PTA to stay

The government yesterday ruled out the possibility of repealing the Prevention of Terrorism (PTA) despite requests by opposition political parties.

In response to a question by Opposition United National Party (UNP) Leader Ranil Wickremesinghe, Prime Minister D.M. Jayaratne told Parliament that though the LTTE was militarily defeated, there were attempts to revamp the organisation in different parts of the world. The Prime Minister said the provisions of the PTA were required to deal with the discovery of weapon hauls hidden by the LTTE. He said the PTA was needed to take action with regard to LTTE suspects who did not surrender after the war ended in 2009.  

“The plan by two LTTE members to kill the supporter of a Tamil political party on March 17 and the arrest of four suspects in South India on December 20 last year can be seen as attempts to revive the organisation. It is ridiculous for the opposition to ask for the repealof the PTA,” the Prime Minister said.
However, Mr. Wickremesinghe asked whether former Colombo Deputy Mayor Azath Salley had been arrested under the PTA over an alleged link with a terrorist movement.

The Premier said Mr. Salley had told an Indian magazine that Sri Lankan Muslims had nothing else to do but up arms to defend themselves against the backdrop of rising violence against them.

He said upon close examination of his statement it can be pointed out that Mr. Salley had committed an offence under Section 120 of the Penal Code. Fomenting tension between communities was a key allegation made against him.

“Before the arrest, Mr. Salley was asked to appear at the CID office but he did not do it.  It is the bounden duty of the government to use the provisions of the PTA to deal with cases which pose a threat to national security and inflame racist passions,” the Premier said.

Meanwhile Opposition UNP Leader Ranil Wickremesinghe accused the government of using the Prevention of Terrorism Act (PTA) to suppress the rights of political opponents.

He said Parliament passed the Proscribing of Liberation Tigers of Tamil Elam and Other Similar Organisations Act in 1978 but since it was observed that this Act contained a number of shortcomings, the Prevention of Terrorism Act was passed in 1979 to replace it.

 “Here, we took the Prevention of Terrorism Act passed by the British Parliament on terrorism in Northern Ireland as our basis. Under this Act, action was taken against terrorists in the South and the North, and arrests were made. Now, the war in the North is over and terrorism has been defeated.  In such a situation, there arises no need for executing the Prevention of Terrorism Act.  As such, this Act should have been abrogated.  At the inquiries made on this matter, the government stated on several occasions in this House itself that it is not going to execute the Prevention of Terrorism Act,” he said. “After the September 11 incident, the whole world is vigilant about international terrorist acts. The British parliament passed another Act in place of the former Prevention of Terrorism Act to prevent such terrorist activities.  That Act has banned applying its articles for suppressing political activities. Nevertheless, now this Act is being used for suppressing opposition political groups in Sri Lanka. Mr. Azath Sally was arrested under this Act.  He is a politician who has been party to political activities both in the Opposition and the Government. At the Presidential Election 2010, he distanced himself from the UNP and supported President Mahinda Rajapaksa.  At no occasion during his life time has Mr. Sally been allied to a terrorist organization.

Mr. Wickremesinghe said he appeared to have been arrested on the basis of a statement allegedly made by him. Politicians may make different statements.  We have witnessed instances in which they make irresponsible statements.  Mr. Sally made this statement at a time in which the government is taking no action whatsoever regarding harassmens made against Muslims; at a time when Muslim Leaders in the government are keeping quiet.
He said against such a backdrop, if there are charges that the frantic statement made by Mr. Sally contains some elements of wrongdoing and irresponsibility, what should first of all have been done was to inquire whether he in fact had made such a statement and to take action under ordinary law if it was confirmed after such investigations that he had committed an offence and Mr. Sally’s arrest under the Prevention of Terrorism Act could by no means be condoned. (Kelum Bandara and Yohan Perera)

Translation Of Azath Salley’s Controversial Interview: “Muslims Will Also Take Up Arms”

Colombo TelegraphOn 20 April 2013, in an interview to the Tamil Nadu bi-weekly magazine “Junior Vikatan”, Azath Salley is alleged to have said that “the Muslims too should launch an armed struggle against the state in the same manner in which Tamils conducted a campaign earlier…(and) that such a struggle would commence once necessary arms are procured.” Salley has later written to the magazine stating that he was misquoted. The magazine published a correction on 4 May 2013.

When Azath Salley was arrested on Thursday May 2nd the Media Centre for National Security (MCNS) Director General Lakshman Hulugalle said that Salley was arrested by the Criminal Investigation Department following several complaints received by the CID regarding conduct which could damage ethnic harmony, and harm national unity. Hulugalle said that Salley was taken into custody under Section 120 of the Penal Code and provisions under the Prevention of Terrorism Act. Hulugalle reportedly stated that Salley had violated clause 21 of the Prevention of Terrorism Act and section 120 of the Penal Code. He (Salley) had incited people with the aim of causing damage to ethnic and religious harmony, in the guise of agitating against the government.
When Tamil National Alliance MP and Lawyer MA Sumanthiran visited him at ward 55 of the Colombo National hospital , Azath Salley told Sumanthiran that the Police so far had questioned him only about an interview he had given to the Tamil Nadu bi-weekly“Junior Vikatan”.

We met the participant at the seminar on  ‘The Right of Sri Lankan Tamils’ organized by the Popular Front of India, in Chennai.
Q:  There is news that attack against Muslims has started in Sri Lanka?
A:  The first attack in Sri Lanka was against Muslims in the riots of 1915 between Sinhalese and Muslims.
Recently in 2011, after the war with the Tigers, a Dharga in Anuradhapura was demolished  by Buddhist monks in the presence of the police.
In 2012 a mosque in Dambulla was demolished.  By demolishing over 10 mosques and madrasas, the Sinhalese have started attacking the Muslims openly.
No one pays any attention to the fact that soldiers are harassing Muslim women wearing the burqua.
Their intentions can be gauged from the statement of the Rajapakse-supporting Sinhala party, the Jathika Hela Urumaya, that a war like that of  1915 is unavoidable.
As a first step to this war, the issue of Halal certification has been banned in Sri Lanka.
If so, there will be no alternative to taking up arms.  For saying this, the The Bodu Bala Sena has said that I should be arrested.
Q:  What actions have you taken to ensure the safety of the Muslims?
A: When America brought forward the resolution on Sri Lanka, I submitted an appeal that the safety of the minority Tamils, Muslims and Christians should be also assured.
Further, we requested the Ambassadors of 24 countries, including those of 8 Muslim countries supportive of Sri Lanka and demanded that they speak on behalf of  the minorities.
We are trying to bring this issue to the attention of the world community.
Q:  There was information before that the Tamils and Muslims were alienated. How is the situation now?
A: The Muslims were driven out of the territory under Tiger control before. From then the Muslim organizations started to differ.  The Tigers should not have done that. If they had embraced the Muslims, the situation could have developed differently. Prabhaharan missed several opportunities.  This has been beneficial only to the Rajapaksa family.
 Q:  The actions (activities) of Rajapaksa?
A:  His only proclamation is that he has won against the Tigers.   The Rajapaksa family which was without anything is today being transformed into the most prosperous family in Asia.
His relatives who were working abroad in super markets and petrol stations are ministers today.
They are travelling to neighbouring countries for discussions. They have captured the media.   Only the Rajapaksa family members are at the head of all governmental agencies.
Gotabaya is guiding the Bodu Bala Sena with the intention of taking the message amongst the Sinhala people that Rajapaksa is the only soldier (Hero) for the Sinhalese.
They think the Rajapaksa Senior is the president and Gotabaya, Basil and Namal are also presidents.  Confiscating people’s properties is Namal Rajapaksa’s occupation.
They divided various occupations among themselves: taking commissions on government tenders is Basil’s share and changing Sri Lanka into a Buddhist country is Gotabaya’s share.
It is on the basis of this confidence that he has changed the rule that one person can be president for only two terms, to that where  one can be president any number of times.
Presidential elections can be held now only once in four years, but the president is engaged in actions to make it possible to hold elections every three years.
Because his party has the majority now, he plans to hold the presidential election again, win and then conduct  the general elections.
However, Tamils and Muslims will not vote for Rajapaksa. He cannot win the confidence of these communities ever.

The CID has begun investigations on the National Unity Alliance General Secretary Azath Salley concerning several occasions in which he threatened the peace of the country and unity among racial groups within the country through statements he made to electronic and print media, Prime Minister D.M. Jayaratne stated.

Responding to questions raised by Opposition Leader Ranil Wickremasinghe in Parliament concerning the government’s use of the Prevention of Terrorism Act (PTA) to arrest political rivals, the Prime Minister stated that Salley had made a statement to the Indian publication ‘Junior Vikatan’ on April 24, 2013 which appeared in an article on page 24 and 25 in which Salley states that the Muslims in Sri Lanka have no choice but to take up arms.

The Prime Minister vehemently denied any hatred between the Muslims, Sinhalese and Tamils, claiming that these communities were living in peace throughout the country with no reports of any issues.

He added that this publication would be seen around the world and news of Salley’s statements would reach the 51 Muslim countries which would in turn think that Muslims were being treated unfairly in Sri Lanka.

Sri Lanka receives the most aid from Muslim nations and if such a picture is portrayed to them relationships between nations could be put at risk, he told Parliament.

The Prime Minister in his response also revealed that the CID had on numerous occasions requested Salley to come in for questioning but the former CMC member had ignored the requests before the CID had arrested him from his residence where he was allegedly “hiding”.

He reminded parliament that the government has a duty to protect the country from terrorism and to act upon the PTA without looking at the status of the person involved.

Opposition members fiercely claim that the arrest of Salley is a blatant act of political vengeance but Prime Minister D.M. Jayaratne stated that the Prevention of Terrorism Act will not be used for political reasons.

Jayaratne went on to explain the importance of the PTA in maintaining peace in the country and preventing domestic and international terrorist agendas against the country.

Following the address by the Prime Minister, Ranil Wickremasinghe requested him to reveal what terrorist outfit Salley was affiliated with to which no response was given.

Full Court Report: BBS Leader Gnanasara Pleaded Guilty To Hit-And-Run And Drunk Driving

Colombo TelegraphCourt documents obtained by the Colombo Telegraph show that Bodu Bala Sena General Secretary and vociferous hardline monk, Galabodaaththe Gnanasara pleaded guilty to hit-and-run charges filed against him by Grandpass police in 2000.
On September 20, 2000, the monk was fined Rs. 12,000 by Traffic Courts, Colombo 12. The accident occurred on April 14, the same year, causing injuries to two others named Mohamed Rifai and Ravindra Kumar.  Gnanasara Thera was driving lorry number 6 Shri 5444. Among the charges against him were drunk driving, speeding, driving without a valid licence and failing to report the accident.
The monk pleaded guilty to all 9 charges.

“It is true we are racists. It is true we are religious fanatics. Yet, we are not the authors of racism and religious fanaticism in this country,” Dr. Omalpe Sobitha Thera, Leader of the Jathika Hela Urumaya (JHU) said.


“When racial and religious issues spring up, we too make emotional utterances. If we have committed any indiscretions, we humbly request the defence establishment to summon us and question us on that,” he added.

The Thera made these comments in response to a question posed by a journalist in connection with the arrest of Azath Salley, while addressing a media briefing at the party headquarters in Battaramulla.


Speaking further, he said, the laws of the country are applicable to all. “Any citizen of the country can be summoned for questioning on account of the country’s security, not only Azath Salley. If Azath Salley is innocent, he can free himself by proving his innocence.


“On the other hand, if the Muslim community thinks that they are special citizens, then they are wrong. Salley was taken into custody based on his statement urging the Muslim youths to take up arms against the injustices that are being committed against the Muslim community.


“If similar utterances are made by the Bodhu Bala Sena, then they ought to be investigated and action should be taken against them. We also make emotionally charged statements. If we are also summoned and questioned, we will relate all the details to the defence establishment.


“Who have brought into this country drugs, pills, birth control vials, and heroin the most? If you analyze, it is clear it is the Muslims who are behind such acts. The political sphere is silent on that.


“The main opposition and other parties with them do not speak about this. They think, if they talk about these things, they will lose Tamil and Muslim votes. When we speak about it, they breathe fire.


“We are in doubt whether before this country can be made a miracle of Asia, it has already become a vice den.” (Ceylon Today Online)

I'll reveal the mafia even if they murder me – Minister Sirisena

He has received information regarding a secretly active mafia in the health sector and he would reveal this information to the people in this country even if he is murdered says the Minister of Health Maithripala Sirisena. He says such rackets should not be allowed in the country.
Minister Sirisena said he had received information that Rs.1000 to Rs.1500 is estimated to a tablet that normally costs only Rs.100 when medicine has to be imported without the tender procedure of the Ministry. He said when he met a delegation of importers they had asked him for a week to find out details regarding the racket.
However, trade unions in the health sector say the Minister made a similar statement regarding 'Senaka Bibile' drug policy but even the draft of the policy is not to be found now they pointed out. They say they had revealed regarding the mafia that is active in the health sector to several ministers who had taken over the portfolio of health but no one took any action and now the minister suddenly talking about the mafia is nothing but a joke they added.
What should be done is not to have discussions with those involved in the mafia but to reveal them to the whole country and take necessary action they pointed

Customs to destroy 22 varieties of drugs

The Customs today took action to destroy some 22 varieties of drugs imported to Sri Lanka on different occasions without the approval of the Drugs Monitoring Authority These were seized by the Custom officials at the Bandaranaike International Airport.

Rs.17 million worth of drugs had been brought here from Pakistan and India. Substandard tablets including injections used for abortions and birth control, tablets prescribed for mental patients and intoxicant tablets were found among the drugs.

Expensive drugs used in treating kidney transplant patients and cancer patients were also among the stock of drugs. Some drugs were priced as high as Rs 105, 000. Pix by Deepa Adikari

The story behind the name “Chichi”? 
When my brother Yo was small, he found it difficult to pronounce ‘chooty’ (small) malli. So once, at a party, he had been stuffing his pockets with food. One of the aunties had asked him as to why he was not eating the food but stuffing it in his pockets, and he had replied saying, “This is for my chichi (supposed to be chooty) malli’. At the time of this incident I was about 1 or 2 months old, since then everyone calls me ‘chichi’.

From the day we were exposed to vehicles, always loved being fast and I love the adrenaline rush you get in fast things.

Yes, I just want everyone to call me that and nothing else.

Hahaha basically to create chaos.

Magistrates Court accepts 13 petitions for Matale mass grave

13 petitioners presented affidavits when the hearing regarding the Matale mass grave was heard in Matale magistrates court today (8th). They asked through affidavits to carry out a test regarding the skeletal remains unearthed from Matale mass graves as they suspect the skeletal remains could be their relatives who disappeared during the 88 – 89 period.
Magistrate Ms. Chathurika Silva said the 13 petitioners would be accepted as parties to the case. She also ordered the CID to record statement from the 13 petitioners. A decision would be given regarding the petitions on the 10th.
10 lawyers, including  Attorney Upul Kumaraperuma, represented the petitioners. Mr. Anura Dissanayake participated representing the JVP.
Speaking to the media Mr. Anura Dissanayake said, "The largest mass grave in the history of Sri Lanka has been discovered. The initial investigations have proved that remains of 156 skeletons have been unearthed. This indicates that it was a mass murder. The duty of a responsible government is to find out the owners of the skeletal remains, who had carried out the murders and take legal action against them.
However, the mediation of the government was to cover up the incident, to hush up investigations and to prove that the buried were those who had died of an epidemic. They also tried to prove that the remains were of those who were killed in Weera Puranappu's uprising in 1848. However, a professor of Archeology and a forensic specialist have proved that the remains were of those who were killed in 88 – 89 period.
Now there are skeletal remains. The period has been established. As such, the government should have carried out necessary investigations and revealed those who were responsible. However, the government shows a very lethargic attitude regarding the case. This is why the relatives of the disappeared have to come to court and submit affidavits to find out whether their sons, fathers, brothers and relatives were murdered and buried here. The court has given a very important decision to consider the affidavits presented by the relatives.
As such this issue should not be allowed to be concealed. Those responsible for the crimes should be definitely punished. They should be exposed. It is the responsibility of a civilized society. A multitude of human beings of a generation has been murdered and buried in a mass grave. It is a mass tragedy. It is a fundamental responsibility to reveal who were responsible and whose remains were buried there. As such, the struggle should be continued until those who were murdered will get justice. The legal action is taken as one of the steps towards winning them justice.
Social procedures too are necessary for this programme. Those who cherish democracy in the country, humanitarians, those who value fundamental rights of the masses should come forward to protect civil rights of the masses.
A broad mass mediation is necessary to achieve this. It is the responsibility of all to mediate in getting justice to those who were murdered."
