Recently reading though some international reports I came across a description of the extreme high pressure atmosphere at the highest decision making levels of the US administration just prior to the commando raid on Osama Bin Laden’s hideout in Abbottabad, Pakistan.  Only a very few in the administration were aware of the intelligence which pointed to the largish compound near a Pakistani military complex as the probable hiding place of the most wanted terrorist in the world. The US had been combing that region of the world for him for nearly ten years. Getting Bin Laden would be an invaluable breakthrough for the US government.
The fact is that until the American commandoes burst in to the upstair bedroom where Bin laden was hiding, they weren’t certain who their quarry was. Between August 2010 and April 2011 more than 40 intelligence reviews were carried out on the Abbottabad compound.

(SALEM) - More evidence of war crimes in Sri Lanka; it is a disturbing matter and the images contained in this article are tragic and gruesome, so proceed at your own discretion.
While these images shake us to the core, it is also true that a strong voice can accomplish tremendous healing for an embattled population when inspiring people and leading them to direct action.
Tremendous devotion and passion are required when delivering people out of Genocide and back to their rightful place. This story is about death and Genocide, and also about a new voice raising hope for those living within the Tamil Diaspora.

Victims of State Terrorism

The Tamil Hindu and Christians who live in the north of Sri Lanka were slaughtered mercilessly in a military onslaught that failed to distinguish civilian from militant in the months preceding the summer of 2009.
Some say 40,000 died, but others place the number much higher. Regardless of the number that died, upwards of 160,000 Tamils ceased to exist when the war ended.
The photos of the dead and dying are so graphic and sad; they leave lasting impressions for those of us who spend time researching this subject and writing about it. We can only begin to imagine the emotional scars that exist as a result of this time period. The toll inflicted upon these people is the result of a calculated Genocide.
One of the darkest aspects for the government of Sri Lanka, is the fact that the military attacks in the north all came at a time that a cease fire between the Tigers and the SLA was in place.

Graphic Videos Offer Few Answers

From this part of this article forward, 17 video clips and one slide show containing 23 images, comprise the group of media dispatched from London to our newsroom, in hopes of identifying those shown. I do not suggest that highly sensitive people look at these, although on the other hand I think we all need to see them to comprehend the enormity of this tragedy.

Today the Tamil survivors are denied the Right of Return that is granted under international law and specifically called for under the Universal Declaration of Human Rights enacted by the United Nations in the late 1940's.
The efforts to wipe out the Tamils began after the election of the current president of Sri Lanka, Majinda Rajapakse, in 2005. Using the assistance of George W. Bush and Tony Blair, Sri Lanka's political planners went about having the armed resistance and political leadership of Tamil Eelam, called sometimes a 'breakaway state', declared a terrorist group.
The LTTE (Liberation Tigers of Tamil Eelam) lost its ability to bargain for Tamils in the world political forum with the 'terrorist' designation.
It was the beginning of the end.
Along with the military invasion of the north came heinous crimes against women and children. The cruelty that was recorded in many cases by the Sri Lanka Army (SLA) soldiers themselves, is devastating to the viewer.
The new series of video that are making the rounds, shows Tamil Tiger prisoners being transported on a bus with the bodies of their dead, handcuffed and helpless.
We recently carried an article that showed the new photographs that were released just before these video clips sent to our newsroom by a London attorney, Vasuki Muruhathas, who represents an unnamed Tamil war crime victim.Captive, Handcuffed and Dying... 'Brutal' and 'Shocking'Describe Newly Released Sri Lanka War Crime Images, shows up close the helpless prisoners cuffed to the metal rails of the bus seats.
Their faces are forlorn and they are very, very young. Not surprisingly, their faces are painted with shades of resignation that seem inevitable. They know the hatred that the Sinhalese hold for them and with a designation of 'terrorist' they are regarded as non-humans.
There are several clips of them alive, many appearing to be seriously injured; we are trying along with other groups to identify these victim/prisoners and learn if any are alive or accounted for.

The comment section is always an option, if the information is private just note this and the comment will not be published, the information will simply be put to good use to help determine identities and the status of the individuals.
A number of clips show rows and rows of dead people who appear to be Tamil Tigers as many are wearing the uniform of the LTTE. As if providing today's investigators of this series of war crimes some type of morbid favour, the SLA photographed and videotaped a great deal of their actions against the Tamils.

More Rows of Dead Bodies

The photographers in this event from the SLA, used video cameras to document the dead and it appears that they are all recorded at a reasonably close proximity. Whether they correlate to the above images is not known; again we are seeking any information that is out there, and we will treat it carefully and properly; the ultimate goal is to be able to provide relatives with answers.

In typical fashion as you see in these images, the women are almost all exposed, their shirts missing or lifted to expose their breasts, many have had their pants removed. It is a sad fact that a a large number of Tamil women and girls were brutalized by the Sri Lankan soldiers.
Past articles have carried the grisly details and some clips even show the SLA abusing the dead and dying bodies of female prisoners. Their morbid comments are among other things, absolutely and completely remorseless.
This is the result of total indoctrination. There is little difference between the Sri Lanka conflict and others in this respect. Resistance groups and their oppressors are often raised to see their counterpart as something close to subhuman.
Hatred and constant killing compounds the bitterness and chances of peaceful co-existence fly out the window; healing from these traumatic events is very difficult for people on both sides of the conflict.
This is a killer of all hope for legal behavior and makes human rights laws become meaningless.
This is why the war crimes of Sri Lanks must not go unpunished; this government has proven to the world conclusively that it is not capable of behaving in a humane or legal manner.
There are endless examples of this taking place and there is the revolting fact that Sri Lanka went after the journalists who wrote honestly about what happened to the Tamils after Rajapakse and his brothers took over the country.
I have written about this detail of the Genocide also and the links to all of my past reports are located below this story and clearly identified.
The sad truth is that many Sinhala Buddhists are raised to hate Tamils and it is a fact that the same is true of Tamils. The divide is tragic for all of the people of this otherwise beautiful island nation.
The history of both cultures here is ancient and there is no reason that the two cultures can not live together peacefully. It is the drive to establish the ideal Sinhala nation that has driven these Buddhists to become such cold blooded killers.
As much as Lankan nationalists would like to deny it, the fact remains that its government is a conduit of state terrorism and its hands are soaked in the blood of tens of thousands of Tamils, and also many Sinhalese who support equal human rights.
There are many examples over the years; both in the time period following liberation from English colonization in the late 1940's, and all of the following generations, of Sri Lanka removing and striking the Tamil culture from official account. This all fed the notion of separation with Tamil Eelam and only the national ego of Sri Lanka's majority have kept this process from becoming fully implemented.
Black July in 1983 saw mobs of Sinhalese Buddhists terrorize thousands of Tamils, raping and murdering people simply because they were Tamil and burning down countless homes and businesses.
It was retaliation to the SLA casualties in a battle with the LTTE. Armed forces fought armed forces; yet the retaliation by a firebrand Buddhist monk close to the government, led to massive carnage.

Krishna Saravanamuttu, A Promising Future Diaspora Leader

Krishna Saravanamuttu, a 26 old Tamil Canadian, who is a winner of Queen’s Jubilee Medal, is a promising young Diaspora leader on the rise. In all the forums he spoke he emphasized the need for an independent international investigation into the war crimes and genocide of Eelam Tamils by Sri Lanka. Mr. Saravanamuttu called on Canada to support the eviction of Sri Lanka from the Councils of the Commonwealth. He has also also been demanding a referendum among the Eezham Tamils on the basis of historical, earned and remedial aspects of Tamil sovereignty as the only means to check the protracted genocide of the Eelam Tamil nation. This is in sharp contrast to some of the wavering stand taken by some of the older Tamil leaders.
It is about time the various Diaspora and Eelam Tamil leaders merge together and put up a common stand on the question of sovereignty and Eelam statehood. For a million Tamil Diaspora a dozen Tamil parties is just too much. It is also about time the older generation move the youth to the forefront and they take a back seat.
Mr Glen Murray, the Canadian cabinet minister in-charge of universities, who nominated him for the award, told TamilNet, “Krisna has provided outstanding leadership in Canada's student movement, in his advocacy with the United Nations for justice for Tamils around the world and his leadership in building youth organizations committed to social justice and human equality.”
“He is one of our countries emerging leaders and demonstrates the personal integrity that has earned him the trust of so many and allowed him to accomplish so much,” Glen Murray further said. A Canadian minister cannot be far out of mark. Please listen to the tube to find out what he has to say.

A Light in the Darkest of Night

A young Canadian named Krishna Saravanamuttu, is speaking out for Eelam Tamils and making a number of points clear:
  • Tamils are the victims of a Genocide in Sri Lanka at the hands of the Sinhalese Buddhist government that peaked in May 2009, yet has reigned for more than sixty years.
  • The Genocide is not over, as 100,000 occupational troops remain in the north and east; Eezham Tamils are prevented from returning to their homes, and resuming ownership of property that is rightfully theirs.
  • Seeking meaningless war crime sanctions will not lead to any real results or positive lasting change for Tamils who seek to live in the Tamil homeland. The only answer is for Tamil Eelam to exist as a nation, which it has, and does still; according to previously established doctrine.
  • Tamil Eelam's existence as a recognized sovereign government, gave it legitimate power to defend itself; therefore completely and totally legitimizing the role of the Liberation Tigers of Tamil Eelam (LTTE).
  • The Tamil Tigers did not form, nor did any Tamils partake in any form of armed resistance, until after three decades of attempting to counter Genocide through non-violent civil disobedience. The elimination of languages and culture are indeed, also aspects of Genocide.
Krisna Saravanamuttu has the unique ability to reach Americans and Canadians in English delivered without a hint of an accent. His sincere call for a Tamil homeland to be established is logical and conforms to established international law, which Sri Lanka has violated for so many years.
The Tamil Diaspora needs a bright light to guide them through the fog; an enlightened leader who can reach the western power brokers and make them understand the fact that none of Sri Lanka's problems would exist had the colonizing British not divided this population; giving advantages to the Tamils that Sinhalese were denied; resentment was fierce and the payback to the Tamils for a preference they received but did not ask for, has been a terrible bloody mess for too long.

SRI LANKA: Mundalama Police enjoy impunity despite torturing and detaining a businessman in fabricated charges

Somarathna, a businessman, filed a complaint with the Senior Superintendent of Police, (SSP) when a water pump and other goods were stolen from his business construction site by a number of police officers attached to the Mundalama Police Station. Two days after he filed the complaint, he was called to the Mundalama Police Station. When he went to the station, he was taken to the back of the building and beaten severely by the OIC and another officer, Priyantha. Mr. Somarathna fell unconscious as the result of this beating and when he awoke, he found himself in a jail cell. His family was not permitted to visit him and the officers threatened the family with Mr. Somarathna’s abduction if they chose to pursue the complaint with the SSP. He was produced before the Additional Magistrate of Puttalam on a false criminal charge, and despite voicing his complaint of torture to the Magistrate, he was sent to remand prison. Mr. Somarathna has checked himself in to numerous hospitals for treatment, but he remains in great pain and is unable to take care of himself without assistance. Although he has filed a complaint with the Human Rights Commission of Sri Lanka and the SSP, a credible investigation has yet to be initiated. This case is yet another illustration of the exceptional collapse of the rule of law in the country.

'Stop rejecting asylum requests by journalists' - RSF

 Reporters Without Borders (RSF)  is urging western governments not to turn away media workers who flee repressive countries including Sri Lanka. On the eve of World Refugee Day, while alerting UN High Commissioner for Refugees António Guterres on the need to provide refugee journalists with better protection, RSF said that European and Northern American countries tend to reject Sri Lankan media workers' applications, 'notably Tamils'.
The ruling on these applications have been that the reprisals journalists in Sri Lanka fear, have vanished with the government announcing a military victory over Tamil Tigers three years ago.

RSF Director General Christophe Deloire told JDS that it is calling upon those countries to abandon such a clear-cut stand as it does not match the complexity of the Sri Lankan context.

"The recent threats exiled journalists in Germany and Switzerland have been receiving clearly show it," said Director General. The Sri Lankan state owned media recently unleashed an unprecedented hate campaign targetting the exiled journalists, accusing them of 'treachery and treason'.

"Although the exodus of Sri Lankan journalists has notably decreased in 2011 and 2012, Reporters Without Borders is still worried about the plight of several media workers who have fled between 2008 and 2010 and who still find themselves stranded in countries such as India and some East Asian countries" he added.

RSF has also called on UNHCR, the United Nations refugee agency, to establish an alert mechanism with a designated referral officer within each of its local offices so that cases involving refugee journalists and human rights activists can be identified and handled more quickly because they are particularly exposed to danger.

Around 80 journalists have fled abroad in 2011 to escape the fate reserved for them by governments hostile to freedom of information, according to information received by RSF.

More than 260 journalists have been killed in connection with their work in the past five years and 154 are currently detained.

The World Refugee Day is observed on June 20th every year.

HONG KONG/ASIA: Media briefing -- Prevention of torture to promote freedom of expression in Asia

AHRC Logo(Hong Kong, June 22, 2012) The Asian Human Rights Commission (AHRC) and Centre for Comparative and Public Law (CCPL) at the University of Hong Kong, are inviting journalists for a discussion with former journalists and the widow of a murdered journalist about the importance of the prevention of torture to promote freedom of expression.
TortureThe event’s theme, "How the Prevention of Torture Promotes the Freedom of Expression and Journalism in Asia," will be held on June 25 (Monday), from 4pm to 6pm at the Foreign Correspondent’s Club (FCC), Hong Kong.
Freedom of expression is the cornerstone of the protection of civil liberties; and journalists play a crucial role in this. Without freedom of expression, prevention of torture by documenting these cases would be difficult. The role of investigative journalists in exposing torture cases Asian countries, where authoritarian and oppressive structures continue to operate, is very important.
The denial of freedom of expression has had serious implications, not only in the protection of absolute freedom from torture, but also in the practice of journalism in developing countries in Asia.
As an illustration, journalists involved in documentation of torture cases have been killed and face continuing threats, like the case of the victims and survivors of the Maguindanao massacre in the Philippines; journalists who were tortured, killed and forcibly disappeared in Pakistan and journalists in Sri Lanka and Bangladesh who have had to leave their countries after they were targeted and tortured for reporting on torture.
In most developing counties, journalists provide opportunities for possibilities of remedy by documenting their case. The victims and their families seek their support for redress. The journalist plays an important role because their reporting draws attention in creating socio-political discourse seeking for appropriate intervention by the State and public.
The speakers for this event are Md. Ashrafuzzaman, Bangladesh; Nilantha Ilangamuwa, Sri Lanka; and Baseer Naveed, Pakistan. These journalists have been actively involved in advocating for the prevention of torture so as to promote free expression in their respective countries. The other is Myrna Reblando, the widow of Alejandro "Bong" Reblando, one of the journalists murdered in the 2009 Maguindanao massacre.

Colombo TelegraphMost of the Sri Lankan newspapers and websites have added the readers’ comments facility and it has become more attractive as they feel they have a role to play instead of reading. It is an obvious fact, that people like to have their own voice rather than listening to someone’s interpretation, which is according to the basics of 2-way communication.
But some argue that the newspaper is not a blog, although it is online and vice-versa. In the Sri Lankan context, the representation of the general public was very limited until mid ‘90s and the only choice was ‘letters to the editor column’, which was also edited according to the editor’s limitations and the space in the newspaper. In the radio this opportunity was limited to listeners’ requests. But with the broadening of the limits of electronic media listeners/viewers opinion became a powerful tool. Some listeners became professionals making comments on any topic and they acted according to the political line of the stations. For example, you will find a listener/viewer engaged in a programme run by a particular channel, made against government, commenting in favor of that topic blaming the government at the same time talking, criticizing the opposition in another programme.

SRI LANKA: A threat to the safety of Dr. Nirmal Devasiri of the University Teachers Union

The Asian Human Rights Commission has received information that two days ago, a group of people who have identified themselves as members of the Ministry of Defense, visited the neighbourhood in which Dr. Nirmal Raanjith Devasiri, (the President of the University Teachers Union and the Secretary of the Arts Faculty Teachers' Association of the University of Colombo (AFTA-CU) resides, and made inquiries about him and his family, in what appears to be an attempt to intimidate them.

Last night, a jeep without a proper licence plate was seen parked near his house. Today, a complaint was lodged at the Maharagama Police Station regarding these intimidating and suspicious actions. The FUTA is preparing to hold a press conference today to inform the media about these incidents. 

In a letter written to Gotabaya Rajapakse, the Secretary of the Ministry of Defence and N.R. Illangakoon, the Inspector General of Police, Professor Asanga Tilakaratne, President of the AFTU-CU stated:

"It has been brought to our notice that a group of men claiming to be from the Ministry of Defence have been behaving suspiciously within the neighbourhood of the secretary of Arts Faculty Teachers' Associations (FUTA), Dr. Nirmal Ranjith on June 19, 2012. They have questioned neighbours regarding Dr. Devasiri's movement's and details regarding his family. Dr. Devasiri has lodged a complaint with this regard at the Maharagama Police Station on 21.06.2012. We are deeply concerned about this and request you to immediately launch an investigation into this matter."

The University Teachers Union has been working to improve the livelihoods of university teachers, notably by campaigning for wage increases and improved working conditions. The Minister of Higher Education, the Hon. S.B. Dissanayake, has publicly opposed these efforts. 

Trade unionists and political activists who campaign for wage increases and the improvement of working conditions, are frequently threatened, and even, physically attacked. The forced disappearances of unionists and activists who disagree with government officials are a regular occurrence in Sri Lanka. Indeed, last week, a shooting in a small meeting of the JVP led to the deaths of two people.

The Asian Human Rights Commission is extremely concerned about the security of Dr. Devasiri, and calls upon the government of Sri Lanka to enquire into this complaint regarding threats made to Dr. Devasiri and his family, and to take concrete measures to ensure his safety.

A surrender to protect both government & Amare – Tilvin Silva

The surrender of Joolampitiye Amare to the High Court is an exercise carried out by the government to avoid accusations against it and for the protection of Amare says the General Secretary of the JVP Tilvin Silva.
This was said at a press conference held at the JVP head office at Pelawatta today (20th). The Member of the Political Bureau of the JVP Parliamentarian Anura Dissanayake too was present.
The General Secretary of the JVP said, “The government doesn’t act in a transparent manner regarding the double murder committed at Katuwana. Two persons were killed when a gang of thugs attacked a meeting held by the JVP on the 15th. There was an outburst in eh society against this act. As such, the government could not avoid the incident. We heard yesterday that Joolampitiye Amare, the main suspect of this incident, surrendered to the court. By this the government expected to say that the person responsible for the incident surrendered and by doing so to avoid the opposition to the government due to the incident and to protect the main suspect from mass condemnation.   Hence, we see this surrender as an attempt to save the government as well as the perpetrator. The government is behind this murder. We have confirmed this. Specially, state officials in Hambantota are behind these murders. There is a curious play acting going on since the incident. It is clear that the government, its officials and the police with their instructions have acted in a manner to save the criminal instead of carrying out investigations and to put the responsibility on others.

SRI LANKA: Government rejects the Universality of Human Rights

Speaking at the 20th session of the Human Rights Council, under the agenda item clustered ID with the Special Rapporteur on Health and the Special Rapporteur on the Right to Education, Sri Lanka attacked the United Nations' role in developing international norms and standards relating to human rights. Speaking on the issue of education, the government noted in an official statement:

"We would however caution on attaching excessive focus and arbitrary conditionalities on developing norms and standards related to quality education, as many developing countries are as yet grappling with the provision of basic education to their populations. Setting goals which require enormous finances which developing countries are often unable to meet, and placing the onus of responsibility solely on the state will not practically advance the quality of education. Instead, it is suggested that realistic goals be set, which are developed taking in to consideration the particular needs of countries and their respective domestic situations, if we are to successfully improve the quality of education worldwide."

Given that in Sri Lanka, the government has been working to downgrade the school and university education systems; this announcement does not come as a surprise. The implication of this statement is that Sri Lankans are not entitled to the highest standards of education, as the citizens of other countries are. Under the pretext of economic difficulties, the Sri Lankan government wants a different set of educational standards for poorer countries. By this, they mean that the poor deserve a poor quality of education.

The setting of international norms and standards for the protection of human rights is the most important function of the United Nations' human rights agencies. Since the adoption of the Universal Declaration of Human Rights in 1948, this has been the United Nations' human rights agencies most significant project. The covenants and conventions have been developed to ensure a similar entitlement of rights for people in all countries, so that basic rights can be enjoyed by every person.

As such, to attack the making of international norms and standards is to strike at the very heart of the United Nations' human rights project. Sri Lanka's present government has been consistently engaged in this attack since its formation.

In relation to the resolution passed by the United Nations' human rights council on the issue of accountability and reconciliation in Sri Lanka, the thrust of the attack by the Sri Lankan government relates to civil and political rights. The Sri Lankan government is vigorously pursuing a project in which international humanitarian and human rights legal codes will be reformed so as to allow serious violations, thus denying the universality of human rights..

During the mid-twentieth century, Sri Lanka was one of the countries which was heralded as a model for other developing nations in light of its progress in establishing quality infrastructure, such as education. There was good reason to hold Sri Lanka in such high esteem at this time. Indeed, from the early 20th century when Sri Lanka was under colonial rule to the early part of the independence period, achieving a higher quality of life for the people of Sri Lanka was one of the government's central goals.

Today, this pursuit of a higher quality of life is suffering due to the incredible level of neglect. Indeed, Sri Lanka has been reduced to a lawless place. The accusation of lawlessness comes from the highest levels of society. Cynical remarks are frequently made regarding the fact that Sri Lanka has a parliament, but does not have parliamentary democracy, that Sri Lanka has courts but lacks an independent judiciary to preside over these courts, and that Sri Lanka has a rule of law system but is nonetheless becoming a lawless nation.

It is quite clear that this deplorable state of affairs has not come about by accident, but is the product of design; the statement made by the Sri Lankan government at the United Nations is testament to this ideological position. These government officials believe that it is acceptable to deny the basic standards of life to the people of Sri Lanka, in terms of civil and political rights as well as economic, social and cultural rights. Moreover, they believe that such a viewpoint is justified on the basis of the idea that people in poorer countries cannot have a high standard of life that others in wealthier countries are able to enjoy.

Sri Lanka is a member of the United Nations. When the Sri Lankan government challenges the efforts of UN human rights bodies and officials to define international norms and monitor the upholding of these standards, it is attacking the core of the United Nations' project on human rights. As such, what justification can Sri Lanka make to remain within this assembly of nations which is primarily devoted to defining universal standards and monitoring their progress?

The universality of human rights is at the heart of the basic philosophy of human rights. In attacking the notion of the universality of human rights, Sri Lanka is attacking the fundamental tenets upon which human rights norms stand. The statement made by the Sri Lankan government at the 20th session is clear evidence of the new direction that the Sri Lankan government is taking to renegade from the enterprise that the world became engaged in when the Universal Declaration of Human Rights was enshrined as a basic, global agreement.

Why this is important

After the end of Civil war in Sri Lanka in May 2009, Tamils are facing more and more hardship to carry on their livelihood. Winning the war against Tamil militant is viewed by the Government of Sri Lankan as winning against Tamil people. Government uses this as propaganda within the majority Sinhalese community to gain popularity.
One of the recent developments is Land Grab by Sinhalese forces. Our friends and families lived in their land for whole lives in the land were chased out by forces. Protests against the government were blocked and people are getting warning by armed forces of the government. UN can take action against this development.

Sri Lankan civil war was ended during 2009 May. Still the wars on Tamils by the Sri Lankan forces are staged on their livelihood. Government is targeting Tamils historical land, their cultural, educational properties and values. More than 500,000 people are living outside their homes. In the recent development, Sri Lankan government forces grab the Lands own by Tamils and increase the speed of colonization with the poor Sinhalese in their lands. Also, Hindu and Muslim religious places are targeted by Buddhist monks to station Buddha statues to claim that they are Sinhalese historical places. Last Monday a protest by leading Tamil political parties rally against the Land Grab was blocked by Police in Jaffna, Northern Province of Sri Lanka. A war crime alleged Sri Lankan Government and their forces which are 98% of Sinhalese populated should stop threatening Tamils and Grab their Lands.
