InsideToronto.comNew federal legislation on refugees contains "dangerous measures" that will "particularly impact" residents of Scarborough, a local New Democratic MP says.
Rathika Sitsabaiesan said the Conservative government's Bill C-31 will unfairly force refugees to wait five years before they can become permanent residents and reunite with their families.
The "flawed" bill, which is headed back to the House of Commons for a third and final reading, would also let Immigration Minister Jason Kenney on his own choose the list of "safe" third countries to which refugee claimants can be returned without appeal, she said.
"It's just not right to have so much power in the hands of one person," said Sitsabaiesan, who held a press conference recently to denounce C-31 at her constituency office in the riding of Scarborough-Rouge River.
With her were representatives from the Canadian Council for Refugees, which fears a "safe-country" designation for Hungary could mean the return of Roma claimants there, and from the Canadian Tamil Congress, concerned Tamil asylum seekers could be returned to Sri Lanka.
Sitsabaiesan said several Roma claimants live in Scarborough's West Hill area and suggested they could face persecution and violence if they are sent back to Hungary. Scarborough is also home to many of the hundreds of Tamils who arrived in Canada by sea with the MV Sun Sea or MV Ocean Lady and whose refugee status claims are undecided, she said.
None of the asylum-seekers were at the press conference, the MP said.
"They are too scared to come out with their stories now."
Another Scarborough MP, however, expressed different views on the bill during May when it was reviewed by the Standing Committee on Citizenship and Immigration.
Roxanne James, a Conservative, said designating certain countries "safe" is "not something new on the world stage" and can speed up processing of claimants from those countries.
Hungary is part of the European Union, the Scarborough Centre MP told the committee on May 7.
"People there have 26 other countries they can choose before coming to Canada," said James. "If you were being persecuted in your country, would you not flee to the most convenient, quickest, safest place to go, or would you choose Canada simply because it's easy money?"
James said reading that the Sun Sea asylum seekers in 2010 paid human smugglers large sums in order to "evade" Canada's passport and visa requirements "actually made my blood boil."
Sitsabaiesan accused members of the Conservative-dominated committee of rejecting concerns about C-31 and New Democrat amendments out of "blind pride," but said she hopes a public outcry will cause the government to reconsider.
Whither Buddhist tenets? pregnant lady raped on Poson poya; clergy charged with rapes

(Lanka-e-News-05.June.2012, 11.55PM) On this holy Poson Poya day (4) of the Buddhists , a young rapist has broken into the home in the south of SL , of a pregnant young woman in broad daylight at noon and brutally raped her , according to reports reaching Lanka e news. 

This bestial crime had been committed on a 23 year old pregnant woman in the Oluera district , Walasmulla police division. The crime had been committed at about 1.30 p.m.. yesterday, police reports say. According to Walasamulla police media spokesman ‘s notice….

On the 4th Poson poya day under the pretext of collecting funds the youth had intruded into the premises of this young pregnant woman when she was alone.. The suspect is 17 years old and is working in a Pirivena at Kekunadura district , , Thalpawila , according to the police notice.

The suspect had been arrested and produced before the Walasmulla Magistrate who had been remanded him until the 11th of June. 

It is significant to note that against the chief of the Raja Maha Vihara situated in historic Mihintale where the Buddhist faith was first introduced , there is a legal proceeding in the Anuradhapura court on charges of committing rape on a 13 year old girl. The case is now at trial stage.
Meanwhile , Somarathna Thero (65 years old currently) the chief incumbent of the Croyden Thames Vihara , London was sentenced to 7 year jail sentence recently on charges of committing rape on a young girl.

Amidst all these outrageous and disgraceful crimes committed by the Buddhist clergy , the three Mahanayakes and the Buddhist leaders remaining silent is something deserving of a place in the Guinness book of ignominious records .

Are the youths who are committing these crimes inspired by the holiness in the (mis)conduct of these criminal monks ?

A revised edition of Handy  Perinbanayagam  A Memorial Volume & The Jaffna Youth Congress edited by  Santasilan Kadirgamar, published by  Kumaran Publishers, Colombo, was  released under the auspices of the Indo-Lanka Foundation on the 4th of March, 2012 at the Saraswathy Hall in Colombo. The first edition of the above publication, also edited by Santasilan Kadirgamar, was produced and distributed by the Handy Perinbanayagam Commemoration Society in Jaffna on 28 June, 1980.
A noteworthy feature of the present revised edition of the publication is its availability in all of the three national languages – - Sinhala, Tamil and English. It was the editor’s determination to make the ideals and vision of the late Handy Perinbanayagam, the founder of the Jaffna Youth Congress (JYC), accessible to all Sri Lankans that made him bring out the volume in all three languages. He endured the delay thus involved in bringing out the revised edition because of his motivation to release all three versions of the book simultaneously.   It is both fitting and proper he should have done so. For Handy Perinbanayagam the Ceylonese nationalist (not, please note, a narrow ethic nationalist) would not have wanted it any other way.
The publication is most timely given that we are at a moment in our history   when the need for a principled search for genuine national reconciliation is extremely urgent.  To this end, the legacy of Handy Perinbanayagam and the Jaffna Youth Congress should serve as a stimulus and congenial guide. Absent such a reconciliation, our future as a united country is in far graver danger than most of us seem to realize.
Handy Perinbanayagam (1899 – 1977) pioneered the movement in Ceylon for total national independence (‘Purna Swaraj’). Inspired by and imbued with the ideals of Mahatma Gandhi, he was an educationist of the highest calibre. He fought for the right of a child to be educated in her own native language and for a people’s right to be governed in  their own. The book before us today is a well deserved tribute to Handy Perinbanayagam’s long and distinguished service to the people of Sri Lanka and to our world in general. His was the voice of liberal humanism.

Pope Benedict to express concern over Mannar Bishop Rayappu Joseph’s safety to President Rajapaksa at Vatican

President Rajapaksa scheduled to visit Britain on June 3rd for a four day trip connected to the Diamond jubilee celebrations of her majesty Queen Elizabeth the second is expected to arrive on June 7th at the Vatican where he has been granted an audience with Pope Benedict.
President Rajapaksa is an ardent Buddhist but the Sri Lankan first lady Shiranthi Rajapaksa is a devout Catholic.
Highly placed sources in the Catholic church disclosed that Pope Benedict will personally express concerns over the safety and security of most reverend Rayappu Joseph the Bishop of Mannar in Northern Sri Lanka.
According to protocol followed in the Vatican his Eminence Cardinal Tarcisio Bertone, Secretary of State of the Holy See will take up the issue in detail with President Rajapaksa after his holiness the Pope expresses concern directly to the Sri Lankan head of state.
Although President Rajapaksa’s trip to the Vatican is primarily a visit of goodwill and the Pope has granted an audience as a matter of courtesy the issue of the Mannar Bishop will be chief among topics discussed.
Catholic church sources said that the Vatican is somewhat perturbed over the Mannar Bishop being the object of a verbal attack of a personal nature launched in Parliament by a cabinet minister in the Rajapaksa Government in early May. A calarification is likely to be sought as to whether the views expressed were reflective of the Government’s point of view.
Wanni district parliamentarian and cabinet minister of Industry and commerce Risad Badhiutheen criticised Bishop Joseph in Parliament over alleged anti-Muslim activity in the Sannar area of Mannar district. The minister is also the leader of the All Ceylon Muslim Congress(ACMC) which is a constituent member of the United Peoples Freedom Alliance (UPFA) Govt.

Sections of the Catholic clergy and laity in Mannar objected vehemently over this speech and organized a meeting and public protest demonstration in Mannar town in support of the Bishop.
The Mannar Police intervened and sought a court order prohibiting the demonstration and meeting. It is alleged by Mannar residents that the Police acted in this manner on the instructions of the minister concerned.
The Mannar magistrate prohibited the demonstration but allowed the meeting to be held within private premises. Over 5000 persons from the Christian, Hindu and Islamic faiths participated at the meeting where resolutions in defence of the Bishop were passed.
A senior Muslim journalist who participated and spoke in support of the Bishop was assaulted and hospitalised by a prominent supporter of minister Badhiutheen.
Members of the Tamil National Alliance(TNA) representing the Wanni district like Adaikkalanathan,Vinoharadhalingam, Aanandan have also criticised minister Badhitheen for attacking Bishop Joseph.
The TNA leaders in turn have been criticised by Wanni district MP and ACMC member Hunais Farook.
While this political storm rages around Bishop Rayappu Joseph and minister Badhiutheen other developments have also led to growing fears about the Mannar Catholic prelates personal safety.
Two officials from state intelligence have recorded statements from the Bishop about the statement he made to the Lessons Learnt and Reconciliation Commission about a large number of People from the Wanni region going missing.
Bishop Rayappu Joseph along with some members of the Northern clergy submitted a letter to the United Nations Human Rights council in Geneva about the human rights situation in Sri Lanka before the US sponsored resolution was passed.
This resulted in several Sinhala newspapers and Sinhala Buddhist political organizations attacking the Bishop viciously.
This in turn led to several members of the Southern clergy and laity issuing statements publicly in support of the stance adopted by Bishop Rayappu Joseph and the northern clergy.
The controversy has led to widespread concerns about Bishop Rayappu’ Joseph’s safety and security. Some fear that the Bishop may be the victim of an “officially sanctioned unofficial disappearance” or extra-judicial execution. Several Christian priests in the North and East have been victimised in that manner in the past.
This has led to several concerned human rights activists, NGO personnel,journalists and prominent members of the Catholic clergy and laity communicating their anxiety about Bishop Joseph’s predicament to the Vatican. These appeals seem to have struck a responsive chord in the Holy see.
It is against this backdrop that the Pope will convey his concerns to President Rajapaksa while the Cardinal will seek clarification from the Sri Lankan head of state.
Bishop Rayappu Joseph who was born in 1940 and inducted into the priesthood in 1967 has been the Bishop of Mannar for nearly 20 years. He has always been outspoken in defending the rights of his predominantly Tamil parishioners in particular and the larger civilian population of the North in general.

Veteran Sri Lankan Tamil political moderate leader, Murugesu Sivasithamparam, passed away peacefully after a brief illness in the Colombo National Hospital at 1:50 a.m. on June 5 2002.
The ailing president of Sri Lanka’s largest democratic Tamil party at that time, the Tamil United Liberation Front (TULF), was admitted to hospital on June 1st and was pronounced out of danger two days later. Fate however decreed otherwise.

The departure of Murugesu Sivasithamparam evoked nostalgic memories of a mercurial personality that strode like a colossus across the Tamil political horizon. When news of Siva’s death emerged, a sadness enveloped most people who knew of him. In contrast, the younger generation of Tamils who know very little about the pre-militancy period of the Tamil non-violent struggle for restoration of lost rights seemed the least concerned.
It is relevant therefore to dwell briefly into Sivasithamparam’s past to know more about a man who devoted his life to the Tamil cause and made great personal sacrifices for it.
Sivasithamparam was literally a towering personality in the political landscape of the island. A well built six footer with a stentorian voice, the mercurial Sivasithamparam was for more than four decades an accredited leader of his people. The brilliant lawyer was a powerful orator and ebullient debater who cut a flamboyant figure at the height of his career.
He was at the time of his death the senior-most Tamil MP in parliament, having been nominated in 2001 on the national list by the newly formed Tamil National Alliance.

At UN, Reuters Hosts Minutes Used to Indict Inner City Press, Small Media Targeted

UNITED NATIONS, June 2, updated below -- Ever since Inner City Press began complaining on May 21 that Reuters and its UN bureau chief Louis Charbonneau used without credit Inner City Press' March 28 exclusive that US official Jeffrey Feltman would come to work at the UN, Charbonneau joined by other big media from Bloomberg, Agence France Presse, Al-Arabiya and Voice of America have been trying to expel Inner City Press.

  That Reuters is implicated in this attack on independent investigative media is most recently made clear by the sending out of inaccurate and incomplete minutes of UN Correspondents Association Executive Committee minutes purportedly putting Inner City Press in a bad light.

  An hour before it met to appoint a "Board of Examination" to "investigate" Inner City Press, the UNCA Executive Committee sent Inner City Press what it said were the minutes to four meetings stretching back to September 2011.

  Before the "Board of Examination" was voted on -- with as chairman a subordinate at Xinhua, whose bureau chief has already voted against Inner City Press -- Inner City Press formally objected to the minutes, noting that they were inaccurate and incomplete.

  As simply one example, Inner City Press' complaint at the May 29 meeting that Herve Ladsous, the fourth Frenchman in a row atop UN Peacekeeping, had explicitly refused to answer Inner City Press' questions about Haiti and Sri Lanka, and that no UNCA Executive Committee member had offered any support, was either not in, or deleted from, the minutes.

Minutes From Behind Reuters Firewall Censor ICP on France, Sri Lanka


Reuters is going after a small media reporter who criticized the UN's use of a war crime suspect on a human rights panel.
Greg McCune of Reuters, and big Reuters cheese Stephen J. Adler(UNITED NATIONS) - Ten minutes after Inner City Press exposed Reuters' involvement in hosting the UN Correspondent Association minutes used to indict it, the link was changed away from Reuters.

But the screen-shot remains, even as Reuters brass continues to be unreachable as the company leads a purge of independent media at the UN.
Still there has been not response to the May 27 and June 2 notifications to Greg McCune of Reuters "Ethics & Training," Top News Editor Walden Siew, deputy editor Paul Ingrassia and big Reuters cheese Stephen J. Adler, on Twitter with a total of four tweets, none since August 2011. So much for New Media. Meanwhile Reuters' Charbonneau slavishing re-tweets other Reuters' reporters stories. Some hope he's paid overtime, and not ONLY for his strenuous efforts to expel the free Press.

Sinhala Army destroys statues of historic Saiva temple in Batticaloa

The Sinhala military occupying Batticaloa has destroyed several tradtional stone-statues at the historic Thaanthaamalai Murukan temple, situated in Paddippazhai DS division of Batticaloa district. The temple, revered by Saivaites in the East as ‘Chinna Kathirkaamam’ and the land of 25 acres around it, were declared in 1959 as a Saiva Sacred Area according to the decree entered by the Court of Law in Ceylon. The area, which was safeguarded by the Tamil Tigers for more than 12 years since 1994, has now been subjected to the intrusion of Colombo's Archaeology Department and the SL Army after the war. The villagers allege that Colombo is attempting to construct a Buddhist stupa on the land that belongs to the historic Saiva temple. 

The occupying SLA soldiers on 18 May destroyed several statues and other sculptures made up of granite stone and desecrated the temple, according to a complaint lodged with the SL Police in Kokkaddich-choalai by the temple authorities. 

Batticaloa district Tamil National Alliance (TNA) parliamentarian P.Ariyanethran, on the invitation of the temple authority, visited the temple, which was subjected to desecration and destruction by the occupying SLA. 

Those who were attempting to construct a Buddhist Vihare in the area, the MP said, have desecrated the temple. 

“I visited the temple on Saturday, 02 June, and saw the destruction caused on the Kanthavea'l temple, which Swami Muthiah had used for meditation,” Mr.Ariynaethran said.

No action had been taken by the SL authorities despite repeated complaints by the temple authorities. They also have sent a memorandum to SL President Mahinda Rajapaksa, urging him to take immediate steps to stop the construction of the Buddhist Vihare.

Thaanthaamalai and its neighbouring villages have been the home of Tamil Saivites for ages. 

The intruding Sinhala Buddhist monks, with the assistance of the Sri Lanka Army, have also occupied the Saiva temple at Kachchat-kodi Swamimalai village in the Paddippazhai division.

The Sri-Lanka-China Relationship: A Print Media Analysis

China’s deepening relationship with Sri Lanka is becoming increasingly conspicuous as the emerging super power extends relations beyond its sphere of influence. This paper brings out the Sri Lankan perceptions of the unconditional and timely help of China for Sri Lanka’s overall development. Some of prominent Sri Lankan newspapers have been referred to gauge the general Sri Lankan outlook. The relevant questions in this context are the factors driving Sri Lanka towards China and whether China’s unlimited help to Sri Lanka is with or without strings attached.

Political relations
Sri Lanka’s contemporary relations with China have been strengthened as never before. The state owned Sunday Observer (‘China-Sri Lanka’s top lender in 2009’, 18 April 2010) has commented that “silky relationship has reached new heights during the Rajapaksha era.” Historically, Sri Lanka and China have been recorded to be on friendly terms. However, the ties have reached a peak level, especially under the administration of President Mahinda Rajapaksha. Tamil Guardian (‘India’s troubles in Sri Lanka’, 4 December 2010) shared a similar view, acknowledging that “Rajapaksha has visited China five times in office and thrice before.”

Channel-4 Journalist And It’s Director’s Wife Deported From Sri Lanka

Colombo TelegraphShirani Sabaratnam, who works at the London-based Channel-4 TV Station as an editor and a presenter, arrived in Sri Lanka on Sunday. On arrival she was detained at the airport by Sri Lankan law enforcement authorities and later deported to Britain, quoting  informed sources Colombo based Daily Mirror reports.

According to Daily Mirror, the sources alleged that Ms. Sabaratnam, a former LTTE member, had arrived with her British husband from Britain via Dubai on Sunday. Her detention and subsequent deportation was the result of her being blacklisted. On being questioned by detectives, Ms. Sabaratnam admitted she had used different passports to travel to Sri Lanka’s North both during the war and after the war ended.
Authorities believe that the husband and wife were visiting Sri Lanka to do another documentary critical of the Government.
Ms. Sabaratnam was born at Vaddukoddai in Jaffna and is married to Stuart Cosgrove a director of Channel 4. They are reportedly playing a major role in Diaspora activities against Sri Lanka. Meanwhile, Police are looking for the husband of Sabaratnam, Stuart Cosgrove, who is reportedly staying in a luxury hotel in Colombo.

Singapore, June 5 (IANS) India and the US have agreed to provide enhanced training facilities for military personnel from Sri Lanka, it was announced Tuesday.
This followed meetings Sri Lankan Defence Secretary Gotabhaya Rajapaksa had with General Martin Dempsey, chairman of theAmerican Joint Chiefs of Staff, and Indian Defence Minister A.K. Anthony here.
The meetings took place on the margins of the Shangri-La Dialogue.
"As a coastal nation, the meetings recognized the pivotal role the Sri Lanka Navy could play in strengthening the security of sea lanes in the Indian Ocean," a Sri Lankan foreign ministry statement said.
It said the three countries "resolved to co-operate closely in drawing on their synergies in combating international terrorism.
"As two key strategic partners of Sri Lanka, the US and India responded positively to a request for enhanced training opportunities for capacity building of defence personnel in their institutes of repute."
The statement said the US and India commended the "incremental and steady progress" made in Sri Lanka's north and east, the former war zone, in rehabilitating those displaced by decades of conflict.
Both countries, it said, "were keen to assist Sri Lanka in all aspects of their multifaceted bilateral partnership for attaining sustainable peace".

Athas Breaks Silence To Reveal His Ordeals Under Different Governments

Colombo TelegraphOne night in February 1998, a group of well-built men, all clutching Browning automatic pistols, forced their way into my house at Wijerama in Nugegoda.
One of them stormed into my bedroom in the second floor, cocked his pistol and placed it on my left temple. My wife Anoma and daughter Jasmin, then seven years old, watching television together with me froze in shock and horror. A second intruder walked in to thrust a loaded pistol at my back. They forced me out of my bedroom.
Outside the door, I saw others with their weapons in hand busy with the household staff. They were poring over their National Identity Cards or interrogating them. When they tried to force me down the stairway, my daughter, fearing she was going to lose her father, raised loud cries. One of them ordered a female help to move with her into a bedroom nearby and shut the door. Instead, she thrust her hands around my neck in a hard bind and screamed “my thathi, my thathi.” The cries could be heard from the road outside.
For some inexplicable reason, three more armed men rushed upstairs shouting “api yamuapi yamu” or let us leave. They withdrew. I rang the Police Emergency at Mirihana. A mobile patrol arrived to ask a few questions but left hurriedly. Word of the incident spread and we could not lie on our beds that night. The telephones rang incessantly. One of the callers was Mahinda Rajapaksa, then Minister of Fisheries. He was championing human rights issues and was kind enough to assure support. Others included highly placed sources in the military establishment and the Police. Some offered to come over. I forbade them for fear of exposure. Yet, there were a few who defied.

Not In Our Name: 1,400+ signatures 

against religious extremism in Sri Lanka

Not In My Name (NION) ran from 27th April to 31st May 2012. The blog was created and launched late on the 26th, just under a week after a violent attack on a mosque in Dambulla, led by Buddhist monks. At the time, the situation was very volatile. Islandwide, despite appeals for calm, there was real concern as to what would happen after jumma on the 28th. NION was an attempt to showcase that the violence in Dambulla, and any religious extremism, was simply unacceptable and by doing so, serve as a bulwark against the spread of violence that Friday, and beyond.
Sadly, given attacks against mosques even around Colombo, and as noted by many who have signed up, attacks against churches in the past, it is clear the violence in Dambulla signifies growing religious intolerance in Sri Lanka. On the other hand, out of over 1,400 comments in English, Sinhala and Tamil, there are a number that quite clearly reveal Sri Lankans who are appalled by this violence.
We’ve captured on Storify some of the most interesting comments in English. Email updates sent during the past month have also highlighted some key comments.
The diversity of individuals who signed up to NION is revealing, and range from a former President of Sri Lanka to a father who signed up so that his children would know he was not silent in the face of growing militant religious extremism. There are leading academics, thespians, popular singers, TV presenters, directors, activists, signatories from every major community and more, bloggers, writers, poets and many others. Some are very well known. Many are not.
As noted on the blog, the names and comments of those who signed up will be printed out and sent to the Presidential Secretariat, the Prime Minister’s Office and the Ministry of Religious Affairs & Moral Upliftment, along with the Department of Buddhist Affairs, Department of Christian Religious Affairs, Department of Hindu Religious and Cultural Affairs and the Department of Muslim Religious and Cultural Affairs.
A copy will also be sent to the Chief Prelate of the Dambulla temple.
All the comments from the English, Tamil and Sinhala versions of the statement have now been uploaded as PDFs to Scribd and embedded below. Obviously, they are also permanently archived on the NION site itself. The PDFs on Scribd can be downloaded and embedded on other sites.
NION didn’t save any lives. During the four weeks it was open for comments, there were more attacks against mosques, right in the heart of Colombo. It is unclear what the response of the President was to the imbroglio in Dambulla. The inability and unwillingness of government to unequivocally condemn religious extremism (the government’s official press release over the Dambulla incident, release days after the violence, called it a ‘minor misunderstanding’) directly contributes to increasing bigotry and a language of hate and harm against Islam in particular, which is thriving online in fora like Facebook groups.
Over 1,400 comments on NION serve as a counterpoint to this growing hate. They are worth fully reading, never forgetting and often repeating.

What will be the general’s peace time 

VikramabahuGen. Fonseka was freed, not because Mahinda got a sudden urge to embrace democracy. The former Army Commander and defeated presidential candidate Sarath Fonseka was incarcerated for more than two and a half years. Hence his release appears as one of the populist moves made by the present regime, at a time when its democratic credentials are being exposed even internationally and the jailing of the General was seen in many quarters, both local and foreign, as an act of political revenge. As far as the middle classes are concerned that stigma has been, to a great extent, lifted with the presidential pardon.

Under pressure
The partial nature of pardon indicates that it was made grudgingly, and under pressure, both local and international.  However it is very clear that the Mahinda regime expects a political advantage from this micro sympathetic act. One thing is clear; the General is not willing to come under the hegemony of the Ranil 17-3-Sampanthan leadership. He has already indirectly attacked the developing UNP-TNA understanding.
Whatever the reason, the Fonseka pardon is a positive measure, not just because it enabled the former army commander to return to his family, but also because it indicates the power of national and international mass pressure. It is true that the Mahinda regime is a vassal state of global powers, but it is a mistake to think that the release of General Fonseka and the agreement to implement LLRC recommendations are entirely due to western pressure. Mahinda was defeated by the recent protests of the proletariat; he had to retreat when challenged by the fishermen; he had to abandon many projects due to struggles of students. The protest of the VV in Jaffna was some thing that he did not expect. Radical breakaways from the JVP moving towards the left that accept the right of self determination, is a surprise to many. Revolutionary forces are still not very significant; but they are significant enough to create ruptures in the main political movements.

Lankan parliament
The ‘detailed reconciliation plan’ of  Mahinda ,which the US Secretary of State praised as ‘good’, will be   disclosed to the Lankan parliament and people in the coming period, once the icing  is added to the cake! Clearly Ms. Clinton knew that the Mahinda regime had concealed the ‘plan’ from the Lankan people, because she reportedly urged Minister Peiris to make it public in both local languages. Mahinda agreed to that. On the other hand he   declared to the Sinhala public, that army camps will not be withdrawn. Also, he did not mention devolution and said nothing about anti Muslim pogroms initiated by pro government Buddhist monks. Clearly there is a growing contradiction within the Mahinda regime. While a crisis has crept into the ranks of the Mahinda regime, Ranil has made a strong alliance with the TNA backed by the Muslim congress. It is in this context that the VV in Jaffna became important. True, that it was not an oppositional unity among the poor, oppressed and the minorities; but it was clearly a nightmare for the regime. Mahinda gang responded with such venom to the VV May Day in Jaffna because it was a model of a distant united mass action.

New challenge
Some believe that release of general Sarath has created a new challenge to the opposition. A key issue that will determine the political future of the General is likely to be the manner in which he deals with the LLRC report. Will he agree to an independent inquiry on war crimes allegations against Lanka? This is one of the important issues that have preoccupied Tamil Diaspora groups, the western governments and human rights organizations. It may be recalled that in November 2009, before he had declared his intention to enter the presidential race but after his falling-out with Mahinda,  that he visited  US and had discussions with important people. There is still some mystery as to what exactly transpired during that visit. When he came back he was firmly committed to a right wing political programme close to the UNP. Though he opposed Mahinda, politically there was not much of a difference. Basically, he condemned Mahinda for fraud and dishonesty. What is his political, economic and social programme?  Will he agree to the anti chauvinist social democratic programme successfully pursued by Ranil or will he opt to compromise with Sinhala chauvinism?
 

Repetition Of The Past?

Colombo TelegraphThe speech of TNA leader R Sampanthan at the annual sessions of the largest Tamil political party that took place in Batticaloa in the east has raised the red flag for many of those whose primary concern is the unity and sovereignty of the country.  This can be seen in the adverse media commentary and statements issued on the topic.  Ironically it was only a month ago that the TNA leader raised aloft the national flag of the country in Jaffna.  He did this together with the Leader of the Opposition, UNP leader Ranil Wickremesinghe at a joint May Day rally held in the northern capital.  On that occasion Tamil nationalist opinion was very critical of his action in raising the flag and saw it as a capitulation to Sinhalese ethnic majority domination at a time when little is being done to address the political roots of the ethnic conflict.
The national flag has long been one of the contested arenas of Sinhalese and Tamil nationalisms.  When the flag was designed more than six decades ago, the stylized lion at the centre of the flag was taken to be an affirmation of the central place of the Sinhalese people in Sri Lanka and was opposed by the minority representatives on the flag design committee. After considerable disputation on the issue the existence of the Tamil and Muslim communities was acknowledged in the flag by two vertical stripes at the corner of the flag.
At this May Day rally Mr Sampanthan also said that the TNA wanted provincial powers in Tamil speaking areas within a united Sri Lanka.   This has been a long standing demand of the TNA.  However, his raising of the lion flag was the subject of discussion and criticism among TNA supporters as to why that he did it. Even some TNA MPs expressed displeasure over the incident.  Responding to Tamil media reports that members of the Tamil community were angered by the gesture, he responded, that the raising of the flag was “a symbol of solidarity with the workers of Sri Lanka and a sign of solidarity and reconciliation between the Sinhalese and Tamil people in the country”.  The TNA leader also felt oblighed to defend his conduct at the May Day rally and denied that he had been pressurized y anyone to hold up the Sri Lankan national flag.

THE REAL RISK OF LOSING THE US GSP TRADE CONCESSION

With approximately 5 percent of Sri Lanka’s exports to the Unites States benefitting from its Generalised System of Preferences (GSP) many senior figures in the Office of the United States Trade Representative are baffled by its dogged defence of this concession. One senior trade representative expected an outright rebuff by the Sri Lankan government when it initiated a review of this concession.
The reality is that the loss of the GSP will have an impact which is trivial to the point of vanishing on bilateral US - Sri Lanka trade. Variables such as the exchange rate, cost of labour and other inputs into the production process, and, infrastructure have a greater impact.
The petition to withdraw the GSP concession has been filed by the American Federation of Labor & Congress of Industrial Organisations (AFL-CIO). AFL-CIO first filed the petition to exclude Sri Lanka from GSP eligible beneficiary countries in 2008. It was updated in 2009 and supplemented by pre- and post-hearing briefs in 2010. Further submissions were made in 2011 and 2012. It levels very serious allegations that work practices in Sri Lanka were and continue to be in breach of International Labour Organisation (ILO) conventions. They include numerous cases where the government has failed to enforce its own laws, repeated breaches of internationally recognized worker rights, a dysfunctional labour inspectorate, and, a hostile Board of Investment (BOI) that is responsible for administering export processing zones.
In the December 2011 update AFL-CIO cites the following event as further evidence of ongoing breaches of ILO conventions; “On May 30, 2011, approximately thousands of workers from several factories in the Katunayake Free Trade Zone protested the government's proposed private sector pension proposal, which had been developed without adequate input from either workers or employers. When police arrived, the demonstration turned violent, with the police beating demonstrators, firing tear gas, and finally shooting live ammunition at the unarmed workers. Various sources put the number of injured demonstrators as high as 460, five of whom were shot with live ammunition, and one of whom, Roshen Chanaka, died”. It also highlights the exploitation of workers in the former warzones stating that “The AFL-CIO is especially concerned about violations of labor law in the North and East (Tamil majority areas) as factories begin to open and hopes that the current situation of uniform wages, as controlled by the Wage Board, continues to apply to the country as a whole”.
Suffice to say that the Sri Lanka’s government has countered this with several submissions and a detailed action plan to deal with such breaches. Sri Lanka’s foreign minister during his most recent raised this issue again.
However, it is not just in the US where allegations of Sri Lanka being in breach ILO conventions have made. Trade unions and journalists in the European Union (EU) have raised this issue as well. A leading British newspaper, the Independent has alleged that workers “in Sri Lanka allegedly receive poverty wages and are forced to work excessive overtime and to meet unrealistic, ever-increasing targets” with management in factories “threatening to sack” workers if they joined a trade union.
The PLAYFAIR 2012 campaign run by the British Trade Union Congress has also highlighted several violations of ILO conventions by Sri Lankan exporters. And, like the US, the EU too has withdrawn its GSP trade from countries which it deemed to have violated ILO conventions, e.g. Belarus and Myanmar.
With Sri Lankan exporters already confronting several headwinds including a prolonged economic downturn in the EU and a 15 percent fall in the value of the Euro, such an action would prove catastrophic. With over 90 percent of Sri Lanka’s exports to the EU benefitting from the GSP concession, it would effectively shut-off Sri Lanka from its second largest export market. This should also be viewed in the context of Sri Lanka’s major export competitors still retaining the GSP+ trade concession which it lost in 2010.
It is this fear which perhaps explains why the Sri Lankan government has mounted a zealous defense of its work practices to the Office of the United States Trade Representative. Ignoring the AFL-CIO petition no matter how trivial the impact the loss of GSP on bilateral US – Sri Lanka trade would be to acknowledge that it is in violation ILO conventions. And, it would have brought it in sight of the crosshairs of European trade unions seeking to improve work practices in countries which export to the EU. Of course, it is not just trade unions which have taken note of this but also human rights organisations which continue to pressure Sri Lanka on accountability, opposition parties and diaspora activists as well.
