Objecting to the reported statement of Sri Lankan High Commissioner Prasad Kariyawasam allegedly trying to instigate north Indians against the people of Tamil Nadu, Union Minister of State in PMO V Narayanasamy today said he “has exceeded his limits”.

“He (Kariyawasam) has exceeded his limits. He should confine himself to diplomatic work,” he told reporters here.

The Minister was replying to a question about Kariyawasam’s reported comments that Sinhalese have their origins in most of the northern states of India, which drew protests from MDMK leader Vaiko who contended it was an attempt to instigate the north Indians against Tamils in the country.

Vaiko had in a letter to Prime Minister Manmohan Singh sought criminal prosecution of the Sri Lankan envoy on the charge of ‘sedition’.

To a question on Kudankulam Nuclear Power Project, Narayanasamy said the production from the first unit would begin soon.

He said false information was being spread among the local villagers that there was a gas leak from the plant.

On the People’s Movement Against Nuclear Energy calling for a seige of the plant township over the issue, he said the Centre and state governments would take necessary steps to deal with it. (Source: Business-Standard)

Why Mr.Subramniya Swamy is coming to the defence of Sri Lankan High Commissioner, Mr.Prasad Kariyavasam ?

| by L. Annadoure

( April 2, 2013, Chennai, Sri Lanka Guardian) The Sri Lankan diplomatic mission resident in Chennai is bound in International law to act befitting the purport of its mission. The Chief Minister of Tamil Nadu who reflecting the collective voice and sentiments of the people of Tamil Nadu or rather the voice of the Tamil speaking people all the world over wrote to the Central Government not to recognize Mr.Prasad Kariyavasam, the Sri Lankan High Commissioner as his press notes and the interviews tended to be detrimental to the interest of the Tamil people ,for he has attempted to pit one people against another and alienate the Tamil people from other States in India.

Some of the functions which may be exercised by an High Commissioner are the ones pertaining to representing Sri Lanka and protecting its Nationals in the receiving State and to promote friendly relations between the sending State and the receiving State.

All of the resolutions which have been passed unanimously in the Tamil Nadu Legislative Assembly are only the reflections of collective voice of the people. The High Commissioner Mr.Prasad Kariyavasam knows pretty well of the prevalence of volatile and nebulous situation in Tamil Nadu and Puducherry whose cause is the country which he is representing .

The student community in entirety in Tamil Nadu has arisen in unison demanding Mr.Mahinda Rajapakshe, the President of Sri Lanka be accused as perpetrator of Genocide against Eelam Tamils, to conduct a referendum to know about the aspiration and determination of the people to have the kind of polity they must have and to conduct an enquiry by an independent International Body into the crime of genocide and other war crimes committed by him.

Mr. Prasad Kariyavasam equally knows well that all the political parties have been agitating and demanding all along that the Central Government of its own accord to bring about an effective resolution which would purport to stigmatize Mr.Mahinda Rajapaskse as a perpetrator of Genocide and pressing for institution of an independent International enquiry to probe into the commission of genocide and other war crimes.

Mr.Prasad Kariyavasam knows too that the entirety of people in Tamil Nadu and Puducherry, people in some parts of the country and the political parties except the Congress Party have been speaking against the Central Government in having betrayed the Tamils’ interests by deliberately failing to bring in a resolution , failing to participate in the informal enquiry and for having read out an argument praising the Sri Lanka so as to bring in resolution in regards of the Sri Lankan Government is least bothered about.

Madurai District president of Hindu Peoples Party has filed a Public Interest Litigation writ petition against the Central Government and sought a direction for closure of Indian High Commission in Sri Lanka before the High Court Madurai Branch and the said petition has come to be dismissed as the petitioner has no locus standi to maintain the application and in fact the filing of such writ petition shows the party president representing the voice of its members who show the pulse and voice of the people in general.

The Sri Lankan High Commissioner Mr.Prasad Kariyavasam would state that the decision taken by the Chief Minister of Tamil Nadu in protesting against the participation of Sri Lankan players, umpires and other officials in the IPL matches proposed to be played in Tamil Nadu is condemnable and while making such condemnatory remarks he also pointed out lack of wisdom in the earlier decisions like the refusal to allow a football team of the Royal College of Colombo to be trained in Chennai and refusal to host the 20th Asian athletics meet in Chennai and he has assertively stated that instead of diplomatically resolving the political matters involving the two countries it is bad to comingle sports with politics and that the approach of the Chief Minister makes future prospects of players very bleak.

The question that now arise is whether the High Commissioner Mr.Prasad Karivavsam has really been directed by the Sri Lankan Government to make such condemnatory note against the Chief Minister of Tamil Nadu and if he admits that he has been authorised to make such a statement then his act should be contemptible because if the sending State perceives that it has been aggrieved over the decision of the Chief Minister of State it has take up the matter with the Central Government. The sending State is precluded from making such a condemnatory note against the chief Minister of State openly and after all, what kind interest Sri Lanka may have in Tamil Nadu except some interests over some Sri Lankan students studying in various institutions, spy on the affairs of Tamil Nadu and to use the mission for spreading propaganda against the Tamils and were the High Commissioner to say that his mission is much more than that then people in Tamil Nadu are not there to learn anything from Sri Lanka culturally or to benefit economically from a rogue state which racially cleansed the Eelam Tamils. The acts of vilification and aggressive posturing against the Chief Minister of Tamil Nadu will not come under the purview and ambit of performance of an official act. Vienna Convention on Diplomatic Relation , 1961 lays down vesting of certain privileges, immunities from criminal prosecution and civil litigation to some extent on Head of consul and consular staff, Head of Embassies and their staff and High Commission and its staff and while enjoying such privileges and immunities and inviolability the High Commissioner, Sri Lanka owes certain responsibilities and he should not make unnecessary comments and condemnatory note.

In Sri Lanka, every one in Government would make one statement or another and there is no hard and fast rule that a particular person alone should speak on behalf of Government of the decisions or policy of Government and there is a saying in current in Tamil Nadu which runs thus: ‘who ever takes a cudgel is an extortionist.’ When others have spoken, either Mr.Mahinda Rajapakshe would make entirely different statement or at his instance somebody would yet make entirely a different statement. The Defence secretary would decide on the policies of the Government and make his own statement.

So for any matter affecting the interests of the sending State is concerned the President , Mr.Mahinda Rajapakshe may register his objection through the Foreign affairs Ministry of the receiving State India and the High Commissioner has absolutely no right to issue a press statement or give interviews criticising the decisions and resolutions passed in the Legislative Assembly of Tamil Nadu and Mr.Prasad Karivasam may be referred to Article 41 of Vienna Convention On Diplomatic Relation, 1961 which reads as follows:

Article 41

1.without prejudice to their privileges and immunities, it is the duty of all persons enjoying such privileges and immunities to respect the laws and regulations of the receiving state. They also have a duty not to interfere in the internal affairs of that State.
2.All official business with receiving state entrusted to the mission by the sending State shall be conducted with or through the Ministry for foreign affairs of the receiving state or such other ministry as may be agreed.

Mr.Prasad Kariavasam has already stigmatized the Tamil Nadu students as terrorists which statement of his highly contemptible not one behoving to the station of an High Commissioner, it is unwarranted on his part and for the said act alone he has to pack his baggage and leave. The Central Government too has to notify the Sri Lankan Government of its refusal to recognize Mr.Prasath Kariyavasam as the High Commissioner of Sri Lanka in view of Article 43(b) of Vienna Convention on Diplomatic Relations and thus respect the requisition made by the Chief Minister of Tamil Nadu.

Under these circumstances, Mr.Subramniya Swamy who has become the spokesperson for Central Government these days has released a press statement hinting that the Police is necessitated to launch a criminal prosecution suo moto against Mr.Vaiko who since demanded the arrest of Mr.Prasad Kariyavasam because the High Commissioner has said the Sinhalese who originally hailed from the states of Orissa and Bengal have to be given protection when ever they come over India with a corrupt intention of driving a wedge between the states, weaken the Tamils’ demand and unduly influence the Central Government.

Here Mr.Subramaniya Swamy must note that the voice of the Chief Minister of Tamil Nadu and other political parties are only the voices of the people. Mr.Subramaniya Swamy may as well appear before the concerned police station and file a complaint against Mr.Vaiko instead of asking the police to foist a case suo moto. Tamil People know extremely well as to why Mr.Subramniya Swamy is coming to the defence of Mr.Prasad Kariyavasam! We may presume Mr.Prasath Kariyavasam is conversant with What Mr.Mahinda Rajapaskhe has answered while he has been at Thirupathi. He said that the people here in India have right to demonstrate. What Mr.Mahinda Rajapashe has said in Sri Lanka in respect of Jappna University Students who have been arrested and incarcerated? He said that the Students have a right to dissent. Therefore, Mr.Prasad Kariyavasam is in the wrong in having branded Tamil Nadu Students’ community terrorists and the Chief Minister of Tamil Nadu is in her own right to have written the letter urging the Central Government to take steps to recall Mr.Prasad Kariyavasam.

Mr.Subramniya Swamy has recently posted a statement in a web site stating that all the political leaders in Tamil Nadu who after having received money from Pakistan are protesting over the visit of Mr.Mahinda Rajapaske and the said statement of his is unfounded, baseless and therefore the Police has to launch prosecution suo moto against Mr.Subramaniya Swamy who has made the libellous and defamatory statement.

Top Ambassadors witness Mannar IDP plight first-hand

 April 2, 2013
A delegation consisting of seven top Ambassadors to Sri Lanka and a First Secretary witnessed the plight of Muslim IDP settlements in the Mannar region when they toured the region on 30 March.
The delegation, led by UAE Ambassador to Sri Lanka Abdulaziz Bin Abdurrahman Al-Jammaz, consisted of several diplomats. They were the Ambassadors to Sri Lanka from Iraq Kahtan Taha Khalaf, Iran Dr. Mohammad Nabi Hassani, Palestine Anwar al-Agha, Pakistan High Commissioner Maj Gen (R) Qasim Qureshi, Turkey İskender K. Okyay, Malaysia Azmi Zainuddin, High Commissioner and Indonesia represented by the First Secretary Albert Abdi.
The y12 aircraft carrying the delegation landed on Mannar’s Thallady Camp Air Strip at 8:25 a.m. on 30 March and was promptly escorted to be welcomed by Minister of Industry and Commerce in Mannar Rishad Bathiudeen.
Under the guidance of Minister Bathiudeen, the delegation visited Muslim IDP resettlements in Talaimannar Pier area, the Museli division, and the Marichikatti divisions.
“They witnessed the plight of these helpless IDPs firsthand and lent a sympathetic ear to their issues. I thank the UAE Ambassador to Sri Lanka Abdurrahman Al-Jammaz for his leadership in this delegation,” said Minister Bathiudeen addressing the media when the tour concluded at 7 p.m. on 30 March.
Minister Bathiudeen, addressing the delegation in his pre-tour briefing, said: “According to para 5.137 of the LLRC Report, 75,000 families were expelled from the Northern Province by the LTTE in a systematic and organised manner during a two-week period in 1990. They were mainly living in Puttalam and other districts such as Anuradhapura, Kurunegala, and Colombo, etc. According to the report, around 14,000 Muslim families have returned to Mannar in 2011, and 2,455 to Mullaitivu District. Due to landlessness, the original land becoming jungles, non-availability of infrastructure facilities and lack of assistance from the donor communities, they couldn’t resettle themselves fully in their places of origin. The displaced during the height of war and later were accommodated at Menik Farm and the new IDPs were all resettled. However, the protracted IDPs expelled in 1990s are yet to be resettled. Also, the process in this regard is taking place as per the Government promise.”

Patriotism, Allegiance And Loyalty Of Sri Lankan Muslims To Mother Lanka

By Rifai Naleemi -April 2, 2013
Dr. Rifai Naleemi
Colombo TelegraphIt is imperative to examine and gauge the true nature of Muslim peoples’ patriotism to mother Lanka. Particularly, this is a timely needed subject in the context of prevailing current debates about Muslim people in Sri Lanka.  Muslim population in Sri Lanka according to the recent census constitutes 9. 2% and do they really have loyalty and allegiance to this land?  Do they love this land as the majority people of the land do? Or do they have loyalty to another land in the world map? Do they belong to Saudi or Pakistan or do they belong to somewhere else.  A strange mystery   has been created in the mind of some people that minority people do not belong to this Island and it has been debated by some section of people at least in utter arrogant to say that this country belongs only to the majority people alone and others are just visitors or unwanted guests. Does such political rhetoric help any one in Sri Lanka?    What a wrong perception is this? What evil perception is this? Who is going to benefit from this type of propaganda?  I shall examine some of these questions in this article.
Sri Lankan Muslim people are not new arrivals to the Island rather they have been living more than 1000 years and it is historically documented that Arab traders settled in this Island in pre-colonial periods.  During the Silk route trade between Middle East and South Asian countries Arab people used Sri Lanka as one of their trading hubs. Since these periods of history Muslim people have been living in this Island generation by generations. The bulk of Sri Lankan Muslim population is a mixture of different ethno-linguistic and cultural groups. The entire Muslim population of Sri Lanka Muslim people constitutes of Arab, Indian, Afghanistani, North/south Indian, Malay and Indigenous Srilankan People. There is no doubt that many inter-marriages took place with other communities and still some Muslim families have families of names/house names of Singhalese people.
Thus, historical origin, antiquity and history of Sri Lankan Muslims people could be traced from early period of Sri Lankan history. It is not my objective here to trace historical origin of Sri Lankan Muslim people rather it is my objective here to examine the true nature of Muslim loyalty to Sri Lanka and to gauge if any Muslim people have done any treason to Mother Lanka since ancient time up to now.
The meaning of loyalty in Islam
Before we examine this issue we would like to shed some light on the meaning of loyalty and allegiance in Islam: What is the doctrine of loyalty in Islam? Does Islam accept any sense of nationalism or loyalty to any piece of land/country/tribe or ethnic groups or clans?  In fact, Islam demands from Muslim people to have full faith, allegiance and loyalty only to God alone not for nay temporal / earthly matters of these types. Muslim people believe that very thing in this universe belong to God and we people too belong to him alone and our full loyalty should be to Him alone. Theologically speaking this is the true loyalty and it is the eternal and real loyalty. In this sense, languages, castes, tribes, colour and country all are temporary and materialistic realities ant these are confined to this world alone.
In a recent survey in England among Muslim people a question was asked: Are you a Muslim or British first? More than 90% of Muslim people said that we are Muslims first and foremost then we are British born people. This is a theological question for any Muslim and unfortunately the interviewer did not have deeper understanding of Islamic theology and put this question to Muslim people simply from western political and social perspectives to gauge the level of Muslim peoples’ loyalty to Great Britain.  It would not be theologically and religiously fitting to say that our loyalty belongs to any land on earth rather our true loyalty should be only to God alone:  people in Saudi do not say that our loyalty belong to Saudi land. People Pakistan do not say that our eternal loyalty belongs to their land or tribe or language rather Muslim people believe that we belong to Allah and we return to Him:
Islamic communities are not formed or originated on the basis of language, colour, race, ethnicity, tribe, lands or nationalism of any particular geographical or ethnical enclaves.  You do not choose your colour, you do not choose your language or you do not choose your place of birth or you do not choose your race: These are bestowed upon you by God beyond your control and you have no choice on these sociological issues. In Islam nationalism, patriotism to any particular piece of land or ethnicity or language does not become bedrock of Islamic ideology or Islamic doctrines.  On this Islam goes beyond all worldly and physical considerations and drives its ideology from God alone. The Holy Quran depicts the true believers of international Muslim communities are one Ummah: This description is beyond all languages, ethnicity, nationality, and geographical enclaves and limitations. In this sense any one embraces faith of Islam from any part of world or nay class of people or any linguistic groups becomes an integral part of wider Muslim ummah:  It is faith that makes bond and brotherly relationship between Muslim people: In this any Muslim living in Non-Muslim government also becomes part and parcel of International Muslim community.
Then people might ask us.  Do not you have any affection/ love to your own country? Do not you love for the country of your birth?  Do not you have any sense of patriotism to your mother land?  Does Islam teach to show love and affection to the lands where Muslim people are born and brought up?  It is a natural instinct of people to be attached to places of their birth, families, villages and countries of origin.  I have been living in the UK for more two decades now and yet, my nostalgia always goes back to my country and my village where I was born and brought up. It is a common human feeling for all people. Islam goes along with this natural sentiment and its respects this human instinct and indeed, it does encourage having  patriotic national feeling of your own village/ town/district and country:  There is no harm in having such feeling as long as such patriotism does not lead into prejudice, injustice and discrimination.
Does this notion of Islamic ummah deem to be detrimental to our love and affection to our mother land or to abide law and order in the countries we live in.  No, not at all. Islam instructs us to love our mother lands: It demands us to abide with laws and orders of our native places. Today, a large percentage of Muslim people migrate from Muslim countries into Non-Muslim countries in the Western European nations and when they get citizenship in these countries very often they will be asked to take oath sometime giving affirmation that they would abide with laws of the country: Such undertaking does not contrast Islamic teaching of loyalty and allegiance to Islamic faiths: This oath is between you and that government that guarantee you protection and return you laws and order in this land: This an agreement and Islam instructs to honour any agreement.
Islam indeed, recognises and acknowledges patriotism of each persons: Indeed Allah created mankind into different groups and nations: so that we human beings know each other, understand each other,  and appreciate one another, It is the beauty of divine design. There is no harm in having affection towards one’s language and tribes and yet we should not have mania and craziness about our language to extent to look down all other tribes and language: We should not have superiority complex because of our language or tribe. That is wrong and Islam condemns such feeling.  Yet, having nationalistic feeling is not wrong with these conditions.
Prophetic examples on patriotism towards native people:
Do we have any prophetic model or examples to justify patriotism in Islam?  Yes, of course the prophet himself had some sentimental patriotic feeling towards his place of birth: It is well known saying of the prophet that prophet said on the eve of his migration from Makka to Madina: looking at the soil of Makka prophet said that “ you are the beloved place for me. If the people of Makka had not chase me out I would not have left you”. This is natural feeling of every one towards his own place of birth. Even the companions when they migrated to Mania they had nostalgia feeling about their life in Makka and they wished that they come back to their native place one day:
Moreover, when different people come to see the prophet he used asked them the names of their tribe in reorganization of their tribes:  We know well that prophet once praised Salman al-Farisi tracing his Persian origin. All our Muslim scholars are nick named with their tribal or village names: al-Bukhari hails from a place called al-bukhara, al- Qurtubi from Qurtuba, and Imam al-Shatibi from Shatiba. Thousands of Imams like these imams related the village affiliations to their names to show their patriotism and identity?  This is an Islamic tradition to attribute our Islamic scholars into their places of birth: This has been for many centuries that this shows that they had some sentimental patriotism towards their places of birth and nothing wrong in that.  This helps us to trace their historical origin and identity.
Muslim patriotism during the colonial periods:
Muslim lands were occupied for more than five hundreds years by different colonial powers such as French, Italian, Dutch/Portuguese and English. During these periods Islamic scholars engaged in freedom struggle and patriotic speeches and poems were made in this freedom struggle: from Jamal-al-Din Afghanis to Imam Hassan Al-Banna all Muslim intellectuals and scholars motivated people to enhance nationalistic feeling and there is nothing wrong in that as along as such feeling does not undermine universal brotherhood, justice and equality of humanity: In India sub-continent many Muslim sacrificed their lives for the freedom of Indian lands and like that in many Muslim land people  laid down their lives to free their lands from occupation;
Our pioneers in Sri Lanka fully participated in the freedom struggle of Sri Lanka. Though we in Sri Lanka did not make any political or military struggle to free the Island from British and yet, during the colonial periods many Muslims people did fight along side Sri Lankan kings to safeguard it form invasions of the Dutch and Portuguese.
Even during the independence time Muslim people unanimously voted with Singhalese members to secure independence of Sri Lanka from British Empire.  ¾ majorities was required by Soulbury commission to secure Sri Lankan Independence and Tamil congress led by Ponnampalam did his best to get support of Muslim members to get his own Tamil Elem then, but People members unanimously supported Senanayake and he managed to secure 51 votes. This was a historical turning point in Sri Lanka history and had Muslim members gone with Mr Ponnampalam the history of Sri Lanka would have been different today: British would have created Tamil Elem long time ago or they would have created another Kashmir in Sri Lanka long time ago yet, it is regrettable that some Singhalese people are becoming seemingly ungrateful to all service and sacrifices Muslims made for the integrity of this Island.
Even throughout the pre-independence history our leaders made many contributions and they had shown their patriotism to the nation: they never made any conspiracy to divine this country and they never collaborated with any one to divine this Island and they never made any treason in Sri Lanka: It has been Muslim leadership’s dream to develop and enhance this Island not merely on communal line rather in a national line: from DR TB Jaya to modern time Muslim political leaders we have had a dream in this Island of Sri Lanka: that dream to contribute  to  the progress and development of this Island as Sri Lankan with due recognition to diversity of culture and language and religions.
What happened in Sri Lankan history since independence was that we have failed to create any Sri Lankan Identity as Sri Lankan people collectively: Each community begun to think in its on communal line: Tamils feel that Singhalese are trying to dominate them and Singhalese feel that their mere existence is threaten by the separatism and diversities of cultures and religions. All other minorities begun feel that their mere existence is threatened by the rapid development of Buddhist extremism.  It is not myth to say that in recent years a growing trend of anti-Christian and Muslim drift has been orchestrated by some extreme elements without any proper geopolitical knowledge and without foreseeing any dire consequence of such extreme trends:
Countries like India,Malaysia, and Singapore with its all diverse cultures, ethnicities and religious managed to maintain their own national identity:  Malaysian whether is Buddhist, or Hindi or Muslim feel proud to say that he or she is a Malaysian.  We do not need to tell you about Indian nationalistic feeling: We have not seen any nations so proud about their nationality like Indians: They are so proud about their nationalism or nationality: It may be Indians from North or South or from West or East: it may be Muslim or Hindu or people of other religions in India. All are proud to be Indians: yet, we in this small Island do not have that sort of national identity or nationalistic feeling between us: Do not we see that When Indians play Cricket with Pakistan Indian Muslims whole heartedly support Indian team rather than Pakistan team and do not we see that a large proportion of Indian Muslim army officials work in the Indian army to protect the sovereignty and integrity of India?  Otherwise, how could this huge country with hundred of ethnic groups hold its grip on the power.
India was ruled by Muslims for more than 700 years and Muslim people have had all their cultural and religious monuments in India. Thaj Mahal was build in the name of Mumthaj by then Muslim ruler. Do you see that any Indian government tries to destroy this historical monument simply because it comes from Muslim history?  Why do not have such broader and wider concept of national identity in Sri Lanka? Why do we still think in confined communal line in Sri Lanka? We have failed to celebrate the beauty of our diverse culture, languages and religions: It is generally believed that Buddhism, Islam, Hinduism and Christianity are world major religions. People in Sri Lanka are practicing these four religions and this gives more beauty to our nation and yet, we have greatly failed to appreciate such diversity.

How Gota used BBS to attack Fashion Bug and the rigged investigations exposed
http://www.lankaenews.com/English/images/logo.jpg

(Lanka-e-News -01.April.2013, 6.30PM) The on going investigations by the police into the losses incurred and the attack launched on the Pepiliyana Fashion Bug clothing establishment by the Bodhu Bala sena’s (BBS) sangha and civilian goons , to say the least is most rigged and falsified according to LeN inside information division reports reaching Lanka e news. The story that is being circulated that a multi millionaire has been arrested is also a fabricated lie by the police , it is learnt.
The attack launched and the rigged investigation are being monitored by the senior DIG Anura Senanayake under the direction of Gotabaya Rajapakse ,the author and main role player of the BBS violence and hooliganism. The OIC of the special investigation unit of Mirihana police Nimal Karunanayake IP is conducting the rigged investigation instructed by the senior DIG Senanayake. Though Four persons were arrested in this connection , and they can be held in custody for 48 hours and interrogated , they had been instead produced before the Nugegoda acting Magistrate and remanded.
The story that the suspects were taken into custody is a fabricated lie. In truth they had been produced by the BBS leadership itself. Among them no one is a multimillionaire. All of them are three wheel drivers who have acted as pawns who had been sacrificed to achieve more dastardly motives of the BBS. Those produced yesterday and remanded are namely , R D Simon , N B W Bandara, C S N Wijetileke and C Belan. There is also publicity given that two more suspects had been produced by the BBS leadership and they had been arrested. These two suspects are : Ranil Fernando and Susantha Wimal de Silva.
Gotabaya had given orders that not a single sangha member of the BBS shall be arrested. The BBS members who attacked as shown by media in their photographs have not been taken into custody based on Gota’s order.
Not only the media even the Fashion Bug video cameras had taped the attack from the beginning to the end when this attack was launched , and copies of these had been handed over to the police team that is investigating this marauding and murderous violence . Yet not one of them had been arrested , and until today , only those suspects produced by the BBS are being taken into custody. All these are orchestrated by Gotabaya via his shameless and notorious DIG Anura Senanayake who is in charge of the investigations. Despite the establishment having lost many millions following this attack , the police had still not made any assessment of this.
If a police investigation is duly conducted , before the suspect is produced before the court , an assessment must be compulsorily made on the losses incurred.
This is how Gotabaya the SL defense secretary notorious locally and the world over as the most unscrupulous and offensive defense secretary gave protection to the criminals :
The Manager of Fashion Bug Ashraf Jumiya had by phone informed the Mirihana police on the 28th , Thursday noon that preparations are in the offing for an attack to be launched on the establishment based on information passed to him by the customers. Prior to this, customers who were visiting the Fashion Bug stores Island wide , had been attacked with rotten eggs and filthy water , and the relevant branches have made complaints to the police stations of those areas.
The Manager of the Fashion Bug headquarters at Pepilyana who had been vigilant based on the threats they were receiving and the attacks already made on their branches , had sensed that there is going to be an attack on the establishment positively when 25 to 30 monks and secretary Gnanasarra Thero of the BBS congregated near the border of the Sunethra Devi pirivena in front of the establishment . He had therefore reported a second time to the police emergency unit on 119 by phone . By that time the marauding crowd had snowballed to about 100. The Manager Ashraf Jumiya had realizing the impending danger had again informed the Mirihana police by phone.
When the officers of the emergency unit receive a complaint on 119 ,they inform the relevant police station of the complaint – accordingly they have intimated to the Mirihana police.
After receiving three such calls , the OIC of the Mirihana police, HQI , Roshan Rajapakse had sought advice from his higher officers , Nugegoda SSP WMM Wickremesinghe and ASP Nishantha Soysa. They in turn had secured advice from senior DIG Anura Senanayake .The latter had told Roshan Rajapakse not to take any further action , and a number of police officers of the police vehicle division will be dispatched.
Accordingly , just four motor cycle policemen who were in that area had been dispatched to the scene. By that time the BBS which had begun its attacks to gratify their satanic (not religious) desires had assaulted the police officers who were trying to control the violence. The Hiru media made a report on this . Thereafter the Hiru journalist was also attacked.
Prior to this violence , the defense secretary Gotabaya had spoken on the phone to the IGP and told him there is going to be an incident at Peplilyana , but not to get worried over it , as the Boralesgamuwa and Maharagama police will look after it . Lanka e news reported this yesterday.
This was the methodology adopted by Gotabaya who told the police to close the eyes and ears , while giving protection to the BBS paramilitary group to unleash violence on the Pepiliyana establishment. After all was done according to his diabolic plans fully well , he sent the official army to give a respite to the paramilitary violent group after they have launched the attack as they wished.
While huge losses had been caused and injured persons are helplessly waiting , and there is a potential for racial unrest , the investigations into this wanton attack is being conducted most uncaringly .The police say , Galgoda Gnaana ssara Thero who led this violence should be arrested but Gotabaya and DIG Anura Senanayake are standing in the way . They also say they are not being permitted even to interrogate any Sangha goon.
What had provoked the Rajapakse regime against the Muslims is their desire to transfer the businesses in the hands of the Muslims to their Sinhala business henchmen . During the New year season , two leading Muslim clothing sales centers , namely, No Limit and Fashion Bug draw the largest crowds . But it is the need of Gotabaya to somehow create turmoil and turbulence to their sales and divert the business to his pal , Preethi Jayawardena , a popular clothes trader , and boost his business. It is to be noted that all imports of clothing by Preethi Jayawardena are not subject to inspection at the Customs because of the Rajapakse patronage he enjoys. He spent lavishly for Mahinda Rajapakse at the Presidential elections. Recently ,when Jayawardena moved into a new home , the chief guest at the house warming ceremony was , Gotabaya Rajapakse.
The paramilitary group in the name of BBS that had been originated by Gotabaya is used to serve the needs of such businessmen.
Another close bosom pal of the Rajapakses is readying to commence the import of canned beef from Australia. It is the BBS paramilitary group that has been selected to do the marketing of those products. A true Buddhist will oppose the consumption of beef. But the BBS paramilitary group opposes the killing of cattle and closes down the slaughter houses by conducting raids. Already they have closed a number of such slaughter houses . This is another racket, for those closures have created an environment for the Rajapakses to import canned beef and sell them.
To the BBS leaders a large sums of monies have been paid for carrying out this contract to close slaughter houses. It is a pity that a section of the people who are gullible and foolish who have no idea of the true picture have fallen prey to the eloquent speeches of these leaders like Galgoda Gnanasara Thero, the drunkard and criminal on whom even a fine was imposed by the courts for driving under the influence of liquor and meeting with an accident .

Inclusive University Education: Is It The Most Pressing Issue In Sri Lanka’s University System?

Colombo TelegraphW.D Lakshman: Sri Lanka’s university education is not inclusive
Colombo University’s former Don and reputed educationist, Professor W.D Lakshman, in delivering the J.E Jayasuriya Memorial Oration 2013 in Colombo last month on inclusive university education and the state university in the country, has left his audience with four main conclusions. The first is that in terms of opportunities for university education, only a small proportion of students who qualify for admission to a university is admitted to the country’s state university system and therefore there is no inclusiveness in higher education. It is only a small number of people who get that opportunity exclusively. Second, even those who are admitted to a university do not get an opportunity to get a comprehensive education since they are taught in separate streams like arts, science, medicine, law, aesthetic studies etc. Hence, in terms of curricula too, there is no inclusiveness of university education.
The State funded universities are the best
Third, to fill the gap and make the country’s university education truly inclusive in terms of both admission and streams, it is the state university system that would serve the nation best. This is because, according to Lakshman, a private university system that depends on tuition fees paid by students is unlikely to serve the students from all the social classes of society. Fourth, even for the state universities, the much hyped business model which is currently in vogue is unsuitable since it would induce universities to select students on the basis of ability to pay rather than ability to contribute to knowledge. In essence, Lakshman’s message is that if society is interested in inclusive university education, it has to realise that objective by reforming the state university system appropriately.

UN to vote on 1st treaty regulating global arms trade

CBC NewsThe UN General Assembly is expected to vote Tuesday on what would be the first UN treaty regulating the multibillion-dollar international arms trade after Iran, North Korea and Syria blocked its adoption by consensus.
Assembly spokesman Nikola Jovanovic told The Associated Press on Monday that the resolution to adopt the treaty requires support from a majority of the 193 UN member states. Since the treaty had strong support when it was brought before UN members last Thursday, its approval is virtually certain — unless there are attempts to amend it before the vote.
Many countries, including the United States, control arms exports. But there has never been an international treaty regulating the estimated $60-billion global arms trade. For more than a decade, activists and some governments have been pushing for international rules to try to keep illicit weapons out of the hands of terrorists, insurgent fighters and organized crime.
Hopes of reaching agreement at a UN negotiating conference were dashed in July when the U.S. said it needed more time to consider the proposed accord — a move quickly backed by Russia and China. In December, the UN General Assembly decided to hold a final negotiating conference to agree on a treaty and set last Thursday as the deadline.
After two weeks of intensive negotiations, there was growing optimism as the deadline approached that all 193 member states would approve the final draft treaty by consensus — a requirement set by the United States. This time, the U.S. was prepared to support the final draft treaty. ButIran, North Korea and Syria objected.

Iran complains of 'loopholes'

Iran said the treaty had many "loopholes," is "hugely susceptible to politicization and discrimination," and ignores the "legitimate demand" to prohibit the transfer of arms to those who commit aggression. Syria cited seven objections, including the treaty's failure to include an embargo on delivering weapons "to terrorist armed groups and to non-state actors." And North Korea said the treaty favours arms exporters who can restrict arms to importers that have a right to legitimate self-defence and the arms trade.
Both Iran and North Korea are under UN arms embargoes over their nuclear programs, while Syria is in the third year of a conflict that has escalated to civil war and is under U.S. and European Union sanctions. Amnesty International said all three countries "have abysmal human rights records — having even used arms against their own citizens."
The General Assembly had left open the possibility of a vote on the treaty if it failed to achieve consensus.
Jovanovic said the assembly will meet at 10 a.m. ET on Tuesday when the first order of business will be a report from the chair of the negotiations, Australian ambassador Peter Woolcott. That will be followed by the vote.
The draft resolution, obtained by The Associated Press, would adopt the Arms Trade Treaty that was put to members last Thursday.
If approved, the resolution asks Secretary-General Ban Ki-moon, as depositary of the treaty, to open it for signature by member states on June 3. It calls on all nations to consider signing and then ratifying the treaty "at the earliest possible date."
In a letter to the secretary-general dated Friday, Britain's UN Ambassador Mark Lyall Grant asked the UN chief to circulate the draft resolution to all UN members on behalf of Argentina, Australia, Costa Rica, Finland, Japan, Kenya, Mexico, New Zealand, Nigeria, Norway, the United States and the United Kingdom.
By the time the draft resolution was circulated Monday, treaty supporters had collected a total of 64 co-sponsors and they were trying to add more countries before Tuesday's vote.

Final draft makes human rights provision stronger

The draft treaty would not control the domestic use of weapons in any country, but it would require all countries to establish national regulations to control the transfer of conventional arms, parts and components and to regulate arms brokers. It would prohibit states that ratify the treaty from transferring conventional weapons if they violate arms embargoes or if they promote acts of genocide, crimes against humanity or war crimes.
The final draft made the human rights provision even stronger, adding that the export of conventional arms should be prohibited if they could be used in attacks on civilians or civilian buildings such as schools and hospitals.
In considering whether to authorize the export of arms, the draft says a country must evaluate whether the weapon would be used to violate international human rights or humanitarian laws or be used by terrorists or organized crime. The final draft would allow countries to determine whether the weapons transfer would contribute to or undermine peace and security.
The draft would also require parties to the treaty to take measures to prevent the diversion of conventional weapons to the illicit market.

Actors and other representatives of the Tamil film industry on Tuesday began a day-long fast demanding the rehabilitation of Sri Lankan Tamils and an international probe into the alleged war crimes.
Film activity in Tamil Nadu came to a standstill as artistes, directors, producers, distributors and exhibitors are participating in the hunger-strike being held at the premises of South Indian Film Artists’ Association in Chennai.
Noted film personalities of Kollywood, including South Indian Film Artistes’ Association president R. Sarath Kumar, Rajnikanth, Ajith Kumar and Surya, are part of the agitation.
These personalities of the Tamil celluloid world are the latest to stage a protest over the issue, which has generated heat in the State in recent weeks with various sections of people, including students, taking to the streets.
Sarath Kumar, who is leading the protest, demanded that the Centre implement the resolution adopted by the Tamil Nadu Assembly recently demanding a referendum on separate Tamil Eelam and action against those who committed war crimes.

Our Moment Of Destiny

By David Blacker -April 2, 2013
David Blacker
Colombo TelegraphI think every generation faces its own particular challenges; but the greatest and most defining ones are those of morality and courage. That moment, if missed, condemns that generation — and often many that follow — to a world far more unpleasant and evil than we would wish it to be. For many in the free world of the late 1930s, that moment came with the invasion of Poland and the bombing of Pearl Harbour. It was a moment when my grandfather’s generation had to decide if they would simply stand on the sidelines or go out and fight someone else’s cause. Fortunately for them, the choice was easy; their respective governments took the right fork, and millions of young men — my grandfather included — went out into the deserts, the jungles, and across the seas to ensure that tyranny and racism would not shape our world. For 1960s America, the moment of destiny was in fact a place — Vietnam — and a moral choice. America made its decision, albeit a little late for millions of Vietnamese.
But when that hour of destiny arrived thirty years ago in Sri Lanka, our parents’ generation failed us. For decades, they had watched as extremist rhetoric leveled at the Tamil community gave way to physical violence. They stood by as our constitution was changed to remove any protection the minorities had a right to under law. They were silent when the nation’s leadership was silent on the racism and hatred that was all around them. They did nothing when their elected politicians in fact helped instigate the violence that climaxed in the orgy of assault, murder, rape, and destruction now known as Black July. For thirty years we have wondered how our parents could have been so docile, so shortsighted, so wrong in their choices. We have watched our country torn apart by suicide bombers and child soldiers, by tanks and artillery. We have watched a hundred thousand die, because our parents didn’t say “stop!”
Thirty years later, the clock is back at five minutes to midnight; racists are calling for violence, for this country to be only for Sinhalese Buddhists. They are calling for a tiny minority to change their lifestyles or leave; they are calling for their right to worship to be curbed. And they are threatening violence if their demands are not met. Our government is at best silent; at worst in collusion. Our police force is standing by while Muslims are attacked. There are no arrests. There is no condemnation. There is no justice.
The last time this happened, I was eleven years old; an uncomprehending child. I grew up to wonder why my father who could ride a motorcycle through a wall of fire to get me home that July, hadn’t been able to stop what was done to the Tamils and to my country. Was he scared? Didn’t he care? I ask the same questions from myself today. Why am I doing nothing as my country heads towards the flames again. I ask it of my friends — especially the Buddhists — my colleagues, my girlfriend. None of you are racists, I think. None of you believe that Muslims must be persecuted and harassed. Why are you not speaking out? Why are you not protesting? What will it take? Or is there nothing that will drive us out of our homes and on to the streets to brave the thugs and the tear gas, the water cannon and the bullets? Have we no fucking shame?
I feel ashamed right now; ashamed of my government; ashamed of my friends; ashamed of my country. More than anything, I am ashamed of myself. I have never felt this way about my country, and I never thought I would, but I feel it now. And I hate feeling this way. In the worst of the war, I told myself that it wasn’t my fault; that I hadn’t chosen this war to fight. But this is now. This is me. This is us. This is our country and our moment of destiny is here. Why are we doing nothing?

Rajinikanth, other actors join strike for SL
[ Tuesday, 02 April 2013, 07:55.42 AM GMT +05:30 ]
Superstars Rajinikanth joined a day-long hunger strike by the Tamil Nadu film fraternity in Chennai today to show solidarity with Lankan Tamils. Top actors and others have already begun gathering at the venue, the South Indian Film Artistes' Association at T Nagar.
A large shamiana with hundreds of chairs under it has been readied to host the celebrity protesters.
The film industry, said its president Sarath Kumar, is endorsing the demands made in a resolution passed by the Tamil Nadu Assembly last week. These include the demand for economic sanctions against Sri Lanka for what they allege is the "genocide" of ethnic Tamils in that country, and for the rehabilitation of Lankan Tamils.
The film stars are adding their voice to protests that have been on in the state for days now, with all major political parties and students demanding that the Centre take a strong stand against Sri Lanka for its alleged war crimes in the final months of the civil war that ended when defence forces crushed the separatist Tamil Tigers in May 2009.
So emotive is the issue, that the DMK pulled out of the UPA coalition at the Centre last month, accusing India of watering down a UN resolution against Sri Lanka; India voted against Sri Lanka, but the Tamil Nadu parties say it let down Sri Lankan Tamils by failing to persuade the United Nations to use stronger language against the island nation and by not pushing for an independent rather than an internal inquiry into the alleged war crimes.
The resolution, moved by Chief Minister J Jayalalithaa, demands India move a UN resolution seeking a referendum on a separate Eelam among Tamils in Sri Lanka and those who have migrated abroad.
Eelam is the separate homeland that Tamils are seeking in Sri Lanka.
The resolution also seeks a credible international probe into the allegations of genocide of Lankan Tamils in the island nation.
The issue has spilt over to sports too, with Ms Jayalalithaa ensuring that no Sri Lankan cricketer of official will be involved in Indian Premier League (IPL) matches to be played in Chennai.
