International investigation now: Solidarity groups launch social media campaign!

Transnational solidarity groups have launched a Social Media Campaign, using Facebook and Twitter, to call for an International Investigation on Sri Lanka at the upcoming United Nations Human Rights Council session in March.
Already United National High Commissioner Pillai has called for an International Investigation for Sri Lanka. Several international organizations like International Crisis Group, Amnesty International and Human Rights Watch are also campaigning for International investigation.
In a powerful endorsement to this investigation, Sri Lanka’s Northern Provincial Council has unanimously adopted a Resolution calling for an International Investigation to investigate War Crimes, Crimes Against Humanity and Genocide.
So far the call to establish an International investigation was advocated only by International NGO’s and diaspora groups like Transnational Government of Tamil Eelam (TGTE). This is the first time; Tamils within Sri Lanka through their elected representatives have called for such an investigation.
There are reports that several countries are planning to introduce a Resolution at the upcoming UN Human Rights Council Session calling for an international investigation for Sri Lanka.
In the past China and Pakistan have led the campaign to oppose any such Resolution against Sri Lanka.
The call for international investigation is to investigate killings that took place in the final months of the war between Sri Lankan Government and Tamil rebels called Tamil Tigers.
According to a UN Internal Review Report on Sri Lanka, troops under the Sri Lankan President's command, killed over 70,000 Tamils in five months in 2009, mainly due to bombing and shelling of Tamils who were cornered into places designated by the Sri Lankan Government as “No-Fire Zones.” Food and medicine were also restricted to the trapped Tamils resulting in several died of starvation, sickness and many of the injured bleeding to death.
There are also reports of sexual violence against Tamil women by Sri Lankan Security forces. According to a May 2012 report by the British Foreign and Commonwealth Office on Human Rights and Democracy; there are up to 90,000 Tamil war widows in the North & East of Sri Lanka.
UK’s Channel 4 has produced series of documentaries on mass killing of Tamils during the war.

Tamils For Obama Calls For A Referendum On Independence

Tamils for Obama, an US lobby group has written to Secretary of State John Kerry urging him to include a referendum for independence and protection for the Tamils against GOSL retribution in the resolution. The Group had sent a letter to Kerry that has highlighted the need for the UNHRC resolution by the US to include a referendum in northeastern Sri Lanka, similar to the one that took place in South Sudan. The group demanded that the referendum must be about what kind of government the Tamils in the northeast want for themselves.
The letter began by thanking the US for its past support at United Nations Human Rights Council (UNHRC) sessions. “We at Tamils for Obama would like to thank the US State Department for raising and passing two resolutions at the UNHRC in support of justice and historical truth in Sri Lanka,” the letter said, and then introduced ” an expected resolution calling for an international investigation into Sri Lanka’s deeds in the 2009 ethnic civil war.”
The Tamils for Obama letter went on “We urge the US to call for a referendum in the northeast of Sri Lanka similar to the one conducted in South Sudan. We concur with Tamil Nadu Chief Minister Jayalalithaa that the Sri Lankan Tamils who were driven out of the country by GOSL oppression should be permitted to vote in this referendum.
“The referendum,” the letter said, “must be part of this UNHRC resolution, and must include choice of government. This is every people’s democratic right: to choose their government and the kind of country in which they will live. This is a US principle, going all the way back to the Declaration of Independence, and we want it for the Tamils.”
“This is an important point,” the spokesman said. “We Tamil Americans all believe it strongly, and we think Secretary Kerry must believe it too.”
The letter concluded “The GOSL reacts with cruelty and violance whenever they are opposed, and their cruelty and violence are usually directed at the Tamils. A way to protect the Tamils from GOSL retribution must be found, and must be included in the UNHRC resolution.”
Tamils for Obama is a politically active group of Tamil Americans. They believe that over 70,000 Tamil civilians were massacred during the last weeks of the Sri Lankan ethnic war. They have also watched the behavior of the Sri Lankan Singhalese victors after the war, and strongly conclude that Tamils in Sri Lanka will only be safe when this unfortunate island is divided into two states.

(Lanka-e-News-01.March.2014, 10.00PM) The verdict given some time ago by the appeal court based on a directive of the supreme court (SC) itself relating to the impeachment motion against the former chief justice, was amended by the SC recently because Saleem Marsoof the president of the panel of judges who sat in the latest hearing , is a captive held firm within the grip of Medamulana MaRa who has in his possession details of a crime committed by Marsoof, according to reports reaching Lanka e news inside information division.
The decision earlier on given by the SC was , the Parliament standing order 78A empowering the speaker to appoint a select committee for appointment of judges pertaining to the impeachment motion is null and void in law.
Marsoof the President of the present panel of judges of the SC had at the outset been against the overturning of the previous SC decision which stated that such an appointment is invalid in law and violates the constitution . Marsoof being the President of the panel , there was ample room for the others in the panel too to give their assent to his decision . However ,one of the judges of the panel who is a MaRa’s stooge has sneaked on this to MaRa. The present chief justice Mohan Peiris the notorious Pachoris ( Cheat Justice) has then come to MaRa’s rescue and proffered advice revealing the following information about Marsoof to MaRa :
The police some time ago seized a load of timber when it was being transported from Nikaweratiya to Puttalam. This timber had been transported for the construction of Marsoof’s house. Marsoof had enlisted the assistance of a lawyer in the attorney general’s department to get the lorry released. The name of that lawyer is Malin Dhanansuriya who had intervened and released the lorry. The present CJ ( cheating justice ) Peiris alias Pachoris was the AG at that time , and he had come to know of all the details of this racket.
Medamulana MaRa who became aware of it through Peiris had taken into his custody all the files relating to the timber transport . Thereafter he had made Marsoof his captive via veiled threats inducing Marsoof to amend the very sacrosanct decision of the SC. Marsoof who descended to the level as low as that of a dog was forced to eat his own excreta having no other place to go to eat or defecate after becoming MaRa’s captive.
In the end Saleem Marsoof like several others who are held captive by MaRa had to stoop and condescend to MaRa ‘s orders thereby giving a corrupt court verdict in order to cover up his own fraud. In other words , MaRa and Marsoof achieved their dastardly illegal goals together sacrificing the national and judicial interests of the country at the altar of their selfish opportunistic ambitions.

The Impeachment Closure: Too Much Learnedness, Too Little Truthfulness; And Homage To A Judge
I have heard a story about a little known University Lecturer in Mathematics and a well-known Queen’s Counsel Lawyer in Colombo. The lecturer did not agree with a circular put out by his university administration regarding the terms of employment of university teachers. Being a man of logical mind, he thought that the circular was illogical, wrong, and unjust. Being also a principled man, he wanted to challenge it whereas all his colleagues went about their business of teaching unconcerned about the circular. So our mathematical man took his anxiety to another level and got a referral to the Queen’s Counsel of this story. At the appointed time, the little known lecturer walked into the intimidating palatial house of the lawyer in the heart of Colombo, and was then led by the house valet into the even more intimidating chamber of the great QC. The lecturer stated his problem, the learned lawyer read aloud the relevant law, and gave his considered opinion. “It does not quite follow”, deadpanned the mathematician. The meeting did not go much longer after that impertinent contradiction.
Government won’t join counter resolution at UNHRC – GL
External Affairs Minister Prof. G.L. Peiris said that Sri Lanka will not join friendly countries to present a counter resolution at the UN Human Rights Council (UNHRC) in Geneva in support of Sri Lanka. The Minister has made this statement at a meeting between President Mahinda Rajapaksa and foreign correspondents based in Colombo.
The President has reportedly told the foreign correspondents that there seems to be hidden factors behind the US move to submit a resolution on Sri Lanka at the UNHRC.
He has observed that the evidence referred to by the international community should be forwarded to the government if there is any such evidence to prove the allegations against the government.
The President has added that the government would look into such evidence if it is presented to them.
Sri Lanka solidarity group boycotts SL govt delegation

The South African Solidarity Group for Peace and Justice in Sri Lanka (SGPJ) this week called for a boycott of the Sri Lanka Government Delegation currently in South Africa ostensibly to study the historical Truth and Reconciliation Commission process that followed post-apartheid.
The SGPJ was initiated by late Minister Roy Padayachie to co-ordinate Tamil Diaspora Organizations support in South Africa in championing the struggle against Human Rights violations in war-torn Sri Lanka, even after the war had “ended” following the massacre of the indigenous Tamil Leaders.
This week, a Sri Lankan (SL) Government delegation led by Mr. Nimal Siripala de Silva, Leader of the House and Minister of Irrigation and Water Resources Management, visited South Africa on 20 and 21 February 2014 for discussions with the African National Congress Party. According to the SL Government spokesperson, the delegation’s discussions was primarily in relation to the South African Truth and Reconciliation Commission, with the aim of understanding the manner in which that exercise can help in Sri Lanka’s own reconciliation process.
However, the SGPJ, together with many world Governments and other international support Organizations, have denounced the visit as an attempt to legitimise the atrocities alleged to have been committed by the Sri Lankan Government, during and after the war. The current Sri Lanka Government of President Mahinda Rajapaksa has come under heavy fire by the Canadian and British Governments, among others, for its brutal repression of the indigenous Tamils and the “white-washing” of the so-called post-war reforms.
In 2013 UN Human Rights Commission (UNHRC) passed a Resolution expressing concern at continuing reports of violations of human rights in Sri Lanka, and reiterating the call on the Government of Sri Lanka to implement the Commission’s recommendations and to fulfil its commitment to conduct an independent and credible investigation into allegations of violations of international human rights law and international humanitarian law. The UNHRC will again convene in March this year with the UN Human Rights Commissioner, ex-Judge Navi Pillay leading the process.
In August 2013, after her week-long visit to Sri Lanka, Commissioner Navi Pillay called for an international probe into war crimes committed in Sri Lanka during the final stages of its ethnic conflict. Her report, said to have been given to the Sri Lankan government at the time, recommended the setting up of an international inquiry mechanism to further investigate the alleged violations of international human rights and humanitarian law and monitor any domestic accountability process. The report also mentioned the emergence of new evidence on what happened in the final stages of the armed conflict, Colombo-based newspaper The Sunday Times, which claims to have accessed the report, said. The report said she reiterated concerns about the continuing trend of attacks on freedom of expression, peaceful assembly and association; rising levels of religious intolerance; and continued militarization — points she had emphasized while wrapping up her visit.
The SGPJ, which works in close collaboration with most SL Diaspora Organisations and other Human Rights champions, has reliably learnt that twenty-three countries will vote for the US resolution against Sri Lanka at the upcoming United Nations Human Rights Council (UNHRC) sessions in Geneva in March.
According to the prediction, the 23 countries that will vote against Sri Lanka are –Czech Republic, Estonia, Montenegro, Romania, Austria, France, Germany, Ireland, Italy, United Kingdom of Great Britain and Northern Ireland, United States of America, Republic of Korea, India, Peru, Argentina, Brazil, Chile, Costa Rica, Sierra Leone, Côte d'Ivoire, Benin, Mexico and the former Yugoslav Republic of Macedonia. It is significant that India is also expected to vote against Sri Lanka.
The SGPJ and other support Organizations in South Africa have therefore reinforced this call to refuse legitimacy to what they deem to be a sham appeal to South Africa for guidance – in their view, a desperate quest by the SL Government for legitimacy to hide the truth as recognised and seen by most of the world bodies.
Aligned with its call for the rejection of this SL Delegation, is their call to the South African Government to join the world super-powers in publicly denouncing the efforts of the Rajapaksa as falling far short of the independent investigative processes that need to take place and which have been recommended by the UNHRC.

Secret deals at UNHRC: Govt. has let down armed forces, country – Kiriella

The government had entered into secret deals with the United Nations Human Rights Council (UNHRC) and let down the armed forces and the country, the UNP alleged yesterday.
Vice Chairman of the UNP Lakshman Kirielle, MP, told the "Sunday Island" that some Ministers were behaving like a bunch of jokers by making stupid statements on accountability issues while covert pledges had been given to the UNHRC.
The Rajapaksa regime which claimed to be the most patriotic in Sri Lanka’s history has in private communications to the UNHRC assured that some security forces personnel would be prosecuted for violations of international humanitarian law during the last stages of the war with the LTTE which ended on May 19, 2009, he alleged.He added the undertaking included that: "……. members of the armed forces or other officials involved in such mala fide conduct or omissions would be dealt with under the disciplinary procedure set out in the Army, Navy and Air Force Acts and in the case of Police Officers under the Establishment Code. Criminal charges would also be filed against such officers."
The MP pointed out that though President Mahinda Rajapaksa had publicly rejected the Darusman Report on accountability issues, his administration had forsaken the security forces and the people by its secret pledges to the UNHRC."
``It is because of this and many other assurances that the United Nations was demanding a credible and independent Sri Lankan inquiry be held into alleged violations of international humanitarian law and not because, as foolishly claimed by a minister, that it was due to the UNP moving a no confidence motion against the government for its failure to rein-in cabinet ministers who have been accused of being involved in narcotic drug dealings. It is high time the current crop of leaders grew up and stopped blaming the UNP for their idiotic actions."
The Rajapaksa regime’s duplicity in publicly claiming that civilian casualties were zero while privately admitting to violations of international humanitarian law had placed the country in the dock, he observed.
"If Sri Lanka rejects an internal investigation, then it would lead to an international probe which would be held ex parte and innocent people could be prosecuted. But if the government implements its private pledge to the UNHRC for an internal inquiry, then it could cross-examine the witnesses", Kiriella noted, recalling that in the Lockerbie trial a suspect tried in absentia was found guilty on scanty evidence.
He urged Ministers G.L.Peiris and Mahinda Samarasinghe to take up his invitation for a friendly debate so that some sense could be driven into to the powers that be to abandon their suicidal approach which, if pursued at the 25th UNHRC annual session which begins tomorrow in Geneva, would be detrimental to the country’s image and integrity.
Fireworks In Cabinet: Mahinda Asks Hakeem To Decide On His Future With The Govt
It is reported that President Mahinda Rajapaksa lashed out at Sri Lanka Muslim Congress (SLMC) leader Rauf Hakeem at the recent Cabinet meeting demanding that he and his party decides whether they would wish to remain within the government. The President’s wrath has been incurred by what is widely speculated to be a document that was given by some SLMC members to UN Human Rights Council chief Navi Pillay during her visit to Sri Lanka in August 2013. The document cited hundreds of attacks on Muslim and Christian places of worship. Navi Pillay’s recent report at the UNHRC had cited the SLMC document as evidence of the Rajapaksa’s regimes anti minority activities.
It is well known that the anti Muslim and anti Christiancampaigns launched by groups such as the Bodu Bala Sena and Ravana Balakaya have been getting the approval and patronage of Secretary to the Ministry of Defence Gotabaya Rajapaksa and the ruling regime. The leading Sinhala nationalists within the government, Ministers Patali Champika Ranawaka and Wimal Weerawansa had raised questions about the SLMC document at the Cabinet meeting. President Rajapaksa, who align with these elements within his Cabinet rather than with how own more moderate party, the Sri Lankan Freedom Party, have lambasted the SLMC and its leader Hakeem.
A visibly angry President Rajapaksa had asked Minister Hakeem about the document given to Pillay. Minister Hakeem had told the President that in as much as the President did not have control over some of the UPFA members he too had no control over some of SLMC members. He had told the President that it was not him butthe SLMC Secretary who had given the document to Ms. Pillay. It was at this point that President Rajapaksa had asked Minister Hakeem to decide whether he wished to continue as a minister in the UPFA Government.
Interestingly the Rajapaksa regime has never denied its involvement with the Buddhist groups such as the Bodu Bala Sena or the Ravana Balakaya which have openly carried out numerous attacks against minorities.
It is also interesting that at the UNHRC last year all the Muslim countries either voted with Sri Lanka or abstained. The United States has cited the State sponsored attacks against Muslims to lobby these countries to vote with them this year. It would be interesting to see how countries such as Saudi Arabia, Kuwait, UAE etc. view these latest developments where the minorities in this country are targeted by State sponsored groups.

The ideological clash between the extremist nationalist elements in the Cabinet and the moderate members has now come out in the public.
Ministers Vasudeva Nanayakkara, Rajitha Senaratne, Douglas Devananda, D.E.W. Gunasekera, Tissa Vitharana, Reginald Cooray, Deputy Minister Navin Dissanayaka and parliamentarian Wasantha Senanayake together with a group of intellectuals have compiled a report on how the government could overcome an adverse situation for the country at the UNHRC.
However, Ministers Wimal Weerawansa, Patali Champika Ranawaka and Rohitha Abeygunawardena have criticised the report.
Meanwhile, the moderate group of ministers are also disgruntled that President Mahinda Rajapaksa had yet failed to acknowledge the report presented by them.

The state owned Dinamina newspaper has published with equal prominence two stories on the report submitted to the President. One news story is a positive one while the other is a critical story on the report.

Burma Suspends All Aid Operations of MSF

RANGOON — The government has suspended all operations of Médicine Sans Frontièrs (MSF) in Burma following disagreements over the implementation of aid programs in Arakan State, where the group offered vital medical aid to Rohingya Muslims.
MSF said in a statement Friday night that it was “deeply shocked by this unilateral decision and extremely concerned about the fate of tens of thousands of patients currently under our care across the country.”
The President’s Office spokesman Ye Htut told The Irrawaddy earlier on Friday that MSF Holland’s projects in Arakan State had violated certain conditions of its memorandum of understanding (MoU) with the government.
He said the alleged violations had led to a government decision to refrain from renewing the current MoU, which had expired last year.
On Friday afternoon, it seemed that discussions were still ongoing on whether or not MSF operations in other regions could continue, but a MSF statement released around 8 pm said all medical aid operations had come to an end.
“Today, for the first time in MSF’s history of operations in the country, HIV/AIDS clinics in [Arakan], Shan and Kachin states, as well as [Rangoon] division, were closed and patients were unable to receive the treatment they needed,” MSF said.
“TB patients were unable to receive their life-saving medicine, including drug-resistant TB patients. This decision by the Union Government will have a devastating impact on the 30,000 HIV/AIDS patients and more than 3,000 TB patients we are currently treating in Myanmar.”
“In [Arakan] state, MSF was unable to provide primary health care to the tens of thousands of vulnerable people in camps displaced by the ongoing humanitarian crisis or in isolated villages,” the group said.
“There is no other medical non-government organization that operates at the scale of MSF with the experience and infrastructure to deliver necessary life-saving medical services,” the group said.
MSF Holland has operated in Burma since 1992 and implements medical aid projects in Arakan, which has suffered from inter-communal violence between Rohingyas and the Buddhist Arakanese majority, and in Shan, Kachin and Karen states, which are affected by ethnic conflict.
The US Embassy said on Friday afternoon that it was aware of the reported suspension of MSF operations and voiced concern over the impact on local communities.
“The United States encourages the Union Government to continue to work
with the international community to provide humanitarian assistance to
communities in need and to ensure unfettered access for humanitarian
agencies, in accordance with international standards,” the embassy said.
Ye Htut said he attended meetings in Naypyidaw with Health Ministry officials Friday, where MSF was informed of supposed wrongdoings during aid work in Arakan State.
He said MSF had deployed more foreign staff then it was allowed to, had failed to stay impartial and neutral, and had run a medical care clinic for newborns against the wishes of the government.
“I told them how they had violated their agreement at a meeting today and … they admitted that they have some weak points,” he said, adding that Arakan State authorities and local communities had also urged the central government to halt MSF aid work.
“For example, we only allow them to have 19 foreign staff [in Arakan], but we found on the ground that they have 39 persons who were foreigners… and there were many persons who did not have registration to treat patients.”
Ye Htut went on to claim that MSF “only gave medical treatment to Bengalis,” before adding, “We are not against the whole MSF, we are only against some foreigners who working with MSF.”
Asked if he thought that government decision to halt MSF operations would hurt the international image of the Thein Sein government, Ye Htut said, “I do not think they would take this view because there are many NGOs working in our country. [The international community] will know we did it to those who violated agreements.”
Burma’s government does not recognize the approximately 1 million Rohingyas in northern Arakan State as citizens, and refers to the Muslim group as “Bengalis” to suggest that they are illegal immigrants from neighboring Bangladesh.
The UN High Commissioner for Human Rights Navi Pillay and international human rights say the Rohingyas are subject to a range of grave human rights abuses at the hands of authorities and security forces, while government restrictions on the group, such as travel restrictions, violate basic human rights.
Authorities have been accused of colluding with the Arakanese Buddhist communities during bloody clashes between Buddhists and Muslims in 2012, which left almost 200 people dead. About 140,000 people, mostly Rohingyas, fled their homes and have since been forced to live in squalid, crowded camps.
Although the government claims that MSF has violated its MoU, the group’s current problems seem to be linked to a Jan. 13 incident in Du Chee Yar Tan, a Rohingya village in Maungdaw Township. The UN said it received “credible evidence” to indicate that Arakan villagers and government security forces were involved in an alleged massacre of dozens of Rohingyas.
In the wake of the incident, MSF said it had treated 22 patients who were wounded in the supposed attack on Du Chee Yar Tan village. The statement prompted an angry reaction from the government, which accused international media and aid groups of misreporting the events.
Burma’s government has vehemently denied the killings took place and government investigations claim that Rohingya villagers killed an on-duty police sergeant. Last week, the National Human Rights Commission said that “it was learned from 2 doctors of the MSF that their clinics did not treat any such patients.”
Ye Htut said MSF had refused to identify the Muslim patients from Du Chee Yar Tan village, adding “They should show to the investigation commission who they treated, but they did not show these persons to us.”
