Restorative Justice and the Youth Court System

GroundviewsThe idea that an offender of the law ought to be judged by a court of their peers is the idea which defines “Youth Court” a legal body consisting of students of the Senior Secondary and Collegiate level age range to which I have belonged to for three years. Youth Court is akin to any other court of law in structure and execution, except for the fact that everyone who partakes in court proceedings is in the 14-18 age range. When someone underage is found guilty of a crime, they are taken for sentencing before a jury of their peers, defended by a team of their peers, and prosecuted by a team of their peers, in a court which is overseen by a judge, who, in addition, is usually 17 or 18 years old. Sentencing is based on the principle of restorative justice, which is a theory of justice that emphasizes the need of the wrongdoer to repair the harm caused by his/her criminal behavior. This system avoids punishment for punishment’s sake and instead seeks restitution and improvement, both personally and in terms of the community. Youth Court is a body recognized by the state as an official court of law and is ingrained in the New York State legal system as a customary measure for discipline. Despite its eccentricities, Youth Court is renowned as one of the most effective systems of justice employed for young people, with a laudable recidivism rate of 5%. This is an especially good indicator of success when one notes that youth offenders are statistically proven to revert back to crime after receiving consequences at a rate triple that of adult offenders.

Colombo TelegraphFor the last three weeks, various opinions are being expressed for and against the budget for the year 2014 within this house and outside and also in the media since it was presented in this house.
H.E. the President has given several promises that give hope to the people. No matter the promises given, if they are not kept effectively through a proper mechanism, the promises so given and not kept would only have negative effects on the people.
During the past 4 years since the end of the war, several promises given by Ministers in relation to the resolution of the land issues have been broken. I therefore, urge the government to take steps to set up an effective mechanism for keeping the promises with the participation of the representatives of the people of the area in order to prevent the recurrence of such mistakes.
The Minister of Lands, Hon. Janaka Bandara Tennakone visited the Potuvil area two years back and spoke words of comfort to the farmers who were faced with the land issues.
The Minister of Lands, Hon. Janaka Bandara Tennakone commands high respect among the farmers of our District. He is highly respected by the members of the minority communities. I pray that the all mighty God blesses him with long life. The farmers who have lost their lands hope that he would break all barriers to come and help them this time.
We have identified the following key actors that contribute to the existing land issues in our District:
  • Department of Wild Life Preservation
  • Forest Department
  • Department of Archeology
  • Those who implement the schemes of setting up new army camps.
  • The racist- minded officers who ignored the suggestions of the people and acted arbitrarily in the delimitation of the new Pradeshaya Sabhas in 1986.
  • The then government officers who failed to follow the proper procedures in taking over the lands from the private owners for the purposes of the Hingurana Sugar Factory and Tile Factory four decades ago.
  • The Liberation Tigers of Tamil Eelam and other armed groups who, under the guise of solving the land issues and disputes, got hold of the instruments the famers had in their possession and destroyed them.
  • The armed groups that forced land owners at gun point to sell their lands at cheap rates to their henchmen.
  • The biased government authorities who orchestrated the release of the gazette notification in 2010 which were released land arbitrarily without the knowledge of the people and the Divisional Secretaries of the area.
  • And the officials who declared 125,000 acres of land, through a gazette notification, as belonging to the Forest Department immediately after the end of the war.                        Read More

The President of the Tamil National People's Front (TNPF) categorically rejected a possible TRC as a solution to the ethnic conflict on the island of Sri Lanka. Outlining the role of a Truth and Reconciliation Commission (TRC) in South Africa and the Apartheid, Gajendrakumar Ponnambalam highlighted the "absence of a political solution" and the "sheer gravity of the crime of genocide" in the Tamil context, and said there was "absolutely no room for a TRC" and only an international investigation is acceptable.


Speaking to journalists at a press conference on New Year's day, he explained the party's position on the subject. 
"The problem is genocide. It's not just that we want some authority or power. What is happening to Tamils on the island of Sri Lanka, is genocide, that is what the ethnic conflict is, and securing ourselves from that genocide is what the solution is."


"On this backdrop, regarding the issue of the TRC, the first thing we need to ask ourselves is, is this an acceptable approach to addressing the issues that are taking place on the island, especially the issues expressed by the Eelam Tamils."
Contrasting the historical context in which the TRC was adopted in South Africa, where the Apartheid ended through a change in leadership bringing the ANC to power, Gajendrakumar Ponnambalam, said, 
"On the island of Sri Lanka, there has been no political solution... the war ended through a genocide. The war didn't come to an end after a political solution was adopted. One side, ie. the Sinhala side, completely destroyed - militarily - the other side, without attempting any sort of political solution."

"Eelam Tamils living on the island of Sri Lanka are today living under brutal military rule as prisoners. So with regards to 'transition' - in Sri Lanka, there is no transition."

"There must be a political solution in order to move towards such an approach. What is happening here, since the time the armed conflict ended, is the planned destruction of the Tamil homeland."
Detailing the pervasive presence of Sri Lankan intelligence operatives in every aspect of daily political life within the North-East, he said, 
"In a situation such as this - in the absence of a solution - there is absolutely no room for a Truth and Reconciliation Commission."
Posing the hypothetical question, would a TRC be acceptable in the eventuality of a political solution in the island, Gajendrakumar Ponnambalam, said his party categorically rejected it given the sheer magnitude and gravity of the crime of genocide.

"If it had been only war crimes, then in the scenario that a political solution was reached, a mass amnesty could be granted, however, in the island of Sri Lanka, what took place and what is taking place is genocide," said Gajendrakumar Ponnambalam. 

"There is no room for a TRC in any place where genocide is taking place.It is impossible to accept this. Genocide is not just an 'ordinary crime', it worst crime of all crimes in the world. For a crime like this - regardless of any reason - there is no space for an amnesty".

A rich black rose in style but  a  Scholarly vociferous voice of Tamils  of the bygone era  has been snatched away from us at the dawn of this decade, the first martyr of this millennium on the 5th January 2000. Yes it is now fourteen years on this 5th of January  2014. Had he been alive, he would have counted 76years at his age born on August 12 ,1938.  It is no one but was my great late leader Kumar Ponnambalam, It is no one but most courageous defender of the human rights of Tamils and an eminent criminal lawyer Kumar Ponnambalam, the proud General Secretary of All Ceylon Tamil Congress  then.

“Kumar” was also well known as “G.G.Ponnambalam Junior”, the only son of a Queen’s Counsel, Statesman and erudite scholar G.G.Ponnambalam an accepted Tamil leader whose name has been engraved in the history of Sri Lanka from the time of State Council’s era succeeding te political journey of late statesman Sir Ponnammbalam Ramanathan.  Perhaps admitting great GG’s statesmanship in recognition ,Srilankan Government published a postal stamp few years after his demise .
Correct analysis of politics has revealed that late G.G. Ponnambalam QC,a dominant leader of Tamils had been the father of thamil nationalism in this country.
Kumar Ponnambalam a product of  Cantab bath (Cambridge) always behaved in a highly refined and civilized manner so much so he had never been hesitant to express his apology when he was wrong. He possessed  high sense of humor . That was Kumar whom I admired for his qualities. Never the less his chosen vocabulary had been volcanic if really rubbed deliberately on the wrong side,but  that is Kumar Ponnambalam .
Kumar was born into wealth and circumstances. Born and bred and stood first among the equal elites of Cinnamon Gardens. But his inheritance was that he was proud to say that he was a blue blooded Tamil. He had been proud and delighted in displaying it. Secondly, he being the son of the great Tamil leader G.G. May be, if Sri Lankans stop ‘honouring’ politicians and refrain from paying veritable ritual homage to them, politicians may get it into their heads not to expect the public to be beholden to them for whatever reason. An issue bedeviling the Lankan public is that they do not adequately exact accountability from those they vote into public office. May be due to a semi-feudal mindset, sections of our public hero-worship politicians who do not constantly remind them that they are public servants with the mandate to go the extra mile in serving the people. Politicians need to be judged on the basis of how effectively they carry out their duties and they must be seen as succeeding or failing purely on this foundation. None could be viewed even appreciatively merely because they hold public office.

The recent decision of the Minister of Education Mr Bandula Gunawardene to suspend the Grade 5 Scholarship has generated an intense debate in our society. The intensity of the debate itself is an indication of.the significance of the Grade 5 Scholarship examination for children, and more imporlantly for their parents. In the first place, that the Minister of Education makes sudden and arbitrary policy decisions regarding an issue that is clearly of such importance for the public is of deep concern. In fact, this reflects a seriolls issue with regard to the decision making process of governments not just in education but in other areas as well.
Ministers make sudden pronouncements, and even more suddenly decisions are reversed. There are already signals that the decision regarding the Grade 5 scholarship too will be reversed in the not too distant future. This is not how stable governments make imporlant policy decisions. This is a reflection of a regime that is out of touch with reality, with the public, and is only concerned with political survival.

The origin of the Grade 5 scholarship can be traced to the decision to provide an opportunity for children from underprivileged circumstances to enter some of the top schools in the country. It was yet another initiative to equalise educational oppofiunities in this country - an impofiant consideration for policymakers of the past. However, there is no doubt that subsequently, the Grade 5 scholarship too became a victim of Sri Lanka's deteriorating education system and is now a huge psychological burden for children. Also, it is not evident, that the original intention of the scholarship scheme is being fulfilled. However, it still remains one of the few opportllnities where merit rather than political or social connections and favours are rewarded.
Suspending the Grade 5 Scholarship examination under these circumstances, will shut down even this remaining vestige of a merit based reward scheme in the current school system.
This will enable politicians to interfere even more so than they do now, in school admissions. We are of the opinion, that this, rather than any consideration of the children's wellbeing influenced Mr Gunawardene's decision.
Fufthermore, in a context where the government continues to deprive schools of facilities, cut funding for education and neglect the importance of addressing serious disparities in the provision of quality education, eliminating the Grade 5 scholarship is not going to achieve anything meaningful. The competition for entering 'good' schools will continue, children will be subjected to great mental pressure due to unhealthy levels of competition and parents will continue to experience high levels of stress trying to enter their children to 'good' schools. ln fact, parents will face a furlher barrier since they will have to run behind
politicians even more so than now if they want to ensure a good education for their children.
ln the view of FUTA, the decisions made by this regime with regard to education are clear indicators of their complete disregard and in fact contempt of values such as equality, justice and good governance. No other government has damaged the education system of this country quite as much as the current one. It is, in our opinion, futile to appeal to the good sense or conscience of the Minister who has singularly failed to display either in the past. We appeal to the public to be awake to these dangers and to ensure that those who are elected to represent their interests are held accountable to their actions.

A team of researchers from Emory University in Atlanta, US, has revealed that reading a book could improve one’s brain function for days. Reading a story is said to cause changes in the brain’s ‘resting-state’. Neuroscientist and lead author of the study Gregory Berns believes what really happens is that ‘the mind is tricked into thinking it is doing something it's not—for example thinking about running can activate the neurons linked to the physical act itself’. In other words, he says, reading a novel could ‘transport you into the body of the protagonist’.

One experiences a similar effect in the theatre as well and it is something Bertolt Brecht frowned on. He invented the V-effekt or the alienation effect to distance his audience from what he called their ‘emotional involvement’ in his plays by reminding them of the artificiality of performances from time to time. But, as for readers, such jolting reminders are not possible.

Before Berns et al, a research team consisting of scientists, psychologists and English academics at Liverpool University established, in January last year, that reading classics boosted one’s brain power. It was found that challenging prose and poetry set off far more electrical activity in the brain than abridged versions thereof. Volunteers were made to read Shakespeare, Wordsworth, Eliot and others and with the help of scanners, the researchers established that their brains were ‘lit up’ when they came across unusual words, surprising phrases or difficult sentence structures.

The novel Berns and his team used in their research was a thriller of the first water— Pompeii by Robert Harris. Those who have read this unputdownable book will agree that its effect lasts on one’s mind for not just days but weeks on end. It is a cliffhanger, as it were, with a difference. Mark Lawson, in a fine review of the book in The Guardian, has said that ‘rather than a whodunit, Pompeii is a whenwillit in which the killer looms in full view over the city, hissing magma’. The story revolves round a person who struggles to save the love of his life while Mount Vesuvius is erupting.

No scientific study has so far been conducted to find out the impact of movies like The Exorcist,Gladiator and Psycho—which, as an early interview with Hitchcock, the Master of Suspense, has revealed, was originally meant to be a comedy!—on the brain. Their effect on the filmgoer does not go away when he leaves the cinema. But, it certainly does not last as long as that of a thriller novel because films don’t leave much to the viewer’s imagination.

Some research should be undertaken to find out the kind of changes films, dramas etc cause in the brain’s activity. It should also be found out whether listening to stories has the same effect as reading novels on the brain. There is reason to believe it does.

Now that researchers have scientifically proved that classics boost brain power and novels bring about, to borrow a phrase from Berns and others, ‘heightened connectivity in the left temporal cortex, an area of the brain associated with receptivity for language, and the primary sensory motor region’ research should be conducted to gauge the damage trash, especially smut, causes to our brains.

The importance of reading has been known for centuries though its beneficial effect on the brain has been proved only recently. So, folks, you don’t have to step up your caffeine or nicotine intake or pay obeisance to the liquid amber to improve your brain function; avoid drinkeries and make a beeline for a bibliotheca and read. What Mark Twain said about reading comes to mind: "A person who won’t read has no advantage over one who can’t read."

Global vigilance urged on ‘genocidal experiments’ by Sinhala Buddhist monks

A recent documentary by a leading Japanese television network depicted the work of a Sinhala Buddhist monk, Kalyana Tissa Thero of the ‘Seth Sevana Lama Nivasa of Attambagaskanda’, an orphanage in the Sinhala-ruled Tamil town of Vavuniyaa, as a ‘reconciliation’ work by a ‘true Buddhist’ who was looking after war-affected Tamil children. But, the monk was sexually abusing the children. The Tamil children, subjected to a genocidal ‘orphanage’ experiment were deprived of their language and religion and were being sent to Sinhala school. Following a specific complaint on sexual abuse committed on a 9-year-old child and amidst prevailing protests by the local child protection activists, the monk was arrested in October. But, two months later, Kalayana Tissa Thero was released on bail with the backing of Colombo's National Child Protection Authority (NCPA), on 31 December 2013. 

Abusing War Affected Children: Suspected Paedophile Buddhist Monk Was Granted A Non-Conditional Bail

Colombo TelegraphIn October 2013 Buddhist monk Kalyana Tissa of the Seth Sevana Lama Nivasa of Attambagaskanda, Vavuniya was arrested for sexually abusing a 9 year old child. The Buddhist monk was kept in remand custody and medical evidence confirmed the sexual abuse of the child on 12.10.2013. Subsequently the custody of the remaining 22 children of the children’s home was taken by the National Child Protection Authority (NCPA) on 15.10.2013. Fearing that the remaining children may have also been sexually abused the Vavuniya magistrate requested the medical examination of the 22 children. Through the court order the suspect remained in custody. However on 31.12.2013 the suspected monk was granted a non-conditional bail on the basis that the Attorney General Department (AG), on the instructions of the NCPA has informed court that it has no objections for the suspect to be granted bail.  The next hearing is to be on the 11th of February.

Most of the children at this home are victims of war. These children have been placed in this home to ensure their education, safety and care by family members who are unable to provide the same for these children. Some of these children have lost their fathers in the war, their mothers are daily wage laborers who work in jobs such as stone breaking and barely earn a living.  These mothers placed their children hoping they would have a better chance at life through education and hoping for their care and protection.  In such a context how far these children’s rights and lives are being protected by the head of this home is a question.  Even though the children in the Seth Sevana Lama Nivasa are Tamil, they have been enrolled in Kaatumankulam Govt.  Sinhala mixed school. Their right to learn their mother tongue, practice their religion and culture, the protection of their ethnic identity has been violated and they are being compelled to assimilate into a Sinhala Buddhist cultural and ethnic identiy. Upon receipt of complaint from the civil society and others an exhaustive investigation was carried out by Vavuniya NCPA child protection officer, probation officer, public health inspector and the police and they jointly submitted a report on 29.11.2010 to NCPA head office.  But due to NCPA’s irresponsible investigation it has risked a group of young vulnerable children continue to suffer emotional and psychological abuses.

The grave site which was stumbled upon last month had at least 10 human skeletal remains buried inside, following which an investigation and forensic examinations were being carried out. Marketing Buddhist Monk Pitiduwe Exposed

Controversial Buddhist monk Pitiduwe Siridhamma Samantha Badra claims that he used the negative publicity against him to become enormously famous.
In a video posted on youtube, the monk claims that he himself had used a photograph in which he was captured wearing a t-shirt to print posters to increase his fame.
The monk has encountered a storm of controversy over the picture and other allegations made by several women that he had fathered their children. One woman filed a case in court against the monk but the case was dismissed for lack of evidence.

Suspend Bribery Chief

The Janatha Vimukthi Peramuna (JVP), yesterday demanded that President Mahinda Rajapaksa suspend the Chairman of the Commission to Investigate Allegations of Bribery or Corruption (CIABOC), Jagath Balapatabendi, paving the way for the Commission to carryout independent investigations on allegations against its Chief.

After handing over the petition to the Commission about bribery and corruption, allegedly committed by Balapatabendi in the past six years, from the time he was a Judge of the Supreme Court, until the present time, in his capacity as the Chairman of CIABOC, JVP Colombo District Parliamentarian, Sunil Handunnetti, said, "It is the President who appoints the Chairman of the Commission and he should take necessary measures to ensure that the credibility of the institution is not at stake. On the other hand, Balapatabendi also should ensure that the Commission has the freedom to carry out free and fair investigations. The Commission will decide whether he is wrong or clear him of the charges. In order to do this, either he has to step down until such time or the President should ask him to step down."

Balapatabendi had come under severe criticism on several occasions in Parliament recently, for allegedly suppressing and covering up charges of bribery and corruption that had been lodged against government politicians and their stooges. UNP Colombo District Parliamentarian, Sujeewa Senasinghe, during the Third Reading debate of the 2014 Budget, it was pointed out how the Bribery Chief had allegedly aided and abetted in the arrest of the former Director (Preventive) of Sri Lanka Customs for an alleged charge of bribery early last year, as a personal favour to one of his friends, the owner of Vehicle Lanka (Pvt) Ltd., Harsha de Silva.

Senasinghe said that though an arrest has to be made when the bribe was being accepted, in the case of the former Customs Preventive Director, Ranjan Kanagasabai, the bribery officials were not present at the time the bribe was purported to have been given, to positively conclude whether the bribe was accepted or not.

Bandaranaike Kumaratunge should join the opposition with the group of government ministers who are loyal to her, JVP politburo member and the party’s chief ministerial candidate at the Western Provincial Council, K.D. Lalkantha said.
Addressing a public meeting in Mortaumulla he has said that UNP Leader Ranil Wickremesinghe was trying to make a foolish move by bringing Kumaratunge as the common candidate of the opposition at the next Presidential election.
He has explained that the opposition needs to be strengthened and it could be done if Kumaratunge joined the opposition with her group of ministers.
“People need to send home this government and they must vote for an opposition political party. The JVP has exposed all the misdoings of the government,” Lalkantha has added.

State employees asked to assist government campaign

Secretary of the Samurdhi Officers’ Association, Chamara Maddumakaluge has said that the Samurdhi officers and the agriculture development officers at the Kesbewa divisional secretariat have asked to work for Western Provincial Councilor Jagath Pushpakumara’s election campaign.

Jagath Pushpakumara had sent out the letters to the government officers and has asked them to attend one of his meetings at the Kesbewa divisional secretariat on the 4th with 10 other members.
Using state properties for election campaign work is prohibited in the country’s law. Maddumage has said that the association will officially lodge a complaint about the matter to the Kesbewa divisional secretary and the Samurdhi director general.

Secretary to the Ministry of Defence Gotabaya Rajapaksa provided a strong clue about a major election in early 2015, when he told a contractor engaged to construct the second phase of a low income housing scheme to house former shanty dwellers in Dematagoda yesterday.

Colombo TelegraphOn an inspection tour of the Mihindu Senpura second phase construction site, the Defence Secretary asked the contractor how long it would take to complete the project. The contractor informed the senior official that the building would take at least 18 months to complete, but his deadline did not meet with Rajapaksa’s approval.
“No way. That is far too long. It has to finish by November this year the latest. There will be elections in 2015, this project has to be completed before that,” the Secretary to the Ministry of Defence told the contractor during his inspection.
He said many companies in Colombo were completing high rise buildings within very short spaces of time.
Opposition parties are insistent a national election will be declared in 2014 but certain constitutional blockades on a presidential election prior to November 2014 may mean the Government will hold elections early next year instead, as hinted by the powerful Defence Secretary.
Five hundred housing units constructed under the 1st phase of ‘Mihindu Senpura’ low income housing scheme was ceremonially vested on public on 18th November last year by the President.
During the inspection tour, Rajapaksa visited Estate 54 and 66, Maligawatte, Pradeepa Mawatha, Edirisinghe Mawatha, Cyril C Perera Mawatha and Salamulla housing sites, the Defence Ministry said.
Chairman of the Urban Development Authority Nimal Perera, Director General Nihal Fernando, Additional Director General Brigadier Samantha Jayasundara, Civil Engineering officials of the project and senior officials of the Urban Development Authority accompanied the Secretary Defence during the visit.
