing 'terror' through white van abductions, killings and by targeting local media organisations and personnel he has successfully suppressed freedom of speech internally in the island. Now by proscribing organisations in Sri Lanka, Mahinda Rajapaksa is trying to intimidate members of international organisations like the Global Tamil Forum to give into his 'terror' tactics. It's a proven fact through the percentage votes his party gained in the recently held elections that his popularity internally too is weakening. UNHRC has given the authority to the Office of the UN HR Commissioner to initiate an international investigation into alleged breaches of international law in Sri Lanka. Fear has set in due to these combined reasons, is the only conclusion that can be drawn for his idea of proscription of organisations that function overseas . This is a typical reaction of dictators, "he said.
A Flawed Triumph And Dilemmas Of The Elite
Purely from the point of power relations, 1990 began as a bright year for the Premadasa Government. The tide had definitely turned in the fight against the JVP, with the key leaders dead. The killing rate was still high in the South and in the North-East, but that did not seem to matter. The Indo-Lanka Accord was undermined and the Indian Peace Keeping Force was set to withdraw. The LTTE and the Government seemed the best of pals and were jointly picking off members of the Tamil opposition. The opposition in the South was in total disarray.
If one did not have a historical perspective of the UNP's record of repression and regular resort to violence against some section of the civilian population, the JVP would appear to be a demonic menace that suddenly descended on this country. Did not Premadasa and Ranjan Wijeratne bring it under control as only those who had no qualms about 'fighting fire with fire' could? Should not the squeamish and vacillating opposition be grateful to them for saving their skin? Was there any role left for them to play? Were they not joining the UNP in droves?
All these factors in favour of Premadasa turned out to be illusions. His own success with the resulting overconfidence was his worst enemy. The UNP's unprincipled style of crisis management thrived on uncertainties and the more the uncertainties, the greater the prospect of disaster. Being committed to the early departure of the IPKF, he could have taken a principled approach. He could have talked to all the Tamil parties and told them that the minimum on their side must be a commitment to the democratic process. CTC categorically rejects the Sri Lankan Government’s reactive measures to the recent UN Human Rights Council resolution on Sri Lanka.

Last month, United Nations Human Rights Council Resolution 25/1 mandated the Office of the High Commissioner for Human Rights to conduct an independent investigation into, “serious violations and abuses of human rights and related crimes by both parties in Sri Lanka,” which was seen internationally as a victory for human rights in Sri Lanka.
It is with great respect for international law that the Canadian Tamil Congress (CTC) has advocated since 2009 for the establishment of an independent international investigation into human rights violations committed by both sides in the armed conflict in Sri Lanka, as well as into the ongoing abuses of human rights in the country. It is evident therefore that the recent proscription of CTC by the Sri Lankan government, and its baseless allegations, are a direct response to the successful establishment of such an independent inquiry through the Human Rights Council’s resolution. Under the guise of counter-terrorism, the Sri Lankan government is clearly attempting to hinder the upcoming investigation in any way possible, by preventing and de-legitimizing the work of human rights defenders on the ground in Sri Lanka and attempting to curb the flow of information regarding the human rights situation internationally.
CTC is an organization that fundamentally believes in principles of human rights, openness, transparency and accountability, and operates in conformity with Canadian and international laws.We invite interested parties to review the recent judgment of the Ontario Superior Court, ruling in favour of CTC in a libel case against Sri Lankan-born ‘terrorism expert’ Rohan Gunaratna, who had been quoted as saying, “the LTTE is operating under the name of the Canadian Tamil Congress, which is the main LTTE front organization in Canada.” In his ruling , Justice Stephen E. Firestone found, “it is unequivocal and uncontroverted that [Gunaratna’s] statements were, in fact, false and untrue,” and awarded damages to CTC in the amount of $ 53,000. In this light, CTC categorically rejects the Sri Lankan government’s proscription of CTC as funding or supporting terrorist activities.
"The work that CTC does in regard to Sri Lanka has always been and continues to be focused on improving the human rights situation, in conformity and with respect for international law," stated David Poopalapillai, national spokesperson for the Canadian Tamil Congress.
"This is a cynical attempt to silence that work. Sri Lanka cannot continue to vilify human rights defenders by resorting to accusations of ‘terrorism’. It is unfortunate, that the government of Sri Lanka is unable to concentrate on seeking justice and accountability, resorting instead to such low tactics and fear mongering "concluded Poopalapillai.
Governed by an increasingly authoritarian regime, with a politicized judiciary, Sri Lanka by all measures is a failed state. Critics of the state are slandered by the government, the rule of law is in tatters, and national institutions are firmly under executive control. It is in this context then that the Sri Lankan government has proscribed CTC, as an attempt at sidelining a vocal and effective critics of Sri Lanka’s gross human rights violations and breaches of international law. In addition to being utterly baseless, the proscription, signed by Defence Secretary Gotabhaya Rajapaksa, also permits the usage of the draconian Prevention of Terrorism Act by the Sri Lankan government against individuals found to be working for or with any of the proscribed organizations. These actions run in the same vein as consistent attempts by the Sri Lankan government to intimidate, harass and silence the voices of human rights defenders in Sri Lanka, most recently this past month during the session of the Human Rights Council. Furthermore, these measures make impossible any form of meaningful dialogue between all communities and parties affected by the conflict in Sri Lanka, including the Tamil diaspora, and show clearly that the Sri Lankan government’s rhetoric on reconciliation is entirely superficial.
The Canadian Tamil Congress is presently considering all possible actions, including legal remedies that may be taken to respond to this slanderous and malicious decision by the Sri Lankan government. CTC will seek the intervention of the President of the UN Human Rights Council, the Canadian government, and various international non-governmental organizations, many of whom have already voiced their indignation at this proscription. We call upon the Canadian government and the international community to condemn these actions of the Sri Lankan government.
The Canadian Tamil Congress has long been a fervent critic of the human rights abuses perpetuated by and within the Sri Lankan state. CTC will not allow such fear-mongering tactics to dissuade our organization, and we will continue to work resolutely for the human rights of all Sri Lankans, and to seek truth, justice and peace for Tamils.
