University Teachers Federation of Associations informed those in power by releasing the four students attached to Jaffna university who are serving  detention at the terrorism intelligence unit,  could escape from the  human rights violation accusation made  by the international community.
 
The students did not have in possession arms. They were not engaged in crime activities. Hence by releasing them, arrangements should be done for the university to function was said by Federation spokesperson Dr.Mahinda Mendis.
 
He further said, government should not make fun out of Sri Lanka. Government should not pave way for the accusations charged that government is violating people’s rights.
 
Due to the situation created in Jaffna, Jafna peoples, Jaffna university students Teachers are in much fear. They are facing harassments.  In view of sudden arrest the normal life style is getting disturbed.
 
Clashes occurred from November, and the university activities came to a standstill. Many university students are interrogated by the terrorism intelligent unit.
 
Already 50 persons are arrested in Jaffna. Their families have made complaints to the Jaffna Human Rights Commission.
 
Government should not make fun out of Sri Lanka.
Government should not pave way for the accusations charged that government is violating people’s rights.

Jaffna University to resume on Jan. 16

Academic activities of the Jaffna University will begin on January 16 after a two-month disruption following the arrest and detention of four students by the military, university sources said.

The four students who are detained at a rehabilitation camp in Welikanda had reportedly requested their colleagues to attend lectures stating that the authorities had promised them they would be released soon.

They had conveyed this message to the Deans and Lecturers who had spoken to the students over the phone.

The university Vice Chancellor will meet the Faculty Deans and the Lecturers on January 7 with a view to resuming university activities.

The students have been continuing to boycott lectures after 11 students were arrested in November in the wake of allegedly holding a LTTE commemoration ceremony within the university premises. Seven of the students were released with four of the students still under detention.(Menaka Mookandi and K. Suren)

Ruhunu students take to the streets against attacks by govt. thugslogoFRIDAY, 04 JANUARY 2013 

An agitation was carried out by students of Ruhuna University protesting against the attack on a group of students by thugs nurtured by the government on the 31st December and the 1st January and the failure of the university authorities or police to take action regarding the incident.
A student activist said the government carried out the attack to bring discredit to university students and to plant the view in the society that university students were thugs and an irresponsible lot. He said the government is engaged in such campaigns at present.
He said several thug students who have been placed by the government inside the university and government thugs from outside have carried out the attack on students and three students injured in the attack had to be hospitalized he pointed out.
The students express their vehement displeasure regarding the failure of university authorities and the police to take action regarding the incident.

The four students from the Jaffna university were arrested and detained and they will be released, but it cannot be said when was said by Higher Education Minister S.P.Dissanayake.
 
Jaffna university society yesterday Thursday met Higher Education Minister and during discussion he made this statement.
 
Higher Education Minister urged at this discussion to expedite in commencing the Jaffna university education activities.
 
However university society informed the Higher Education Minister to commence the university education activities,  to release the arrested detained students.
 
 
On response Higher Education Minister said, arrested and detained students will be released, but it cannot be said when.
 
Minister told the university society, students education should not get affected hence educational activities should resume immediately, was the information given by one of the members attended the discussion.  
 
Jaffna university Deputy Dean Prof.Vasanthi Arasaratnam, Deans, council members and University Grant Commission Chairman attended the meeting.

EPDP accuses occupying SL military for inaction on child rape

TamilNetIn a strange turn of affairs, SL minister Douglas Devnanda’s Eelam People Democratic Party (EPDP), a paramilitary collaborating with Sri Lanka government, demonstrated on Thursday against the rape and murder of a 4-year-old child in one of the islets off Jaffna, shouting slogans against the occupying SL military. Why the Sri Lankan forces that were quick in arresting those who were hoisting Tiger Flags is unable to arrest the culprit behind the heinous crime, the EPDP demonstrators questioned. The girl child, Chudarini Gunasegaram reported missing from her house at Ma’ndai-theevu in Jaffna on 27 December, was found slain and dumped into an abandoned well the following day, with traces of rape in brutal ways.

The EPDP, which has been controlling political and civil affairs in the islands divisions of the Jaffna district, mobilised the protest against the Sri Lankan forces in the name of a proxy front organisation called Rojavanam Chi'ruvar Kazhakam (Rose Garden Childrens' Congregation).

More than 300 people, including the officials at the government offices and civic bodies, took part in the protest. Mr Devananda had personally phoned several officials instructing them to participate in the protest, informed sources in the island told TamilNet. 

School children also took part in the protest. 

The protestors who marched from the St. Peter’s Church towards the Sri Lankan police station at Ma'ndaitheevu shouted slogans against the Sri Lankan forces.

Meanwhile, news sources said that the SL police had arrested a 31-year-old EPDP supporter on the allegation of suspicious movement at the site of the crime at that time. But the SL police, when contacted by media, denied any arrest. 

Recently, the collaborating EPDP is found sidelined by the occupying Sinhala military that favours direct collaborators who have joined Mahinda Rajapaksa’s Sri Lanka Freedom Party (SLFP).

Two villages in the Vadamaraadchi region of the Jaffna peninsula saw Christmas events organised by the Sri Lankan Army.


Soldiers of the 55th Division, based in Vetrilaikerni near Elephant Pass, dressed up as Santa and in traditional Singhalese clothes, singing songs in Singhalese, English and Tamil.

Pictures on the “Civil Military Coordination” website, show dozens of children watching the show put on by the soldiers, many of whom would have taken part in combat during the brutal end-phase of the armed conflict in 2009.

 Sri Lanka petroleum authority losses amount to Rs. 95 billion last year

Jan 03, Colombo: The state-owned petroleum supplier, Ceylon Petroleum Corporation (CPC) incurred losses of approximately Rs. 95 billion, its Managing Director Susantha De Silva has said.
Despite hiking fuel prices several times last year, the CPC incurred losses due providing fuel at subsidized prices and to the delay in payment by state institutions for fuel supplied, the official said.
The fuel authority says that it incurs losses amounting to Rs 16 on the sale of a liter of diesel and Rs 26 on kerosene while the loss Rs 40 is incurred on a liter of crude oil.
The CPC increased the price of a liter of petrol by Rs. 10 on December 14.
According to the official, the power and energy supplier, Ceylon Electricity Board (CEB) owes Rs 47 billion to CPC.
The CPC increased the price of a liter of furnace oil by Rs. 25 from December 31 to recover the losses it incurs from supplying fuel to the CEB at concessionary rates.
The CPC says it was forced to increase the price of furnace oil as it incurs losses of Rs. 4.2 billion per month from providing furnace oil at concessionary price to CEB and several private sector power suppliers.
In addition to CEB, the national carrier SriLankan Airlines owes the CPC Rs 21 billion, the Defence Ministry Rs 14 billion and Sri Lanka Railway Rs 5 billion.
Although the CPC suffers losses form the diesel sales, the Corporation has no plans to raise diesel prices, the Managing Director has said.

HHow did 14 sudden deaths occur at Jaffna Teaching hospital? Civic case filed in court to investigate.

When deaths increase, it should be investigated and notified to Health Ministry, and ample medical assistance should be obtained. Concerning the death, hospital Director and Regional Health Service Directors should conduct adequate investigations. 14 petitions had been filed in Jaffna courts concerning the 14 deaths occurred last year in the Jaffna district during pregnancy and deaths owning to diseases. Concerning 14 deaths, Coroner M.Udayasiri has filed petitions at the Jaffna courts. What sort of diseases has affected the children to die should be in detail investigated was appealed by Coroner Udaya Siri in his report submitted to the courts regarding the death cases. Around five and more male babies and six and more female babies have died. Subetha Fernando Rajitha who was admitted to Jaffna Holy Cross private hospital for child birth and her twin babies altogether three have died are also the cases included. Coroner�s report submitted to the courts further states, deaths due to old age will be considered an individual human loss and a loss for the family, but mother and child deaths should be considered as a loss to the society. The past war and migrations have created a massive space in the young generation. Aged marriages, husband wives both employed, difficulties in caring the children including many reasons the birth percentage in the Tamil society is getting lessen. When deaths occur in the senior society, social density will get minimized. This will create a major impact in social, politics and economy in the future. By considering this action should be taken to prevent mother and child deaths. When mother and child deaths increase, should investigate and notify the health ministry, and should acquire the required medical assistance. Regarding these deaths, hospital Director and Regional Health Service Directors should conduct suitable investigation. But so far it is not aware of such activities have occurred. Some who have got affected have submitted some indictments. Patients are not examined benevolently and with concern when they visit hospitals to obtain treatment for diseases. Medicine is given without diagnosing the diseases. Most of the medical experts, examine patients at the state hospitals who had paid cash and have registered in private hospitals. Deaths occur due to the reason that satisfactory treatment is not provided at the proper time. Gynecologists at the Jaffna Teaching hospital is not available during child birth, and the house doctors only attend to pregnancy, it is also the reason for deaths to occur during child birth, were the allegations made by the people was mentioned by Coronet in his report.

22 SL Government sites hacked

A number of 22 subdomains of the North Central Provincial Council (nc.gov.lk) owned by the Sri Lanka government have been defaced by Bangladeshi Grey Hat Hackers (BGHH).

The affected subdomains represent the sites of the Public Service Commission, the Department of Sports, the Department of Agriculture, the Ministry of Health and many others.

“Some so-called hacker from Sri-Lanka challenged us that their country’s gov sites are too secured and unbreachable. We defaced the 22 gov sites to show them and to prove them ‘No system is secured from us.’ We also urge the government of Sri-Lanka to increase the security of their sites,” the hackers said in a statement.

BGHH also defaced the site of Joomla India (joomla.in), a company that provides web design and web development services. It’s worth noting that the firm, Joomla India, is not affiliated in any way with Open Source Matters or the Joomla! Project.

A campaign group for human rights has criticised "tasteless" holiday accommodation built on the site of Sri Lanka's "killing fields".

The lagoon of Nanthi Kadal, on the island’s north coast, was, in 2009, the scene of atrocities in the Sri Lankan army’s final push against the Tamil Tigers. Now the location, where the UN estimates tens of thousands of civilians were killed, is the setting for army-run holiday homes. One teak villa was opened by the president, Mahinda Rajapaksa, and his brother, the defence secretary.
“Enjoy a soothing holiday and the cool breeze of Nanthi Kadal lagoon,” is how the three-bedroom property, Lagoon’s Edge, is promoted on the resort’s Facebook page. On its walls hang memorials to the civil war. A Sinhala language newspaper report describes it as where “thousands of war heroes, terrorists and others died”.
“War tourism is all about presentation,” said Fred Carver of Sri Lanka Campaign for Peace and Justice. “In Cambodia, for instance, the killing fields are presented by the victims. When done properly it can have a healing role but in this case it’s all from the perspective of the victors, the Sri Lankan army.
“It’s all about 'come and see where we killed Prabhakaran’ [leader of the Tamil Tigers]. I can guarantee there’ll be no mention of civilian casualties.”
Jono Vernon-Powell, managing director of the tour operator Nomadic Thoughts, questioned “whether the tourism project is appropriate, given that it is on the very site where a UN report claims the Sinhalese military committed war crimes and crimes against humanity”.
The Sri Lankan military runs various private businesses in the country. At Lagoon’s Edge, “all meals and services are supplied by the Sri Lanka army”, and visitors have to be “recommended by a Sri Lanka army official”, it says on the Facebook page.
“We’re concerned about the push the military is making into tourism generally,” said Mr Carver. “They already own several hotels, run whale-watching trips and own wildlife sanctuaries.”
Some tour operators are just beginning to promote Sri Lanka’s previously off-limits northern and eastern coasts.
“There’s unique food and wonderful Tamil culture,” says Sam Clark, managing director of Sri Lanka specialist, Experience Travel. He acknowledged there can be some positive outcomes from “dark tourism” to war zones but cautioned that, in this case, “it is very soon”.
As for staying in army-run accommodation, Mr Clark said: “We encourage people to stay in small, independently owned places rather than ones run by a government institution.”
Sri Lanka’s acting high commissioner, Neville de Silva, objected to the term “war tourism”.
“Just because there was conflict in an area, does it mean tourists shouldn’t go there?” he asked. “Tourism is providing livelihoods for people who were caught up in the conflict.”

More needs to be done for IDPs return - UN

United Nations High Commissioner for Refugees Antonio Guterres said more needs to be done by the Sri Lankan government of the country of origin, to create conditions for people to feel comfortable about considering the possibility of returning from India.

In an interview with the Hindu newspaper, Mr. Guterres, who was the former Prime Minister of Portugal said, “It has to do with the living conditions, work, education, health, property and security; these are all key questions that need to be addressed for the voluntary repatriation of the people. It is very important that the government of the country of origin do everything possible to re-establish the confidence of people. And I hope it will be also possible in the near future to intensify the voluntary repatriation of the Tamils into Sri Lanka.”

“The number of people going back to Sri Lanka has decreased substantially in the recent past. We need to look into what are the obstacles and how the two governments of India and Sri Lanka, working together can improve the conditions and create opportunities for the voluntary repatriation of the people. Voluntary is the key word here,” he said.

Mr. Guterres also said that the UNHCR has been running several welfare programmes to support the people who returned and the internally displaced people of Sri Lanka. “We are already cooperating with India and ready to intensify our programme in order to offer our contribution to the successful operation of people going back to their homes whenever possible with safety and dignity.”

Court rejects Sri Lanka judge Shirani Bandaranayake inquiry

Lanka's Supreme Court has ruled that an attempt to impeach the chief justice is unconstitutional.
A parliamentary select committee found Shirani Bandaranayake guilty of professional misconduct in December.
Mrs Bandaranayake denies allegations of financial and professional wrongdoing. She could be dismissed after parliament votes on the report in January.
Critics say the impeachment charges are politically motivated and challenge the judiciary's independence.
But the Supreme Court on Thursday declared that a parliamentary committee does not have the legal power to investigate allegations against the chief justice.
In the ruling, the judges said it "has no legal power or authority to make a finding adversely affecting the legal rights of a judge," the Associated Press news agency reported.
Information Minister Keheliya Rambukwella is quoted by AP as saying it would be "premature and unfair" to comment on the ruling until the speaker of parliament has expressed his views.
Civil society figures and lawyers have accused the government of trying to stifle the independence a judiciary which has made rulings unfavourable to Sri Lanka's powerful president.
The government has denied pursuing a vendetta.
Australians protest against cricket tour as campaign grows

More than 50 Australians gathered outside the Sydney Cricket Ground to protest against Australia hosting the Sri Lankan cricket team in their tour of the country, as more supporters signed on to the boycott Sri Lanka cricket campaign.
Campaigners handed out leaflets and displayed banners at the entrance to the Sydney Cricket Ground, as they continued their boycott campaign.
Present at the protest was David Shoebridge, Greens Member of Parliament for New South Wales. He had earlier stated in a press releaseby the Tamil Youth Organisation Australia,
“Sport can be a wonderful way of uniting people across the planet but it is also abused by illegitimate regimes as a form of soft diplomacy... The current Sri Lankan regime tortures dissidents, disappears journalists and abuses the human rights of the Tamil minority."

“No Australian sporting team should be providing them with legitimacy by playing them at an international level."

“We saw with the boycott of the South African apartheid sporting teams how a united opposition to those who abuse human rights can create the environment for change, and we should be doing the same in relation to Sri Lanka."

“When we see our government working hand-in-hand with a brutal and repressive administration, such as Rajapaksa’s, then it is even more important that the rest of civil society takes a stand.”
With the protest attracting a large media crowd, Nick Riemer of the  Refugee Action Coalition told TEN Sport, 
"As with the South African apartheid regime, Sri Lanka deserves a boycott of cricket tours and other sporting teams,"
"Sri Lanka President (Mahinda) Rajapakse uses the country's cricket team to promote his dictatorial regime, being constantly photographed with the players and naming Colombo's new cricket stadium after himself," said Riemer of the Refugee Action Coalition.
Sri Lanka are currently on tour in Australia, where they are losing 2-0 in a three-test match series. A series of one-day and Twenty-20 matches are also scheduled to be played.

Sampanthan, Herath could get into hot water

Deputy Speaker Chandima Weerakkody yesterday said that action would be taken against two MPs, R. Sampanthan (TNA) and Vijitha Herath (DNA) who were also members of the Parliamentary Select Committee that probed the charges in the impeachment motion against Chief Justice Shirani Bandaranayake, if they had given evidence before the Court of Appeal hearing a petition against the PSC.

He said that special permission was needed for MPs to give evidence regarding Parliament proceedings and its committees outside Parliament and these two MPs had obtained no such permission before they appeared before the Court of Appeal yesterday.

The Deputy Speaker said that he was unaware whether the two MPs had given evidence before the Court or a sworn affidavit which could be also considered as evidence.

"If the said MPs have given evidence, action could be taken against them under Section 17 of the Parliament Powers and Privileges Act," Weerakkody said, adding that a censure motion could be brought against MPs Samapanthan and Herath on the grounds that they had undermined Parliamentary supremacy. "Else they could be charged for contempt of Parliament," he said.

The Deputy Speaker pointed out that the statement made by Speaker Chamal Rajapaksa, when notice was first issued by the Supreme Court and the statement made by former Speaker Anura Bandaranaike, stated that a third party could not intervene in the affairs of Parliament and that principle applied to the impeachment process as well.

The Deputy Speaker went on to say that the Court of Appeal or the Supreme Court had not notified the Parliament regarding its decisions.

He said that the Appeal Court interpretation on the PSC had no impact on Parliamentary process. He added that Speaker Chamal Rajapaksa would declare the stand of Parliament over the matter when the House meets on January 08.

Amend Divineguma Bill, Don’t Impose It On North

The Divineguma Bill now before Parliament provides for the setting up of a new department called the Divineguma Development Department, the main object of which is the administration of a poverty alleviation programme. The Bill was challenged before the Supreme Court and the Court held that as much as fifteen clauses of the Bill dealt with matters enumerated in the Provincial Council List. Article 154G (3) of the Constitution requires every Bill in respect of any matter set out in the Provincial Council List to be referred by the President to every Provincial Council for the expression of its views before it is placed in the Order Paper of Parliament. The Divineguma Bill had not been so referred to Provincial Councils and, as such, the Supreme Court held that the Bill could not become law unless so referred. As the Bill had been placed in the Order Paper without complying with Article 154G (3), the Court made no determination on the other grounds of challenge.
The Bill was then withdrawn and referred to the eight Provincial Councils which have been constituted and to the Governor of the Northern Provincial Council. All existing Provincial Councils agreed to the passing of the Bill. The Northern Provincial Council not being constituted yet, the Governor of that Province purported to express agreement to the passing of the Bill, on behalf of the Council. The Bill was then placed in the Order Paper and was challenged before the Supreme Court. On the ground of challenge that the Bill has not been referred to all Provincial Councils and therefore could not have been placed in the Order Paper, the Supreme Court held that “every Provincial Council” must be interpreted to mean every Provincial Council that had been established and constituted. It follows from the decision of the Court that the Bill could therefore have been placed in the Order Paper.
Divineguma- Implications for Devolution
If the Divineguma Bill becomes law, many functions of Provincial Councils will be taken over by the Divineguma Development Department. Among the matters that the Supreme Court observed to have a co-relation to items in the Provincial Councils List are: implementation of provincial economic plans, rural development, food supply and distribution, construction activities, roads, bridges and ferries within a Province, rehabilitation of destitute persons and families, rehabilitation and welfare of physically, mentally and socially handicapped persons, market fairs, co-operatives, regulation of unincorporated societies and associations, agriculture, promotion and establishment of agricultural, industrial, commercial and trading enterprises and other income generating projects and relief for the disabled and unemployable. The Divineguma Development Department will become a super-department not only at the expense of other central government departments but Provincial Councils as well.
While programmes for poverty alleviation and guaranteeing social equity may be undertaken by the Centre, it is important that they be implemented without transgressing on the functional competences of Provincial Councils. In fact, Provincial Councils should be made implementing partners of such national programmes. We therefore call upon the Government to make suitable amendments to the Divineguma Bill to ensure that where functions relating to the programme envisaged are within the competence of Provincial Councils, such functions are carried out by the Provincial Councils and not the Divineguma Development Department. The Department would, of course, co‐ordinate the implementation of such programmes by the Provincial Councils.
The Bill also provides for the setting up of Divineguma organizations at community, regional and district levels under the supervision of the Divineguma Department. The objects and powers of such organizations are mostly related to matters enumerated in the Provincial Council List. We therefore urge the Government to amend the Bill suitably so that Provincial Councils would not be denied of their functions under the Constitution.
An eleven-member Divineguma National Council is to be established to assist the Department in respect of the policy and management of divineguma development programmes. The Council will have no representation from Provincial Councils. We urge that the Council be expanded to include four nominees of the Chief Ministers’ Conference.
The Supreme Court has held that several provisions of the Bill are inconsistent with the Constitution and suggested amendments to make the provisions consistent with the Constitution. We call upon the Government to amend those provisions as suggested by the Supreme Court rather than using the two-thirds majority it has to pass the provisions.
Imposing Divineguma on the Northern Province
Article 154 G (3) of the Constitution provides that where every Provincial Council agrees to the passing of a Bill on a matter in the Provincial Councils List, such Bill could be passed in Parliament by a simple majority. However, where one or more Councils do not agree to the passing of the Bill, such Bill must be passed by a two-thirds majority if the Bill is to become a law that is applicable to all nine Provinces. If passed only by a simple majority in Parliament, the Bill would become a law applicable only to the Provinces which had agreed to the Bill.
An important question that arose before the Supreme Court was whether the Governor of the Northern Province could have expressed agreement to the passing of the Bill on behalf of the Northern Provincial Council. On this issue, the Court held that the views of the Governor cannot be considered as the views of the Northern Provincial Council and as such, the Bill would be required to be passed by a two-thirds majority. What follows from the Court’s determination is that if the Bill is not passed by a two-thirds majority, the Bill would not become a law applicable to the Northern Province.
Under Section 10 of the Provincial Councils Elections Act, the Commissioner of Elections is required to call for nominations within one week of the dissolution of a Provincial Council. However, in the case of the first election to a Provincial Council, the Commissioner could call for nominations only after the President gives him a direction to hold the election. Thus, the Northern Provincial Council has not been constituted only because of the President has not made such a direction. The President has, on more than one occasion, stated that the first election would be held in September 2013.
The importance of holding elections to the Northern Provincial Council need not be emphasized, especially when the Lessons Learnt and Reconciliation Commission (LLRC) appointed by the Government has stated that a political solution is imperative to address the causes of Sri Lanka’s ethnic conflict and that there should be more devolution. Since the end of the separatist war in May 2009, presidential, parliamentary and local elections have been held in the Northern Province but not elections to the Northern Provincial Council.
In the above circumstances, we urge Parliament not impose the Divineguma Bill on the Northern Province by passing it with a two-thirds majority. The people of the Northern Province have not been able to express their views on the Bill through their Provincial Council only because no direction has been made to hold elections to that Council and it would be against the spirit of devolution to impose the Bill on the people of the Northern Province.
Friday Forum especially calls upon those political parties and Members of Parliament who believe in a political solution to the ethnic conflict and have been speaking out on the need to strengthen devolution not to be a part of a two-thirds majority that would impose the Divineguma Bill on the Northern Province and its people. Once the Northern Provincial Council is constituted, appropriate legislation could be brought to extend the new law to the Northern Province and the Northern Provincial Council given an opportunity to express its views on the Bill in the same manner in which the other Provincial Councils were given an opportunity.
In the post-war period, the Centre has found various means of weakening of the Provincial Councils, a good example being pressurizing them not to collect Business Turnover Tax in violation of their own statutes. Passing the Divineguma Bill in its present form and imposing it on the Northern Province would further weaken Provincial Councils and also have a negative effect on efforts at reconciliation.
