ICG silently withdraws mischief on TamilNet

The International Crisis Group (ICG) silently removed a mischievous part of a statement on TamilNet that appeared in its latest report on Sri Lanka, No. 239, dated 20 November 2012. TamilNet on 23 November, in a news item “ICG plays mischief with TamilNet,” challenged the ICG to prove its credibility on the concerned part of the statement and said, “If an open apology is not forthcoming from the ICG, TamilNet may have to seek justice from the law of the countries where the ICG is registered.” TamilNet, on Monday, has noted the removal of the part along with its implicating footnotes in the online version of the ICG report.

TamilNet considers the removal of not only the mischievous part of the statement but also the implicating footnotes as a fitting message to writers who come out with unfounded allegations on TamilNet.

However, the damage done to TamilNet by nearly 20 days of circulation and downloads of the ICG report has not been compensated or repented by the ‘silent’ removal, without an open apology published.

TamilNet is sad to note the lack of etiquette on the part of the ICG that fitting to the high-profiled world personalities associated with it, should be actually setting norms in media culture and in the delivery of justice to media.


Condemn The Assault On The Students, Academic Community And Media In Jaffna By The Armed Forces

Colombo TelegraphMembers of the academic community  of the University of Jaffna,  comprising students and lecturers, had assembled on “Heroes Day”  to commemorate all those who had shed their blood and sacrificed their lives- the tens of thousands abducted, disappeared and killed  yet unaccounted,  for the cause of the liberation of the Tamil Nation. They assembled to share their grief and renew their hopes of freedom. Such is the bottomless grief and the desperate cry for freedom arising from the agonized and tortured souls of the Tamil people that they would assemble on this day, in spite of the draconian military occupation and violent repression they are forced to submit to.  This goes to show how the cry for freedom shall persist and endure, and grow stronger, the more that freedom is suppressed by hated tyrants and oppressors.
The armed forces were let loose by the Regime against these participants, including students,  professors and media personnel, with the aim of extinguishing every living trace of memory of the Tamil Nation in its struggle for liberation. It was aimed at wiping out every pain of grief, every tear of sorrow, every cry for justice arising from the agonized depths of an enslaved, degraded and subjugated people. The vulgar criminality of this brutal assault by the armed forces against unarmed and peaceful citizens in Jaffna is compounded by the consequent arrest and incarceration of participating students under the Prevention of Terrorism Act. The Regime is determined to extinguish the fires of freedom from the Earth through military occupation, political subjugation and by erasing the collective memory of the Tamil Nation, such that the very notion and reality of the Tamil Nation shall be eradicated from the soil. The war has simply taken on new, more insidious, invidious and more deadly genocidal forms.
Yet, the Logic of History and the Natural Law of Justice decree that against all the barbaric cruelty and depraved abuse, against all the sophisticated mechanisms of terror and torture, against all the systemic, systematic and routine violent suppression, the cry for freedom and shall rise from the very depths of mass oppression and slavery and seek justice in the Tribunal of History. Every crime and atrocity endured, every grievous loss borne, shall forever keep alight the lamp of freedom and illuminate the path of liberation for all generations to come.
As it is, this gross criminal violation has served to raise the consciousness of the masses, bringing new awareness of the criminal nature of the Regime and the State. They are aware that this assault on the foundations of democracy and civilized decency is a continuation of the unbroken and intensifying fascist repression by a corrupt and parasitic narco-mafia/ crony capitalist Regime; A dynastic regime out to amass fortunes by selling the country to foreign imperialist  and regional predator powers for fat commissions, while bleeding the toiling masses dry and terrorizing the people.
The sustained assault against the student movement gives testimony to the crucial role of the students and youth, and of the academic community in general, in the struggle for freedom. Students in the North and South are being hounded, persecuted, jailed and killed at will. Abductions, disappearances and extra-legal killings multiply. At the same time, prisoners are massacred in execution style. Workers, fishermen and farmers are shot down. This is while murderers, rapists, robbers, drug lords and war lords roam and reign with impunity and occupy positions of power and privilege. It should be clear that, whether in the North, South, East and Hill Country, the oppressor is the same. Every attack against the foundations of democracy, every violation of the life and freedom of the people, should be a basis to build the revolutionary unity of the oppressed masses to rise against the system of world imperialism and neo-colonial domination and subjugation, and together build a new world, a new social order – a new era dawning on the horizon- where the Earth shall be shared and people enjoy freedom by celebrating their unique creativity and infinite diversity, bound together in a shared destiny.

Sri Lanka Defence coerces parents or fabricates statements on conscripted Tamil girls

TamilNetThe helpless parents of the Tamil girls conscripted by the occupying Sinhala military in Vanni are now either coerced by the military or are left to accept fabricated statements coming in their names supporting the conscription. The official website of genocidal Sri Lanka’s Ministry of Defence and Urban Development run by presidential sibling Gotabhaya Rajapaksa, came out with a reporting on Friday that by slip showed coercion or fabrication. The SL defence report follows Tuesday’s news about 21 out of around 100 Tamil girls coerced to join the Sinhala military ending up in hospital in a mentally affected state, allegedly due to the sexual agenda of the military of genocidal intent. 

The SL defence website published the photos of 6 Tamil parents, who were telling that their daughters joining the SL military on 17 November have found the training methodical, they have adjusted to Army environment, have found new friends, got opportunities for sports practices, enhanced their flower decoration abilities, have begun computer training and have received unmatchable medical care when they fell sick.

According to the SL Defence highlights of the story, the parents have been saying: “The future of our children is secure, our daughters are enjoying the Army life, their training is very systematic and methodical and our children have inculcated a lot of discipline and good habits into their personal life too” – all within a time of less than a month.

But the slip was showing. 

The coercion exerted on the parents by the handling of them by Sinhala reporting staff of the SL defence website, or fabrication of the whole thing by Sinhala defence writers became evident in the way names appeared in the story. 

When the parents reportedly tell ‘I am so and so, or my daughter is so and so’, the names go as, Murugal Pille Pradeepa, Somarathnam Sunethra Kasthri, Pathinadan Priskilla, Thangawaddu etc. Any one who knows Tamil could guess what might have happened.

Sure the US and Indian militaries have a lot to learn from the genocidal military of Sri Lanka rather than giving training to it, but the Sinhala military has a long way to go in learning Tamil even to qualify in fabrications, commented a women’s group worker in Vanni familiar with the happenings related to the issue.


13 Tamil women admitted to Killinochc​hie hospital suffers from sexual tortures: JMO
13 Tamil women recently joined to the Lankan Army suffered from the physiological problems admitted to Killinochchie hospital for medical treatment. However Judiciary Medical officer (JMO) stated all these young women were suffering from sexual abuses.
Most of these Tamil women have faced sexual torches. It was also revealed Killinochchie hospital was not sufficient to treat these young women due to this doctors received medicines from the Jaffna Teaching Hospital.
Only the Sinhala doctors were permitted to provide medical treatment for these victims. Parents, nurses, doctors, government officials and ministers were not permitted to visit them. Military personals were deployed in the surrounding of Killinochchie base hospital, Judiciary Medical officer said.
However Lankan army announced all these women were suffering from physiological problems.

Chain of protests in London against repression of students in Jaffna

A series of protests have been organized outside the British Prime Minister’s Office in 10 Downing Street, London since Monday to condemn the repression of the Jaffna University students by the occupying Sinhala military. Condemning the arrests and detentions of the students and the Sinhala military’s systematic assaults on the civil rights of the Eezham Tamils as a part of the genocide of the Tamil nation, the protestors urged UK and the International Community to ensure the immediate release of the arrested students and to safeguard the democratic rights of the Eezham Tamil nation in the island. 



Speaking at the demonstration on Friday, Dr. Andy Higginbottom, principal lecturer in politics and human rights at the Kingston University, said the British government and British politicians have full knowledge of what is happening in the island, urging the Tamils in the UK to mobilize the larger British public.

Speaking to TamilNet from the protests, Sasithar Maheswaran from the TCC-UK said “The arrests and detention of the students is taking place under the Western endorsed rehabilitation and reconciliation model. Anyone who expresses the national aspirations of Eezham Tamils is automatically labelled as terrorists and incarcerated. This is the international community’s solution. This is genocide.”

A petition submitted by TCC-UK to the PMO criticized the UK for its silence. “The UK, which created the modern Sri Lanka state for convenience during the heydays of colonialism, seems little interested in correcting the wrongs of a stained history. Instead it is underwriting the genocidal acts of Sri Lanka state, offering its support at every international fora.” 

Four Jaffna University students sent to Welikanda detention camp

The Terrorism Investigations Department (TID) on a directive by the Defence Secretary has transferred four Jaffna University students to the Welikanda detention camp. Their parents have been informed of the transfer. Seven out of the 11 students who were arrested were released on the 11th.
Head of the Jaffna University Students’ Union, B. Bhavanandan, secretary, P. Dharshananth, head of the Arts Faculty Union, K. Jenamay Jayanth and S. Solomon from the Science faculty have been transferred to Welikanda from the Vavuniya TID.
“I went to the Vavuniya TID office in the morning to see them. They were not there. We were told that they have been taken to the Welikanda military detention camp,” a relative of a student said. The students’ parents have not been given a reason to transfer them to Welikanda.
Former LTTE members are also being detained for a long period at the Welikanda camp. A recent report by Amnesty International stated that persons being detained at the camp were subjected to torture.
The seven students who were released are K. Sajeevan, S. Prasanna, C. Sasikanth, S. Jengan, T. Abharajithan, P. Subeshkumar and Subeshkumar.
It is learnt that there are moves to frame false charges against the Jaffna University students who are being unlawfully detained.
The TID is reportedly trying to frame charges to say that they are being manipulated by the Tamil Diaspora and that they have links with the underworld.

Reconciliation 10 Points: Some Tamils Changed Their Names To Sinhalese After 83, Were They Accepted?

1. Reconciliation is necessary to maintain one country and one State within it. Reconciliation is a process. It entails how Sinhalese, Tamils and Muslims perceive their future to be. It requires more than a set of proposals to reconcile the marginalized communities.
2. Many Sinhalese see it as simply coexistence; others regard it as respect, and still others as mutual forgiveness. All intractable conflicts that really do end must go through some reconciliation process if the parties are going to have to interact together again in the future. If they do not, the conflict is likely to recur, even after a victory or peace settlement if a particular episode (or dispute) is reached which can escalate. Without reconciliation t is difficult to visualize the other side accepting to be part of the same state. Some aspects of reconciliation:
  • truth (acknowledging there is some merit to the other side’s interpretation of events and to their demands)
  • justice (granting redress as a means of putting the past to rest),
3.  Religious and ethnic based nationalism always leads to conflict in a plural society and not to reconciliation. The Government seems to believe that with Economic development of the North & East there will be reconciliation. But however necessary and desirable it is, it cannot itself bring about reconciliation. We need to develop a fair and just framework to address the national question- 13th Amendment or 13thAmendment plus? Measures must be taken to reconcile adversaries. It is necessary to talk to all the parties involved in the current situation, namely the democratic Tamil leadership, the Tamil Diaspora and engagement even with the UN. Reconciliation requires facing up to the truth.
4. The key to achieving reconciliation is to build strong equitable relations where distrust and fear were once the norm. The priority is for a political settlement- the 13th  Amendment or 13th  Amendment plus which has to be negotiated between the democratically elected Tamil leaders and the President.  The nature of the settlement must suit the present conditions and the demand for devolution has to be addressed and cannot be evaded. The President can carry the Sinhalese nationalists particularly the Maha Sangha with him because he still has the trust and confidence of the Sinhalese people.
5. The most valuable lesson to be drawn is the need for political leaders and the Maha Sangha to take a pluralistic Sri Lankan national identity rather than an ethnic or religion based nationalism. Previous attempts to resolve the problem failed owing to the opposition of sections of the Maha Sangha. Attempts must be made to win the acceptance of the Maha Sangha
6.In addition to resettlement of the IDPs and providing them a livelihood it is necessary to address the problem of trauma suffered by these people. Their self esteem has to be re-established. This aspect of the rebuilding of their psychology can be best done by civil society groups, NGOs, Church groups.
7.A Sri Lankan identity means there should be no more appeals to Sinhala nationalism or Tamil nationalism. All sections of the people particularly the media and the political leaders must decide against it. But the answer is not to seek to plant more Sinhalese in these areas and reduce the Tamil majority for that would only worsen the fear and suspicion of the Tamil people that the Sinhalese are seeking to dominate them. The stoppage of State aided colonization has always been a demand of the Tamil people to which we have to pay heed. Peace can come only through justice and reconciliation.
8.Devolution of power is the only way to win over the Tamil people to the acceptance of a one country and one people. India did it and it has helped India to build an Indian national identity. Gone are the days when Indians considered themselves as Sikhs, Bengalis or Tamils. They are now proud to call themselves Indians. We still pride ourselves as being Sinhalese or Tamils but as Sri Lankans. The Tamil expatriates have much to offer to re-build the country if Reconciliation can be achieved. The people of all communities are ready for reconciliation. It is up to the Government of President Rajapakse to take the lead without playing politics of race and religion as in the past. We have failed to build a Sri Lankan nationalism. Some would say there is no such thing as a Sri Lankan nationalism and that it was a myth which the English educated have sought to foist on the country. There are three basic paradigms of nationalism: secular nationalism, ethnic nationalism, and theocratic nationalism. We have to decide between them in building our post-colonial independent State. Countries like Singapore followed the secular nationalist model as did India. Pakistan and Iran follow the theocratic model. Malaysia also selected the ethnic nationalism paradigm. There were the 1967 ethnic riots which led to much carnage and the country’s leaders learnt their lessons and sought to address the challenge of ethnic pluralism.
9.Countries that have followed ethno-religious nationalism have failed to achieve liberal democracy although the façade of elections and political parties may continue as they do here. But behind such façade is the Sinhala Buddhist identity which assumes that the country belongs only to the majority community who are the native sons who should inherit the land which includes the land where the minorities are settled and constitute a majority.  In states where the dominating culture which affects democracy is ethno-religious nationalism only the majority are automatically assumed to be loyal citizens. The minorities are suspect and have to prove their loyalty to the State.
10.Forced homogenization- A spurious solution of some Sinhalese nationalists is that the only way to integrate the minorities is to remove their majority status in parts of the country they inhabit and assimilate them to Sinhala Buddhist culture. So they suggest a policy of colonization of the areas of habitation of the minorities if not openly at least by stealth. The fear of the Tamils that ethnic colonization is planned should be dispelled and the best way to dispel it is to resettle the IDPs in their original homes and villages. But we must learn from history.
A Jewish ethnic group was forced to convert to Islam in Turkey under the Ottoman Empire. But this group called the Dönme did not marry outside their community and the Muslim majority despite their efforts to integrate into the Muslim State came to be looked upon with suspicion by the majority Muslims of Turkey. They were branded separatists and perceived as a “fifth column, “an internal danger to the majority. And during the First World War they were accused of assisting the enemy. So despite the public efforts of minorities to integrate in new nation-states, religious identities can persist and not be entirely replaced by secular citizenship. Even when they attempted to play their part, minorities were not always accepted as equal citizens in practice. So the policy of trying to make Sinhala Buddhists out of the Tamils, Muslims or Christians is not a policy that can succeed, with Turkey being the best example.
Some Tamils changed their names to Sinhalese names after the pogrom against them in 1983. But were they accepted as Sinhalese by the majority. Professionals who had married Sinhalese wives lament how their children and wives were as much victims of the pogrom as they themselves. Much of the scholarship on nationalism discusses the slow development of the formation of “nationness.” It is described as a gradual process lasting centuries, from nation building, to the emergence of nationalism and nationalist movements, to processes of nationalization .We obtained Independence only few decades from three centuries of colonial rule. We must not be in a hurry to build a nation-ness” Attempts to culturally or even racially to incorporate minorities into the mainstream are not workable projects which will bring success. Instead they merely lead to stratification within such a society.
Scholars therefore argue for the open, universalist secular approach to citizenship. It envisages a slow development of a nationhood consciousness. Ethno-religious nationalism has not so far succeeded anywhere in the modern world. When “nationalizing nationalisms “work for the interests of the majority community alone, an individual’s ability to define himself or herself may be limited. When the core nation (Sinhala Buddhist) is considered the “legitimate ‘owner’ of the state, which is conceived as the state of and for the core nation,” nationalizing states promote that group’s “language, culture, demographic preponderance, economic flourishing, or political hegemony” President Mahinda has to decide between this concept of nationalism and the secular concept of nationalism. The choice he makes will determine the future of this country. Buddhism as promoted by the sections of the Maha Sangha is less concerned with belief systems but more with social and political identity. The search for a common national identity through a process of accommodation and acceptance of its ethnic and cultural diversity will take some time to develop ‘nation-ness”—
11. There is a lack of trust and easy communication between the groups—as both communicate largely in their respective ethnic tongues. Although race has been used as an ideological weapon to achieve many political ends, the distinction between one race and another is but perceptual and at best cultural, and does not correspond to any biological or epistemological absolutes
12. Role of English – English is not the native language of any of the ethnic groups. It makes the people’s consciousness cross-cultural. The Language Act which made Bahasa Malaysia the National Language was adopted in 1967. However, since then English has made a comeback in Malaysia generally and there is more acceptance of the language in all sectors of society than, say, in the 1970s.
12 People ought to share their love for the country categorically and the country in its turn should show affection for all its people without partisanship or bias. Only then, through this dialogic process of mutual respect and allegiance, will the country realize its full potential as a nation. On the other hand, if every group tries to inscribe its authority on the island and seeks to deprive the other groups of their due share from the country, it will lead to the degradation and potential destruction of the homeland. By focusing attention on their interactive past, the groups could overcome their present differences, restore the spirit of accommodation and friendly unity, and achieve their common destiny as a nation
All of us must make amends. Each and every one of us has to make an individual effort. We must show by individual actions that we will not tolerate bigotry and race hatred any more. A law against Incitement to hatred against minorities by speech or writing should be introduced and the use of such inflammatory speech or writing to further election campaigns should be banned as in India.

Statement from MP Rathika Sitsabaiesan on the arrest of students in Jaffna, Sri Lanka

Recently, the Sri Lankan government arrested and detained students without cause following a silent protest after security forces broke up a lamp lighting ceremony at a women`s hostel at Jaffna University. The students, protesting against the lack of freedom of expression, were attacked and beaten by officers, with at least 20 undergraduate students suffering injuries.

This clear assault on freedom of speech, freedom of assembly, and breach of human rights is completely unacceptable. The Sri Lankan Government must uphold the right to freedom of expression, stop attacks by security forces on students, and release P. Tharshananth, Sanmugam Solaman, Kanesamoorthy Sutharsan and K. Jenemajeyamenan.
It saddens me to see the continued oppression of Tamils in Sri Lanka and it serves as a continued reminder of the work to be done to achieve equal rights under the current government.
In Canada, our government must work with our partners in the international community to pressure the Sri Lankan Government to improve its treatment of Tamils and bring those responsible for this violation of human rights to justice. Holding individuals without charging them, along with having no clear evidence linking them to any alleged crime is inexcusable.
The Sri Lankan Government must be told that Canada and the rest of the international community will not tolerate these oppressive measures. The Canadian Government must do more to uphold human rights and democracy in Sri Lankan.

Statement from the Official Opposition Human Rights Critic, Wayne Marston on the arrest of students in Jaffna, Sri Lanka
The Official Opposition calls on the government of Canada to work with the international community to pressure the government of Sri Lanka to promptly release the students recently arrested in Jaffna. P. Tharshananth, Sanmugam Solaman, Kanesamoorthy Sutharsan and K. Jenemajeyamenan were arrested without warrants, and in the absence of clear evidence linking them to any alleged crime.
 On 27 November security forces broke up a lamp lighting ceremony at the women’s hostel at Jaffna University, reportedly breaking lamps, threatening students and pointing weapons at them. The following day students responded with a silent protest and short march and held placards denouncing the restrictions on freedom of expression. At least 20 undergraduates were injured and beaten by riot police and officers in civilian dress.
 New Democrats believe that freedom of speech, freedom of assembly and the principles of fundamental justice are basic human rights. The Government of Sri Lanka must secure these rights for the entire population. The Sri Lankan Government must ensure an end to attacks by security forces against students and peaceful demonstrators and ensure those responsible are brought to justice.

(SALEM) - A new round of arrests and unlawful detentions in Sri Lanka aimed at two particular human rights groups, remind us of the political danger that this island nation represents.

As our Human Rights Ambassador William Nicholas Gomes writes in this letter to the Sri Lanka president, the members of human rights organisations 'Right to Life' and 'Families of the Disappeared' are being targeted only because of their work that draws attention to and demands accountability for enforced disappearances in Sri Lanka.
In fact the police were very clear, that some of those hassled were undergoing that treatment specifically because of a documentary they produced and showed.
Mr. Gomes urges the authorities in Sri Lanka to cease all further forms of harassment against human rights defenders working with the NGOs in question. He believes that they have been targeted solely as a result of their legitimate and peaceful human rights work. He asks Sri Lanka to immediately return items confiscated as they are manifestly not linked to any criminal activity.
He also seeks a guarantee in all circumstances that all human rights defenders in Sri Lanka are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions including judicial and police harassment. This would be in keeping with international law which guarantees the right of free speech, regardless of how much effort Sri Lanka officials go to in order to stifle it.

I came to know about the alarming situation from Front Line Defenders.
Members of the human rights organisations 'Right to Life' and 'Families of the Disappeared' (FOD) were repeatedly summoned and questioned by police and immigration officials on 4 and 7 December 2012 following a solidarity event organised by the Asian Federation against Involuntary Disappearances (AFAD) and its partners. Police officers appeared at the event and threatened to arrest several human rights defenders who were in attendance, seizing a copy of a documentary and electronic equipment in the process. Both NGOs work on human rights issues including enforced disappearances in Sri Lanka.
The solidarity event took place at Lagoon View Restaurant in Negombo around 6.30pm on 3 December 2012. Among the guests were AFAD Council members from various Asian countries including the Philippines and Indonesia, and numerous members of civil society organisations as well as two mothers of victims of enforced disappearances. A Sinhala-language version of an AFAD primer on the UN Convention for the Protection of All Persons from Enforced Disappearance was presented, and a documentary was shown about the commemoration of victims of disappearances and massacres in Sri Lanka that was held on 27 October 2012.
At 9.10pm, a group of people including the two mothers of disappeared victims and FOD Secretary Mr Wasantha Ranil Kumara left the venue in a taxi, which was stopped 100 metres further down the road. A group of policemen, both uniformed and in plain clothes, questioned the human rights defender and the mothers of the victims before forcing them to sit in the police jeep and confiscating their mobile phones and a laptop which they had with them. Wasantha Ranil Kumara was told by the officers that the group would be arrested. The officers reportedly said this was because they had shown a documentary critical of the President to foreigners at the event. The officers also demanded a copy of the documentary. After being held in the jeep for an hour, the group were eventually let go without arrest after the FOD Chairperson Mr Brito Fernando arrived and argued with the officers. Right to Life Secretary Mr Philip Dissanayake was also stopped by police while leaving the venue, and the organisation’s laptop, projector and camera were seized. AFAD Council members who left the venue to go to the airport were also followed and stopped by police officers who recorded their passport details.
Around 1pm the following day, five officials from the investigative unit of the Department of Immigration and Emigration led by Chief Immigration Officer W. P. Aminth S. Perera came to the Right to Life and FOD offices and questioned three staff members, among them Wasantha Ranil Kumara, about the purpose of the event and the foreigners who had come to attend it. When Brito Fernando arrived, he was similarly questioned but refused to answer in the absence of an official written request. He was subsequently summoned for questioning at the Department of Immigration and Emigration on 7 December 2012. During that interview he was again asked for details of the foreign visitors who had come to Sri Lanka for the event.
I believe that the members of human rights organisations Right to Life and Families of the Disappeared are being targeted solely because of their work drawing attention to and demanding accountability for enforced disappearances in Sri Lanka.
I urge the authorities in Sri Lanka to: 1. Cease all further forms of harassment against human rights defenders working with the NGOs Right to Life and Families of the Disappeared as I believe that they have been targeted solely as a result of their legitimate and peaceful human rights work; 2. Immediately return the confiscated items as they are manifestly not linked to any criminal activity; 3. Guarantee in all circumstances that all human rights defenders in Sri Lanka are able to carry out their legitimate human rights activities without fear of reprisals and free of all restrictions including judicial and police harassment.

Relatives of prisoners killed in the Sri Lankan prisonIt is reported that Carlton Motor Sports Club has imported 19 motor cars including Lamborghini, Italian luxury and super sports cars at a cost of nearly hundred million rupees (Rs.93,366,272). The luxury cars have been taken away from the port without paying any taxes.
When importing goods Port and Airport Development Levy (PAL), Customs duty, VAT and Nations Building Tax (NBT) are levied. However, none of these taxes have been paid and the amount the country has lost is more than Rs. 202,231,439. Despite tax has been withdrawn for racing cars, the custom levy has to be paid. The President removed taxes for racing cars in his 2013 budget.
Thirteen of the nineteen racing cars have been removed on 11th December paying Rs.2500 as service charges.
Among the cars that have been imported are Porsche - 3900 CC from Japan, Aston Martin -3500 CC, Nissan Fairlady -3500 CC and Honda Civic - 3500CC from Malaysia, two Lamborghini Callardo - 4961 CC motor cars from Hong Kong and Macau. Thirteen cars have been imported from Toyota Kirloskar Motor Private Limited in India. Among the cars imported from India are brand new Etios Motor Racing Cars with 1496 cc capacity and 1197 cc capacity.
The motor cars are imported by Gac Logistics ltd for Carlton Motor Sports Club  on Carnet scheme which permits the temporary importation of private vehicles. Carlton ahs made use of this loophole to get down vehicles and custom officers say there is no guarantee that the cars would be taken back as required by the law. According to the regulation the vehicles have to be returned to the country of origin within five months. However, this period could be extended. Custom officers are randomly transferred on political needs so that the mass scale racket could be concealed say customs sources.

Colombo Night Races – Should Citizens Be Concerned?

While at least 500 railway crossings remain unprotected, countless villages in Sri Lanka remain without access roads and another large number of the citizenry have very meagre means of transport, the glamorous second edition of the Colombo Night Races will be held here in Colombo on the  14th and 15th December 2012 – Today and tomorrow.
The event will be conducted collaboratively by Carlton Motor Sports Club (CMSC), the Asian Motor Racing Club (AMRC) and the Sri Lanka Motor Cycle Club (SLMCC). Qualification round of the event will be held on 14th Friday at the Colombo Fort CNR race track and races will be held on the 15th December at 7.00 PM onward at same track. The Track Layout is published below.

“It was revealed that the Race track will be similar to last year’s track with an extension up to Galle face. The GT-3 and the GT-4 category will be an international event which hopes to attracted drivers from Malaysia, Indonesia and Japan and Hong Kong. This year’s McLarens 1300 event is an addition to the Colombo Night Races with ten cars arriving on to the track, which will be driven by local experts as well as up and coming young drivers. VW Polo Cup Race is planned with seven Indian drivers in action along with three local drivers. It was also noted that the SL-GT Super Cars up to 3500cc race attracted the 24 drivers which is the highest recorded for a race of this nature. The organizers expect few riders from Maldives to arrive in the island to compete along with our local riders which to is expected to add glamour to Motor Cycle events.Four Motor Car races will be happening on race night with experienced International racers. Super Car GT3 / GT4, VW Polo cup and Toyota Etios races will race twice during the day since the given categories were identified as super experience for spectators.
VW Polo and Toyota Etios events are newly added categories for the CNR 2nd edition and expects many more foreign races for both events.
However, AMRC official acclaimed that number of racing categories which were on 1st edition taken down from 2nd edition this year to minimize difficulties fro organizers.

Concerns of Citizens
Usually citizens of a country should be extremely proud and happy, when events are conducted and showcased in their own country. Especially when that event is to do with endurance of individual athletes or teams, when the city is organized especially for the event, when the selection of the country is made based on best bids for competition, when the event is a classified regional or international competition and when the event is conducted transparently and with the proceeds going for the betterment of the country’s sports infrastructure or development of the sport through a national body or for charitable causes citizens should not only be proud, but support this actively.
However in the case of the Colombo Night Races, conducted on the roads used by the citizenry for their day to day affairs and the resultant inconvenience for weeks now and when there seems to be no transparency in its conduct, this situation is worrying and aggravating at the same time.
So being a Citizen of the City of Colombo an attempt was made to pose the following questions to the Colombo Municipal Council. But this attempt did not prove fruitful. It is only professional and ethical to write something based on feedback, fact and evidence. As no answers were received from the Mayor’s Office, the writer decided to put before the reading public, the questions that were asked. The reader therefore can decide if the questions are reasonable and warrant answers in the interest of good governance, central to which is transparency.
These are the 10 questions:
1. Is the CMC part of the Colombo Night Race 2012 organizing committee as public amenities are used?
2. Are the roads on which the race is worked out under the purview of the CMC or RDA?
3. As last time, is it happening this time as well – that contours and pavements are changed or flattened?
4. Who paid to get them back to original condition? Is the same happening this time as well?
5. From where are the sand bags and from which river/location was this sand mined? Who paid for the sand bags?
6. What about the nuisance factor? These are within areas of hotels, apartments and offices.
7. What about the hazards and laws re hazards – normally races are on special tracks? (In the USA and Canada such races on ordinary roads are deemed illegal)
8. Is any revenue coming back to the city of Colombo?
9. What is the total expense and income of this event?
10. As the roads are very narrow for racing, if something happens to a bystander/spectator does insurance cover this person?
Are these valid questions? Should the city’s tax payers know the answers or not?
